Chairman Councillor Susan Barker was appointed Chairman for the ensuing Municipal Year. 2. Deputy Chairman The appointment of Deputy Chairman was deferred until the next meeting 3. Urgent Item Membership of the Joint Committee Following a request by Members at the On-Street Parking meeting on 21 June 2012, Members considered a briefing note from Essex Legal Services in respect of Can Deputy Cabinet Members act as a substitute member of the Joint Committee? The briefing note concluded that As a result if the appointed member of the member authority is unable to attend a meeting of the Joint Committee, if the member authority wishes to retain voting capabilities on decisions before the Joint Committee, the substitute must be someone to 4

7 who executive power can be delegated. As a result the persons able to act as a substitute in accordance with the statutory provisions would be another Cabinet Member only. Given this advice Councillor Mitchell tabled the following motion. For Partner Authorities to agree to formally change the constitution under which the Joint Committee operates to allow Deputy Cabinet/Executive Members to vote. This would be in the interests of all partner authorities and in accordance with the original spirit of the partnership and the mutual trust and respect placed on each other's views and opinions Councillor Mitchell said Braintree s view is that if the constitution of the Joint Committee needs changing to accommodate the above, every effort should be made to do so. This is about how we work together in the interest of one another whilst maintaining an effective working relationship. Mr. Paul Partridge (Braintree) said there should be a degree of reasonableness in determining the membership of the Committee, in the spirit of the partnership. Councillor Stock believed it should be a Cabinet Member that attended and would otherwise seem odd. He had not come across a situation before where Non-Cabinet Members attended such meetings. Whilst it was agreed that it was not possible under the current arrangements to accept the proposed motion from Braintree District Council, it was suggested the Committee could write to Essex County Council to request them to consider the proposed motion from Braintree, and consider amending the NEPP JCA 2011 to allow Deputy Portfolio Holders to attend future NEPP meetings and be able to vote. Whilst Councillor Waller was of the view that each partner authority should have a nominated Portfolio Holder to substitute for absent Members, he was not adverse to the proposal being made. Councilor Barker, supported by Councillor Hunt and Councillor Waller agreed to this suggestion. RESOLVED that the Committee agreed that the Partnership write to Essex County Council to request them to consider the tabled proposal from Braintree, that asked for an amendment to the NEPP JCA 2011 to allow Deputy Portfolio Holders to attend future NEPP meetings and be able to vote. Councillor Mitchell and Mr. Partridge left the meeting following the discussions about governance matters. 4. Declarations of Interest Councillor Barker (in respect of being a Member of Essex County Council), declared an interest in all the following items. Councillor Hunt (in respect of being acquainted with representatives of the CCTV Car suppliers) declared an interest in the item CCTV Further update. 5. Minutes RESOLVED that the minutes of the meeting held on 8 March 2012 was confirmed as a correct record. 5

8 6. Protocol update Mr. Walker, Group Manager, North Essex Parking Partnership, introduced the report on the current and revised TRO protocol and scoring system that forms the overall TRO process. Mr. Walker confirmed to Councillor Stock that points supporting local businesses are now covered by Viability and the contribution to economic development. On that basis Councillor Stock said he felt the flow chart for the TRO process was complicated, the new one more so than the original one. Councillor Stock did not believe this priority worth 6% of the total allocation was adequate, and felt that section needed to be more descriptive. Mr. I. Taylor said there would be occasions when emergency or urgent TRO were required, and it was important to ensure fairness and to try and avoid situations where some authorities may receive more TRO changes / implementation than others. Mr. I. Taylor also asked if the Partnership was keeping to the allocation of so many per authority as before, and requested an update on the cost or charge for TRO in view of the fact Colchester was able to purchase additional TRO changes previously. Mr. I. Taylor felt that with a lack of democratic representation, there is a real danger of alienating local parishes and local communities where TRO requests more often than not come from, by rejecting applications before they are even considered. Mr. I. Taylor said this issue needed clarification. Councillor Hunt and Mr. A Taylor (Uttlesford) also said they were concerned with the removal of engagement with the public services and other organisations from the Prioritisation Methodology (PM), Councillor Barker said the revised PM needed to show democratic representation and public involvement. Mr. Walker said