(a) Confirmation of the Minutes of the following meetings: (a) Minutes of the meeting of the members of the Municipal District of South & West Kerry held on 19 th May, (b) Minutes of the Annual meeting of the members of the Municipal District of South & West Kerry held on 30 th June, (b) Reception of Deputations (a) Residents of Sneem Re: Derelict estate in the Village. (a) To note the change in membership on the Board of the Kerry Recreational & Sports Partnership (b) Notice is herby given, in accordance with Section 34(6) of the Planning & Development Act 2000 (as amended), that Kerry County Council intends to consider deciding to grant permission (Planning Ref. no. 16/1302) to (a) demolish existing structure (b) construct a single storey commercial unit as an extension to the western side of existing shop (c) construct a wall along rear of site (d) relocate existing car wash (e) ancillary site works and services at Milltown Co Kerry. The proposed development would materially contravene the objectives of the Tralee/Killarney Hub Functional Local Area Plan in which plan the subject site is located in an area zoned Public/Community/Institutional/Educational. ( C ) In accordance with the Local Government Act 2001 (as amended) and having regard to section 180 of the Planning and Development Act 2000 in relation to the taking in charge of estates, to consider any objections or representations received and the making of an Order declaring the following roads to be public pursuant to Section 11 (2) (i) of the Roads Act Agenda South and West Kerry MD 2

3 (i) Ardmoniel, Killorglin - Road from its junction with L to all terminal points within the estate in Cathair Lakes, Ardmoniel, Killorglin, Co. Kerry Map 13 (serving 38 houses). Total Length of road to be Taken in Charge: - 292m (ii) Knockavota, Milltown - Road from its junction with L & L to all terminal points within the estate Ard Na Greine, Laurel Avenue, Ard na Greine, Knockavota, Milltown, Co Kerry Map 32 (serving 62 houses). Total Length of road to be Taken in Charge: - 825m (iii) Nuns Road, Killorglin - Road from its junction with L to all terminal points within the estate Castle Gardens, Nuns Road, Killorglin, Co Kerry Map 33 (serving 9 houses). Total Length of road to be Taken in Charge: - 70m 2. (a) To consider and approve allocations from the 2017 Community Facilities Scheme. (b) To note report from Economic & Community Development Directorate (c ) Notice of Motion 1. Cllr. M Cahill: I propose that Kerry County Council improve the appearance of all towns and villages in the county by initiating a major Art's Competition in respect of old, rundown/derelict properties as this will greatly encourage visitors to stop, shop and stay. 2. Cllr. M. Cahill: I propose that Kerry County Council give 100% support to Killorglin Chamber Alliance in regards to their application for LEADER funding to light up the old Metal Bridge in Killorglin as this will be a major attraction for the town and also their application under the Town and Village Renewal Scheme to brand and market Killorglin as an Adventure Gateway and Gateway to the McGillycuddy Reeks - make it discoverable on sites such as TripAdvisor and Google Trips-train local providers-a PR iniative focusing on National Geographic and other outdoor publications. 3. Cllr. M. Cahill: I propose that Kerry County Council supports Glenbeigh Community Council s 2 applications for LEADER funding in respect of the provision of a footpath from Glenbeigh village to Rossbeigh Beach on "Health and Safety Grounds 4. Cllr. J F Flynn: That Kerry County Council look at the possibility of building a playground in keel. (d) Questions Agenda South and West Kerry MD 3

4 1.Cllr. M. Cahill:I propose that Kerry County Council take into consideration the fact that the numbers of people cycling in our county has increased dramatically in recent years and that Kerry hosts the largest cycling event in Ireland, the Annual Ring of Kerry Charity Cycle and grasp the initiative by employing a Cycling Officer for the county whose role will include the provision of Bike Stations similar to other Local Authorities, liaising with the Road Design Office in regards to the provision of new Cycle Lanes where possible and the prioritising of 'Health and Safety' on all our roads.this is a golden opportunity to promote our county and with a number of Greenway's coming on stream, Kerry can be the Number One cycling county in Ireland. 