1 BISHOPS CLYST PARISH COUNCIL Minutes of Bishops Clyst Parish Council Meeting Held on Monday 9 September 2013 at 7.30 pm Clyst St Mary Primary School Hall PRESENT Cllrs D Axford (took the Chair) P Cain C Trudgeon C Fairburn S Perry M Fernbank A Cotterill S Eyre County Cllr Peter Bowden, District Cllr Mike Howe, the Clerk and 4 members of the public were present. 1 APOLOGIES - Apologies were received from Cllrs R Norman, M Gibbs, R Hatton and M Norman. 2 MINUTES - Cllr Cotterill proposed, Cllr Cain seconded and all agreed that the Minutes of the July meeting be confirmed and signed as a correct record. The Chairman signed the July Council Minutes. 3 RISK ASSESSMENT/DECLARATIONS OF INTEREST AND DISPENSATIONS - Risks were noted. No written requests for dispensations had been received. 4 MATTERS ARISING FROM THE LAST MEETING: 4.1 The Chairman welcomed Cllr Simon Eyre to the Council who signed his declaration of acceptance of office. 4.2 Friends Life (FL) the Landlord has aborted all plans for a permitted path over Friends Life land due to possible development. The Stable Club at FL is likely to close which could have an impact on the sports facility including existing tennis courts. The Cricket Club land is also likely to become available on the open market. 4.3 Car Parks : Frog Lane C/Pk quotes for the line marking had previously been circulated. Cllr Cain proposed to accept the lowest quote ( 350 plus VAT) from Line Marking Services of Newton Abbot, to include one disabled parking bay and to complete the work within one day (possibly during half term in October). Seconded by Cllr Fairburn. All agreed. The Clerk has been in dialogue with St Bridget Nurseries who will provide the Council with a quote for the removal of the two middle (Mountain Ash) trees, making good the soil and replanting also to weed and prune around bases of existing two trees. The Clerk reported that weed spraying around edges of car park had been completed on Upper C/Pk P Landscape had visited this car park twice to undertake the bank strimming but on both occasions cars were parked too close to the bank to enable the strimming to be completed. Clerk to ask P Landscape for some cones and date so that those areas could be cordoned off to enable completion of works. Weed spraying around edges of c/pk completed The Council could report that there had not been any misuse of the car parks recently however one bay had been filled with rubbish as a result of a vehicle breaking down. A telephone number had been left at the scene. PCSO Donna Baker has been contact with the owner who promises to remove the rubbish by The Council agreed that the signage at both car parks is adequate and did not need adapting. 4.4 Any Other Matters Arising:- Environment Agency Cllr Axford reported that Cllr M Norman had been advised by two EA Engineers that the likelihood of the flood prevention wall being raised to enable a 1:100 year protection was unlikely without them obtaining approximately 70% of the funding from local businesses. Small repairs had however been carried out. Bridge House - Cllr Howe reported that the owner will possibly be submitting a planning application for 5 houses along the front. 5 REPORT FROM COUNTY COUNCILLOR - PETER BOWDEN Following advice from the Campaign for the Protection of Rural England it has been discovered that the amount of wetland habitat lost through predicted increases in sea levels is not as much as had been anticipated which has resulted in the western bank modifications only being carried out in one area where that landowner had consented. All other landowners unanimously agreed not to have works carried out that would result in the flooding of their land. Proposals to create habitat on the east bank of the River Clyst had previously been withdrawn by the Environment Agency and therefore no works will be carried out.
2 DCC had resolved a complaint from a resident in Winslade Park regarding a tree that needed lopping. A tree surgeon had carried out the work New Cat & Fiddle signs had been erected on the A3052. DCC advise that this should result in motorists decreasing their speeds, with the perception of entering a residential area. Cllr Bowden continues to put pressure on Council about a speed reduction. The new junction just off of M5 J29 saw an accident involving several cars. Fortunately, there were no fatalities. Cllr Bowden had received a report that school children are crossing the dual carriageway and not using the pedestrian crossing. Cllr Bowden has been in touch with the school who are treating the matter seriously. DCC have been asked to make 35m cut backs this financial year. Cllr Bowden advised that one area that will see a reduction in spending will be the provision of youth services/clubs and libraries. He spoke about the safeguarding of children in schools and how DCC aims to improve this area of their work. The recent data collected during 1 hour south/north bound through Frog Lane recorded average speeds of 18mph and 17mph respectively. Cllr Bowden advised that the Council carry out their own survey and that registration numbers of speeding vehicles are logged and reported to the police. County Cllr Peter Bowden left the meeting. 