1 IN THE KEYS CONCESSIONARY TRAVEL SCHEMES BILL 2015 Explanatory Memorandum 1. This Bill is promoted by the Department of Infrastruture. 2. The objetive of the Bill is to onfer a statutory power on the Department of Infrastruture to make onessionary travel shemes for passengers travelling by publi road or rail transport. 3. Clause 1 states the short title of the Bill. 4. Clause 2 inserts a new setion 23A in the Isle of Man Passenger Transport At 1982 so as to enable the Department to make onessionary travel shemes. 5. Clause 3 provides for the expiry of the resultant At (whih will not affet the amendments made by it). 6. The Bill is not expeted to have any signifiant effet on publi revenue, expenditure or personnel. 7. In the opinion of the member moving the Bill its provisions are ompatible with the Convention rights within the meaning of the Human Rights At 2001.

5 Conessionary Travel Shemes Bill 2015 Setion 1 e CONCESSIONARY TRAVEL SCHEMES BILL A BILL to enable the Department of Infrastruture to make onessionary travel shemes. BE IT ENACTED by the Queen s Most Exellent Majesty, by and with the advie and onsent of the Counil and Keys in Tynwald assembled, and by the authority of the same, as follows: Short title The short title of this At is the Conessionary Travel Shemes At Isle of Man Passenger Transport At 1982 amended In Part V of the Isle of Man Passenger Transport At 1982 (misellaneous and supplementary), before setion 24 insert 23A Conessionary travel shemes (1) The Department may make onessionary travel shemes. (2) A onessionary travel sheme is a sheme for the provision of travel onessions to eligible persons travelling on eligible servies. (3) A onessionary travel sheme must inlude provision (a) determining, or for the determination of, the rate or rates of travel onessions; and (b) speifying, or for the speifiation of, the days and times during whih travel onessions are provided. (4) Without limiting subsetions (1) to (3), a onessionary travel sheme may (a) permit a person to publish forms and other material in respet of a matter speified in the sheme; (b) make provision for the eletroni submission of information and douments in respet of a matter speified in the sheme; Page 5

6 Setion 3 Conessionary Travel Shemes Bill () permit a person to exerise a disretion in dealing with a matter speified in the sheme; (d) presribe fees whih may be levied under the sheme; and (e) make provision for suh other matters onneted with the sheme as the Department onsiders appropriate. (5) A onessionary travel sheme may provide for the modifiation or revoation of any onessionary travel sheme relating to the arriage of passengers by road or rail established in the Island and in operation when this setion omes into operation. (6) Before making a onessionary travel sheme under this setion, the Department must onsult the Treasury. (7) In this setion eligible person means a person of suh desription as is speified in the onessionary travel sheme; eligible servie means a servie relating to the arriage of passengers by road or rail of suh desription as is speified in the onessionary travel sheme; and travel onession, in relation to a journey, means (a) the redution of the fare for the journey below the amount appliable to an adult who is not entitled to any redution; or (b) the waiver of suh fare Expiry (1) This At eases to have effet on the day following its promulgation. (2) Subsetion (1) does not affet the ontinuing validity of the amendments made by setion 2. Page 6
