2 664. Verbal update from Irish Rail on the City Centre Resignalling Project Presentation on Planning Application No. 3467/16. Planning Application No.: 3467/16 Application Type: Permission Location: RDS Lands (approx hectares), Ballsbridge Dublin 4. Proposal: PROTECTED STRUCTURE: The specific area of the proposed development comprises c hectares and relates to the replacement and redevelopment of the Anglesea stand and associated Anglesea Terrace with a new 3 level 6,481 person capacity grand stand with a connected 2 level (storey) hospitality / service building (Pocket Building) and is bounded generally by Judging Ring Nos. 1 and 2 to the north, the RDS main arena to the south, Simmonscourt Road to the east and the existing RDS offices and Anglesea Road to the west. There are a number of Protected Structures within the RDS complex. The development will consist of :- A) Revisions to the permitted refurbishment Anglesea stand under Dublin City Council Planning Reg. Ref. 2617/03 (An Bord Pleanála Ref. 29S & extended under Dublin City Council Planning Reg. Ref. 2617/03/x1) and revised under Planning Reg. Ref. 2876/15 relating to the Anglesea stand and associated structures to provide a new 3 level grandstand (6,481 person capacity) with a connected 2 level (storey) hospitality / services building (&;Pocket Building&;) with basement level - 01 (107 sq.m) including a club shop and substation (overall 8,604 sq. m [enclosed areas 2,805.3 sq. m, concourse areas 2,721.7 sq.m with views facing onto Judging Rings, external upper and lower tier of stand 3,077 sq.m) with concrete, painted steel, metal panels render and glass finishes to structures in place of previously permitted refurbished stand and comprises:- B) Demolition of: Existing Anglesea stand and Anglesea Terrace structure (approx. 7,716 sq. m); & Lean-to open fronted shed bounding Simmonscourt Road (Approx. 145 sq. m) and removal of modern terrace (Approx. 44sq.m) area surrounding the clock tower (a Protected Structure); C) Provision of a new grandstand (7,332.2 sq. m) over 3 levels M [26.8M OD] in height (with associated floodlighting and acoustic pa within roof of new stand) with a connected (via a glazed bridge link at level 01) & Pocket Building of (1,204.3 sq. m GFA) comprising a 2 level (storey) 9.91M [15.41M OD] in height (with plant 89 sq. m) at roof level [within a louvered cover - overall height 10.66M 16.12M OD]) to the east). The proposal will include the following flexible ancillary accommodation net sq.m areas (for new grandstand and &;Pocket Building&;) :- Security / control rooms (c. 13.3M); media, players and officials facilities (c sq.m [217.8 sq.m in Horseshow mode]); corridor / circulation areas (c sq.m 30.7sqm in Horseshow mode]); bar / servery areas (c sq.m [1,185.8 sq.m in Horseshow mode]); WC facilities [including disabled & staff facilities] (c sq.m); stores / cold rooms (c sq.m); Season ticket / VIP hospitality areas (c sq.m); Ancillary plant / electric areas (c sq.m); The internal arrangement of the pocket building (and ancillary areas) will be flexible to accommodate rugby and horseshow requirements / events; D) Single storey substation (c sq.m) 3.6M in height [9.92M OD] located to the east of existing south stand; and a single storey double height club shop (c sq.m) 6.7M in height [12.2M OD] located adjacent to existing RDS office building; E)

3 Terrace areas level 00 (396 sq.m) and level 01 (92 sq.m) with Pocket Building on southern facade as well as views from all levels towards parade rings from grandstand and Pocket Building; F) Provision of signage zones (overall sq.m) to north (16 sq.m) and south (115 sq.m) elevations of proposed Anglesea stand north (2 sq.m) and east (2.5 sq.m) elevations of proposed club shop; G) Revised landscaping to north of Anglesea stand and external areas; H) Revisions to permitted surface water / drainage / attenuations / storage arrangements including all associated site development and landscaping works; I) Access arrangements and parking provision as per the established layout and operation of the RDS complex. Planning Application No.: 3605/16 Application Type: Permission Location: Harold s Cross Road, Parnell Road and Greenmount Lane, Harold s Cross, Dublin 6W Proposal: Intends to apply for an 8 year permission for development at this site, measuring c.0.998ha at the site is occupied by Nos & Harold's Bridge Court & and Nos. 1-3 Clare Villas existing housing and by an