1 Desert Gardens RV Park Rules and Regulations, Revised 11/03/2015 Summary of changes I would like to introduce the Rules & Regs committee members for this year. I want to especially thank Mike Olson and Lidy Hauch for their help with the committee for the last two years who have moved on to other community efforts. Procedural change for complaint form procedures. All complaints for R&R will come to Bob Amma or Tony Buzzard. Architectural issues will be come to Bob Amma or Dennis Pavek. Current: Site Occupancy: Space is rented on the basis of two adults per site. Commercial use of the site is not permitted. Soliciting is not permitted in the park. Site Occupancy: Space is rented on the basis of two adults per site. Sites can not be rented out from May 1rst thru Sept 30th with out Board approval. Commercial use of the site is not permitted. deleted: Soliciting is not permitted in the park. This does not belong in site occupancy.. it is identified in the Bi-Laws. With the increase of park models, we see a change coming down the road. A lot of people are now using the small RV's to travel from their home base to their winter homes. They also use them as their primary transportation at each end. Our bi-laws prohibit 2 RV's on a lot. Vehicle Use: Speed limit for all motorized vehicles within the park is 10mph. One RV or park model and 2 vehicles, are permitted per site in D and 3 vehicles per site in E and F, Vehicles that are parked inside a shed or cargo trailer are not counted. Vehicles are defined as motor vehicles, golf carts, motorcycles, and small trailers are allowed and defined as those not exceeding 12 feet in length (not including hitch) and not exceeding 9 feet in height. Van type RV's under 25' long, and 10' high, not connected to utilities will be treated as a motor vehicle and allowed on sites.no box type trucks permitted on site. Park in designated spaces only. Parking is not allowed on streets, empty lots or common areas. Motorized vehicles are permitted to drive only on designated gravel roadways. Golf cart are permitted to drive on all gravel pathways.
2 Pets: No animals other than two household pets are permitted. Pets must be registered in the park office. Pit Bulls, Rottweiler, Doberman, or any other aggressive pet are not permitted. Pets must be leashed and accompanied at all times when not on their site. Pets will not be left unattended outside their RV; owners must be on site. Pet enclosures are allowed on a site. They must be a temporary metal wire enclosure, commercially purchased, no higher than 3', no larger than 8' X 8' or 64 sq ft. Said enclosures must be close to the RV and meet established property line setback requirements. Pets, with the exception of service animals, are not permitted in or around park facilities. There is a zero tolerance for nuisance barkers and pet waste left on individual sites or anywhere within the park. Owners must have a means of picking up pet waste with them when walking their animals. In the event that a pet owner fails to comply with this policy Management reserves the right to evict the pet(s) and owner or institute a fine after appropriate notice.
3 Desert Gardens RV Park Rules and Regulations, Revised 11/03/2015 Vehicle Restrictions: Units permitted in the park include Class A,B and C motor homes, and tow vehicles up to class 6 trucks, 5 th wheel trailers, travel trailers and approved park models. RV s must be a minimum of 25 ft. in length and a maximum of 15 years old at the time of site occupancy. All other RV's require board approval. Class 7&8 tractor type tow vehicles will be allowed in the park but will not be allowed on the site and must be placed in the storage lot when not in use. Site Occupancy: Space is rented on the basis of two adults per site. Sites can not be rented out from May 1rst thru Sept 30th without Board approval. Guests: Guests are welcomed to enjoy the park but must be registered in the office. There are limited facilities for children; however, 2-week visits are permitted with adult supervision. There is a nominal charge for overnight guests; however this charge does not apply to owners unless the visitation period extends beyond 2-weeks. RV Parking: RVs must be positioned on the site gravel surface so that the rear of the vehicle is at least 5 ft. from the lot line in D and 8 ft. in E and F, and the side, not including slides, is at least 5 ft. from the lot line. All wheels and jacks must be on gravel. At no time will the tires or jacks be allowed to cross or rest on the sewer lines. An extension to the sewer line may be required. Hook-Ups: Park sewer connections are 3-inch receptacles; outfit your sewer hose with the corresponding threaded, screw-on connection to ensure it will be air tight. Please DO NOT use chemicals or additives of any kind in your waste water tanks and lines. Vehicle Use: Speed limit for all motorized vehicles within the park is 10mph. Golf cart vehicles are permitted to drive on all gravel pathways. Campfires and BBQ s: Fires are permitted on sites in fully enclosed, off the ground fire pits and BBQ s, and must be supervised. Fully doused coals or ashes should be bagged and placed in the dumpster, not scattered in the desert. Facilities: All park facilities are open to residents and their registered guests. Hours for use are posted. Non-scheduled use requires prior management approval. Owners, visitors and guests use the park facilities at their own risk. Management and Coop-Owners are not responsible for any damages, injury or loss to persons, pets or property occurring at the park. Interference with Electronic Systems: Transmission of electromagnetic radiation within the park is prohibited if it interferes with residents enjoyment of their electronic systems. In recognition of the fact that Amateur Radio provides needed public service communications during disaster situations, the use of amateur radio within the park is allowed provided that its use causes no interference with residents television, radio, satellite or WiFi systems.

