Which LSOHC section priorities are addressed in this proposal: Protect shoreland and restore or enhance critical habitat on wild rice lakes, shallow lakes, cold water lakes, streams and rivers, and spawning areas. Protect forestland through acquisition or easement to prevent parcelization and fragmentation and to provide the ability to access and manage landlocked public properties. 1

2 How will you sustain or maintain this work after Outdoor Heritage Funds are expended: Crow Wing County currently manages for multiple uses on approximately 105,000 acres of tax forfeited forest lands. The multiple uses include timber production, recreation, water quality and wildlife. The trail application is consistent with multiple land use plans that embraces forest and recreation management practices that protect, restore and enhance habitat. It meets the Crow Wing County (CWC) Comprehensive Land Use Plan goal of Maintaining and enhancing parks, recreation and open space for Crow Wing County residents and visitors by providing diverse recreational opportunities that are accessible to people of all ages and abilities, while preserving the County s high quality natural areas and open space. It meets the objectives of the Comprehensive Recreation Trails Plan which addresses priorities for the management of diverse recreation trails and trail opportunities on the lands managed by the Crow Wing County Land Services Department. Moreover, the trail is managed consistent with the Crow Wing County Forest Resource Plan, which says that the County manages for wildlife habitat at both the coarse and fine filter levels and works to maintain and improve wildlife habitat as an integral part of a comprehensive land management program. Furthermore, trail management is subject to the sustainability standards of the world s two leading forest certification programs of the Sustainable Forestry Initiative (SFI) and the Forest Stewardship Council (FSC) that are devoted to avoiding negative impacts to soils, water, plants, wildlife, and wildlife habitats associated with recreation use. CWC public forestlands undergo annual rigorous independent third party forest certification audits covering over 300 different environmental principles including validating that these county forests conserve biological diversity and its associated values, water resources, soils, and unique and fragile ecosystems and landscapes, and, by so doing, maintain the ecological functions and the integrity of the forest that are critical to protecting, restoring, and enhancing habitat. In addition, should the trail be approved for Grant in Aid funding, it must be managed according to the Minnesota Department of Natural Resources Trail Planning, Design, and Development Guidelines which states that trails must...protect soils, water quality, wetland and 2

3 riparian area, wildlife and native plant communities, historic and cultural resources. 3 Finally, County natural resource managers believe that designating the trails as proposed will substantially improve management and maintenance of the currently used motorized trails, which will enhance, protect and restore habitat beyond the level articulated by the LSOHC in recommending legislative approval of the acquisition. First, there will be increased law enforcement. Conservation Officers with the MN DNR and Deputies with the CWC Sheriff s Office will periodically monitor the trail system based on the usage of the area. Second, there will be systematic monitoring. If approved by the State of Minnesota for Grant- In-Aid funding, the Minnesota DNR Trail Ambassador program will be initiated. If inappropriate riding practices are observed, trail ambassadors will inform users of safe recreation riding practices or incidences will be reported to law enforcement officials. Third, there will be increase systematic maintenance on the trail system that includes possible closing of trail segments if negative habitat (off-trail travel), soil (rills, erosion), or water quality (damage to wetlands) impacts are observed. Enhanced funding to accomplish this would come from the Minnesota DNR Trail Assistance Program. Fourth, there will be increased education and awareness of responsible recreation use as it relates to wildlife and habitat impacts. An information kiosk and pamphlets will be made available at the trail head / parking area to inform visitors about the property as it relates to wildlife habitat, water quality, aquatic invasive species, and safe/sustainable recreation practices. Also, interpretive signage would be installed at scenic locations, particularly along the Mississippi River, educating recreationalist about wildlife habitat. A survey and sign in sheet at the trail head will ask users for feedback concerning the trail system. According to the trail designation application dated November 5, 2014, the applicant picked this area for recreation trail designation due to its proximity to the Mississippi River to the north, available scenic areas, the availability of existing wide and well-traveled multiple use trails, and close proximity to nearby cities and amenities. The proposal is located approximately mid-way between Brainerd and Crosby/Ironton. Concerning rider safety during hunting season, the proposed trail designation will only be open for recreation use from May 1 st thru October 31 st. Recreation riding on forest trails passing through Crow

