Members of the public: Two Press: None CHAIRMAN: Cllr Harvey 13/67 APOLOGIES FOR ABSENCE Cllr Sheppard Ill. 13/68 DECLARATION OF INTERESTS Cllr Mee declared a Disclosable Pecuniary Interest in planning application FUL/MAL/13/00217 as he is a partner in the applicants business. Cllrs Harvey and Potten declared non pecuniary interests in planning application FUL/MAL/13/00217 as they knew the applicant. 13/69 DISPENSATIONS None. 13/70 MINUTES OF THE LAST MEETING It was resolved to approve as a correct record the minutes of the meeting held on 19 March /71 PUBLIC FORUM There were no matters raised. 13/72 PLANNING. Applications received from Maldon District Council. To respond as a consultee: Cllr Mee vacated the room. FUL/MAL/13/00217 Installation and operation of a ground mounted solar PV system with a capacity of up to 25KW. Grange Farm, Grange Road, Tillingham. Mr C Mee Tillingham Parish Council supported this application. Members raised general concern that this type of system could absorb good agricultural land in the area. Cllr Mee returned to the room. 3 Appeal B Site Address: Lower Burnham Road, North Fambridge Essex Application Reference No: FUL/MAL/12/00119 Appeal Reference No: APP/X1545/A/12/ Description of Development: The proposal seeks permanent road widening works for the purpose of facilitating access for abnormal load deliveries to the proposed wind farm at Turncole Farm. The new highway created will be fenced or similar to allow access to the abnormal loads only and not all traffic. The works will take place at the two road junctions between Lower Burnham Road and Fambridge Road near Cold Norton. The works will result in a change of use from residential and agricultural land to form new highway. (Resubmission of Previous Application FUL/MAL/11/00806). Appeal C Site Address: Twizzlefoot Bridge Marsh Road Burnham on Crouch Essex Application Reference NO: FUL/MAL/11/00879 Appeal Reference No: APP/X1545/A/12/ Description of Development: The proposal seeks permanent road widening and a new bridge to the South of Twizzlefoot bridge for the purpose of facilitating access for abnormal load deliveries to the proposed wind farm at Turncole farm,. The works will result in a change of use from agricultural land to form new highway. Other Planning Matters Information only - Proposed development of Tillingham Hall Farmyard, North Street Tillingham. A letter had been received from Strutt & Parker stating that there will not be any affordable housing provided on the proposed site, and instead a financial contribution will be made towards off site affordable provision within the District. They advise the contribution will be made to the District Council via a Section 106 Agreement should planning permission be granted for the scheme. Other detailed amendments have been made to the scheme. The planning application and reports are being finalised and will be submitted to MDC soon. Strutt & Parker advise the Statement of Community Involvement will be submitted with the planning application. Neighbourhood Planning and Community Infrastructure Levy Cllr Pluckrose addressed this topic under agenda item 13/72. In summary, MDC will support parishes wishing to pursue a neighbourhood plan, but in reality they realise this could be beyond the resources of many parish councils. Council Tax Capping. An had been received from Emma Foy MDC requesting annual account figures for 2011/12 to support a letter she would be sending to Eric Pickles stating that parishes cannot sustain capping of council tax precept increases. Further information would be requested/investigated concerning capping. The account figures would be sent. 13/74 HM CUSTOMS AND REVENUE RETURNS FOR THE YEAR ENDED 5 APRIL The Clerk confirmed the year end returns had been completed and accepted by HMRC. 13/75 HM CUSTOMS AND REVENUE REALTIME PAYE The Clerk advised that the honorarium paid for West Field Grass Cutting will now need to be paid over a period of time to accommodate Real Time PAYE. The Clerk recommended the budgeted figure is paid over 6 months from April to September. It was resolved that the budgeted figure for West Field Grass Cutting be paid over 6 months from April to September. 