6 REPORT FROM DISTRICT COUNCILLOR - MIKE HOWE Cllr Howe reiterated that 100% of the affordable homes at Cranbrook are made available to local people or for people who have a local connection. St Martins Primary School has also endorsed this fact. A letter from EDDC had been circulated to Councillors giving the reasons behind the need for another Open Space survey to be undertaken. In principle, Councillors were happy with it but could benefit from slight rewording. Cllr Howe agreed to do this. Permission for the development on Land to the East of the Village Hall has been granted. The S106 education element is being questioned before a decision notice can be finalised. Bridge House - as mentioned earlier (item 4.4), a new application is likely to be submitted. The owner is claiming un-viability (must be proven) which could exclude him from paying any S106 contribution. A new family has recently moved into the village. Unfortunately only one of their two children has been able to get a place in the local primary school. The Parish Council offered their support in allocating of places at the local school to local children. Advanced Childcare (a facility for vulnerable children) has moved into a property at Longmeadow. The dredging of rivers could become a reality. Previously opposed to dredging, the Environment Agency are now considering the advantages following badly silted up rivers that have established as a result of years of non-dredging practices. EDDC s office relocation from Knowle. Other sites are being looked at in locations other than Honiton. The parent company of Friends Life has approached EDDC with a view of developing the site. EDDC have advised that the main house must be reinstated to a stand alone building due to its historical significance. Another option for the site is that it remains as an employment site. The DEFRA site remains on the open market but the remainder is not currently on the open market. District Cllr Mike Howe left the meeting. 7 REPORT FROM PCSO DONNA BAKER A copy of her report is in the Minutes Book. 8 OPEN SESSION No matters were raised. Open session closed. 9 S106 FUNDING Dealt with under item 6 above. Members once again stated the importance of a correctly worded letter which will be forwarded to the October meeting. Clerk to make contact with EDDC regarding possible training dates and a committee to be formed at the October meeting. Cllr Cain reported that the Football Club had been reimbursed for the perimeter barrier and that a reception was to be held on 24 September at the football field (6.30 pm) open to all, to show people how the S106 funding had been spent.
3 10 PLANNING - Cllr Perry Applications for Consideration: Plan No & Type Location Proposed Development 13/1782/ADV Bishops Court Gardens Retention of various non-illuminated signs CSM on fences at entrance off Bishops Court Lane. The Planning Committee supported this application. 13/1925/TCA Old Rectory, Sowton T1 Robinia: Remove declining branch making 1 x 300mm pruning cut. Prune back to vertically growing side branch which grows into Hazel. T2 Beech: Reduce eastern aspect of lower canopy by 2m up to a height of 10m making pruning cuts of up to 50mm diameter. Crown raise to give 4.5m clearance above the ground, making 1 x 100mm pruning cuts and multiple cuts to 1st, 2nd & 3rd order branches up to 50mm in diameter. Cllr Fernbank proposed this application be supported. Seconded by Cllr Cotterill. All agreed. Decisions from EDDC: Plan No & Type Location & Decision Proposed Development 13/0946/FUL Myrtle Cottage, CSM Grant Conversion and extension of outbuilding to create separate dwelling and construction of new boundary wall. 13/0948/LBC Myrtle Cottage, CSM Grant Conversion and extension of outbuilding to create separate dwelling and construction of new boundary wall. 13/1072/CPE The Millhouse, Oil Mill Lane, CSM Grant Certificate of existing lawful use/development. Any other matters for information/discussion: To discuss any relevant planning matters, if required. Neighbourhood Planning the Parish Plan Committee are meeting with the Community Council of Devon on and will report back at the October meeting. Action: PP Comm IKEA re: planning proposals IKEA are keen to meet with Councillors possibly before the November (11 th ) meeting. The Clerk is awaiting a response regarding opening the meeting up to the public. Action: Clerk Advertising Boards : Aaron Fox; Crealy; Greendale Farm Shop; Ladram Bay Holiday Pk; Darts Fm. During the summer months a number of advertising boards have appeared in the Parish without the required planning permission. Aaron Fox sign is still insitu on DCC s land; Enforcement at EDDC are dealing with the Greendale and Darts Fm signs that remain insitu. Crealy and Ladram Bay have both been co-operative in removing their signs in accordance with legislation. Development Management Committee Land to East of Village Hall (dealt with under item 6 above). 11 ACCOUNTS AND FINANCES - Cllr Cain/Clerk. Cllr Axford proposed the monthly transactions be authorised, seconded by Cllr Trudgeon. All agreed. A copy is in the Minutes Book. CSM Noticeboard revamp next to Post Office Repair costs have been submitted however it was reported that there is a PO fund that includes provision of new noticeboards and Cllr Howe will be looking into this for the Council (deadline ). The Clerk continues to obtain quotes for the replacing the existing boards in metal. Action: Cllr Howe/Clerk. Plaque next to birch tree, upper car park - now completed but wooden base has split due to the heat. Mr Pedrick has kindly offered to replace this with a solid block of wood. The brass plaque is not weathering well and the Clerk to make contact with Stalite signs regarding weatherproofing options. 12 HIGHWAY MATTERS - to receive updates on matters previously raised Ditch at bottom of Winslade Park Avenue - grip request not done during the lengthsman s visit. Clerk to find out when next visit is to take place Church Lane - marker post replacement not carried out after lengthsman visit. Clerk to find out when next visit is to take place.