4 Wing County administered public lands is prohibited during the State firearms deer hunting season. This restriction does not preclude biggame firearm hunting, with a valid deer hunting license, which allows for off-highway vehicle operation before the legal shooting time, from 11 a.m. until 2 p.m. or after legal shooting hours, ½ hour past sunset. 3/17/16 Dan Hegstad Generally, I like the proposed project. Mixed use seems reasonable. There is a proposal to extend the Cuyuna Lakes trail to Brainerd. Does that cross this area? Will the trails intersect? If so, proper signage and enforcement should be in place to protect the paved trail from motorized use in the summer. There is much I don't know so I'm just guessing these may be issues. Thanks! If the proposed recreation designation is approved, the County will utilize the Minnesota Department of Natural Resources (MN DNR) signage guidelines as identified in the Forest Access Signing and Placement Guidelines (2005). Safety and regulatory signage will provide useful and necessary information to trail users. A proposed information kiosk at the trail head will inform users about safe, responsible, and legal recreation trail use practices. The Cuyuna Lakes Trail (CLT) is a legislatively authorized state trail (MN statutes , subd. 24) which, when complete, will connect the communities of Baxter and Brainerd to the west with Aitkin to the east. In between, the state trail will connect and travel through multiple Cuyuna Iron Range communities, Cuyuna Country State Recreation Area, and other points of interest. In the 2004 Master Plan (see: plan.pdf), the trail alignment was divided into four planning segments: 1. Baxter to Lum Park in Brainerd 2. Lum Park to Riverton 3. Riverton to Cuyuna 4. Cuyuna to Aitkin. Currently there are completed segments from Riverton (its current western terminus) to Crosby, and a segment in the City of Aitkin. Engineering and design are being completed on another segment between the cities of Crosby and Deerwood. The MN DNR has not identified a trail alignment west of the city of Riverton, however the City of Brainerd does have paved trails that could be designated as the CLT through a cooperative agreement between the City of Brainerd and MN DNR. Appropriation language on the Mississippi Northwoods property does include the need for approval by the LSOHC if a paved trail is proposed on the property, as follows: Development of a paved trail on land acquired under this paragraph constitutes an alteration of the intended use of the interest in real property and must be handled according to Minnesota Statutes, section 97A.056, subdivision 15. Any plan, including trail alignment, for the development of a paved trail must be submitted to the Lessard-Sams Outdoor Heritage Council for approval. No paved trail development or paved trail use is allowed unless it is specified in the plan for trail use 2 4

5 and alignment approved by the Lessard-Sams Outdoor Heritage Council. 3/17/16 Herb Davis If you go that route then call it an ATV trail because it isn't going to be safe or enjoyable on bikes or horses. No one has been able to enforce speed and drinking violators and it will not be safe or allow for peace and quiet. Thank you for your comments. The proposed recreation trail designation involves no new trail construction, no widening of existing trails, and no change in current uses which includes off-highway vehicles. Although the trail system will be maintained by the applicant, non-motorized uses will be (and currently are) allowed on all segments of the proposed designated trail system. This includes use by horses, hikers, hunters, and mountain bike enthusiasts. This "multi-use" concept is common and has occurred successfully on many recreation trail systems in Crow Wing County, the state of Minnesota, and many other states including Idaho, Massachusetts, Maine, Wisconsin, Washington, and Oregon. A key component is regulating ATV use. In Crow Wing County, this is partially accomplished through proper enforcement. Officers with the Sherriff s Office have full authority to enforce state statutes and county ordinances related to off-highway vehicles. As described in the project evaluation criteria, proposed mitigations to private residences include the use of safety and regulatory signage to help reduce the chances of unlawful recreation riding on the trail system. Between January 1, 2014 and November 13, 2015, the Crow Wing County Sherriff s received 62 calls, or less than 1/10 th of onepercent were related to an alleged unlawful ATV operation. One of the 62 involved alcohol use. A noise pollution study was conducted on the Red Top ATV trail system in Aitkin County in The results of that study indicate that 88% of neighboring residents less than 1 mile of the trail system felt noise impacts from recreation ATV riding was tolerable or very tolerable. Minnesota state statutes dictate that decibel levels emitting from off-highway vehicle (OHV) mufflers must not exceed more than 99 decibels at 20 inches away. Illegal modifications to mufflers and engines is not lawful. 