there clearly needed to be certainty in achieving local support to the scheme, the engagement process was now dealt with in full, as part of the Local Decision identified as stage B on the procedure flow-chart. Mr. McGill (Harlow) said whilst it is in the best interests of all concerned to make the Traffic Regulation Order process simple, it is inherently complicated. Mr. McGill said at district level Local Panel members are aware of what is happening and do have an opportunity to consider TRO and recommend proceeding or deferment back to the NEPP Committee for further action. Mr. I. Taylor and other officers said some of the terminology within the revised PM was not considered clear, and in some areas considered more subjective than the existing PM and in some cases made little sense. It was suggested Impact could be replaced with Safety local support and concerns. Mr. Young (Colchester) said the process had to have accountability, and that was provided through the scoring within the PM and the processes set out in the procedure flow-chart. In response to Mr. I. Taylor who said the process of providing agenda papers and discussion points only seven days in advance of NEPP meetings did not allow sufficient time for districts to discuss issues and to consult widely, and placing things, e.g. the CCTV Car item on the TRO Sub Committee agenda, only makes the situation worse, Councillor Barker said the CCTV Car report was requested following the presentation at the June meeting. Whilst it was acknowledged that the Sub-Committee s remit was to consider work concerning TRO, and the separating of duties and appropriate reports had to this point worked well, in this case the item was needed to be considered as a matter of urgency, to enable officers to complete any further work before the September meeting and subsequent implementation. The point about 6

9 providing sufficient pre-meeting briefing time for agenda papers was agreed, and Councillor Barker also requested that Mr. Walker and Mr. Judd draft a Forward Plan, to include all (On/Off/Sub) future meetings and a schedule of all reports, to be updated as required and reported to all future meetings. It was further agreed following the meeting that Mr. Judd would arrange Client Officer Premeetings, preferably a clear week before each Committee meeting, providing an opportunity for local briefings and for any amendments to be made to papers as a result of the meeting. RESOLVED that the Joint Committee; i) Approved the revised TRO Protocol with the decision points outlined, but requested officers to take account of the comments from Members of the Committee. ii) iii) iv) Approved the revised scoring system for the Prioritisation Methodology, to become a component of the TRO process, but requested officers to take account of the comments from Members of the Committee. Approved the on-line implementation of the application process and TRO progression system and the development and implementation of a database to provide public access to information on the progress of cases. Agreed that officers draft a Forward Plan, to include all (On/Off/Sub) future meetings and a schedule of all reports to be regularly updated, and reported to all future meetings. 7. Verbal update on progress of Parking Schemes Mr. Trevor Degville (Parking Partnership) presented the Parkmap Tiles for New Restrictions, and gave a verbal update on the progress of each scheme. The schemes had been approved by the Committee for implementation. The schemes that were discussed are as follows: Brise Close (Braintree), Chalks Road (Braintree), High Street, Dedham (Colchester), Coventry Close (Colchester), Eudo Road (Colchester), Victoria Esplanade, West Mersea (Colchester), Villa Road (Colchester), Kendal Avenue (Epping Forest), Torrington Drive and Gardens (Epping Forest), Frobisher Drive (Tendring), Wellington Street (Tendring), Queensway (Tendring), Wix Cross (Tendring), Cambridge Road (Uttlesford) and Common Hill (Uttlesford). RESOLVED that the Joint Committee considered and noted the progress made with the new restrictions. 8. CCTV Car Further Update Mr. Walker (Parking Partnership) gave a brief introduction on the reasons for considering the introduction of a CCTV Car and the benefits that would accrue. Equita was offering to provide the facility at no cost to the Council, for receiving income of (half the discounted rate of 35 per PCN) for each PCN issued. Despite the financial benefits from implementing a CCTV Car, some members and officers still had reservations about this form of additional parking enforcement. Though they were in 7

10 agreement on the principle to make area outside schools safe, they wondered if there are not any other solutions. Whether or not this form of parking enforcement was used in the future, Councillor Barker could not see a reason for not agreeing to a CCTV Car on a one year trial at no cost to the Partnership and an opportunity to gauge its effectiveness, a point echoed by Councillor Waller. Councillor Stock said if a CCTV Car is going to catch those motorists obstructing public transport it was a good reason to consider this as a form of enforcement. Mr. Walker confirmed that since Equita went public with there CCTV Car model that there are now a small number of other suppliers now on the market, of which at least three of these provide a similar service. RESOLVED that the Joint Sub Committee agreed that further project work was needed, whereby further information could be obtained, including a cost-benefit model on the different procurement options. The Joint Sub Committee asked for the information to be presented to the next NEPP Joint Committee meeting for On-Street Parking. 8

