Midweek use doesn t necessitate a minimum stay except during Red Season 1 and 2, which requires a seven-night minimum stay if booked more than 90 days in advance. Reservations may be split between two or more resorts, and in that case an additional housekeeping fee applies. 1 THE LIFESPAN OF A WINDOWS TO WYNDHAM MEMBERSHIP Deposit paid today AUD$199 (NZD$249) (Eg: 30th Sept 2012) There is a two-night minimum stay on weekends. The Windows to Wyndham Membership program is designed for those who wish to sample some Vacation Ownership experiences with WorldMark South Pacific Club by Wyndham, for the purpose of discovering the value of Vacation Ownership lifestyle. The Windows to Wyndham Membership ( Membership ) is offered to guests who completed a 90 minute Vacation Ownership Presentation, but at that time did not take up an offer to become a WorldMark South Pacific Club Owner. The Windows to Wyndham Membership program is offered by Wyndham Vacation Resorts Asia Pacific as the Developer of WorldMark South Pacific Club by Wyndham. The Windows to Wyndham Membership Program is separate from WorldMark South Pacific Club and does not intend to provide Members with full WorldMark South Pacific Club Ownership, usage, access and rights. Red is for the highdemand period, White is for the mid-demand period, Blue is for the low-demand period). SECTION B RESERVATIONS 1. Reservations Using Windows to Wyndham Credits. Members may reserve occupancy at a selection of WorldMark South Pacific Club by Wyndham Resorts, designated as available for use by Members of the Windows to Wyndham Program, as listed in this program guide, and as may be advised from time to time. Please refer to for any updated locations. Reservations may only be made by a Member using Windows to Wyndham Credits. 2. Making Reservations. Reservations can be made once the Member has received a letter from Wyndham Vacation Resorts Asia Pacific accepting their application for Windows to Wyndham Membership (usually 12 calendar days from the date of submitting a Windows to Wyndham Membership Application). Reservations can be made for up to 12 months in advance of the resort arrival, as long as the reservation(s) are made within the lifespan of the membership being 12 months from Activation Date. Please refer to page 52 of this guide The life span of a Windows to Wyndham program. Members are encouraged to make reservations well in advance as availability usually declines as the booking window decreases. 3. Reservation Booking Order. Requests for reservations will be honoured on a first-tobook, first-served basis and shall be assigned a reservation number. No reservations shall be honoured other than confirmed in writing to a Member and reservations are only final upon receiving such written confirmation. 4. Reservations Booking Method. Reservations may be made via windows.reservations@wyn.com or via telephone: in Australia and from New Zealand during regular business hours, which are currently Monday to Friday 7.00am to 8.00pm and Saturday and Sunday 8.30am to 4.30pm Australian Eastern Standard Time (AEST). Please note business hours are subject to change, for further information please visit: 5. Reservations system. Apartments are assigned by a best-fit computer system to ensure that Resort stay opportunities for all WorldMark South Pacific Club Owners and Windows to Wyndham Members are maximised. They shall not be assigned at the time of check-in. All Apartments are ranked in order of preference with special features, such as views given the highest priority. The Best Fit system will assign the highest priority apartment available for the length of stay, giving preference to reservations made furthest out. Special requests may be accepted at the time of making the reservation with medical documentation, however it cannot be guaranteed although all attempts will be made to honour the request. 6. Qualification for Using an Apartment. Members must occupy their reserved Apartment and are responsible for any taxes (if any) related to their usage of Apartments, such as sales tax or transient occupancy or Hotel Turnover Tax. 7. Use of Rental Credits for Reservations. Members may be able to purchase additional Credits from Wyndham Vacation Resorts Asia Pacific to complete a reservation where they have insufficient Windows to Wyndham Credits available to make their desired reservation. Rental credits must be paid by the Member prior to a reservation being completed and cannot be used to reserve Apartments unless used in conjunction with Windows to Wyndham Credits. 8. Use of Windows to Wyndham Membership. The Windows to Wyndham Membership program is designed solely for the Members to sample Vacation Ownership experiences, in view of making a choice to take up a full WorldMark South Pacific Club by Wyndham Ownership. Therefore, the Windows to Wyndham Membership is non transferable or assignable, and any resort stays using Windows to Wyndham Credits can only be completed by the Member. Family and friends can accompany the Member during the Resort stay, subject to the occupancy capability of the Apartment the reservation is made for. A request for exemptions to this provision need to be addressed in writing to the Director Sales Operations Windows to Wyndham, at the below stated address. 