Pool and Spa: Pool hours may vary by season and are posted at the entrance. The use of the pool and spa is at your own risk. No lifeguard is on duty. Please use the adjacent restrooms and showers before entering the pool. Children under age 12 must be supervised by an adult. No glass, food or pets are allowed in the pool area. Privacy: Please respect the privacy of residents. DO NOT trespass on or directly behind occupied sites. Quiet Hours: Quiet hours are observed from 10p.m. to 8a.m. Excessive noise is not tolerated at any time. Removal of Desert Plants: It is unlawful to remove plants, wood, or other materials from the Sonoran Desert. RV or Vehicle Service or Repair: No vehicle service or repair is to be done in the park except by preauthorized mobile services. Site Use: Management is responsible for the maintenance of rental sites and reserves the right to enter the site for that purpose. Seasonal visitors are expected to keep sites in good condition and remove all belongings prior to departure. Rakes and hula hoes are available for shared use. All improvements to owner owned sites including installation of patios, sheds and shade structures and changes in landscaping must be pre-approved by the Architectural Committee. Tarps, signs (other than name and site number), under RV or visible storage, concrete block stabilizers, RV skirting and evaporator coolers are not permitted on sites. Commercial sun and outer rooms approved by the Architectural Committee, and well-maintained 5 th wheel front canvas enclosures free of clutter are permitted on sites. Smoking: All park buildings and common areas are smoke free..trash: Place bagged trash in the dumpsters located across the street from the office. No trash should be left outside RVs in trash cans or bags. Contact the office for assistance in removing substantial yard debris. Walking Trails: Several walking and biking trails are maintained at the perimeter of the park and may be accessed from a number of locations. Motorized vehicles with the exception of maintenance vehicles and mobility chairs and scooters are not permitted. Bicycles are welcome but walkers have the right of way. Non-aggressive, leashed pets are welcome. Do not walk on or directly behind occupied sites.
5 Washing of RV s and Vehicles: Owners and seasonal visitors in the park for 1 month or longer, are permitted to wash their RV s and other vehicles once a month on their site. Only biodegradable products are allowed. Washing must be done with bucket and hose with a shutoff nozzle or power washer to conserve water. Weed Control: Chemicals used for weed control will not be used near saguaro cactus. Wildlife: Hummingbird feeders are encouraged. Please DO NOT feed desert wildlife. Rules and Regulations Enforcement: Management reserves the right to evict or refuse entry to any person who has evidenced a disregard for the Park Rules and Regulations. Coop Owners are subject to the published document, Park Rules and Regulations Enforcement, approved by the RV Park Cooperative Advisory Board. Notice of Violation (NOV) - Desert Gardens RV Park Cooperative Member Site Date Authority The Board of Directors (Board) of the Desert Gardens RV Cooperative is charged with the duties of enforcing the Articles of Incorporation, the Bylaws of the Corporation, the terms outlined in the Proprietary Lease, and the Rules and Regulations of the Co-op including the Architectural Guidelines. The Board partially delegates these enforcement duties to the Park Manager, the Rules and Regulations Committee, and the Architectural Committee as the Board deems appropriate.
6 Notification You are hereby notified of the following violation. Should the violation cease no further action will be taken. Nature of Violation - If the violation is not corrected, a fine(s) will be levied as indicated in the Schedule of Fines and Procedure sections below. SCHEDULE OF FINES TYPE OF VIOLATION AMOUNT AND IMPOSITION Damage to Common Facilities Pet Issues Excessive Noise Issues Motor Vehicle Issues Safety / Health Issues (smoking, campfires, pool/spa rules, trash, etc.) Improper Use of Site or Facilities Improper Use of Site or Facilities Permit, Construction, Architectural Issues Inadequate Site Maintenance Actual Costs + Labor, Per Incident $20 per Day $50 per Day $20 per Day Date of Delivery The date of the delivery of this NOV will be recorded and, if it is against any absentee member or his/her lessee(s) or invite(s), the NOV will be sent to the absentee member at the address of record by certified mail, return receipt requested. Violations and fines are bases on either per incident or per day, as stated in the schedule above. Procedure for Per Incident Fines In the case of per incident fines, a member will be notified as above within (3) business days. If there is a re-occurrence of the same violation within 30 days, the fine associated with the first offense as well as each additional offense will be levied. The Park Manager or appropriate Committee shall give the member notice of the imposition of such a fine(s) and file a copy thereof with the Board. Procedure for Per Day Fines In the case of per day fines, a member will be notified as above. The member will be given ten (10) days to correct the violation. Continuation of the violation will result in the imposition of a daily fine, beginning with the eleventh (11 th ) day. The Park Manager of appropriate Committee shall give the member notice of the imposition of such a fine and file a copy thereof with the Board. All Fines Any member who disagrees with the imposition of any fine may file a written request with the Board for a hearing before the Cooperative Advisory Committee and the Board. Such a written request must be received by the Board within ten (10) days of the date that the NOV was received by the member. The determination of the Board at such a hearing shall be final and binding upon the member. A fine of either type shall be considered and treated as an Enforcement Assessment under the provisions of Article IX of the Bylaws. Issued by Date of Hand Delivery Delivery Date of Certified Mail