2. Cllr. P. Connor-Scarteen: Please arrange for the Playground in Caherdaniel to open as soon as possible. 3. Cllr. D. McCarthy: Would the council consider giving funding to the relevant community group, to establish a youth cafe for the Kenmare area. 4. Cllr. N. Moriarty: That we liaise with the local community group and begin the twinning process between Kenmare and Sucé-sur-Erdre near Nantes in France as requested by the municipal authority of this French town. 3. (a) To note update report from Quality of Life Water, Environment, Fire and Library Services Directorate (b) Notices of Motion 1. Cllr. M. Cahill: That Kerry County Council accommodate members of the Public as a matter of priority by introducing Credit Card facilities at all Transfer Stations in the county, ie Milltown, Caherciveen, Dingle, Coolcushlagh, Killarney and Kenmare. 2. Cllr. N Moriarty: To provide a dog fouling bag dispenser along the Sportsfield Road, Sneem. 3. Cllr. D. Quigg: That this Council look at projects in the coastal areas of South and West Kerry that would qualify under the Flag Funding for coastal communities, this is an under utilised source of funding that would make a huge difference to our Coastal communities. 4. Cllr. J. F. Flynn: Will Kerry County Council provide a free water connection to each tidy towns group. (c) Questions Agenda South and West Kerry MD 4

5 1. Cllr. N. Moriarty: That the wastewater holding tank in Chapeltown be emptied more regularly and that close monitoring of same is carried out as there are odour issues. 2. Cllr. N. Moriarty: Were there design plans to encase the outflow pipe at Waterville from the shore and if so can we see same? The current system is continually becoming blocked and would be improved if it were encased properly. 3. Cllr. J. F. Flynn: When is the expected start and finish date of the pipeline in Glencuttane. 4. (a) To note update report from Housing Directorate (b) Notice of Motions for Housing & Corporate Services. 1. Cllr. M Cahill: That Kerry County Council give a detailed report on the Single Rural Cottage Building Programme in Kerry and is adequate funding available to build cottages for Qualified Housing Applicants who can provide a site and who wish to live in the countryside and that the council give an update in regards to vacant single rural cottages, how many are been renovated / sold. 2. Cllr. D. Quigg: That this Council give a definitive timeline as to when the houses planned for Ardmoniel, Killorglin will be built, there is an urgent need for these houses to be built. 3. Cllr. J.F. Flynn: That Kerry County Council start the building of the 14 houses in Ardmoniel, Killorglin as soon as possible as the waiting list is at absolute crisis in the area. 4. Cllr. M. O Shea: To ask would the Housing Department of Kerry County Council create a green area adjacent to (Details with Directorate). 5. Cllr. M. O Shea: To ask the Director of Housing have there been any further lands purchased in the South & West Municipal District for social housing. (c) Questions for Housing & Corporate Services. 1. Cllr. M. Cahill: That Kerry County Council give a detailed report in regards to the number of Qualified Housing Applicants for 1 bedroom, 2 bedroom, 3 bedroom, 4 bedroom and 5 bedroom properties and how long are these applicants waiting? 6 2. Cllr. M. Cahill: That Kerry County Council outline how it intends to deal with the housing crisis that is about to explode with more and more landlords increasing rent and sending out letters of Notice to Quit etc. 3. Cllr. N Moriarty: To arrange a meeting with the new Tenant liaison officer for the Waterville/Caherciveen Area and the residents association of Árd Aoibheann Estate Waterville to develop a work plan. 5. (a) To note update report from the Operations, Safety & Infrastructure Directorate (b) Notice of Motion 1. Cllr. M. Cahill: That Kerry County Council take into consideration the granting of Planning Permission to FEXCO for a major development on the Killarney road that will greatly increase the volume of traffic by requesting the Road Design Office and Transport Infrastructure Ireland to expedite the acquisition of lands for a new footpath from Killorglin Town out to the old Liebig Factory. 2. Cllr. M. Cahill: That Kerry County Council carry out as a matter of extreme urgency road lining/markings and adequate signage at the very busy and dangerous Knocklyne Valley junction with the Sunhill road and that the Council make a submission for funding to the Department of Transport on "Health and Safety Grounds "for safety measures to be carried out at this location under the Low Cost Accident Scheme. 