3 3/17/16 Mark Hagen My family supports this proposal 100%. We have a cabin in the area and some of our best family time has been out on the trail enjoying nature sensibly with our four children. 3/17/16 Brett Hardy I think this is a great proposal. That is the only reason they should be there. The state has the ability to take the property back if they deem crow wing county has misused the funds. 3/18/16 Giles Radtke I went through and read the Trail Suitability Analysis and Proposed Application Summary and I think this is a great idea. I support the Mississippi River Northwoods Trail 100% and am glad to see the these two forms online giving everyone for or against this easy access with all the information. I hope to see this go in and being local my wife and I will make this a picnic trip on our ATV this summer along the river. I hope to see more well thought out OHV or OHM trail proposals in the future. 3/18/16 Jeff & Deb Norlin I am giving my full support to this Trial designation. I think it would provide many recreational opportunities for both motorized and non motorized uses in the area. This area has been a long time recreational use area. I believe with the Cuyuna Iron Range Riders ATV club heading up this project, it will be developed and maintained in a very good manner. Please consider this proposal as a definite benefit to the Crosby and Brainerd areas. 3/18/16 Brian Mathison The Wife & I like having a place to ride ATV that is near by besides the great Miller Black Bear trails. We have rode the area many times the only thing that would make it better is if got signing done like the Miller Black Bear trails. It will make the area more safe for all users. Maps of the area would help people from getting turned around & make it more enjoyable to all. I have also rode the area with my grandson, he really enjoyed the area & looking around at the river. 3/18/16 Dan Moddes According to the Dispatch, you are seeking public comment on whether or not OHV trails should be allowed in the Mississippi Northwoods park. If I have studied the map of proposed trails correctly, it appears that there two clusters of trails - one on each side of Sploezen's Road. May I ask that these OHV trails be kept to the east of Sploezen's Road? My family utilizes the trails on a routine basis for hiking. I will even mountain bike here. These are the more "silent" recreational activities that this park should also consider. 6 Thank you for your comments. We believe the proposed trail designation will provide more effective enforcement, management, and natural resource protection than the current approach of undesignated trails. Existing motorized trails in this area presents opportunities to create an improved system of designated, managed trails. Thank you for your comments. A system of designated, managed recreation trails will provide formal and enhanced monitoring, enforcement, and protection of the natural resources. Thank you for your comments. The map provided as part of the proposed trail designation application summary (p. 4) shows both the proposed recreation trail designation (yellow lines) as well as the already existing designated Miller Hills Off-Highway Motorcycle (OHM) Trail (purple hashed-lines). The Miller Hills OHM Trail, primarily located to the east of Sploezen s Road, has been a designated recreation trail system since 2007 and is not part of this recreation trail proposal. According to the trail designation application dated November 5, 2014, the applicant picked this area (west of Sploezen s Road) for recreation trail designation due to its proximity to the Mississippi River

7 to the north, available scenic areas, the availability of existing wide and ATV's can be loud (I know as our family also uses them). By keeping trails to well-traveled multiple use trails, and close proximity to nearby cities the east of Sploezen's Road, such constant noise would be kept more distant and amenities. A noise pollution study was conducted on the Red Top from western part of the preserve. The proposed designation includes no new trail construction, no existing trail widening, and no trail conversions to different uses. 3/18/16 Lawrence Severt, President of the Rice Lake Association I strongly object to converting existing trails to multi-use. There are precious few places, even in our so called north woods, where a person can escape the noise and odors of internal combustion engines. We don't need to sully what is now somewhat removed from those insults to one's senses. ATVs generally lack differentials and tend, even if driven sanely and carefully, to rip up terrain. And then not all ATV riders are sane and careful. Secondly, this would also open the area to dirt bike type motorcycles. Some years ago we lived across Black Hoof Lake from the mine area, and we were often subjected to and captive to the noise of dirt bikes. A good share