9. Minimum Length of Stay Requirements.(a) There is a seven (7) night minimum stay during Red Season for any reservation booked more than ninety (90) days in advance, unless that stay falls within regulations 4.9(b) and 4.9(c). This 7 night minimum stay is for consecutive nights and may be split between two (2) or more Resorts. Housekeeping fees will be applicable. (b) There is no minimum stay for any reservation booked during Red Season 3, 4, 5, 6, 7, 8 and 9, unless the reservation includes either a Friday or Saturday, where there must be a two (2) night minimum stay. (c) At Wyndham Vacation Resorts Asia Pacific Sydney there is a three (3) night minimum stay during Red Season for any reservation booked more than ninety (90) days in advance, except for those dates described as Blackout Dates, where there is a seven (7) night minimum stay. All three (3) night stays must be for consecutive nights. Seven (7) night stays must also be for consecutive nights but may be split between Wyndham Vacation Resorts Sydney and another Resort. Housekeeping fees will be applicable. (d) There is a two (2) night minimum stay when either a Friday or a Saturday are included in the reservation, subject to two nights being available. (e) There is a four (4) night maximum stay for each Bonus Time reservation and a seven (7) days maximum stay for each Bonus Time reservation in an Exotic Resort. (f) For any reservation made ninety (90) days or less there is no minimum stay requirement unless the reservation includes either a Friday or Saturday, where there must be a two (2) night minimum stay. 10. Number of Reservations. A Member may have and use as many reservations as may be possible with the number of Windows to Wyndham Credits the Member has available; provided that a Member may have only one Weekend Only reservation at a time for each block of 6,000 Windows to Wyndham Credits. Members may only reserve one Weekend Only reservation at a time for each block of 6,000 Windows to Wyndham Credits owned, eg 6,000-12,000 Windows to Wyndham Credits = one Weekend Only reservation, 12,000 and above = two Weekend Only reservations. 11. Housekeeping Fee. A Housekeeping fee is required for the housekeeping service which occurs at the end of each stay, or mid-stay if a continuous stay in one Apartment exceeds seven (7) nights. A seven night minimum stay that has been split between Resorts will result in additional housekeeping fees at subsequent Resorts. Windows to Wyndham Members will be allowed one free housekeeping service for the duration of the Windows to Wyndham Membership program. The free housekeeping service will occur at the end of the first continuous stay at one Resort. 12. Additional Housekeeping Fees. Additional stays shall be subject to a housekeeping fee per stay. All fees must be paid at time of reservation. During any stay, a Member may obtain additional housekeeping services, by contacting the front desk at the Resort. Please note that housekeeping fees are subject to change, please refer to pds/ or contact us on (Aus) or (NZ) for the current housekeeping fee rate. Housekeeping Fees. 55 13. Applicable Taxes. Members are responsible for any taxes related to their usage of Resorts and/ or Apartments, such as occupancy tax and or Hotel Turnover taxes wherever applicable. Any applicable taxes will be advised at point of reservation, and where applicable, some taxes will be payable at point of reservation and some at the point of check-out. 14. Confirmation. All reservations must be confirmed by Wyndham Vacation Resorts Asia Pacific in writing, fax or by , with a reservation number assigned before the reservation is valid. This reservation confirmation must be presented at the time of check-in at the Resort. The confirmation will state the number of Windows to Wyndham Credits charged for the reservation, and the Member s Windows to Wyndham Credit balance for the remaining term of their Windows to Wyndham Membership Program. If a reservation confirmation is not promptly received, the Member should call Reservations. The Member is responsible for verifying correctness of the reservation upon receipt of the confirmation and immediately notifying Reservations of any errors. Wyndham Vacation Resorts Asia Pacific Pty Ltd does not guarantee any reservation other than that confirmed on the printed confirmation. 