3. Cllr. M Cahill: That Kerry County Council give a detailed progress report in respect of the South Kerry Greenway from Glenbeigh to Caherciveen, our county's biggest and best ever Tourism Project that will play a massive contribution to the local economy here in Kerry and job creation in the South West, an area that has been ravaged by emigration and subject to continuous population decline. This World Class Greenway when complete will bring life back to the towns and villages throughout South Kerry and for the sake of this generation and generations to come, it is imperative that this project is supported and progressed by all to fruition. 4. Cllr. M. Cahill: That Kerry County Council give a detailed progress report in regards to the Cliff road, Rossbeigh and confirm as to approximately when this major E1.1 million road project will commence and how long it will take to complete. 5. Cllr. P. Connor-Scarteen: That Kerry County Council please repair and resurface the local road at Cuhig, Lauragh just before the County bounds on the left. There are 9 houses on it and it s in a shocking condition. 6. Cllr. P. Connor-Scarteen: That Kerry County Council please improve the sight distance when exiting onto the Kilgarvan R569 road at Cleady, Kenmare. Agenda South and West Kerry MD 6

7 7. Cllr. P. Connor-Scarteen: That the Kerry County Council please erect a map of headstones at Killowen Burial Ground, Kenmare ( KE ) 8. Cllr. P. Connor-Scarteen: That Kerry County Council please provide a new ride on lawn mower for Dromneavane Estate, Kenmare, the current one bought in 1994 no longer works. 9. Cllr. P. Connor-Scarteen: That Kerry County Council please install appropriate traffic calming measures on the Gap of Dunloe Road, Beaufort. 10. Cllr. P. Connor-Scarteen: Please erect go slow signs on either side of Castlecove village as requested previously. 11. Cllr. P. Connor-Scarteen: Please include the Gowlanes Road, Castlecove in the next roads programme. 12. Cllr. S. Fitzgerald: Will Kerry County Council provide funding to do an E.I.S. (Environmental Impact Statement) studyand any other related study which many be necessary so as to bring the proposal to erect a footbridge adjacent to Milltown Bridge, Dingle to Planning stage. 13. Cllr. S. Fitzgerald: Will Kerry County Council liaise with the Department of Marine to progress the erection of navigation lights at Derrynane Harbour? 14. Cllr. S. Fitzgerald: Will Kerry County Council initiate plans once again for the new proposed Cromane Pier? 15. Cllr. S. Fitzgerald: Will Kerry County Council tarmacadam the space between the public road and the Grotto at Castlegregory Junction? 16. Cllr. S. Fitzgerald: Could Kerry County Council include the speed limit to be extended on the High Road in Ventry leading out from the Primary School when it s making its submission to the relevant authorities? 17. Cllr. S. Fitzgerald: Will Kerry County Council remove the sod of grass between the footpath and the public road from Monacappa Estate along the Spa Road towards the Hillgrove Hotel in Dingle? 18. Cllr. S. Cllr. S. Fitzgerald: Will Kerry County Council contact the landowner in Baile na ngall to see if the road could be widened and land made available to develop extra car parking spaces. 19. Cllr. S. Fitzgerald: Any update on getting funding to improve the road down to Carrigaha Beach, Castlegregory Agenda South and West Kerry MD 7

8 20. Cllr. S. Fitzgerald: Will Kerry County Council replace the Cloghane / Castlegregory directional signage at the Spa Road, Dingle. 21. Cllr. D. McCarthy: To ask Kerry County Council to approve funding for improvement works at the entrance to Reenagross via the Bell Height as a matter of urgency. 22. Cllr. D. McCarthy: To ask Kerry County Council to erect a cul de sac sign at Feorus Cross. 23. Cllr. D. McCarthy: To ask Kerry County Council to apply for funding for improvement works on the road from chill Mhuire to the cross at Kilmurry. 24. Cllr. D. McCarthy: That Kerry County Council apply to take over the car park at the Kimego ring fort, Over the Water Cahersiveen for safety reasons. 25. Cllr. N. Moriarty: To carry out immediate repair works at Maulin Bridge. 