6 Amendment Annex II Amendment "The label, the optional label with text box and the registration number shall be printed either in two colours (Pantone 347 green for the leaves and stem of the flower, the Є symbol, the web address and the EU acronym and Pantone 279 for all other elements, text and borders), or in black on white, or in white on black." Shall be replaced by: "The European Commission will provide further instructions on the design and use of the EU Ecolabel Logo after consulting the EUEB in a separate guidance document." 6
7 Cleaning Services MAIN CHANGES TO TAKE INTO ACCOUNT THE LAST COMMENTS Optional Criterion on consumable goods (it was number O5 - Consumable goods and electric hand driers supplied to the client) has been removed and the point system adjusted o Difficulties in verification o No influence of cleaning companies on client's choices o Proposed to be kept for EU GPP criteria (verifiable on a contract basis)
8 Cleaning Services MAIN CHANGES TO TAKE INTO ACCOUNT THE LAST COMMENTS Criteria text clarification (some example) o o o o Cleaning of small glass surfaces is included Activities for which the cleaning products are provided by the client are excluded Sub-contractors may not perform more than 15% of the work Criterion M1(b): criteria for cleaning products not Ecolabelled (Hazardous substances not allowed from criteria on hard Surface Cleaning detergents) For a few optional criteria extra thresholds have been added in order to offer more flexibility to applicants

10 Photovoltaic Panels Photovoltaic Panels ECODESIGN Working Plan has been adopted in the Winter energy package on 30 th November 2016http://ec.europa.eu/energy/en/news/commissionproposes-new-rules-consumer-centred-clean-energytransition PV panels are part of the ECODESIGN Working Plan A preparatory study will soon be launched that will investigate at the technical feasibility of different policy measures such as eco-design requirements, energy labelling, EU Ecolabel or GPP 10

12 Article 11 project "Article 11.1 study" Project Period: Article 11 (1) Where EU Ecolabel criteria for a given product group have been published, other nationally or regionally officially recognised EN ISO type I ecolabelling schemes which do not cover that product group at the time of publication may be extended to that product group only where the criteria developed under those schemes are at least as strict as the EU Ecolabel criteria. 12

15 Alignment of the EU Ecolabel Regulation to the Lisbon Treaty EUEB Meeting 23 June 2016, Brussels Kathryn Tierney DG ENVIRONMENT / EUROPEAN COMMISSION
16 TFEU ("Lisbon Treaty") DELEGATED ACTS (Article 290, TFEU) A legislative act may delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act. The legislative act specifies the objective, content, scope and duration of the delegated acts on a case-by-case basis. EP/Council may decide to object to an individual delegated act or to revoke the delegated powers in the legislative act. NOTE: No Committee role. Definition of delegated act is almost identical to the regulatory procedure with scrutiny.
17 TFEU ("Lisbon Treaty") HOW TO IMPLEMENT ARTICLE 290? In 2013, an attempt to align "old" RPS to delegated acts through three Commission OMNIBUS proposals failed during co-decision negotiations. The Commission withdrew the proposals. The INTER-INSTITUTIONAL AGREEMENT ON BETTER LAW-MAKING (IIA-BL) was signed by COM/Council/EP, entered in force on 13 April 2016 and contains a Common Understanding on Delegated acts. Systematic consultation of MS experts (through Commission expert groups) based on draft texts Standing invitation to EP/Council to attend expert group meetings on preparation of DA Alignment of existing legislation which refers to regulatory procedure with scrutiny (RPS) Commission Proposals by the end of 2016, then adoption by EP/Council via ordinary legislative procedure ("codecision"). A joint register for delegated acts to be set up by COM/Council/EP by the end of 2017.
18 Alignment of RPS/("PRAC") to Delegated acts UPDATE MARCH Following the INTER-INSTITUTIONAL AGREEMENT ON BETTER LAW-MAKING (IIA-BL), April 2016 the Commission adopted an Omnibus Proposal on (COM(2016)799) to align 168 acts, which refer to the regulatory procedure with scrutiny, to delegated acts (Article 290, TFEU). 23 ENV acts concerned, amongst them the Ecolabel Regulation. (RPS is mentioned in Art. 6 (5) and (7), Art. 8 (2), Art. 15 of EU Ecolabel Regulation, see proposed changes in COM(2016) 799 Annex I) The Commission Proposal must now be adopted by EP/Council via ordinary legislative procedure ("codecision"). Council has set up a Friends of the Presidency group (of legal advisers) and the first of a series of meetings will take place on 20 March. ENV acts scheduled for discussion on 2 May, with MS comments to be requested in advance by MT PRES. EP discussions begin on 23 March in the Legal Affairs Committee (JURI) (Rapporteur: J Szajer (EPP/HU)). Until the Proposal is adopted as a Regulation of the EP and Council, the regulatory procedure with scrutiny will continue to apply.

24 Article 11 - Ecolabelling schemes in the Member States 1. Where EU Ecolabel criteria for a given product group have been published, other nationally or regionally officially recognised EN ISO type I ecolabelling schemes which do not cover that product group at the time of publication may be extended to that product group only where the criteria developed under those schemes are at least as strict as the EU Ecolabel criteria. 2. In order to harmonise the criteria of European ecolabelling schemes (EN ISO type I), EU Ecolabel criteria shall also take into account existing criteria developed in officially recognised ecolabelling schemes in the Member States. 24
