3 Introduction The Wastewater Infrastructure Funding (WIF) program is a gap-financing tool that provides supplemental assistance grants to municipalities with high priority wastewater projects that meet established affordability criteria. The program is administered by the Minnesota Public Facilities Authority (PFA) and used in conjunction with the PFA s Clean Water Revolving Fund loan program and with the U.S. Department of Agriculture s (USDA) Rural Development grant and loan program. The WIF program is established in Minnesota Statutes Section 446A.072. To access the program, municipalities must have their projects listed on the Minnesota Pollution Control Agency s ( s) Project Priority List (), and must apply for funding either to the PFA through the Clean Water Revolving Fund (CWRF) application process or to USDA Rural Development through their grant and loan application process. WIF funds are awarded to projects based on their priority ranking on the s, their readiness to proceed, and eligibility criteria established under Minnesota Statutes 446A.072. WIF Application Process and Funding Criteria Small rural communities with median household incomes below the non-metro state average may apply to USDA Rural Development for wastewater grants and loans. Those projects that receive a USDA Rural Development grant based on the Rural Development affordability criteria may receive a WIF matching grant for up to 65% of the grant eligible amount determined by USDA Rural Development. This state-federal partnership allows the state WIF funds to assist more projects, makes it easier for small communities to access funding, reduces state administrative expenses, and helps USDA Rural Development maximize the loan funds allotted to Minnesota. Projects that do not receive grant funding from USDA Rural Development may apply for a WIF grant as part of their CWRF loan application to the PFA. Projects are eligible for a WIF grant in conjunction with a CWRF loan if the average annual residential system cost after completion of the project would otherwise exceed 1.4 percent of median household income. The amount of the grant is equal to 80 percent of the amount needed to reduce the average residential system cost to 1.4 percent of median household income. The WIF eligible project cost is determined by multiplying the total project cost by the Essential Project Component percentage calculated by, which represents that portion of the project needed to meet existing needs. Under the program statutes, funds appropriated to the WIF program are available to projects based on their ranking on the s Project Priority List (). Each fiscal year the PFA reserves available funds for eligible projects when the applicant submits plans and specifications to the or when the project receives a funding commitment from USDA Rural Development. WIF funds are reserved based on the estimated project cost when the funds were appropriated. WIF grants are awarded when the project takes bids and is ready to start construction, with the grant based on the amount reserved or the as-bid costs, whichever is less. Whether a WIF grant is awarded as a match to a USDA Rural Development grant or in conjunction with a CWRF loan, the maximum grant is $4,000,000 per project or $15,000 per connection, whichever is less, unless specifically approved by law. System Replacement Fund Requirement Under the provisions of Minnesota Statutes, section 446A.072, subdivision 12, WIF recipients must establish a system replacement fund and annually deposit $.050 per 1000 gallons of wastewater flow to be used for major rehabilitation, expansion, or replacement of the treatment system. The funds 3

4 must remain in the account for the life of the corresponding PFA or USDA-RD loan, unless the use of the fund is approved by the PFA. In some cases a municipality receives a WIF grant for improvements to a portion of a much larger wastewater treatment system. When this would result in the accumulation of a replacement fund larger than the original WIF grant, the PFA allows the municipality to propose a pro-rated annual deposit based on the percentage of the WIF funded project to the total system. Current WIF Awarded or Reserved The PFA has awarded or reserved WIF grants for the projects listed below on the Project Priority List using available WIF funds, including funds appropriated in the July bonding bill. These projects have submitted plans and specifications and been approved and certified for funding by the, or have received a funding commitment from USDA Rural Development. WIF grant funds were reserved based on the affordability criteria in Minnesota Statutes, section 446A.072, subdivision 5a using demographic information and project cost estimates when funds were reserved. WIF grants are awarded after projects are bid and ready to start construction, in an amount based on the estimated project cost at the time funds are appropriated or the as-bid cost, whichever is less. The projects listed below are now all under construction or expected to start construction in. All of the appropriated WIF funds are committed to projects, with the exception of $1million appropriated in July 2011 for the City of Albert Lea. The WIF program requirements and criteria are problematic for this project and the appropriation language will have to be amended to award this grant. 5 WIF s The table on pages 7-8 identifies estimated WIF funding needs for projects on the s Project Priority List. Only projects that appear to be eligible for WIF grants from new appropriations are shown. The estimated WIF grant amounts are based on preliminary project information from municipalities and other information compiled by the PFA, including 2010 median household income data that was released by the Census Bureau in December The 2010 median household income data will be used to calculate WIF grants from any new appropriations. In November and December 2011, the PFA surveyed all municipalities with projects on the and received updated information on 113 of the 349 projects. In most cases this information is still considered preliminary and has not been verified. Therefore, the WIF amounts shown in the table are estimates and are subject to change. At the current 45 point funding cutoff on the Intended Use Plan for Clean Water Revolving Fund loans, estimated WIF needs exceed $93 million for 72 eligible projects. It is important to note that getting a wastewater project to the point of construction is a complex process for a local government that can often take several years to plan and design. The PFA generally expects 50% or less of the projects in fundable range to proceed to construction in any given year.