12 1. Summary and Scope 1.1. The North Essex Parking Partnership Sub Committee for Traffic Regulation Orders ( The TRO Sub Committee ) considers requests for making parking restrictions on the highway in order to secure the expeditious, convenient and safe movement of vehicular and other traffic and provision of adequate parking The TRO Sub Committee is asked to consider and approve, defer or reject schemes from the list of requests in order to maintain a manageable and sustainable work programme The North Essex Parking Partnership operational service (NEPP) office has now received over 300 informal requests for new parking and waiting restrictions since its inception Meetings have taken place between NEPP officers and Client Officers to discuss the merits or otherwise of, and conduct informal consultation about, the requests received, since the last round of traffic orders were agreed by the TRO Sub Committee. 2. TRO Requests 2.1. The requests that are to be considered are listed in the Appendices by district/borough council area Numbering re-starts at scheme request 54, beginning from number 10,000 in order to retain lists by districts, as shown in Appendix A. The first 53 requests were considered at the meeting on 8 March A separate case report has been provided for local consultation and is also available for inspection for each of the requests. 3. School Restrictions 3.1. There are over 300 schools in the area covered by the North Essex Parking Partnership. Many of these have restrictions The North Essex Parking Partnership frequently receives complaints from residents concerning parking around schools at opening/closing times due to perceived dangers Some of the school keep clear markings are advisory only and are not supported by a Traffic Regulation Order (TRO) Enforcement of the restrictions by Civil Enforcement Officers is therefore not possible in the advisory locations and any perceived problems persist It would be advantageous to be able to implement TROs for these areas without having to adhere to the current TRO approval process individually, but rather by way of a delegation to officers This would only relate to TROs for any lines that are already in place, not for additional new restrictions which would continue to follow the current decision making by member process. 13 4. Scoring Matrix 4.1. The current scoring matrix has been adjusted, from the original form used, in an attempt to introduce and consider relevant information required for a TRO. It is apparent from meetings held with client officers that the matrix may require further adjustment and an open discussion in relation to this should be promoted For the purposes of this meeting however, the scoring is an indication of the relative position of each scheme and should be used as a guide when promoting schemes, alongside any other qualitative measures which may become obvious during debate of the relative merits of particular schemes. 5. Decisions 5.1. Members are asked if they wish to promote and progress to full consultation or defer any of the requested parking and waiting restrictions from the lists in their possession, including previously deferred schemes, by deciding to implement TROs on the highway Members are also asked to reject all restriction requests which do not meet the criteria where the introduction of a scheme is not deemed appropriate; with the option of deferring schemes to remain on the list Members are asked to delegate the power to implement TROs at all existing school zig-zags to officers in order to introduce TROs at school sites for the purpose of expediency in order to validate advisory-only restriction markings thereby allowing enforcement to be carried out The reason for making parking restrictions on the highway is in order to secure the expeditious, convenient and safe movement of vehicular and other traffic and ensuring the provision of adequate parking NEPP officers will arrange to contact all interested parties to inform of any decision made and, in the case of rejections, to remove the request from pending list held This is deemed necessary to manage customer s expectations and to ensure that the current request recording system is sustainable. Introduction and Purpose of Report 1.1 The report gives update of the TRO progression to date 2 Colchester Schemes 2.1 Roads around hospital - A questionnaire survey has been completed. The results of this are detailed in a separate report which has been given to the Colchester Borough client officer 2.2 Coventry Road, Villa Road, Eudo Road, Victoria Esplanade, Dedham High Street. These traffic orders have been formally advertised. Some objections have been received. These are the subject of a