existing warehouse building. It is bounded generally to the north by other housing and commercial development fronting Parnell Road, to the east by Harold's Cross Road, to the south by Greenmount House and Argus House office buildings and residential development accessed from Harold's Cross Road, Greenmount Avenue, Limekiln Lane and Greenmount Court, and to the west by Greenmount Lane. The proposed development (c.12,874 sq m total gfa above ground, excluding plant, bin stores, bike stores and basement car park) generally comprises: The demolition of 4 no. 3-storey duplex residential buildings (48 no. habitable dwellings, c.3,929.4 sq m gfa) and 2 no. 1-storey residential buildings (c.50.6 sq m and c.51.7 sq m) within Harold's Bridge Court, 3 no. 2-storey habitable dwellings at Clare Villas (c sq m gfa) and an existing warehouse (c. 1,233.1 sq m gfa) and ancillary structures fronting Greenmount Lane. The construction of 6 no. residential apartments buildings and 1 no. mixed use building, accommodating 121 no. apartment units and 1 no. crèche in total, including: Block 1 residential building adjoining Block 2 (4-storeys, c.1,700 sq m gfa), accommodating 16 no. 2-bed apartments, with associated balconies for each apartment on east and west building elevations from ground to 3rd floor levels; Block 2 residential building adjoining Block 1 (4-storeys, c.1,236 sq m gfa), accommodating 12 no. 2-bed apartments, with associated balconies for each apartment on east and west building elevations from ground to 3rd floor levels. 6 Motions 673. Motion from Councillor Dermot Lacey This Committee requests a response from the Manager on the issues submitted as part of this motion and set out below in relation to quads, jet ski and drones using Sandymount Strand. There are new notices that have appeared in the car parks along Sandymount Strand and at the start to the walk that leads to the Irishtown Nature Reserve. They point out that the area is a Special Area of Conservation under the EU Habitats Directive and that it is also a Special Protection Area (SPA) under the EU Birds Directive (1979). However the notices also say that "The beach is also used by horse riders, quad bikers, jet skis, kyte (sic) fliers and outdoor fitness classes." Given the area's special status, it is most inappropriate that quad bikers and jet skis should be permitted (if they actually are). In my opinion, no motorised vehicles (other than Dublin City Council) should be permitted on the strand; the notice should state as much. Given the fact that the area is an SPA, surely drones should also be banned? 674. Motion from Councillor Dermot Lacey This Committee requests the Manager to install a Basketball Court in the plans for Herbert Park or in Beech Hill Park Motion from Councillor Dermot Lacey To ask the Manager if she will consider the suggestions re cleaning of Camden Street as suggested in the note submitted with this motion. It was suggested that I bring this to your attention so that you could make representations on behalf of residents living in Camden Street area to DCC Waste Management Division. Due to the large numbers of people socialising in the Camden Street area, particularly late at night, it appears that some of the side streets have become urinals. The portable loo that was introduced into Camden Street was a disaster but if DCC Waste Management Division introduced a system of hosing down the sidewalks this might improve the situation Motion from Councillor Frank Kennedy This Area Committee resolves to write to the Minister for Housing, Planning, Community and Local Government to request that powers be conferred upon the Inspector of the Street Furniture Unit to remove items placed on the public footpath which are deemed to cause a hazard to and/or block the mobility of limited mobility residents, in particular those who rely on the assistance of a carer and/or walking frame/wheelchair/similar device, in light of the serious problem of items such as garden furniture being placed on very narrow public footpaths which impede the access of limited mobility neighbours and which on occasion result in it being necessary for such persons to venture onto the public road and be exposed to the serious risk of an accident Motion from Councillor Sonya Stapleton That this Committee supports O Callaghan s Hotel on Street Stephen s Green in their request for a parking permit to allow for one car at the front of their hotel.

