20 DECISION/DIRECTION NOTE Title: Proposed Text Amendment to the Commercial Local (CL) Zone Applicant: City of St. John s 4 Ricketts Road Date Prepared: March 28, 2016 Report To: His Worship the Mayor and Members of Council Councillor & Roles: Councilor Art Puddister, Chair, Planning and Development Committee Ward: N/A Decision/Direction Required: That Council adopt the attached resolution for St. John s Development Regulations Amendment 632, 2016, which will have the effect of amending the Commercial Local (CL) Zone to add Take- Out Food Service as a discretionary use. Discussion Background and Current Status: At its Regular Meeting on February 29, 2016, Council accepted the recommendation of the Planning and Development Committee to advertise the proposed amendment to the St. John s Development Regulations. This text amendment has been prompted by an application for a pizza take-out use located at 4 Rickett s Road (PDE File #REZ ). This amendment maintains the intent of the Commercial Local (CL) Zone, which currently permits a convenience store use asof-right and a recycling depot as a discretionary use. The proposed amendment as well as the application at 4 Ricketts Road has been advertised on two occasions in The Telegram newspaper and was posted on the City website. Any written public submissions received by the City Clerk will be referred to the agenda for the Regular Meeting of Council. Staff recommend moving forward with the amendment. This property is close enough to my house on Derby Place that I have concerns about it. We already have one guy just up the street from that with a car up on jacks and being stripped for the last 2 months. It doesn t take long for an area to start looking run down and uninviting. Although I appreciate anyone who has the drive and ambition to start their own business I have a number of reasons for not wanting to support this effort. First and foremost this area is zoned residential. People buy there because it is residential and expect it to stay that way. They don t want houses with flashing OPEN signs next door to them. Commercializing any part of the neighbourhood will have a negative impact on the character and value of the area. I am also concerned that if you allow one person to change the zoning then the door will be open for others. Perhaps the most important thing for the city to consider is safety. That driveway will not allow for turnaround traffic. The clients will have to either back in or back out into traffic. Logy Bay Road is busy and narrow for 4 lanes. To say speed limits are often exceeded in that area would be an understatement. Backing out there can be dangerous at the best of times. Having people backing in or out of there when they are not used to the area is only asking for trouble. Add in the number of people that walk to and from the park in that area and I think this would be a dangerous thing to allow. Finally, with the downturn in the economy there must be a lot of available commercial space for ventures like this. I would assume areas are zoned commercial for these types of businesses. If not why bother to zone areas at all. Thank You.

There is already enough traffic, noise, garbage, and late night fights on this street corner; and, as a resident of the townhouses next door I am really stressed about the fact that this proposal is being considered at all. There is a convenience store/deli on the corner and then a hair salon... the traffic is obscene in this area due to the fact that there is also a day care, junior high school, and the hospital all on this stretch of road. Not only is this street busy from local traffic, but it is also the main thoroughfare for the City of St. John's maintenance vehicles (plows, dump trucks, you name it), fire trucks, ambulances, and the police. Not a day goes by without the rumbling of fast moving vehicles in an area that SHOULD be zoned as a 30 kilometer zone, given the number of children in the area every day. Many vehicles drive through this area at speeds far in excess of the posted limit without a care in the world and no regard for the people or time of day. In addition to the traffic, we experience allot of noise from couples/random people in nearby housing, apartments, or boarding units fighting at all hours of the night (especially during the summer months). Adding a new HANG OUT, such as a pizza take out will further exasperate these issues. The additional traffic, lack of parking, and undoubtedly an invitation for drugs and other annoyances are NOT WELCOME IN MY NEIGHBORHOOD. Moreover, there is already a pizza take out located on the opposite corner of Ricketts Road,

