5 GENESEE COUNTY TREASURER S OFFICE AUCTION OF PROPERTY FRIDAY, OCTOBER 28, 2011 RULES AND REGULATIONS Note: To bid on a property at this auction, the buyer must be present at the auction. There will be no online or absentee bidding for this auction. 1. Registration On site registration will begin at 11:00 a.m. and all sales will begin at 12:00 noon. No bids will be accepted unless the bidder has registered and received a pre-numbered bid card. A valid driver s license or other photo ID will be required in order to receive a bidder number. You will be responsible for all purchases made under your registration. 2. Properties Offered The attached list of County Treasurer owned properties being offered, identified by sale unit numbers, have been approved for sale at public auction by the County Treasurer. The County Treasurer reserves the right to pull parcels from the sale prior to the auction and anytime up to execution and delivery of the deed. According to state statutes, ALL PRIOR liens (other than IRS liens), encumbrances and taxes are cancelled by Circuit Court Order. The County Treasurer does not guarantee the usability or access to any of these lands. PLEASE KNOW WHAT YOU ARE BUYING, THERE ARE NO REFUNDS OR CANCELLATIONS OF SALES. It is the responsibility of the prospective purchaser to do their own research as to the use of the land for their intended purpose and to make a personal inspection of the property on the ground to determine if it will be suitable for the purposes for which it is being purchased. The County Treasurer makes neither representations nor claims as to fitness for purpose, ingress/egress, conditions, covenants, or restrictions. Occupied structures may not be entered without the tenant s permission; secured vacant structures may not be entered. All offered properties may be subject to flooding. Any new construction or reconstruction should be elevated above the 100-year flood plan. Also, any filling, dredging, or other permanent construction below the ordinary high-water mark of the water body involved may be subject to the provisions of the 1972 Public Act 346. Any earth change on the property may be subject to the provisions of the 1972 Public Act 347. These properties may also be subject to the Goemaere-Anderson Wetland Protection Act, 1979, Public Act Starting Bid Price The starting bid for the November auction will be.00 per parcel. 4. Bidding Any registered person may bid on the properties offered. Any person unable to attend the sale can be represented at the sale by an agent or other representative with authority to bid and otherwise represent the person. The registered bidder is legally and financially responsible for all parcels bid upon whether representing one s self or acting as an agent. Each sale unit will be offered separately and in the order appearing on the list. Each sale will be awarded to the individual bidding the highest amount. An oral bid accepted at public auction is a legal and binding contract to purchase. No sealed bids will be accepted and the County Treasurer reserves the right to reject any or all bids. 5. Terms of Sale The full purchase price must be paid the day of the sale and within 1 hour of the closing of the sale. The purchase price consists of the final bid price plus 13% of bid price as buyer premium, and $20.00

6 processing fee. There will be a 3% discount for payment by cash, check, money order, bank cashiers check or travelers check. The first 0 of combined purchases will be required to be paid by either cash, certified funds or bank cashiers checks. Money orders, personal checks and travelers checks are NOT acceptable as payment for the first 0. The balance of the purchase price may be paid by any negotiable instrument including personal or business check, money orders and travelers checks. The County Treasurer may prosecute any purchaser who bounces a check or fails to consummate a purchase. If your check or other payment is not honored by your bank the 0 deposit will be forfeited. Any bidder who fails to consummate a purchase will be banned from bidding at all future land auctions. No purchases can be made on a time-payment plan. Checks should be made payable to Title Check LLC Customer Escrow Account. A signed statement will be required at the time of payment certifying the purchaser agrees that 1.) Any delinquent taxes on any property in Genesee County must be paid prior to title being transferred to any property purchased at auction, and 2.) All current year taxes must be paid on the parcel being purchased prior to title being transferred and 3.) The purchaser has never been foreclosed upon in Genesee County for non payment of taxes. The County Treasurer reserves the right to cancel ANY sale, at ANY time, including up to execution and delivery of the deed. 6. Purchase Receipts Successful bidders at the sale will be issued a receipt for their purchases upon payment. Purchasers will be entitled to deeds for the property descriptions identified by the assigned sale unit numbers noted on the receipts. 7. Title Being Conveyed Quit-claim deeds will be issued conveying only such title as received by the County Treasurer through tax foreclosure. Title insurance companies may or may not issue title insurance on properties purchased at this sale. The County Treasurer makes no representation as to the availability of title insurance and the unavailability of title insurance is not grounds for reconveyance to the County Treasurer. The purchaser may incur legal costs for Quiet Title Action to satisfy the requirements of title insurance companies in order to obtain title insurance. 8. Special Assessments All bidders should contact city or township offices to determine if there are any outstanding bonded assessments for future tax years on the properties being offered. This also includes but is not limited to assessments for demolition, weed cutting, water, sewer, and debris removal. 9. Possession of Property We recommend that no purchaser take physical possession of any property bid upon at this sale until a deed has been executed and delivered to the purchaser. No activities should be conducted on the site other than a baseline environmental assessment to contaminated properties. However, steps should be taken to protect your equity in this property by securing vacant structures against entry and obtaining (homeowners) insurance for occupied property. Buyers will be responsible for all procedures and legal requirements for conducting evictions. Additionally, buyers are responsible for contacting local units of government to prevent possible demolition of structures situated on parcels. 10. Conditions The purchaser accepts the premises in its present as is condition, and releases the County Treasurer and employees and agents from all liability whatsoever arising from any condition of the premises, whether now known or subsequently discovered, including but not limited to all claims based on environmental contamination of the premises.