4 12.3 Strimming of bank in Frog Lane by Lengthsman completed but is becoming overgrown again Bishops Court Lane - Road surface under trees and surface water DCC assessing. This matter to be carried forward to October meeting for Cllr Bowden to update Footpath A3052 Winslade Park sweeping was completed but falling leaves are building up Overhanging vegetation around bus shelters completed Lorries entering Sowton Village A missing sign has now been replaced however lorries continue to drive into the village. Cllr Fernbank forwarded an example sign to the Clerk alerting drivers to not follow their SATNAVS. Clerk to find out if DCC would consider funding such a sign and if not, whether the Parish Council could pay for it with DCC s permission Overhanging hedges Winslade Park Cllr Perry reported that he would like to re-word the existing Council s polite notice to include legislation references. Action: Cllr Perry 12.9 Damage to roadside bank at Sowton DCC is dealing with this issue Any other highway matters: Dual-carriageway road closures in both directions (CSM to M5/M5 to CSM). Cllr Fairburn had received a complaint from a resident stating that there had been no forewarning about this road closure on 2 and 4 September. Clerk to investigate. Action: Clerk Overgrown vegetation along the footpath from the bottom of Winslade Park to the CSM roundabout making the pathway very narrow to negotiate. Lane markings at M5 Junction 30 and approach roads - Clerk to chase DCC for an update. The grass along the verges next to the Old Rectory Wall at Sowton needs removing. Action: Clerk There is a hole that requires filling and made good, in the passing place outside Venns Farm, Sowton. To consider the possibility of traffic lights at Clyst St Mary roundabout. For October meeting. 13 POLICIES/DOCUMENTS DUE FOR REVIEW/AGREEMENT Emergency Committee to report on response from Tony Hogg (PCC) re: terms of reference, gypsy and traveller protocol including survey for unauthorized encampments and procedure steps (letter received from Antonia Weeks, Inspector for Exmouth and Ottery St Mary, circulated ). Councillors were surprised to not receive any acknowledgement from Mr Hogg and the Clerk was asked to write to Mr Hogg asking for an explanation. 14 CORRESPONDENCE A synopsis of correspondence received and not covered elsewhere on the Agenda was received. A copy is in the Minute Book. Request from Clyst Honiton resident for re-opening of bus stop which just falls within the Sowton Parish boundary. This is supported by Broadclyst Parish Council (which cover this area of Clyst Honiton). The matter is being managed by DCC in conjunction with Stagecoach. If it goes ahead, there will be a cost involved and DCC is looking into this. The Council felt that any cost should be met from Broadclyst s Precept as this service will benefit their residents. EDDC - Surface water flooding sandbags. Cllr Axford agreed to speak with Cllr Howe regarding the numbers that could be stored at the shop before placing an order with EDDC. Action: Cllr Axford/Clerk EDDC Submission of E Devon Local Plan ( ) for Examination. Examiner requested that the changes be submitted for consultation (see next bullet point). EDDC Consultation on Proposed Post-Publication Changes to Local Plan (circulated ) Copy of complaint to DCC re: tree on Clyst Valley Road - dealt with under item 5 above. 15 REPORTS 15.1 Village Halls - Clyst St Mary - have been successful with funding bids to enable the new hall stage to go ahead. Sowton - The annual BBQ and Treasure Hunt was well supported Airport - next meeting Allotments - Julia Upton has relinquished plot 7, and this has been taken by a resident at Clyst St George at nil rent until 31 March As Farringdon Parish Council do not own any allotments and we are accepting residents from that area, we could form a partnership to gain access to the Parishes Together Fund. Farringdon PC will be discussing this at their September meeting. The brambles along the back hedge are getting out of hand. Agreed to wait until after blackberry season had finished before cutting back Play Area/Field The SITA Funding had been unsuccessful due to the enormity of applications received. However the Fast Track application process with SITA has been applied for instead and the Clerk should know the outcome of this bid by 21 October Report from School Governor - Cllr Hatton not present and no report received Any Other Reports. DCS debrief meeting Cllr Axford (report circulated ). Car parking in CSM
5 possible charging. For discussion at October meeting. Crealy Neighbour Liaison Meeting Cllr R Norman had previously circulated his report. Devon Remembers following on from the March 2013 meeting (item 15.6), Cllrs Cain and Fernbank, (together with Cllr Gibbs), are finding out what they can about the men of these two parishes who died in WW1. Cllr Cain has looked into the Devon Regiment historic records and proposes to look at other Regimental records in time. The Sowton Church memorial will be refurbished using available funding. Action: Cllrs Cain/Fernbank/Gibbs 16 ANY OTHER BUSINESS RAISED BY AGREEMENT. The Council agreed that a letter should be sent to the family of Rebecca Scott who tragically died following cycling accident, offering the Council s sincere condolences. Cllr Perry asked that we discuss provision for older children in the village at the October meeting. Cllr Trudgeon asked that we discuss a more regular bus service at the October meeting. 17 DATE OF NEXT MEETING - Mon 14 October pm at SOWTON VILLAGE HALL The Chairman thanked those present for their attendance and declared the meeting closed at 9.37 pm.
