3 THE CORPORATION OF THE TOWN OF EAST GWILLIMBURY BY-LAW NUMBER BEING A BY-LAW TO REGULATE TRAFFIC ON ROADS UNDER THE JURISDICTION OF THE CORPORATION OF THE TOWN OF EAST GWILLIMBURY WHEREAS section 11 of the Municipal Act, 2001, authorizes municipalities to enact by-laws respecting matters within the sphere of jurisdiction of highways, including traffic on highways, in conjunction with the Highway Traffic Act. NOW THEREFORE the Municipal Council of the Corporation of the Town of East Gwillimbury enacts as follows: PART I DEFINITIONS For the purpose of this by-law; a) authorized sign means any sign, or marking on a roadway, or curb or sidewalk or other device placed or erected on a highway under the authority of this By-law for the purpose of regulating, warning or guiding vehicular and pedestrian traffic; b) bicycle includes a two or three wheeled non-motorized vehicle having wheels of more than 60 centimetres in diameter; c) boulevard includes that portion of the highway located between the edge of the roadway and the property line of the highway, and without limiting the foregoing, may include the un-traveled portion of any highway, a dirt, grassed, gravelled or paved area and ditches; d) corporation means the Town of East Gwillimbury; e) crosswalk includes that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway, or any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrians crossing by signs or by lines or other markings on the surface; f) emergency vehicle includes an ambulance, fire department vehicle, and police department vehicle; - 3 -

4 g) General Manager, CPI means the General Manager for the Community Programs and Infrastructure Department for the Corporation of the Town of East Gwillimbury and shall include any person authorized by the General Manager, CPI to carry out any of the powers and or duties of the General Manager, CPI pursuant to this By-law; h) heavy truck means a commercial motor vehicle for carriage of goods having a weight when unloaded, of 3 tonnes or more or, when loaded, of 5 tonnes or more, but does not include a passenger vehicle, ambulance or any vehicle of a police or fire department; i) highway includes a common and public thoroughfare, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle intended for, or used by, the general public for the passage of vehicles, and includes the area between the lateral property lines thereof; j) intersection means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the arterial boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; k) motor assisted bicycle includes a bicycle that is fitted with pedals which are operable at all times to propel the bicycle weighing no more than fifty-five (55) kilograms, and has no hand or foot operated clutch or gearbox driven by the motor and transferring power to the driven wheel. It includes an attached motor driven by electricity or having a piston displacement of not more than fifty (50) cubic centimetres; and which does not have sufficient power to enable the bicycle to attain a speed greater than fifty (50) kilometres per hour on level ground within a distance of two (2) kilometres from a standard start. l) motorcycle means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel with not more than three wheels in contact with the ground, and includes a motor attached and a motor scooter; m) motor vehicle includes an automobile, motorcycle, mobile home and motor assisted bicycle unless otherwise indicated in the Highway Traffic Act, as amended, and any other vehicle propelled or driven other than by muscular power, but does not include a street car, or other motor vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road-building machine within the meaning of this By-law; n) motorized snow vehicle means a motorized snow vehicle as defined in the Motorized Snow Vehicle Act; o) municipal service vehicle means a vehicle operated by or on behalf of the Town while the vehicle is being used for the repair or maintenance of highways, the collection or transportation of waste, or other municipal purpose for which heavy equipment is required; p) official sign includes any authorized sign approved by the Ministry of Transportation of Ontario and the General Manager, CPI or his designate; q) pedestrian includes an invalid in a wheelchair and a child in a baby carriage; - 4 -

5 r) pedestrian crossover means any portion of a roadway, designed by by-law of a municipality, at an intersection or elsewhere, distinctly indicated for pedestrians crossing by signs and signals on the highway and lines or other markings on the surface of the roadway as prescribed by the regulations; s) personal mobility Device is a compact motorized transportation device used by disabled persons to allow greater freedom of movement. Such devices are electrically powered, up to 1.3 metres in length and can travel at speeds up to 13 kilometres per hour. t) pocket bike is a small motorcycle powered by a gasoline engine up to 55 cc in displacement (15 horsepower). They are less than 50 centimetres in height and less than 1 metre in length. The maximum speed can be up to 70 kilometres per hour. u) police officer includes a member of the York Regional and/or the Ontario Provincial Police; v) raised curb means a curb, the face of which measures not less than thirteen (13) centimetres in height; w) regional road means a highway designated as a regional road by the Regional Municipality of York; x) roadway means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term roadway refers to any one roadway separately and not to all of the roadways collectively; y) schedule means a schedule referred to in this By-Law and forming part of this By-Law; z) school crosswalk means a crosswalk marked by authorized signs and pavement markings designating it as a school crossing location; aa) sidewalk means that part of a highway not being part of the roadway that has been improved by paving or other means, for pedestrian traffic; bb) sign means any sign, marking on a roadway, curb or sidewalk, or other traffic control device, other than a traffic control signal system, that provides notice of traffic regulations; and cc) traffic control signal means that part of a traffic control device that consists of one set of no less than three coloured lenses, red, amber and green, mounted on a frame and commonly referred to as a signal head; dd) u-turn means the turning of a vehicle within a roadway for the purpose of traveling in the opposite direction; ee) vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine, and any vehicle drawn, propelled or driven by any kind of power, including - 5 -

