The appeal is made by Astonhurst Ltd against the decision of East Lindsey District Council. The application Ref N/110/02187/08, dated 08/07/08, was refused by notice dated 24/09/08. The development proposed is: Construction of asymmetrical pitched roofs to 8 No. timber-clad chalets, adjacent to the north-east site boundary of the Chalet Park. Decision 1. I dismiss the appeal. Main issue 2. From all I have read and seen I consider that the main issue in this case is the effect of the proposal on the amenity of residents of dwellings along Seaholme Road. Reasons 3. The appeal relates to the addition of asymmetrical pitched roofs to eight chalets along the north-east boundary of the Chalet Park as a part of their upgrading. One of the chalets for which approval is sought (No. 2) has already been upgraded and the new roof constructed. 4. Permission for alteration to the roof form has been granted in respect of the remainder of the chalets on the Park. 5. The chalets the subject of the appeal are angled to the boundary and their eastern-most corners are around 3m from the timber fences separating the Chalet Park from the rear of properties along Seaholme Road. The fences are around 1700mm high but some have sections added to the top. Whilst there is variety in the dimensions of their rear areas, the dwellings on Seaholme Road, which comprise a mixture of bungalows and houses, have very shallow rear gardens. 6. In order to assess the impact of the proposal I viewed the site from the rear garden of Bromley, one of the properties on Seaholme Road. Judging from the impact of the new roof on chalet 2, I consider that the proposal would have a seriously adverse impact on the amenity of residents of the dwellings along Seaholme Road.

2 Mablethorpe Park Tingdene Ltd Appeal Decision APP/D2510/A/08/ /NWF 7. With the revised roof form the overall height of the chalets increases by around 1.5m. Bearing in mind that the chalets are to the south-west of the existing properties, the additional height of the chalet roofs would reduce sunlight in the small gardens and on the rear elevations of the dwellings. Whilst the existing fence may currently have an impact on afternoon and evening sun the situation would in my opinion be materially worsened by the proposal. Also in view of the proximity of the chalets to the rear of the Seaholme Road properties the proposal would have an overbearing effect on the outlook from the properties and their small rear gardens. 8. I appreciate that permission has been granted for the revised roof form on chalets 9 and 10 which are close to the boundary with properties to the southeast. However, this does not justify a form of development that in my view would significantly detract from the amenity of residents of properties on Seaholme Road. 9. I have taken account of all the other matters raised in the material before me including reference to the various additions that have been made to the Seaholme Road properties. I am also aware that the existing chalet roofs are nearing the end of their effective lives and the revised roof form would enable water storage tanks to be installed as part of the general upgrading of the units. These other matters do not alter my conclusion that the proposal would unacceptably harm the amenity of people living nearby and would therefore be contrary to Policy A4 of the of the East Lindsey Local Plan Alteration As a consequence the appeal should be dismissed. The park was purchased a few years ago for redevelopment and a Tingdene sales office has been setup onsite. The refurbished chalets are expected to be offered with 99 year leases. The chalet upgrade work and park management is provided by Paul Spriggins Concept Of Leisure Ltd. Last September East Lindsey District Council planning Department rejected an application for the addition of pitched roofs pictured on their website. Details Attached.

4 Park Further work carried out on mobile home development by Fok on Tue 23 Feb :41 GMT Permanent Link Further work has been carried out on the Mobile Home/Maintenance Area, despite planning permission being refused back in January work has continued with the addition of timber closed boarded fencing around caravan and metal gates & fencing across front of maintenance yard. One of the resaons why the development, was refused was its proximity to the boundaries of adjacent residential properties and the loss of screening trees around the site, would be likely to result in a harm to the amenity of these properties through noise and disturbance KPCOA Latest gfedc all blogs Environment Agency

It would be difficult to oppose similar in the village if these were approved at this location. These look like they belong on the front of a holiday brochure in a travel agent. A more traditional sign might be more appropriate matching that already there with this or similar sign board located more discreetly further in from the entrance, perhaps visible but away from the gates. 6 Park KPCOA Latest gfedc all blogs Chalet alteration work started by Fok on Sat 08 Nov :06 GMT Permanent Link Tingdene have announced that during the closure period (Nov Feb) they intend to refurbish some of its chalets and offer them for sale in accordance with a number of different layouts, in addition to a brand new 99-year lease. The different layouts available are in thier chalet purchase packs. Attached are some pages that show the various designs and details of the off-plan lodges for sale. As may be seen, they intend to alter the front of the chalet by bringing the living room out to the edge of the existing veranda and then extending part of the veranda further forward. The plans represent a significant change in the external appearance of the chalets, which has been successfully maintained since they were built in the 1980 s, including the four chalets built in The vast majority of chalets are arranged as semi-detached units with the front, aspect, which is fully glazed, being recessed some three feet from the front of the existing Veranda thus allowing a sufficient degree of privacy which would be considerably eroded if these modifications were to be made. Owners may also be concerned by the visual imbalance if one of the properties is developed while the other remains in its original state. Various Chalet owners have written to Paul Francis, the Senior Investigation Officer at DDC regarding the proposed developments. His view, after visiting the park at the beginning of October, is that the proposals amount to development for which planning permission is required. Mr Paul Spriggins from Tingdene has recently said "We have contacted Dover District Council and planning permision is not required"

Dover District Council have re-advertised the planning application for the additio equipment, changing it to a 'retrospective application' to get the unauthorise granted permission. Back in April, Dover District Council wrote to the KPCOA and confirmed that in a with Central vernment guidelines, planning application would be required for t car park and play area developments and that they have invited Tingdene to apply permission.
