PROPOSED CONSTITUTIONAL AMENDMENT AMENDING THE MANDATORY JUDICIAL RETIREMENT AGE Shall the Pennsylvania Constitution be amended to require that justices of the Supreme Court, judges, and magisterial district judges be retired on the last day of the calendar year in which they attain the age of 75 years? Plain English Statement of the Office of Attorney General The purpose of the ballot question is to amend the Pennsylvania Constitution to require that justices, judges and justices of the peace (known as magisterial district judges) be retired on the last day of the calendar year in which they attain the age of 75 years. Presently, the Pennsylvania Constitution provides that justices, judges and justices of the peace be retired on the last day of the calendar year in which they attain the age of 70 years. Justices of the peace are currently referred to as magisterial district judges. If the ballot question were to be approved, justices, judges and magisterial district judges would be retired on the last day of the calendar year in which they attain the age of 75 years rather than the last day of the calendar year in which they attain the age of 70 years. This amendment to the mandatory retirement age would be applicable to all judges and justices in the Commonwealth, including the justices of the Pennsylvania Supreme Court, judges of the Commonwealth Court, Superior Court, county courts of common pleas, community courts, municipal courts in the City of Philadelphia, and magisterial district judges. The ballot question is limited in that it would not amend any other provisions of the Pennsylvania Constitution related to the qualification, election, tenure, or compensation of the justices, judges or magisterial district judges.

5 The effect of the ballot question would be to allow all justices, judges, and magisterial district judges to remain in office until the last day of the calendar year in which they attain the age of 75 years. This would permit all justices, judges, and magisterial district judges to serve an additional five years beyond the current required retirement age. PROPOSED LUZERNE COUNTY HOME RULE CHARTER AMENDMENT 1 AMENDING ARTICLE VIII AUTHORITIES, BOARDS, AND COMMISSIONS, SECTION 8.02.H - APPOINTMENTS TO BOARDS AND COMMISSIONS/VACANCIES Should the Luzerne County Home Rule Charter be amended at Section 8.02.H as follows?: Delete the provision: For a period of one year after leaving office, no member of any County board or commission may serve as an elective County official. Plain English Statement of the Bureau of Elections and Registration The purpose of the ballot question is to amend the Luzerne County Home Rule Charter to delete the provision that prohibits a member of a County board or commission from serving as an elected County official for one year after their leaving their board or commission seat. Presently, the Luzerne County Home Rule Charter prohibits members that are no longer serving on a County board or commission from serving as an elected County official for one year after leaving their board or commission seat. This ballot question is limited to whether Section 8.02.H should be amended. The ballot question would not amend any other provisions of the Luzerne County Home Rule Charter. The effect of this ballot question would be to amend the Luzerne County Home Rule Charter so that a member of a County board or commission would no longer be restricted for one year from serving as an elective County official. PROPOSED LUZERNE COUNTY HOME RULE CHARTER AMENDMENT 2 AMENDING ARTICLE VIII AUTHORITIES, BOARDS, AND COMMISSIONS, SECTION 8.03.E - APPOINTMENTS TO AUTHORITIES/VACANCIES Should the Luzerne County Home Rule Charter be amended at Section 8.03.E as follows?: Delete the provision: For a period of one year after leaving office, no member of any County Authority may serve as an elective County official. Plain English Statement of the Bureau of Elections and Registration The purpose of the ballot question is to amend the Luzerne County Home Rule Charter to delete the provision that prohibits a member of a County Authority, from serving as an elected County official for one year after their Authority seat. Presently, the Luzerne County Home Rule Charter prohibits members that are no longer serving on a County Authority from serving as an elected County official for one year after leaving their Authority seat. This ballot question is limited to whether Section 8.03.E should be amended. The ballot question would not amend any other provisions of the Luzerne County Home Rule Charter. The effect of this ballot question would be to amend the Luzerne County Home Rule Charter so that a member of a County Authority would no longer be restricted for one year from serving as an elective County official. PROPOSED LUZERNE COUNTY HOME RULE CHARTER AMENDMENT 3 AMENDING ARTICLE V BUDGET AND FINANCE, SECTION 5.10.B CHANGES IN THE BUDGETS