6 muscular power, but does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails. PART II GENERAL PROVISIONS 1. This By-Law applies to highways under the jurisdiction of the Corporation of the Town of East Gwillimbury. 2. The Community Programs and Infrastructure Department is responsible for the administration of this by-law, including the installation and maintenance of signs that have been authorized. 3. In accordance with the requirements of the Highway Traffic Act, The General Manager, CPI is designated by Town of East Gwillimbury Council as the person whose approval is required prior to the erection or installation of any new traffic control signal system or traffic control signal used in conjunction with traffic control signal system that has been authorized. 4. Where any expression of time occurs or where any hour or other period of time is stated, the time referred to shall be standard time except in periods when daylight savings time is in effect, in which periods it shall be daylight savings time. 5. The Town Roads Foreman shall be authorized to close local roads within the Town of East Gwillimbury for social, recreational, community or athletic purposes, parades, or a combination of such purposes, upon passing of a resolution by Council for specific events. 6. The General Manager, CPI or his designate is hereby appointed as the Officer of the Corporation authorized to issue permits on behalf of the Town under the Authority of the Highway Traffic Act or any amendment or re-enactment thereof. 7. Part III, Sections 2 c), 2 d) and e), 7 a), and 9 a) shall not apply if: a) a motor vehicle of a municipal, regional or volunteer fire department responding to a fire alarm; b) a motor vehicle operated by a Police Officer in the performance of his/her duties; c) an ambulance transporting a person to hospital or answering a call for assistance; or d) vehicles are engaged in public works operated by or on behalf of a municipal/regional corporation or a public utility

7 PART III TRAFFIC PROVISIONS 1. TRAFFIC SIGNS AND SIGNALS a) The General Manager, CPI or his designate is authorized to place or erect and to maintain such authorized signs and traffic control required to give effect to the provisions of this by-law or as are required to warn or guide traffic for the safety of the public. b) No person shall place, maintain or display upon or in view of any highway; any sign, signal, marking or device which purports to be or is an imitation of or resembles an authorized sign or traffic control signal, or which conceals from view or interferes with the effectiveness of an authorized sign or traffic control sign. c) Yellow paint applied to a curb is hereby declared to be an authorized sign indicating that parking is prohibited where the curb is so marked. 2. MISCELLANEOUS DRIVING RULES a) The driver or operator of a vehicle emerging from a driveway, laneway or bus loop onto a highway shall bring the vehicle to a full stop immediately before driving onto a sidewalk or footpath and upon proceeding shall yield the right-ofway to pedestrians upon the sidewalk or footpath. b) U-turns shall be made only where they can be made in safety and without interfering with other traffic. c) No person shall, except under the direction of a police officer, drive a vehicle on a highway between the vehicles comprising of a funeral or other procession recognizable as such by the display of pennants or other identification while the vehicles in such procession are in motion. d) No person shall drive a motor vehicle, except for those defined in PART 1(s), upon a sidewalk or footpath on a highway except for the purpose of directly crossing the sidewalk or footpath. e) No person shall drive a motor vehicle over a raised curb. 3. PEDESTRIAN RIGHTS AND DUTIES a) Except where traffic control signals are in operation or where traffic is being controlled by a police officer, a pedestrian crossing a highway at a place other than a pedestrian crossover shall yield the right-of-way to all vehicles upon the roadway, but nothing in this section shall relieve the driver of a vehicle from the obligation of taking all due care to avoid an accident. b) No pedestrian shall proceed over or go under a barrier permanently installed on a sidewalk