15. Cancellation Guidelines. Windows to Wyndham Members, are subject to the following cancellation rules: (a) A Member may cancel a reservation by notice to Reservations in such manner as notified by Wyndham Vacation Resorts Asia Pacific from time to time. (b) A Member shall not be charged a cancellation fee as set out below if they give notice to Reservations within the following periods: For Reservations made: No later than: 61 days to 12 months in advance 30 days before use 15 days to 60 days in advance 10 days before use 48 hours to 14 days in advance 48 hours before use 0 hours to 48 hours in advance No cancellation (c) If a Member cancels a reservation outside the allowable periods stated above then, the applicable number of Windows to Wyndham Credits for the reservation will be forfeited by the Member. Should further bookings be taken to ensure the resort is fully booked for the Apartment type, size and dates the Member cancelled then the forfeiture will be reversed, unless cancelled after the lifespan of the Membership. (d) Windows to Wyndham Credits which have been forfeited in accordance with Section 15(b) and 15(c) above may be reinstated at the discretion of Wyndham Vacation Resorts Asia Pacific where it can be determined that the cancellation was due to the death or a serious medical condition of a Member, their immediate family member or a guest that was scheduled to accompany the Member on the reserved travel. Members must provide documentary evidence to substantiate such reinstatement and if reinstated, Windows to Wyndham Credits will be assigned the original date of expiry, unless cancelled after the lifespan of the membership. (e) There shall be a forty-eight (48) hour waiting period between a cancellation and a new reservation if a Member cancels a one week reservation in the Red Season and requests that same reservation for less than one week within the ninety (90) days or less of occupancy. 16. Delinquency. No reservation requests shall be confirmed if a Member is delinquent in the payment of any amount owed on the purchase of their Windows to Wyndham Membership. 17. Reservations. May be made at selected Resorts as listed in this guide, and as may be amended at the absolute discretion of Wyndham Vacation Resorts Asia Pacific from time to time. SECTION C USING WINDOWS TO WYNDHAM PROGRAM RESORT PROPERTIES 1. Registration. Check-in shall be 4:00 pm or later and shall require a confirmation and ID, and check out shall be 12:00 noon or earlier. Checkin/check-out times may vary from Resort to Resort. Confirmation letters give notification of these times for the particular Resort where the Member has made a reservation. 2. Occupancy Limits. The number of persons, including children of any age, which may occupy an Apartment, in most cases is as follows: Studio/Hotel One-bedroom Two-bedroom Three-bedroom 2 persons 4 persons 6 persons 8 persons Apartments may vary in occupancy limits between Resorts and Members shall be advised of the relevant occupancy limits at the time of making a reservation. These occupancy limits will be strictly enforced. Members checking into a Resort with more persons in their party than the applicable occupancy limit may be given the opportunity to reserve a larger Apartment, if available, subject to the use of additional Windows to Wyndham Credits for payment/ Rental Credit fee, or to reduce the number of persons in their party, or if necessary to vacate the Resort. All persons under the age of 18 years shall only occupy an Apartment under parental supervision. 3. Care of Apartments. Members are responsible for any damage or loss of any items or furnishings that might occur during the occupancy by a Member or a Member s guest(s). 4. Charges. Charges for any missing items, damage during occupancy, excessive cleaning requirement or charges for any unpaid services will be billed to the Member. Non-payment of such charges will be cause for suspension of reservation and occupancy privileges until paid in full. 5. Day Use Prohibited: No Apartment shall be held for any reason other than accommodation purposes and only those persons who are occupying Apartments may use Resort facilities, except that Members may have daytime guests within the occupancy limit allowed for the Apartment. 6. The Disposal of Rubbish and General Cleanliness. All persons whilst at the Resort shall have regard for and keep clean, neat and tidy their Apartment and all other parts of the Resort, not leave any garbage, rubbish, waste, disposable napkins, bottles and cans otherwise than in the receptacles provided. Should this not be adhered to, in addition to the housekeeping fee as mentioned above in these guidelines, Members may be charged a minimum of AUD$25.00 for the disposal of rubbish and cleanliness of the Apartment; where it is the opinion of the Resort Manager that the Apartment has been vacated and left with an unacceptable amount of rubbish and/or in an unacceptable condition. 7. Inventory. In each Apartment there is an inventory list of major items. Members should report any missing items, or damage noticed in the assigned Apartment to the Resort Manager, as soon as possible after check-in. During the four hours maintenance period after each occupancy, an inspection of the Apartment, its furnishings and equipment will be conducted. 8. Modifications. No structural changes, reorganisation or removal of furniture, wall hangings, floor coverings, or redecorating of any type within the Apartments or other areas of the property is permitted. 