SECON JUICAL CIRCUIT 2/ 5 efendant's Name RUCE, MON'TAVIOUS ZAVON The undersigned certifies and swears that he/she has just and reasonable grounds to believe, and does believe that the above named efendant on Tuesday March 27TH 208, at approximately 0:3, at 88 CAPITAL CIR NE did the following violation of law: TIME OF ARREST (ARRESTEE IN PHYSICAL CUSTOY): :3 am EFENANT NAME: Montavious ruce O: 07/6/999 Sex M O 07/8/999 Agency Report 8-8798 FACTS TO SUPPORT AOVE CHARGE(S): I responded to a weapons call located at 88 Capital Circle NE (Circle K) The call notes advised that there were two black males in a red Kia Soul shooting a handgun into the air The incident was called in by two witnesses who were cashiers within the Circle K The witnesses described one of the black males as being light skinned, wearing a skully and a gray hoodie The other black male was described as a dark skinned black male with nappy hair The witnesses relayed information that the suspects were last seen driving north on Capital Circle The two witnesses were identified as Keila Washington and Cory Jackson I arrived on scene approximately three to four minutes after the call was dispatched I observed a red Kia Soul at the intersection of Capital Cir NE/ Centerville Rd (which is just north of the incident location) coming from the east side of the intersection The red Kia drove westbound on Centerville Rd and turned south after reaching the intersection I followed the vehicle until backup arrived The red Kia had a Florida tag of Y88HQQ, which came back to a registered owner named Jonquaris Richardson I initiated a traffic stop on the Kia just south of the intersection of Miccosukee Rd and Capital Cir in a veterinary parking lot I exited my vehicle, pulled out my department issued Glock 22 (serial PZE829) and held it at a high ready position My firearm was directly pointed at the red Kia as well as the occupants of the vehicle as they exited Sgt Todd called out the driver and passenger of the red Kia one by one over the loud speaker of his police cruiser oth the driver and passenger were compliant with Sgt Todd's commands The driver, identified as Jonquaris Richardson, was a dark skinned black male wearing black pants, black jacket and his hair was in the beginning stages of growing dreadlocks (nappy hair as described by Washington) The front passenger, identified as Mon'tavious ruce, was a light skinned black male wearing a skully and a gray hoodie oth occupants were a match to the original information given by Washington and Jackson oth Richardson and ruce were detained in handcuffs then separated into separate vehicles for further investigation At approximately am, Washington stated that two young black males came into the Circle K to buy a polar pop and a black & mild The two black males soon after walked out of the store, only to loiter in the parking lot Washington walked out to the parking lot to inform the two black males (Richardson and ruce) that they could not just sit in the parking lot ruce and Richardson initially left the parking lot going south on Capital Cir, then made a U-turn to head north on Capital Cir The red Kia Soul was near the intersection of Capital Cir NE/ Miccosukee Rd when Washington witnessed three or four gunshots fired out of the driver window (into the air) Washington 00% identified Richardson as the driver and shooter in a show up on scene Jackson is the co-worker of Washington within the Circle K Jackson exited the store along with Washington to assist and tell Richardson that he needed to leave the parking lot Jackson observed the red Kia drive north on Capital Cir Jackson heard five or six gunshots come from the vicinity of the red Kia Jackson was not able

SECON JUICAL CIRCUIT to identify who was actually shooting from inside the vehicle, but identified Richardson as the driver of the red Kia Jackson stated that Richardson was wearing all black with longer hair 3/ 5 I read Richardson his Miranda Warning, per card, in which he Richardson initially consented for the police to search his vehicle The doors to the vehicle were open in order to clear the vehicle of any other passengers efore officers on scene were able to search the vehicle, Sgt Todd observed a firearm under the front driver seat The firearm was able to be seen due to the back door being wide open Only a small portion of the firearm could be seen from an angle The firearm was concealed in such a way that could not be seen on a routine traffic stop I located that particular firearm along with another firearm under the driver seat oth firearms were readily accessible (near his person) by Richardson Richardson is not licensed to carry a concealed weapon oth firearms were photographed and collected Under the driver seat was a black/camo 9mm Glock (serialgt58) along with a black 9mm Smith and Wesson (serialhwp558) The Glock had one magazine inserted with fifteen rounds inside of it The Smith and Wesson had a magazine on the floorboard beside it loaded with eight rounds along with another magazine inserted into the gun with eight rounds Neither firearm had a round in the chamber Richardson Richardson had been identified as the driver discharging a firearm in public by Washington Richardson was on a paved road, less than 000 feet from the Circle K and its occupants; knowingly discharging his firearm in a reckless and negligent manner ruce was read his Miranda Warning, per card, by Ofc ullock ruce The firearm located by Ofc Senatus under the passenger front seat was readily accessible by ruce The firearm under the passenger seat was a black 9mm Smith and Wesson (serial L3033) The Smith & Wesson did not have any rounds inside of it or the magazine This particular Smith & Wesson was checked and did come back as being stolen under Tallahassee Police case 8-8798 Neither ruce or Richardson had any criminal history as an adult or juvenile A secondary verification was conducted to verify that the stolen Smith & Wesson was taken out of NCIC/FCIC The firearm was removed by Teletype Operator Gammon 223 An e-mail was sent to the property crimes investigators for follow up James Seay, the owner of the stolen firearm, was contacted and informed of the recovery The vehicle on scene was taken by Richardson's mother, Emaria Ann ryant The traffic stop and investigation was captured on Mavric 007 igital photos were taken by Ofc raxton with camera 3097 All of the physical evidence was impounded at Tallahassee Police epartment There were a large black/yellow bag full of tools located in the back seat of the Kia Richardson stated Richardson said The ewalt tools were impounded as well A hit confirmation for stolen property was sent by Warm Springs Tribal Police (Oregon) in reference to the ewalt Impact river with a serial number of CF885 I spoke to Ofc Wilson 329 who advised that this stolen property case was being investigated by etective Williams 3 The phone number given by Ofc Wilson was 5-553-7 The case number is 800386 At the jail, Richardson was asked if he would like to speak to an investigator about this incident Richardson Sgt utler was notified about the connection to burglaries located on Nabb Loop