26 which is sufficient in my opinion. A second pizza take out (or any other commercial establishment) is not needed in this area. There are two chinese food take outs around the corner (Blackmarsh Road and Cambell Avenue). Every day I have to pick up garbage from the junior high school students who go to the convenience store on the corner of Campbell and Ricketts for lunch. This convenience store has a deli (and, probably also serves some form of pizza, I suspect I wouldn't know, as I never use the store). I am very tired of the mess and really don't need something else for them to toss on my lawn! I will be formally drafting a letter in response to this proposal for submission by the deadline. However, as my Ward's representative, I expect you to go to bat and ensure that this proposed take out is NOT APPROVED. I envision people parking in the housing unit across the street to get their take out and running across a busy road that is near the intersection and leading into a turn. People will be injured and that is just one issue with this proposal. I won't even get into property values and resale values, as I am simply too frustrated. Please do all you can and enlist the support of as many members as possible. This simply cannot happen on Ricketts Road. There is NO VACANCY and no place for another commercial venture in this area. Blue is the New Black Advertising Campaign (media/verbal presentation) The Director of Strategy & Engagement, the Manager of Communications, and the Marketing Associate were present to discuss the above noted and to address the recent controversy raised by Councillor O Leary in relation to the Spring 2016 edition of the City Guide. Particularly, she has received complaints from the general public about the front cover and the message blue is the new black ; don t be trashy and the depiction of a woman in a gown made from recyclable garbage bags. Some felt that the message was derogatory and objectified women. The Manager of Communications elaborated on the purpose of the recycling campaign which was developed to address the reduction in household recycling as evidence by reduced tonnage. There was a need to enhance public awareness and promote the importance of continued recycling. In this regard, a concerted in-house marketing campaign was launched, based on extensive research and external consultation that determined women were the number one recyclers in average households. The Committee was also presented with a series of short video campaigns further elaborating on the recycling campaign. Members of the Committee had no issue with these videos; however, agreed that the phrasing don t be trashy be removed from all forms of media in relation to this campaign. 40 INFORMATION NOTE Title: TD Green Streets Residential Tree Planting Program Grant Date Prepared: March 16/16 Report To: Ward: Public Works Standing Committee City Wide Issue: The Parks and Open Spaces Division has developed an initiative to that encourages home owners to plant trees on their properties in such a manner as to create street/sidewalk tree canopies within the City of St. John s. Discussion Background and Current Status: The City of St. John s has found it difficult to enhance its street tree canopy, a primary goal of the Urban Forest Management Master Plan, due to the lack of city owned land adjacent to street rights of way. Current development policies do not include a provision requiring the planting of street trees during the development stage of new residential communities. In an effort to address this issue, a program was created to encourage the planting of street trees (trees located such that they overhang or front public streets) on private properties. Once these trees reach maturity they will be designated as Public Trees and be preserved for the future.. The program, will include the following: The initiative is scheduled to run until July 31/16, but may be extended if funds are available. On April 4/16 a call for applications will go out to all residents via social media, main stream media, the City Guide and the City of St. John s website. Applications will be due on May 13/16. Once the applicants are approved they will be required to attend a mandatory Tree Planting & Tree Care workshop. Approximately 150 applicants will be accepted. At the workshop they will receive a voucher for a new, appropriately sized and hardy tree, which can be redeemed at several local nurseries. Nurseries will forward the redeemed voucher (maximum value $150 +HST) and invoice for payment to the City of St. John s. Residents will plant and care for their trees. City of St. John s Marketing and Communications Division will work with the Parks and Open Spaces Division to create a marketing /communications plan. All planted trees will be monitored, evaluated and added to the City of St. John s Tree Inventory. Requirements of the City of St. John s: Ensure the TD Green Streets program logo is prominently displayed or applied in all notices, publications, advertisements and other materials produced for or by the municipality in relation to the program. Display a recognition plaque in City Hall for a period of one year. Hold a launch event prior to May 30/16. Upon confirmation of acceptance, it is anticipated a formal announcement will be made at a future meeting of Council. Operational details will be provided to the public once finalized. The radar unit recorded the average speed in the area at 66 KPH in the 85% Percentile. We have deployed our feedback signs in the area multiple times in the past.