of dirt bike riders are not content with the stock racket these things emit. They remove the mufflers so the noise is deafening. Thirdly, the manner in which dirt bikers ride is almost always destructive to the environment. I urge you to leave the area as is. This is what those of us who fought for the acquisition of this land envisioned, and opening it to motorized use would be a slap in the face. Of course, that's what we've come to expect from government. Money rules all. Managing sustainable natural surface trails for multiple uses can be accomplished through good design and proper use of native soil materials and through proper systematic maintenance that result in trails that resist compaction, displacement, and erosion. Crow Wing County has found that the key to sustainably managed trails is through designation and management on appropriate soil types and terrain/topography. During Step 2 of the Trail Proposal and Designation Process, each trail segment proposed for designation was analyzed for its potential sustainability as a multiple use recreation trail. No trail segments on the proposed 11.5 miles includes soils or topography that will not be sustainable if properly and systematically maintained, which the applicant intends to do. 10 Minnesota state statutes dictate that decibel levels emitting from offhighway vehicle (OHV) mufflers must not exceed more than 99 decibels at 20 inches away. 8 3/18/16 William and 11 Jean Meyer As a long term resident of Crow Wing County I am totally opposed to this land use on this property. I have been a resident of the County for 36 years and over that period of time we have seen miles of ditch bottoms eroded by ATV s, private driveways shredded, and quiet areas turned over exclusively to these motorized enthusiasts. Once that occurs, the area is no longer a multiple use area but rather a motorized haven intimidating and excluding other uses. 1] An area to the North has already been turned over to the ATV s, Black Bear. 2] ATV use precludes other uses by its nature, for safety reasons, and by environmental reasons. 3] The property was purchased by the State of Minnesota for wildlife preservation with tax dollars. It was assigned to the County for management. It was not assigned with the intent that it be turned over to a group who will, by the nature of their use, continually disturb the wildlife, and preclude other uses. 4] There is no demonstrated need for more ATV trails in the County or in nearby counties. 5] By the County s own analysis, this area does not connect to any other ATV trail areas. From the ATV perspective it is simply another piece of land to ride roughshod over. 6] The County has not completed a comprehensive management plan but if this is approved, it will preclude any other desirable uses and preempt any logical management plan. 7] The purchase of the property was predicated on its length of Mississippi River frontage. ATV use does not relate to that frontage, but rather has a major potential to environmentally damage that resource. In summary, this is a bad idea and is rather a impulsive initiative by the local ATV interests to quickly grab off public land for their singular use. 8 Thank you for your comments miles of existing trails exist on the MRNW property and are open to motorized use currently, as they were when the LSOHC recommended the purchase to the MN State Legislature. The proposal involves no new trail construction, no widening of existing trails, and no change in current uses which includes off-highway vehicles. These existing trails were on the property prior to its purchase by Crow Wing County, as noticed by the original sponsor of the purchase, the Trust for Public Land in its assessment of the site, which states that the subject property has several former logging roads that form the current recreational trail network through the subject property. (P. 3-2). The Miller Black Bear Area Trail, a multiple-use recreation trail system located just west of the City of Trommald and northeast of the Mississippi River Northwoods area, was approved by the County Board in 2013 and 95% of the proposal included designating existing trails already being by OHVs as recreation trails. Since the time of its designation, many improvements to the trail system have occurred including signage, trash pick-up, picnic tables, grills, tree clearing following storms, and trail erosion prevention and fixing. Although the trail system will be maintained by the applicant, nonmotorized uses will be (and currently are) allowed on all segments of the proposed designated trail system. This includes use by horses, hikers, hunters, and mountain bike enthusiasts. This "multi-use" concept is common and has occurred successfully on many recreation trail systems in Crow Wing County, the state of Minnesota, and many other states including Idaho, Massachusetts, Maine, Wisconsin, Washington, and Oregon. It has been the experience of Crow Wing County that designated, managed trails that include OHV use continue to experience multiple uses, including non-motorized uses, even after the recreation designation has been made. These include hiking, biking, and horseback riding among other uses. As set forth in the Crow Wing County Comprehensive Recreation Trails Plan, County natural resource managers performed a feasibility analysis as part of Step 2 of the Trail Proposal and Planning Process. County natural resource managers used specific criteria to evaluate the proposed designation. The criteria are designed to inform an objective evaluation process with flexibility to address the diversity of situations that exist. Crow Wing County utilized the Natural Heritage Information System