Motion from Councillor Sonya Stapleton That this Committee calls on the Manager to organise a meeting with residents of O Carroll Villas to discuss and find solution to problems with parking that the residents are faced with Motion from Councillor Sonya Stapleton That this committee asks the Manager to implement a plan for the gardens at the back of O Carroll Villas flats. It is badly over grown with weeds / bushes and is an eyesore to residents Motion from Councillor Mary Freehill That funding is allocated to update the maintenance of Mount Argus Park, to provide for seating & review the use of railings. Furthermore to investigate the possibility of an opening from Sundrive Road to Lower Kimmage Road along the Poddle Valley to make way for a pedestrian way and also a cycleway. It is important that separate space be made available for pedestrians and cyclists, a design where both would have to compete for the same space would not work. That the Parks Dept. report back on progress at February 2017 meeting Motion from Councillor Mary Freehill At a meeting of the Lower Kimmage Road Residents and Harold s Cross Community Council on 23 rd August in the city council the issue of pedestrian crossing was discussed. It was discovered that there was confusion with an application for corner of Aideen Avenue. This request is about the crossing at Priory Road and Mount Argus and it doesn t seem to be on the list despite several requests. The issues are: Timing has been changed for pedestrians; it now takes much longer for the light to respond to pedestrian request. At various times of the day Kimmage Road is either a semi static car park or a race track. Residents are concerned to find ways to slow down traffic. The Traffic Speed Camera doesn t seem to have much impact on speed levels. At the meeting residents asked that the Traffic Dept. consider ways of slowing down speeds by use of digitised signs, or speed triggers i.e. the faster traffic moves the more likely the pedestrian crossing light will be activated. Requests have been made on numerous occasions about this space and to find that it wasn t even on the list is worrying therefore I propose that it be given priority for that reason. The second issue is that many Lower Kimmage Road residents, due to clearway have to park on Westfield Road. There is an issue about lack of parking on Lower Kimmage Road shortage of spaces, refusal for off street parking and now that Westfield Road is due to get disc parking. So these residents could be left with no place to park and we certainly don t want residents to be forced to park on a clearway. While I am aware that six months following implementation of disc parking that they will be in a position to apply for Westfield Road for that interim period this Committee agrees that they be assisted and ask the Traffic Dept. to please facilitate them Motion from Councillor Patrick Costello That this Committee agrees to install street lighting on Grosvenor Lane to facilitate the current houses there without lighting and the several houses that are planned for this lane.

Motion from Councillor Patrick Costello That the Manager agrees to install a cycle lane on South Richmond Street that was recently removed Motion from Councillor Mannix Flynn Given the level of tourists and visitors to Dublin city and with particular numbers of visitors growing within the city centre and Sundays being an ideal day for visitors to visit the many city attractions, that this committee calls on Dublin City Council executive to reopen City Hall on Sundays so as the many thousands of visitors who frequent this area through the day and particularly on Sundays can visit and experience the full exhibition of the history of the city. City Hall is now very much paying for itself with regards its private functions, weddings, corporate events etc it is unacceptable that this magnificent offering to tourists is closed on a Sunday. I am calling for Dublin City Council to permanently open this building to visitors, the Irish public and the citizens of Dublin Motion from Councillor Mannix Flynn Given the recent offer of a so-called gift of a Bloom Show Garden - Yi Garden (Friendship Garden) and the lack of any procedures and protocol around the receiving of such a gift, while also bearing in mind the issues surrounding the Norma Smurfit pavilion which is intended to be gifted to the city council, that this committee calls on Dublin City Council to initiate full protocols and procedures that are transparent, open and accountable and are subject to best practice governance in the first instance and that these gifts or offers of gifts or initiatives be brought before the proper committee i.e. the Protocol Committee, the Public Arts Committee, etc for consideration before any of these offers are accepted. Also with regards these matters that the public is made aware of these offers of gifts Motion from Councillor Mannix Flynn That this committee of South East Area requests Dublin City Council to initiate a full protocol and management system with regards to what flags are permitted to fly on Dublin City Council flagpoles. These flagpoles run the length and breadth of the River Liffey and also there are a number of them at Palace Street. In recent times, tattered, torn and faded flags advertising commercial events in the city have been flown for long periods of time on these poles. Upon inquiry, it was learned that there was no criteria established, no protocol or guideline in place with regards these banner advertising flags Motion from Councillor Mannix Flynn Considering the institutional abuse meted out to many children at St Joseph s Industrial School, Artane and the trauma that many continue to suffer, and, given the fact that the Artane Boys band was at the centre of promoting this institution, this committee calls on the Artane Band to consider renaming the band. For those of us who experienced years of violent inhumanity in these institutions at the hands of certain Christian Brothers with the knowing consent of the state and the congregations of Christian Brothers themselves, it adds insult to injury to be constantly reminded every time the Artane Band performs that this legacy is still promoted as if nothing has happened and nothing has changed. As a mark of respect to those thousands throughout the world and in acknowledgement of the great wrongs that were committed at Artane Industrial School we request that this band be renamed.