9. Specific Resort Rules. WorldMark South Pacific Club by Wyndham may establish and post specific rules related to the orderly management of each Resort. Members and Member s guest(s) must abide by these specific Resort rules. The Resort Manager may, at reasonable times and upon reasonable notice enter any Apartment for the purpose of maintenance/ inspection. 10. Conduct. Members and Member s guest(s) shall respect all other Resort users and guests as well as the property through reasonable behaviours in respect to noise, usage of Resort facilities, and other matters relating to an orderly use of the Resort. 11. Animals. No animals or pets, including reptiles and birds, may be brought onto any of the Resort properties, including in any type of vehicle, except for those used in the assistance of visually impaired persons. 12. Children. Parents are responsible for the conduct of their children. Children will be expected to play and behave in a manner that does not create any undue disturbance to the vacation enjoyment of other Resort users or cause damage to property. 13. Personal Property. Neither Wyndham Vacation Resorts South Pacific Limited, WorldMark South Pacific Club by Wyndham nor Wyndham Vacation Resorts Asia Pacific Pty Ltd is responsible for any belongings left by Members or Member s guest(s). Members or Members guest(s) are responsible for removing all personal property from the Apartment prior to checkout. Except in areas that may be designated for such purpose by the Resort Manager (for example, storage lockers), neither Members nor Member s guest(s) may keep personal property on the Resort other than in the Apartment during occupancy. 14. Security. Apartments should be locked when unattended and any suspicious or unusual activity should be reported immediately to the Resort Manager. 15. Signs. No signs, advertisement, notice or other lettering shall be exhibited displayed, inscribed, painted or affixed to or on any part of the Resort property. 16. Failure to Vacate. If the Member or Member s guest(s) fail to vacate an Apartment by checkout time on the last day of the reserved period of occupancy, the Member will be subject to the repayment of all costs incurred in any inconvenience caused to any person by the Members actions, and other consequences including possible suspension of the Windows to Wyndham program. SECTION D ADMINISTRATION 1. Lifespan of Program. The Windows to Wyndham Membership program is valid for 12 months from Activation Date. Reservations, using Windows to Wyndham Credits can be made 12 months in advance, however, the reservation needs to be made prior to the expiration of the Membership. Any Windows to Wyndham Credits which have not been used to make a reservation 12 months after the Activation Date will expire and Members will no longer be able to use these Windows to Wyndham Credits under any circumstances. 2. Entry. The Resort Manager has a master key to all rooms. In case of emergency, the Resort Manager or the Resort Manager s staff may enter an Apartment and shall notify the Member, as soon as reasonably possible, of the reason for such entry. 3. Amendments. This Guide and the WorldMark South Pacific Club Guidelines and Regulations may be amended from time to time. This can include without limitation, the amendment of any fees or hours of operation. For current information please visit 4. Enforcement. The Resort Manager will have full authority to implement these Guidelines and any local specific Resort rules and regulations. Reservation employees/agents shall have full authority to apply these Guidelines in the booking of reservations. 5. Liability. Members and their Guest(s) shall occupy the Resort and Apartments at their own risk. They shall release and indemnify the Resort Manager, Wyndham Vacation Resorts Asia Pacific, WorldMark South Pacific Club and all related entities, officers and employees from and against any and all action or demands due to any damage, loss, costs, injury or death caused by or as a result of the Members or Guests act, use, occupation of the Resort, Apartments, except to the extent that it was caused by the willful or negligent act of the Resort Manager, Wyndham Vacation Resorts Asia Pacific, WorldMark South Pacific Club. 6. Violations. Failure of a Member to abide by these program guidelines or other terms and conditions as stated in the Windows to Wyndham Membership application may result in temporary or permanent suspension of Members rights and privileges under this Windows to Wyndham program. Should the Member status be temporarily suspended, the Member will be unable to make reservations or otherwise deal with their Windows to Wyndham Credits or Membership until such failure to comply has been rectified. Should the Member status be permanently suspended the Member may no longer be entitled to any benefit of the Windows to Wyndham Membership program and may no longer be able receive any WorldMark South Pacific Club Purchase Incentives.