26. Cllr. N. Moriarty: To carryout drainage and repair works at Bolus Head road Cill Rialaig and to source a funding stream for the full resurfacing of this section of the road at 2.8km in length, as well as the 4km at Ducalla both of which serve the Bolus Loop walk. 27. Cllr. N. Moriarty: To erect a safety barrier along the Sportsfield road at Sneem at a section that is prone to flooding. This visible guide is essential for road users. 28. Cllr. N. Moriarty: To repair and resurface the Killelan Road. 29. Cllr. N. Moriarty: To resurface, drain and repair the Claghanecarhan Road. 30. Cllr. D. Quigg: That this Council widen the bridge at Keel, Glencar to allow farm machinery pass over it. 31. Cllr. D. Quigg: That this Council powerwash and re-sand the footpaths in Killorglin town 32. Cllr. D. Quigg: That this Council provide a full time employees for the general upkeep of the larger towns and villages in this Municipal area, tidy towns groups are carrying out voluntary labour intensive work away above and beyond their capacity and resources. 33. Cllr. D. Quigg: That this Council look into possible sites in Killorglin for extra car parking and coach set down, the current situation is not sustainable going forward and businesses are losing out in the town whilst they pay lucrative rates for their premises to Kerry County Council. 9 34. Cllr. D. Quigg: That This Council look at the prospect of introducing designated cycle routes directing cyclists to quieter roads with lower volumes of traffic on a pilot scheme as it would lower the risk of fatalities on our roads in Kerry in relation to vulnerable road users. 35. Cllr. D. Quigg: That this Council in conjunction with the landowner beside Bensons Shop, Keel work together to improve the sight line when entering and exiting the shop and petrol pumps there, there has been a number of accidents and near misses at this location and a serious accident is going to happen if this is not addressed very soon, the shop owner is quite willing to assist the council and landowner in relation to any costs incurred. 36. Cllr. J.F. Flynn: That Kerry County Council look at creating a viewing area at the top of Caragh Lake mountain. 37. Cllr. J. F. Flynn: Will the council erect a street light at Ross cottages in Keel. 38. Cllr. J. F. Flynn: That Kerry County Council write to the TII to highlight the dangerous junction at Tullig cross. 39. Cllr. J. F. Flynn: That the Holly Bush road be repaired as it's probably the busiest private road in this Municipal District. 40. Cllr. M. O Shea: What is the update to date position with the flooding problems in Valentia? 41. Cllr. M. O Shea: To ask will Kerry County Council to include Fybagh school in the next allocation for the CLÁR programme. 42. Cllr. M. O Shea: To ask Kerry County Council and TII is there any plans in place to seek funding for Caragh Bridge, Glenbeigh and the School Bridge, on the N70 South West of Glenbeigh Village. 43. Cllr. M. O Shea: What is the update position with erecting public lights on the N70 between Milltown village and the grave yard. 44. Cllr. M. O Shea: That Kerry County Council would assist the landowner (Details with Directorate) with the entrance road to his property, off the L5616 (Short Mountain road) 45. Cllr. M. O Shea: To ask that Kerry County Council will fill the serious lags on the Ballyfinane road, the L2019, as these pose a danger to all road users. 46. Cllr. M. O Shea: Can Kerry County Council issue a hedge cutting notice to landowners if hedging is left grow out of control and restricts householders and in particular commercial businesses from views in scenic locations. 47. Cllr. M. O Shea: To ask Kerry County Council to erect signs on the L6516 warning large vehicles that the road isn t suitable for purpose. Agenda South and West Kerry MD 9

10 (c) Questions 1. Cllr. M. Cahill: That Kerry County Council submit an application for funding to the OPW as a matter of extreme urgency in respect of Flood Relief Works at Cromane Lower and Glosha that will include the raising and strengthening of the embankment and seawall so that family homes are protected from Tidal Flooding. 