Motion from Councillor Mary Freehill That the Traffic Dept. presents a traffic solution report on the challenges currently for cyclists and tour buses in Charlemont Place and Harcourt Terrace, my of 14 July refers. There are a number of traffic management issues in this and while I am very much aware of the back log, I do think this issue warrants urgent attention. I would greatly appreciate if the issues addressed in this would be examined, as Ciaran points out this a temporary issue but will last for the next 2 years. If a temporary solution could be found that would be great. Any chance of the bollards being temporarily moved on Harcourt Terrace with an access only sign or whatever. I would greatly appreciate if you would let me know what action can and will be taken please. From: Sent: 14 July :00To: Cllr Mary Freehill Subject: Re: End of Term Report Thanks for keeping us updated with these developments. I wanted to bring something to your attention as you might be able to help. Like hundreds of others I commute to work by bicycle and the Grand Canal cycleway has been a fantastic and very well used and appreciated enhancement for cycle commuters in the city. A new office building is nearing completion on Charlemont Place, and the construction traffic has had an inevitable negative impact on the use of the cycle way. I'm not complaining about this; as an architect myself, I know you can't make an omelette without breaking eggs. However, the presence of the Hilton Hotel means frequent bus traffic on the narrow cul-de-sac, and there are frequent infringements on the kerb of the cycleway, between the hotel traffic and the construction traffic. Another large building project has just begun on the next stretch of Charlemont Place, between Harcourt Terrace and Leeson Street Bridge. Currently, the only vehicular access is along the same stretch of Charlemont Place and it looks like, if nothing else is done, this congestion of Charlemont Place will continue for the next 1-2 years. There is an easy alternative for traffic to access the new site, which is to temporarily remove the barrier at the canal end of Harcourt Terrace, so that the new site can be accessed via Harcourt Terrace. I know the roads engineers will want to prevent Harcourt Terrace becoming a rat run again, but I'm sure there is some such solution which would reduce the danger to cyclists from traffic congestion for the duration of the new construction project Motion from Councillor Mary Freehill That the Manager presents a report on the progress and current position on residential disc parking application made by residents of Brighton Avenue, Rathgar earlier this year Motion from Councillor Chris Andrews That this area committee opposes the proposed location of the Dublin Bikes / JCDecaux sign at the mall in donnybrook and propose that it would be placed further up the Stillorgan Road at the garage in Donnybrook or at the corner of Donnybrook Bus garage? 691. Motion from Councillor Chris Andrews That the Manager outlines what progress has been made to put in place the play area for Ross Road and when does she think work will commence?