7 A person who acquires property that is contaminated (a facility pursuant to Section 20201(1)(1) of Natural Resources and Environmental Act (NREPA), 1994 P.A. 451, as amended) as a result of release(s) of a hazardous substance(s) may become liable for all costs of cleaning up the property and any other properties impacted by the release(s). Liability may be imposed upon the person acquiring the property even in the absence of any person responsibility for, or knowledge of, the release. Protection from such liability may be obtained by conducting a Baseline Environmental Assessment (BEA) as provided for under Section 20216(1) (c) of NREPA. However, the BEA must be conducted prior to or within 45 days of the earliest date of purchase or occupancy of the property. Persons who acquire contaminated property may have due care obligations under Section 20107a or NREPA even if they conduct a BEA and are not liable for the contamination. Pursuant to part 201 of NREPA, the person(s) responsible for any activity causing a release at the property is obligated to pursue response activities at the property. Consequently, the non-liable purchaser may be required to provide access to the liable party to conduct response activities at the property in the future. Section of the NREPA requires that a person who has knowledge that their property is contaminated provide a written notice to the purchaser or other person to whom the property is transferred which discloses the general nature and extent of the release. Additional disclosure obligations may also apply at the time the property, or an interest in the property, is transferred. Accordingly, the County Treasurer recommends that a person who is interested in acquiring surplus County property contact an attorney or an environmental consultant for advice prior to the acquisition of any surplus County property that may be contaminated. 11. Deeds Deeds will be executed within 30 days. It will be the responsibility of the County Treasurer to record the deeds and remit them to the purchaser after completion of recording by the Register of Deeds. (It is currently taking approximately five months to receive recorded documents back from the Register of Deeds Office.) 12. Bundle This sale includes one or more parcels which are considered nuisance, contaminated, potentially contaminated, unkept, obsolete and/or blighted properties. In the public interest, the Foreclosing Government Unit ( FGU ) has determined that these nuisances require abatement as a condition of sale. In order to bid on this auction lot, any prospective purchaser MUST submit a detailed written plan to the office of the FGU (County Treasurer) no later than close of business five business days prior to the date of auction. In this written plan, the offeror must identify the deficiencies it recognizes in EACH parcel offered. Specify what abatement plan it has for EACH property specifically, the timetable of this abatement, and the identity, contact information and qualifications of the person(s) who will perform the work. This auction lot will ONLY be available to auction bidders that have submitted such a written plan to the FGU prior to the time and date noted, and whose plan is ACCEPTED by the FGU, in its sole discretion, as being in the interest of the public in abatement of nuisance(s). the offeror should strongly consider offering posting of a performance bond, personal guarantee or other surety to assure completion of the proposed work in its written plan. If there are no satisfactory proposals, then no bids will be accepted and the property will be deemed as offered but unsold. All decisions of the FGU are final. There will be no negotiation of terms or plans. Please make your plan as parcel-specific and detailed as possible. Incomplete or insufficient proposals shall be rejected without detailed comment. For most properties in this bundle, there exists a demolition order upon the property. Prior to closing the sale of these properties, the buyer must agree to the following: a.) to the extent demolition has been completed, reimbursement to the County must be made for the cost of the demolition, or, b.) to the extent that the demolition is not complete, there must be proof satisfactory to the Treasurer of the buyers ability to satisfy the Treasurer s demolition obligations. 13. Property Taxes All property taxes, special assessments and liens that became due and payable after March 31, 2011 will be the responsibility of the purchaser. 14. Personal Property

8 Personal property (items not attached to buildings and lands such as furnishings, automobiles etc) located on tax foreclosed land or within structures situated on foreclosed land was not taxed as part of the real estate, does not belong to the Treasurer and is not sold to the purchaser of the real estate in this transaction. You are advised to contact former owners of the lands and provide them an opportunity to reclaim contents. A certified mail notice to their last known address is strongly advised. Mobile Homes may be titled separately and considered personal property. 15. Mineral Rights You will receive any and all title that the Treasurer obtains via their tax foreclosure through a quitclaim deed. If the owner of the surface rights to the property also owned the mineral rights, those will become part of your title interest. However this will be subject to the rights of any outstanding leaseholders of oil, gas, mineral or storage rights. You would be obligated to honor the balance of any remaining lease (automatic renewals if so written) but the royalty payments would be payable to you. However if the mineral rights have been severed (split from the surface rights) and are owned by a third party, they have not been foreclosed by the Treasurer and are not included in the mineral rights conveyed to you. In either instance, the leaseholder still has the right to explore for and/or extract minerals under the terms of and outstanding agreement.