13/76 ANNUAL RETURN FOR THE YEAR ENDED 31 MARCH 2013 Brian Wheeler the Independent Internal Auditor had completed the internal audit on 16 April 2013 and signed page 4 of the annual return. It was resolved to approve the accounting statements for the year ended 31 March 2013 and to sign page 2 of the annual return. It was resolved to approve the annual governance statement for the year ended 31 March 2013 and to sign page 3 of the annual return. 13/77 A REVIEW OF THE EFFECTIVENESS OF THE SYSTEM OF INTERNAL AUDIT AND FINANCIAL RISK ASSESSMENT It was resolved that the review of the effectiveness of the system of internal audit and financial risk assessment in accordance with The Governance and Accountability in Local Councils in England & Wales A Practitioners Guide was satisfactory. 13/78 A REVIEW OF THE RISK ASSESSMENT REGISTER It was resolved that the Risk Assessment Register had been reviewed and updated in April 2013 and that it was satisfactory. 13/79 APPOINTMENT OF INTERNAL AUDITOR It was resolved to appoint Brian Wheeler of C&S Accounting as the competent and independent Internal Auditor for 2013/2014. 5 13/80 NATIONAL SAVINGS INVESTMENT ACCOUNT (Designated New Hall Reserve). It was resolved that the new signatories on this account would be Cllrs. Harvey, Potten and Pluckrose. The signing mandate is any two out of three signatories. New forms were completed. 13/81 NOTICES, MEETINGS AND TRAINING COURSES TO ATTEND Rural Housing Task Group Meeting. 17 April pm-4pm at RCCE Feering. No nomination. The Localism Agenda-Planning. 1 May 2013 at Foakes Hall. Gt Dunmow 9.30am- 4.15pm. Fee 67. No nomination. LCLC. The scheduled meeting for June will now be held on Wednesday 15 May 2013 at 10.00am at three Rivers golf and Country Club. This will also be the AGM. Cllrs Pluckrose and Bryant to attend. EALC Village Halls workshop 22 May 2013 at Foakes Hall, Gt Dunmow 10.00am- 3.30pm. Fee 67. No nomination. EALC Short Course is now booked for Thursday 20 June /82 REPORTS FROM MEETINGS ATTENDED. MDC Parish planning workshop 11 April Cllr Pluckrose reported from this meeting giving an update on the Maldon Local Plan, Economic Development, Heritage Crime, Presumption in favour of sustainable development and Neighbourhood Planning. 13/83 EALC EXECUTIVE MEMBER The EALC advise that following the sad death of Cllr Kevin Ascott, the Dengie Hundred Group of Parish Councils require a new EALC Executive Member. Professor Lew Schnurr, who is a Councillor at Heybridge Parish Council, had offered to take on the role. He had also offered to sit on the Standards Committee as Kevin s replacement. Cllr Bryan Ledger, Asheldham and Dengie Parish Council, had also nominated himself for these roles. It was resolved by a majority decision to support Professor Lew Schnurr as the Dengie Hundred Group of Parish Councils EALC Executive member and to also sit on the Standards Committee. 13/84 THE GENERAL POWER OF COMPETENCE The Clerk had passed Section 7, General Power of Competence of the CILCA Sheila Welham, Clerk is once again a qualified Clerk. Tillingham Parish Council now meets the criteria to adopt the General Power of Competence however it was resolved that this would only be adopted if the need arose. 13/85 THE CHILDRENS PLAY AREA General maintenance is required: Collection of twigs/leaves. The Clerk will contact Community Services or Bradwell Power Station community help group. Removal of bird droppings from the equipment: Cllr Bryant to monitor and wash as necessary. There are signs of wear and tear on the monkey bar chain. The Clerk will obtain new parts. The annual Rospa inspection is due in May The Clerk is investigating neighbours back garden gate access. 13/86 THE WEST FIELD Minutes Apr

6 It was resolved to pay for litter picking for a six month period April to September. Cllr Harvey informed members that Ken Lambert had advised that he would have to give up the West Field grass cutting due to ill health. It was resolved that MSJ Garwood & Son be requested to operate the tractor and mowers until a replacement for Ken was confirmed. General maintenance is required: Wash/clean the youth shelter. Rake/sweep leaves, twigs, debris from boundary of West Field. Clerk to contact Community Services or Bradwell Power Station community help group. It was noted there are piles of dead leaves within the school boundary fence that blow onto Parish Council land. It was resolved to write to