Motion from Councillor Chris Andrews That the Manager puts in place a cleansing programme for the lanes in the new houses in Ringsend and outline the procedure residents need to take in order to put gates on the entrance to the lanes Motion from Councillor Chris Andrews That the Manager arranges for the person with responsibility for the delivery of Astro pitches to meet with councillors and the committee from Beechill United to go through the criteria that need to be met to have an Astro pitch in Beechill Park Motion from Councillor Dermot Lacey This committee requests the Manager to present a report to this committee on how existence of a Pub at number 5 Aston Quay can be deemed established use for number 4 Aston Quay and that no Planning Enforcement action was taken on foot of a legitimate complaint by residents Motion from Councillor Dermot Lacey That the Manager outlines what progress has been made to put in place the play area for Ross Road and when does she think work will commence Motion from Councillor Mary Freehill Considering the seriously dilapidated state of 201 Harold s Cross Road (17 th cent. building) and the numerous attempts by the Derelicts Sites Department to get the owners to make the building safe and secure. Despite this effort the building is a serious blight on the village of Harold s Cross and a continuous safety threat for residents of neighbouring buildings. Squatters have lit fires in the building and neighbours are concerned for their safety. This committee therefore resolves that Dublin City Council put a lien on the property which would compensate them for the cost of refurbishment of the building Motion from Councillor Claire Byrne That this area committee objects to the proposed sale of the Graving Docks in Grand Canal Dock, seeks to protect the Graving Docks as a local amenity, and asks the Area Manager to outline what options are available in order to protect them Motion from Councillor Claire Byrne That this area committee requests that the tree outside 52 Synge Street be replaced as a matter of urgency. The residents fought for years to have this tree planted, which was then damaged and subsequently died. I understand that the tree is due to be replaced in the 2017 tree planting programme however as this is only one tree it should be replaced sooner.

Reply: The criteria for the provision of a disabled parking bay outside a private residence has been forwarded to the resident concerned. Q.2 Councillor Dermot Lacey To ask the Manager if she will arrange for the trees that overhang the railings of Herbert Park as it faces up towards Pembroke and Street Broc s Cottages to be pruned as they make walking on the pavement very difficult and indeed dirty. Reply: This work will be undertaken as requested over the coming week. Q.3 Councillor Dermot Lacey To ask the Manager if the really bad potholes on Rampart Lane and Eglinton Terrace, Donnybrook can be repaired as a matter of urgency. Reply: Potholes on Rampart Lane and Eglinton Terrace have been given to a crew to fill. Q.4 Councillor Ruairí McGinley To ask the Manager to include roads in Terenure on list of bag collection areas Ashfield Park is not included, nor is one road in Terenure The reason why these roads were designated as bag or bag and green bin collection areas, terraced houses with limited storage for bins, has not changed. Please include Ashfield Park, and the other roads in Terenure, which currently have a bag collection, in the Street. Reply: Dublin City Council can only designate areas where bags may be collected on or after 1 st July 2016 in line with the criteria issued by the Department of the Environment, Heritage and Local Government, which are summarised below: 1. No space within the boundary of the property, front, rear or side to store 3 bins. 2. Physical features which make it difficult to move a bin to the front edge of the property or nearest boundary for presentation, e.g. steep gradient and or steps. 3. The area (e.g. street) is too narrow for an RCV to access properties and the nearest Designated Collection Point or suitable presentation point is greater than 100m from the property. Where a minimum of one of these criteria was met the area was designated as an area where bags may be collected on or after 1 st July Ashfield Park was deemed not to have met the criteria above, and hence was not designated as an area where bags may be collected on or after 1 st July 2016.

15 We are awaiting confirmation from the department to clarify what, if any, are the implications for the bag area designations following the recent discussions between the minister and the waste industry. Q.5 Councillor Anne Feeney To ask the Manager to erect more speed limit and 'Children at Play' signage on Neville Road as a significant amount of traffic is using this narrow road as a shortcut from Highfield Road to Rathmines Road. Reply: A standard speed limit of 50km/h exists in Dublin City except for certain areas where a 30km/h or a higher speed limit exists. Speed limit signs are provided only at the points of entry to a speed limit zone and at the points of change from one speed limit to another. Repeater signs are not provided along roads where there is no change in the speed limit as this would lead to a proliferation of signs throughout the city. A request for Children Crossing signage on Neville Road has been referred to the Traffic Advisory Group for examination and report. The councillor will be informed of the recommendation in due course. Q.6 Councillor Anne Feeney To ask the Manager to examine a potential safety problem with parked cars and camper vans around the perimeter of Palmerston Park. The park is used by families and small children and the entrance gates open straight out onto the road between parked cars (no pathway). Reply: Requests for traffic calming and improved pedestrian safety at Palmerston Park are listed for examination and report by the Traffic Advisory Group. The councillor will be informed of the recommendation in due course. Some measures were undertaken at the junction with Palmerston Road some years ago to ensure safe crossing of the road at this location. There are also double yellow lines along sections of the boundary of the park and cars are not allowed to park along this side of Palmerston Park road. Additional changes to address the potential safety problem will have implications for management of the traffic on this public road and will require input from the Roads Department. Q.7 Councillor Anne Feeney To ask the Manager to arrange for pruning of a tree to be done on a tree on the public pathway at the corner of Terenure Road West and Parkmore Drive, as soon as possible, as the branches are leaning onto the garage roof of 76 Terenure Road West and are in danger of causing damage to the resident's roof. The tree itself is on the public pathway and therefore is the responsibility of Dublin City Council. Reply: This tree has been added to our pruning schedule and will be dealt with over the next 6 weeks. Q.8 Councillor Anne Feeney To ask the Manager to remove an abandoned bicycle (abandoned for more than a year) chained to a pole on Neville Road, Rathgar.

