4 US Visa issued by Embassy vs. ESTA We arrived internationally into the United States with a passenger that has told us they had a U.S. Visa, when in fact it was an ESTA authorization under the Visa Waiver Program from a previous commercial flight to the U.S. 4

5 The U.S. has a Visa Waiver Program (VWP). Must arrive on an approved air carrier to take advantage of the VWP. Some Part 91 operators and 135 Air Carriers operate under the Visa Waiver Program. Verify passengers have a current visa if you are not part of the VWP. If part of the VWP verify passengers have completed ESTA and have printed confirmation 5

6 Crew and Pax Visas, or lack thereof. 6

7 Verify the Crew and Pax all have the CORRECT visa for entry planning and day of trip. Ensure the ISP has all and correct crew and pax documentation information. ISP and Operator must work together to ensure everyone aboard has the proper documentation. 7

10 Flight ops. involving sanctioned countries are complicated and take extensive planning. All passengers require licenses from US Treasury OFAC (Office of Foreign Assets Control). Temporary Sojourn License for the aircraft & crew from Commerce Dept. BIS (Bureau of Industry & Security). Other US Agency limitations e.g. CBP. Universal blog series on U.S. Sanctioned Countries. 10

The pilot collecting the information described in paragraphs (b)(3) and (b)(4) of this section is responsible for comparing the travel document presented by each individual to be transported onboard the aircraft with the travel document information he or she is transmitting to CBP in accordance with this section in order to ensure that the information is correct, the document appears to be valid for travel purposes, and the individual is the person to whom the travel document was issued. 18