8 c) No person shall play or take part in any game or sport upon a roadway and, where there are sidewalks, no person on roller skates, a skateboard or riding in or by means of any coaster, toy vehicle or similar device shall go upon a roadway except for the purpose of crossing the roadway, and when so crossing, such person shall have the rights and be subject to the obligations of a pedestrian. 4. REGULATIONS FOR BICYCLES AND MOTOR-ASSISTED BICYCLES a) A person operating a bicycle or a motor-assisted bicycle upon a roadway shall ride as near to the right side of the roadway as practicable and shall exercise due care when passing a standing vehicle proceeding in the same direction or a vehicle parked at the side of the roadway. b) Persons operating bicycles or motor-assisted bicycles upon a roadway shall ride in single file. c) No person operating a bicycle or motor-assisted bicycle shall carry any package, bundle or article which prevents the rider from keeping both hands on the handle bars. d) No person shall park a bicycle or a motor-assisted bicycle on a highway except in such a manner as to cause the least possible obstruction to pedestrian or vehicular traffic. e) No person shall ride a bicycle or a motor-assisted bicycle with a wheel or wheels more than sixty (60) centimetres in diameter upon a sidewalk on any highway. i) No person who sells, offers for sale, or takes orders for goods, wares, merchandise or produce from a vehicle, shall, for the purpose of carrying on his business, stop the vehicle on any part of the highway lying between two intersecting highways for more than a thirty (30) minute period at any one location. f) The operation of Personal Mobility Devices (motorized wheelchairs and mobility scooters) shall be permitted on the sidewalk whenever one is available. Scooters must follow the rules of the road that apply to pedestrians and drive at the same speed as other pedestrian traffic. All personal mobility devices, whether or not they are used for short periods on the road, must have appropriate reflective devices to ensure that they can be seen from the front, back and both sides in low light conditions. g) The use of Pocket Bikes on sidewalks and roadways is not permitted at any time. 5. ONE-WAY TRAFFIC a) The highways set out in of Schedule II, between the limits set out in of the Schedule, are, during times or days set out in of the Schedule, hereby designated for one-way traffic only in the direction set out in Column 4 of the Schedule

9 b) Each designation made by Section 5. a) shall be effective upon the erection of official signs indicating such designation. 6. THROUGH HIGHWAYS, STOP SIGNS AND YIELD SIGNS a) The highways set out of Schedule III, between the limits set out in of the Schedule, are, except as provided in subsection 6 b), hereby designated as through highways for the purpose of the Highway Traffic Act, as amended. b) The designation in subsection 6 a) of a highway or portion of highway as a through highway shall not include any intersection thereon where the highway intersected is a King s Highway or a Regional Road forming part of the Regional Road System of the Regional Municipality of York. c) The erection of stop signs is hereby authorized at each of the intersections set out in of Schedule IV for the control of traffic entering the intersection from the highway or portion of highway set out in of the Schedule. d) The erection of yield right-of-way signs is hereby authorized at each of the intersections set out in of Schedule V for the control of traffic entering the intersection from the highway or portion of highway set out in of the Schedule. 7. HEAVY TRUCKS a) Except as provided in Section 7. b), when authorized signs to that effect are displayed, no person shall move, drive, operate or park a heavy truck on the highways set out in of Schedule VI, between the limits set out in of the Schedule, during the times or days set out in of the Schedule. b) Section 7. a), shall not apply to any vehicle actually engaged in making a delivery to or a collection from property or premises which cannot be reached except by way of a highway or portion of highway or to prohibit the use of vehicles for purposes, provided that in making the delivery or collection the highway or portion of highway is traveled only insofar as is unavoidable in getting to and from such property or premises. This exemption does not apply to vehicles making deliveries in connection with the Town s Fill By-law, as amended, or any successor legislation thereto. 8. LOAD ON BRIDGES a) Pursuant to the Highway Traffic Act, as amended, when authorized signs are on display, no person shall drive a vehicle with a load in excess of 5,000 kilograms (5 tonnes), per axle on any highway or part thereof described in of Schedule VII of this by-law

10 9. SPEED LIMITS a) When any road or portion of road set out in of Schedule VIII has been marked to comply with the regulations made under the Highway Traffic Act, as amended, the maximum rate of speed thereon shall be the prescribed maximum rate of speed set out opposite thereto in of the Schedule; in the location described in of the Schedule. 10. SIGNAL-LIGHT TRAFFIC CONTROL SYSTEMS a) The erection and operation of signal-light traffic control systems in accordance with the Highway Traffic Act, as amended, and the regulations made there under at the locations described in Schedule IX is hereby authorized. PART IV SCHEDULES The Schedules referred to in this By-law shall form part of this By-law and each entry in a column of such schedule shall be read in conjunction with the entry or entries across there from and not otherwise. PART V REPEALING SECTION That By-Law # , as amended, is hereby repealed. PART VI PENALTY SECTION 1. Every person who contravenes any provision of this by-law is on conviction therefore guilty of an offence and shall be liable to a fine as provided for pursuant to the Provincial Offences Act, or the Highway Traffic Act for each offence. 2. If this by-law is contravened and a conviction entered, the court in which the conviction has been entered and any court of competent jurisdiction thereafter may, in addition to any other remedy and to any penalty that is imposed, make an order prohibiting the continuation or repetition of the offence by the person convicted.