16 Reply: Following recent inspections on two occasions, no bicycle was found to be chained to any pole along Neville Road in Rathgar. Three bikes have been identified locally, one on each of the roads either end of Neville Road (nearby Vernon Grove and Highfield Road) and another on Villiers Road. If these still remain in situ in the coming weeks they will be deemed to be abandoned and tagged for removal under the Procedure for the Removal of Abandoned Bicycles which was adopted at the Transportation Strategic Policy Committee meeting on 10 th February Q.9 Councillor Ruairí McGinley To ask the Manager to arrange following repairs to a tenancy property (details supplied). Reply: No maintenance repair request has been received from this tenant in relation to these issues. The last repair request was in These requests have been logged on our computer system and the Area Maintenance Foreman will arrange an inspection of the dwelling. Q.10 Councillor Claire O Connor Can the Manager provide an update as to whether there is a plan to house a family in 10 Street Enda s Road which has been unoccupied for over two years? Reply: This property requires major structural works before refurbishments works can commence at this property. Q.11 Councillor Claire O Connor Can the Manager curb the use of residential permits on Synge Street in circumstances where there are a number of permit users parking on the street from 9 to 5 who are clearly not resident on the street? Reply: The Dublin City Council Parking Control Bye-Laws regulate with regard to residential parking schemes and set out the entitlement and eligibility to parking permits and all permits are issued in accordance with the provisions contained in the bye-laws. It should be noted that many resident permit holders have adjoining roads included on their permit. Nevertheless, if the councillor wishes to provide registration numbers of the vehicles concerned the circumstances in which resident parking permits were issued and the owners entitlement to permits for Synge Street can be investigated in more detail. Q.12 Councillor Claire O Connor Can the Manager consider putting ramps on Ormond Road South, Rathmines? Reply: The request for ramps on Ormond Road South has been referred to the Traffic Advisory Group for examination and report. The councillor will be informed of the recommendation in due course.