the school to request that they organise a leaf collection working party. The annual Rospa Inspection is due in May It was resolved to increase the Park Rangers hours in line with the budget. The Tillingham Flower Show Committee had confirmed they will also require the use of the West Field on Friday 26 th July The EALC had sent a letter of congratulations in respect of the certificates awarded to Tillingham Parish Council at the Essex Playing Fields Best Kept Playing Field Competition The Clerk had submitted a grant application form to Magnox socio-economic funding for the Multi Use Games Area. 13/87 THE WEST FIELD CAR PARK & TOILET BLOCK The Clerk had requested the toilet caretaker to spring clean the inside of the toilet block. 13/88 BIRCH GARDEN GREEN Cllr Mee advised there was little evidence of driving on the grass. Cllr Harvey reported that he had received a telephone call from Mr Gilder, who expressed his thanks for the grass cutters doing a good job on the green. The sign had been damaged beyond repair. The Clerk would investigate a new sign. 13/89 HIGHWAYS Update from ECC highways: Yellow Lines in Tillingham: An apology had been received from ECC Highways for the lack of response. North and South Street are both Priority Route 2 in their functional route hierarchy. Parking problems that cause congestion on Priority Routes will allow the proposed parking restrictions to be considered by the Maldon District Local Highways Panel. The next meeting is 14 June Progress is to be monitored. Maldon District Local Highways Panel Meeting minutes of 22 March 2013 state that: Works on the footway slurry seal at St Nicholas Road, Tillingham had been delayed due to the adverse weather conditions. South Street and Bradwell Road, Tillingham, markings regarding 30mph boundary had been agreed at a cost of To report matters to ECC Highways. Potholes at Wantz Corner and the bus stop in South Street. ECC Highway Rangers: Maldon District Local Highways Panel Meeting minutes of 8 February 2013 state that Parish Councils take up of this facility has been low. It was resolved to request the Highway Rangers to clean all direction and name signs and to trim back overgrowth around signs. 13/90 PUBLIC RIGHTS OF WAY (PROW) None. Minutes Apr

7 13/91 CORRESPONDENCE RECEIVED A letter from John Kingston, Department for Communities and Local Government in reply to our letter to Eric Pickles MP. from Mr Knight with comments concerning the Parish Council meeting of 19 March A letter from the Fox & Hounds Public House congratulating the Parish Council and the grass cutters MSJ Garwood and Son on the excellent grass cutting on the Square. 13/92 EAST OF ENGLAND CO-OPERATIVE COMMUNITY ACCESS DEFIBRILLATORS No further updates had been received. 13/93 CASUAL VACANCY BY ELECTION MDC Electoral Officer has issued the Statement of Persons Nominated. Only two candidates were nominated: Ray Keane and Kevin Knight. The By Election will take place on 2 May 2013 alongside the Essex County Council Election. The By Election costs will be met from the Parish Precept (part of the Council Tax residents pay to MDC). Some of the costs may be able to be combined with the ECC election. 13/94 ANNUAL PARISH MEETING 2013 The Annual Parish meeting was held on 20 March There were 35 people in attendance and guest speakers from 17 clubs, associations and organisations. Many people had commented that it was an excellent meeting. Members also agreed it was an excellent meeting. Members commented that the Annual Parish Meeting must be kept fresh. It was suggested that for next year the emergency services e.g. fire station and first responders are invited to give a demonstration. 13/95 INDEXING OF INFORMATION Cllr Pluckrose suggested that the Clerk should establish a formal indexing system. The Clerk advised printed material becomes out of date quickly and that research on websites allows up to date information to be obtained. 13/96 DATE OF NEXT MEETING The next monthly meeting, the Annual Parish Council Meeting, will be held on 21 May Agenda items must be notified to the Clerk by Monday 13 May Cllr Potten gave her apologies for the meeting on 21 May Agenda Item: The Pump on the Square. 13/97 ANY OTHER BUSINESS Cllr Pluckrose advised that the information contact list would be included in the Parish Paper.