6 Should the Luzerne County Home Rule Charter be amended at Section 5.10.B as follows?: Add to existing language at Section 5.10.B.: An affirmative vote of a majority of the current members of County Council shall be required to introduce any ordinance under this subsection. Plain English Statement of the Bureau of Elections and Registration The purpose of the ballot question is to amend the Luzerne County Home Rule Charter to add to existing language that in order to introduce any ordinance under the subsection, an affirmative vote of a majority of the current members of County Council will be required. Presently, under the Luzerne County Home Rule Charter, Section 5.10.B, prior to February 15 in the year following a municipal election, County Council may amend any of the budgets and the rates of taxation by ordinance. Any such ordinance could currently be introduced by a minority of four members of County Council. The amendment would require a majority of at least six members to make an amendment. This ballot question is limited to whether Section 5.10.B should be amended. The ballot question would not amend any other provisions of the Luzerne County Home Rule Charter. The effect of the ballot question would be to add language to Luzerne County Home Rule Charter that would require an affirmative vote of a majority of the current members of County Council to introduce an ordinance amending any of the budgets and the rates of taxation following a municipal election and prior to February 15. PROPOSED LUZERNE COUNTY HOME RULE CHARTER AMENDMENT 4 AMENDING ARTICLE VIII AUTHORITIES, BOARDS, AND COMMISSIONS, SECTION 8.03.E - APPOINTMENTS TO AUTHORITIES/VACANCIES Should the Luzerne County Home Rule Charter be amended at Section 8.03.E as follows?: Persons who are employed or otherwise compensated by individuals or entities that have contracts with or are paid consultants of Luzerne County or any of its boards, authorities or commissions shall be allowed to serve on Luzerne County Authorities after such person has fully disclosed the nature of their interests and relationship with Luzerne County in writing. Such written disclosure by an Authority applicant shall be made public at a meeting of Luzerne County Council prior to the applicant s appointment to an Authority and public comment shall be permitted. The provision currently restricting appointments of such individuals to Luzerne County Authorities shall be deleted from the Home Rule Charter. Plain English Statement of the Bureau of Elections and Registration The purpose of the ballot question is to amend the Luzerne County Home Rule Charter allowing persons to serve on Luzerne County Authorities when employed or compensated by individuals or entities that have contracts with or are paid consultants of Luzerne County or any of its boards, authorities or commissions, as long as applicant fully discloses in writing, the nature of their interests and relationship with Luzerne County at a public meeting of the Luzerne County Council, where public comment will be permitted. Presently, the Luzerne County Home Rule Charter prohibits members of any County Authority from being employed or compensated by any individual or business serving as a contractor to the County or any County authority, board, or commission. This ballot question is limited to whether Section 8.03.E should be amended. The ballot question would not amend any other provisions of the Luzerne County Home Rule Charter. The effect of the ballot question would allow the appointment of persons to Luzerne County Authorities who are employed or compensated by any individual or entity that have contracts with or are paid consultants of Luzerne County or any of its boards, authorities or commissions, as long as the applicant has fully disclosed the nature of their interests and relationship with Luzerne County in writing. VOTERS WITH HEARING IMPAIRMENT OR DEAF MAY CALL THE TELECOMMUNICATIONS DEVICE (TDD) BY DAILING TOLL FREE: ANY QUALIFIED ELECTOR WHO IS HANDICAPPED OR ELDERLY (65 OR OLDER) AND ASSIGNED BY HIS OR HER COUNTY BOARD OF ELECTIONS TO AN INACCESSIBLE POLLING PLACE HAS THE RIGHT, UPON ADVANCE REQUEST OF THE ELECTOR, TO CAST AN ALTERNATIVE BALLOT ON OR BEFORE ELECTION DAY.