17 Q.13 Councillor Claire O Connor Can the Manager confirm if Dublin City Council is in negotiations with any of the clubs on Grosvenor Square in respect of leases or if the council has any plans in relation to Grosvenor Square? Reply: According to the Property Register Records the City Council have no ownership in the property in question and the Development Department are not in negotiations with any of the clubs in respect of leases. The Development Department have no plans in relation to Grosvenor Square as it is not in the ownership of the City Council. Q.14 Councillor Claire O Connor Can the bump in the road at the side of No. 6 Rathdown Park and opposite No. 7 be repaired? Reply: Clarification has been sought from the councillor. councillor on receipt. A reply will be issued to the Q.15 Councillor Claire O Connor Can the broken footpaths in Greenmount Lawns be repaired including outside street lamp No. 6; at the corner of Nos. 9 and No. 14 Greenmount Lawns and in front of 22A? Reply: Road Maintenance inspected the footpath at the above location and added it to our works programme for repairs to be carried out. These repairs will be carried out when a crew becomes available in the neighbouring area. Q.16 Councillor Claire O Connor Can the tree be replaced outside No. 5 Greenmount Lawns? Reply: The tree at this location has been noted for planting and will be included as part of the 2017 tree planting programme. Q.17 Councillor Claire O Connor Can the double yellow lines on the right hand side at the entrance to Greenmount Lawns be extended to correspond with the double yellow lines on the left hand side? Reply: The request to extend the double yellow lines on Greenmount Lawns has been referred to the Traffic Advisory Group for examination and report. The councillor will be informed of the recommendation in due course. Q.18 Councillor Claire O Connor Can the Manager confirm that the wall between Street Joseph s Church and Greenmount Lawns is a safe structure? Reply: This wall has been the subject of numerous inspections since May 2014 and an Engineer s report carried out by PKT Consulting Engineers Lt. dated 10/04/2014 recommended re-securing the wall by means of buttressing or demolishing the wall

18 and rebuilding. This report was commissioned by Street Joseph s NS and Seamus Leahy for Archbishop s House Drumcondra. The costs of these works were according to Mr. Leahy prohibitive in the short term and it was agreed that a protective barrier be erected 3m back from the wall as an interim measure. This wall is being monitored on a regular basis and the inspector concerned may at his discretion decide to issue a dangerous buildings notice should the condition of the wall deteriorate further. Q.19 Councillor Claire O Connor Can the yellow box between Westbourne Road and Rathfarnham Road be repainted? Reply: This location will be listed without delay and tasked for renewal. Q.20 Councillor Claire O Connor Can the yellow line at the end of Rathdown Drive going into Rathdown Crescent be extended as parking blocks the vision of other road users? Reply: The request to extend the double yellow lines at the above location has been referred to the Traffic Advisory Group for examination and report. The councillor will be informed of the recommendation in due course. Q.21 Councillor Frank Kennedy To ask the Area Manager to arrange for the drains, shores and gullies in Powers Court, Dublin 2, which is in charge to the council to be cleared. There is now huge pooling of water covering the road anytime it rains heavily. Many drains in and around the estate are pretty clogged but one is totally blocked (photo of location attached). Residents believe that the suction trucks that come along and clear out the drains are required. The estate is in charge to Dublin City Council. Reply: The hole in the wall at this location can be repaired over the next two weeks. The surface water gullies on Powers Court were cleaned on the 27 th of June 2016.

19 Q.22 Councillor Frank Kennedy Following the motion which was passed unanimously as the South East Area Committee in April 2016 (no. 585) calling for a flag pole to be installed in Donnybrook to be put under the charge of the local Tidy Towns group, members were assured that despite the response to the motion the officials will look at this further. To ask the Manager for an update on what steps have been taken since this motion was passed in the intervening three months. Reply: Following guidelines determined at the commemorations committee we will meet shortly with the Donnybrook Tidy Towns Committee to discuss and advance this item. Q.23 Councillor Frank Kennedy To ask the officials to paint yellow lines at the corner where Sandymount Road turns into Tritonville Road. While I understand that the general principle is that lines are unnecessary in such a situation because it is illegal to park alongside a solid white line, the situation here is highly confusing, because as seen in the attached five photos, there are lines on the other side of Tritonville Road even though that is also alongside a continuous white line. The result is that motorists are confused and they are frequently clamped. It also creates a major safety risk because cars constantly park at this spot in the mistaken belief that it is permissible. The attention of the manager is drawn to my motion (no.73) at the October 2014 South East Area Committee meeting which was passed with the unanimous support of members: Having regard to the fact that a frequent response to traffic related queries is that there is no need to take a particular action or preventative measure because the underlying problem is already illegal (for example, there is no need for painting yellow lines within five metres of a junction because it is already illegal to park there; see Reply to Q.35, South East Area Committee September 2014), and having regard to the serious health, safety and welfare risks which can arise in certain situations where additional measures are not put in place, this committee calls on the Area Manager to amend local traffic policy to the effect that the mere fact that an action is already illegal is not, in isolation, a reason to prevent additional signage etc. being put in place. Reply: Following a meeting with councillors from the South East Area held on the 6 th July I have recommended that double yellow lines be installed at this location to eliminate any confusion for motorists. The lines will be installed once the statutory consultation process has been completed. Q.24 Councillor Paddy McCartan To ask the Manager to give an update on the trapping and relocation of badgers on the banks of the Dodder at Anglesea Road, Dublin 4. Reply: A new / artificial badger sett has been constructed in the Licensed Vintners Association (LVA) grounds under the directions of Dublin City Council s (DCC's) ecologist, Brian Keeley. On Friday the 1 st of July, Brian was issued a license from the National Parks and Wildlife Services (NPWS) to authorise the trapping and relocation of badgers to the artificial sett. At present, Brian has set up a number of gates and traps on the embankment adjacent to the LVA and the cricket ground. Brian is in consultation with the NPWS regarding the details of the trapping strategy, e.g. number of gates etc.