separate report for the members to consider before the order can be sealed 3 Braintree Schemes 3.1 Brise Close and Chalks Road/Church Street. Orders have been drafted and these are booked to be advertised on 18 th October in the Braintree and Witham Times 3.2 The Essex County Council (Braintree District) (Permitted Parking and Special Parking Area) Consolidation (Amendment) 44 has been advertised and sealed. The effect of this order is to remove the over 65 concession for free resident permits. It has also been used to clarify and amend some of the definitions in the order 4 Tendring Schemes 4.1 Wellington Street, Queensway, Crossroads at Wix, Frobisher Drive. Orders have been drafted and are booked to appear in the Harwich and Manningtree Standard and Clacton Gazette on Friday 26 th October 5 Epping Schemes 5.1 Questionnaires have been delivered to Western Avenue and The Wantz London Road. Introduction and Purpose of Report 1.1 This report concerns objections that have been received following the publication of notices of intention in the Colchester Borough. 1.2 Formal Consultation has taken place and details of the objections which have not been withdrawn are shown below. 1.3 Members are asked to decide whether to proceed to the making of the traffic regulation orders notwithstanding objections made following the statutory notification of the proposed traffic regulation order. 2. TRO Schemes 2.1 Coventry Close No objections have been received. 2.2 Dedham High Street No objections have been received 2.3 Villa Road Objection Objector A Objects to the proposal as they feel that it is unnecessary and therefore a waste of public money at a time of severe financial restriction. The school run does cause some congestion and inconvenience but only for a short period of time in a working day. Objector A feels that this should be tolerated for the sake of responsible parents who wish to see their children safely to school. They should be encouraged to behave responsibly and not obstructed by overzealous application of parking restrictions. As for public safety aspect, the present situation has existed for many years without any serious incidents and objector A fails to see the necessity for any further action at this time NEPP Officer Response The restriction is a remedy to the inconvenience suffered by local residents during school collection and drop off times. Although the parking is for a short period of time, the planned restriction would only be in place for a similar period of time and is deemed an acceptable resolution in this case. The restriction will ensure that future safety at the site is promoted and the lack of accident incidents is preserved. It will also enable our enforcement officers to instigate immediate action to contravening motorists. We have received no further objections to this scheme and although there have been no significant safety issues reported, site visits conducted have illustrated the parking practices of parents and the perceived threat to pupil safety. The restriction will 31

34 Page 2 of 2 ensure that future safety at the site is promoted and the lack of accident incidents is preserved. 2.4 Eudo Road Objection Objector B Has relied on parking at Eudo Road since 1994 as Objector B has no off-street parking. If they were no longer able to park in Eudo Road they would have to consider having a dropped kerb installed and converting their front garden to a parking space, as is the case at numerous nearby properties. NEPP Officer Response The parking restrictions are requested by the owner of the road to promote access and to regulate parking on the road by the facility users. The formal parking measures are seen as an alternative to the instigation of private enforcement of the road. There has never been a formal agreement in place with the owners to allow parking in the area. 2.5 Victoria Esplanade informal objection Objector C has objected as they suggest that the extension of the parking restrictions will lead to people parking opposite their driveway causing access issues. NEPP Officer Response The restriction has been funded by an internal department and the area chosen was done so due to complaints received locally. Objector C was invited to confirm their formal objection and no further correspondence has been received. It is not considered that the road will be adversely affected by the introduction of further restrictions and access to the resident s property will still be available. It is considered that the obvious benefits of removing parking close to a blind bend, with the introduction of the planned restriction extension will outweigh the minor perceived inconvenience to the local resident. 3.0 Decision 3.1 Members are asked to consider the Objections to the schemes outlined above. Options available are to consider alternative schemes, to withdraw the scheme on the basis of the Objection or to progress with the schemes having dealt with the Objector s concerns. 3.2 Members are therefore asked to decide whether to progress with the schemes. 3.3 Members are recommended to approve the progression of the schemes despite the formal objections that have been received, for the reasons given above. 32