2. Cllr. M. Cahill: That Kerry County Council take into consideration the huge success of Star Wars, the large number of visitors to Skellig Michael and the great success of the Wild Atlantic Way by acquiring a suitable site adjacent to Portmagee village and provide much needed additional Car Parking and a Playground as a matter of extreme urgency for the local community and the huge crowds that visit the area. 3. Cllr. M Cahill: That Kerry County Council following on from numerous previous " Notice of Motions " that I submitted over the past number of years, give a detailed progress report in regards to the Kilderry Bends Realignment Project as this is a major Health and Safety matter. When will this important project go out to tender, when will it commence and how long will it take to complete? It is imperative that the road commences as soon as possible as it is one of the most dangerous sections of road in the country. Will the estimated 10m cost of this scheme be sufficient? 4. Cllr. M. Cahill: That Kerry County Council carry out a major traffic management plan for Killorglin town that will include the identification of new car parking areas new roads etc. 5. Cllr. M. Cahill: That Kerry County Council install a water tap at Ballinakilla burial ground and the Killeen Burial Ground Glenbeigh as matter of priority. It is very unfair on family members who have to travel long distances and have to bring bottles of water when attending to flowers and plants at loves ones graves. 6. Cllr. P. Connor-Scarteen: Please ensure the Casual Trading area in Sneem is the only place that casual trading can take place. 7. Cllr. P. Connor-Scarteen: That Kerry County Council as soon as possible start the repair works on the bridges in Doory, Portmagee and Killoe, Cahersiveen. 8. Cllr. P. Connor-Scarteen: That Kerry County Council please pursue the land owners to cut the overgrown bushes ( Rosdohan, Tahilla) or arrange for the bushes to be cut. Agenda South and West Kerry MD 10

11 9. Cllr. P. Connor-Scarteen: That Kerry County Council please erect signage in the vicinity of the Suspension bridge and along the Main road at Mucksna warning motorists to slow down and take care of pedestrians. 10. Cllr. P. Connor-Scarteen: That Kerry County Council please acquire extra land for Parking in Portmagee. 11. Cllr. P. Connor-Scarteen: That Kerry County Council please do a safety audit of the road from Suspension bridge to the County bounds at Lauragh. 12. Cllr. P. Connor-Scarteen: Signage is needed in the vicinity of Glounaguillagh National School, Killorglin, to direct tourists especially to the viewing area for Caragh Lake approximately 2 miles away. Also two signs need to be fixed as they are pointing the wrong way. Please address these issues. 13. Cllr. P. Connor-Scarteen: That Kerry County Council consults with TII and erect signage on prominent tourist routes, warning tourists to stay on the correct side of the road, the warnings should obviously be in their native language i.e German and French. 14. Cllr. D. McCarthy: Have the council applied for funding to improve the sight distances at Cleady cross? 15. Cllr. D. McCarthy: Is there any funding available to cut the over growth at Ardea cross? 16. Cllr. D. McCarthy: Would the council consider asking the Board of Management at St John's school, Kenmare for the use of the car park for parking busses during the summer season? 17. Cllr. D. McCarthy: What is the latest update regarding the street traders / Casual Trading in Kenmare town? 18. Cllr. D. McCarthy: That Kerry County Council cut the hedge from Blackwater bridge to the Black Water tavern. 19. Cllr. N. Moriarty: That far greater consultation and liaison is carried out with local area staff and TII when it comes to all road matters and in particular the lining and relining of roads and junctions. 20. Cllr. N. Moriarty: That we include in the next Roads programme the 2 km of road badly in need of restoration from Scarriff to Grannafulla. 21. Cllr. N. Moriarty: That we look to providing a care taker for Dromod Graveyard, now the only place for burials in the Dromod parish as Waterville has reached capacity. Agenda South and West Kerry MD 11

12 22. Cllr. N. Moriarty: To clear and clean all gullies in the town of Caherciveen and replace plastic drain grills with metal ones as there are several that are broken. 23. Cllr. N. Moriarty: To reconnect the Street light near the Church of Ireland in Sneem. This threw light on the rocks and also provided a connection point for Christmas lighting. 24. Cllr N. Moriarty: That we improve the signage and information on same on approaching Sneem. That these signs include symbols indicating the various amenities available in the area. 25. Cllr. D. Quigg: Hedge cutting is still a big problem in our Municipal District, whilst I commend the Council for the hedges they have cut in recent weeks, there is still a shortfall in this area, I would ask that elected members be allowed point out areas within their various Municipal District that have been highlighted or brought to their attention and consideration be given to cutting the hedges at these locations, especially busy roads. 