20 I have been advised by the ecologist that it is likely to take a minimum of 2 to 3 weeks to complete the trapping process based on past experience but he has also said that this can vary from site to site. Once we have been advised that the area is clear of badgers by DCC, the flood embankment works may then proceed. Q.25 Councillor Paddy McCartan To ask the Manager to have a tree located at the Appian Way-Leeson Street Upper junction examined. On casual inspection, it seems to be diseased and possibly hazardous, and may need to be removed. Reply: The condition of the tree at this location (Aesculus sps.) has deteriorated substantially in recent months. Considering its age and location, it is proposed to have the tree felled as soon as practicable over the coming weeks (see report to SEAC July meeting). Q.26 Councillor Paddy McCartan To ask the Manager who has the contract for weed spraying in the South East Area. A company with Co. Fermanagh registration plates has been seen carrying out the work in the Sandymount Area. Reply: A notice was published on Etenders on 10 th October 2014 seeking submissions for a Single Party Framework Agreement for a Service Provider for the Control of Weeds on Roads in Dublin City Council for the years Following evaluation of the tenders received, Greentown Environmental Ltd. was awarded the contract for the year There is an option to renew the framework agreement for three further periods of one year to cover the years 2016, 2017, and 2018 respectively. Following a review, it was found that Greentown Environmental Ltd. had satisfactorily carried out this contract in 2015 and it was then allocated to them again for Greentown Environmental Ltd s head office is based in Enniskillen, Co. Fermanagh. Q.27 Councillor Paddy McCartan To ask the Manager to have a tree at the following location cut back and pruned. It is located at the main gate of Ringsend Park adjacent to 30 Canon Mooney Gardens. See map attached. It currently blocks the sunlight to that apartment. Reply: This tree will be pruned over the coming weeks as requested. Q.28 Councillor Mannix Flynn Can the Manager issue a full report on the Dubline project? This report to include when there was last meetings held, expenditures to date and a project implementation report. Also, please include what monies / grants were declined by individuals and organisations and why? Reply: Dubline Steering Group meetings attended by Dublin City Council management take place once a month. The last meeting took place on 17 th June, Meetings between Dublin City Council and Fáilte Ireland take place approximately every six weeks and the last meeting took place on 27 th June The last meeting of the Dubline Partners group was held on 9 th April 2014.

Q.29 Councillor Mannix Flynn Can the Manager issue a full report as to what is the situation regarding legislation to deal with charity collectors (chuggers) and the growth of that culture, which is now seriously impacting on free movement on our streets? It is now becoming a common practice for groups of individuals collecting on behalf of the likes of Amnesty International, Concern etc. to block entire footpaths and interfere with people s right of way. Reply: The Charities Act 2009 is the legislation to deal with the above issue. The Charities Regulatory Authority (CRA) is Ireland's national statutory regulatory agency for charitable organisations. The CRA was established on the 16th of October 2014 under the terms of the Charities Act It is an independent agency of the Department of Justice and Equality. Under the Charities Act 2009 the CRA has the following general functions: Increase public trust and confidence in the management and administration of charitable trusts and charitable organisations. Promote compliance by charity trustees with their duties in the control and management of charitable trusts and charitable organisations. Promote the effective use of the property of charitable trusts or charitable organisations. Ensure the accountability of charitable organisations to donors and beneficiaries of charitable gifts, and the public. Promote understanding of the requirement that charitable purposes confer a public benefit. Establish and maintain a register of charitable organisations.
