5 AGENDA PLACEMENT MEMO TO: FROM: Denton County Commissioners Court Claire Yancey, Assistant District Attorney DATE: November 14, 2017 SUBJECT: Public Hearing to discuss and take formal action on the proposed abandonment of Prairie Mound Cemetery Road from Old Justin Road southerly approximately 2,200 linear feet, located in Denton County Commissioner Precinct #4, and any appropriate action. ****************************************************************************** BACKGROUND: Commissioner Eads has requested that the Denton County Commissioners Court take formal action on the abandonment of Prairie Mound Cemetery Road from Old Justin Road southerly approximately 2,200 linear feet, located in Denton County Commissioner Precinct #4. A Public Notice is required to close, abandon, vacate, or alter a public road. A unanimous vote of the Denton County Commissioners Court is required to close, abandon, vacate, or alter a public road. Texas Transportation Code provides that residents in a commissioner precinct may apply for a new road or a change in an existing road by presenting to the Commissioners Court a petition signed by one (1) property owner in the precinct, if the application is for a change in a road other than discontinuing the road. The Commissioners Court may not grant an order on an application unless the applicants give notice of their intent to apply for closure by posting, at the courthouse door and at two other places in the vicinity of the affected route, a written notice of their intent for at least 20 days before the date the application is made. Title to a public road or a portion of a public road that is abandoned to the center line of the road vests on the date the order is signed by the county judge in the owner of the property that abuts the portion of the road being abandoned. Tex. Transp. Code Ann (Vernon 2014). On October 24, 2017, the Denton County Commissioners Court scheduled a Public Hearing on November 14, 2017, at 9:00 a.m. to discuss and take formal action on the abandonment of Prairie Mound Cemetery Road. The Aide-to-the-Court posted a Notice of Public Hearing in the Denton Record Chronicle on October 29, OPERATIONS AND MAINTENANCE: None. LEGAL INFORMATION: Denton County has statutory authority to consider and take action to close, abandon, vacate, or alter a public road under Texas Transportation Code and FINANCIAL IMPACT: Unknown. 5 of 18

PRECEDING COURT ACTION: On December 18, 2012, Commissioners Court approved the abandonment of a portion of Prairie Mound Cemetery Road from FM 407 to the north property line of the cemetery, Court Order No On February 21, 2017, Commissioners Court approved the abandonment of another portion of Prairie Mound Cemetery Road from the north property line of Prairie Mound Cemetery Road northerly approximately 1,500 linear feet, Court Order No On October 24, 2017, Commissioners Court scheduled a Public Hearing to abandon a portion of Prairie Mound Cemetery Road from Old Justin Road southerly approximately 2,200 linear feet, Court Order No of 18