9 (NHIS), a collection of databases containing information about Minnesota s rare natural features maintained by the Division of Ecological and Water Resources within the Department of Natural Resources. The NHIS is continually updated and is the most complete source of data on Minnesota s rare or otherwise significant species, native plant communities, and other natural features (i.e., RTEs). If a RTE species is found within the vicinity, the County utilizes the MN DNR s Rare Species Guide (online) for specific management-related considerations related to trails to mitigate potential impacts. In short, the results of that analysis indicated that because the trail proposal includes no new trail construction and will result in no changes to the current allowed uses, the proposed designation will not significantly affect wildlife. 9 The County, in fact, does have a comprehensive management plan for the Mississippi River Northwoods property. The property is being managed to the standards set forth in the Crow Wing County Forest Resource Plan, the Comprehensive Recreation Trails Plan, the County Comprehensive Land Use Plan, and the standards and principles of the world s two leading forest certification organizations, the Forest Stewardship Council (FSC) and the Sustainable Forestry Initiative (SFI). See staff responses to comment #1, above for more information. The County has consistently been open and transparent that it would manage this property in accordance with these plans and standards. As per the County s testimony offered to the Lessard-Sams Outdoor Heritage Council (Lessard Council) on November 15, 2011, the County clearly articulated that the county intended to manage the property as it manages other County forest lands, including for recreation and trail access. Like several other counties in this part of the state, Crow Wing County s policy is that existing trails are open for multiple uses unless posted otherwise (i.e., closed to motorized use). As for future trails, the project Accomplishment Plan dated May 11, 2012, and approved by the Lessard Council on August 1, 2012, states that any future non-paved trail considerations will follow the County s Comprehensive Recreation Trails Plan as adopted by the Crow Wing County Board. During the planning phases prior to the acquisition by CWC, County staff formally presented the proposal to the CWC Board of Commissioners Committee of the Whole Meeting on 11/17/2011 and then officially sought a resolution supporting County ownership on 11/22/2011, which passed unanimously by motion 5-0. The proposal was also brought

10 before the County s citizen advisory committee, the Natural Resource Advisory Committee, twice for their review (7/27/2011 & 12/15/2011). All of these public meetings were open to the public. Concerning potential damage to the Mississippi River frontage area, all proposed designated trails incorporate recommendations from the Trail Planning, Design and Development Guidelines manual (MN DNR). The manual includes detailed considerations for ecological and physical sustainability, (including trail alignments, soils, slopes, drainage, etc.) wetland, and water issues among other important topics. Additionally, all forest management activities and as well as trail building and maintenance in the area incorporates concepts from the Voluntary Site-Level Forest Management Guidelines best management practices. As part of Step 2 of the Trail Proposal and Planning Process, impacts to soil conditions, slope, grade, wetlands, and public waters were evaluated in two separate objective categories (see Trail Suitability Analysis sections 10 and 12) and were found to score high on the sustainability rating. 3/18/16 Robert Fier After reviewing the map of the proposed trail I think it is a great utilization of the land. It makes me smile when I can see ATV, MTB, Hikers and Skiers all use the same area and get along. We all pay tax dollars and therefore each of our respective sports should be accommodated on Public Lands. Thank you for your comments. I support it and think this will be a valuable asset to the community. Brainerd has many off road enthusiasts that can enjoy this trail. It will also bring more tourist dollars into the community. My family will be traveling to enjoy the trail when it is completed and will eat and stay in town. Outdoor recreation is very important especially as more and more people lose their connection with the land and outdoors. This trail system sounds like something everyone can enjoy and will be an asset to the community.