26. Cllr. D. Quigg: Will this council consider opening talks with landowners in relation to linking the new South Kerry Greenway from Glenbeigh to Killorglin. 27. Cllr. J. F. Flynn: Will Kerry County Council provide a public toilet in Milltown. Milltown has double in population in the past ten years but also its a very busy town with tourist passing everyday. 28. Cllr. J. F. Flynn: Will the council provide funding for lighting for the Laune bridge. 29. Cllr. J. F. Flynn: That street lights are erected from Glenbeigh village out to Falvey s caravan park. 30. Cllr. M. O Shea: What facilities / public conveniences are in place for walkers on the prescribed routes such as the Kerry Way? 6. Motions / Questions relevant to other Directorates or issues not relevant to Kerry County Council business (a) Notices of Motion 1. Cllr. M. Cahill: That Kerry County Council call on the Minister of State at the Department of Tourism and Sport, Brendan Griffin TD to allocate a Tourism Grant as a matter of extreme urgency in respect of the Valentia Island Ferry as this service is vital to the Tourism Industry in South Kerry. 2. Cllr. M. Cahill: That Kerry County Council call on the Minister for Justice and the Government to get tough on lnsurance fraud, as a matter of extreme Agenda South and West Kerry MD 12

13 urgency as lrish motorists and Irish businesses are being ripped-off and that Minister Flanagan introduces a law whereby persons caught lying in Court in respect of false lnsurance claims, are immediately jailed. 3. Cllr. M. Cahill: That Kerry County Council ask the Minster for Health, Simon Harris TD why he has to date refused to meet with a delegation from the Council, despite numerous requests, in regards to the disgraceful and unacceptable circumstances where by members of the public in Kerry and throughout the country are in fact going blind while awaiting cataract procedures. 4. Cllr. P. Connor-Scarteen: Can Kerry County Council make people that paid the NPPR in Kerry aware that they may potentially obtain income tax relief on this charge for 2013 by filling out a NPPR notification form. 5. Cllr. P. Connor-Scarteen: That Kerry County Council please request the Department of Communications, Climate Action and Environment to conduct a public awareness campaign to inform the public what it the policy in terms of registering septic tanks. 6. Cllr. P. Connor-Scarteen: Recent decisions regarding increased recycling charges need to be reversed, what reply have we got back from the Environment Minister Denis Naughten TD. 7. Cllr. P. Connor-Scarteen: That Kerry County Council call upon the Minister of State with special responsibility for Disability Issues, Minister Finian McGrath TD, to allocate more funding and resources for Respite care. 8. Cllr. D. McCarthy: To ask Kerry County Council to write to the Minister for Agriculture, Food and The Marine to increase funding to the social farming project. 9. Cllr. Quigg: That this council write to the Minister for Transport in relation to cars that are costing huge amounts of money to insure and in some cases where a car is 10 or more years old they will not be considered for insurance at all, this is wrong and it is having an adverse effect on small car sales businesses and first time drivers. 13. Cllr. D. Quigg: Is Killorglin town being considered for the new CCTV rollout and when will consultation take place in relation to this? 14. Cllr. J. F. Flynn: That we write to the HSE to provide the equipment and expertise to Kerry University Hospital to carry out operations for people with cataracts. This is a massive issue that's going to get a lot worse and affect more and more people. 15. Cllr. J. F. Flynn: That Kerry County Council write to the Minister for Health and the HSE to highlight the serious issue of young teenagers on waiting list to be assessed for depression. 16. Cllr. J. F. Flynn: That we write again to the Minister for Health, requesting him to bring in an opt out system for people to carry a donor card. 17. Cllr. J. F. Flynn : When will this council start employing new staff. We have council workers retiring without being replaced. It will be impossible going forward to run the day to day repair work unless we start employing new staff.
