2 3- Rhine Vessel Inspection Regulations On October 7th, 2018, the CCNR published the Rhine Vessel Inspection Regulations Revised The number of the administrative instructions available in French, German and Dutch - ( DIENSTINSTRUCTIES ) has been reduced to three: - N 16 Emissie van schadelijke gassen en luchtverontreinigende deeltjes Testprocedure, - N 19 Vervangingsmotoren, and - N 23 Indeling van het gebruiksdoel van de motor naar de typegoedkeuring en bijzondere gebruiksdoelen van de motor (gebruik van de motor) The Police Regulations (RP) have also been revised. See: 4- Inland Navigation Vessel Certificates There is only one certificate type in ESTRIN - the Inland Navigation Vessel Certificate. The model can be found in Part 1/Annex 3 of European Standard Annexes of ESTRIN (page 275). Instructions for completion of this Inland Navigation Vessel Certificates are in ESI-I-1 (page 399). According to ES-TRIN terminology an Inland Navigation Vessel Certificate is: - ED/2016/1629: a UNION CERTIFICATE for Inland Navigation Vessels (the designation is no longer Community Certificate as previously in ED/2016/87); - Rhine Vessel Inspection Regulations ( Rhine Rules ): a RHINE Vessel INSPECTION CERTIFICATE. 5- FM200 (or Heptafluoropropane or HFC-227ea) Source: document CESNI/PT(18)64 of Hereafter is a summary of the impact of Regulation (EU) 517/2014 on the use of permanently installed firefighting systems - HFC-227ea. EU Regulation 517/2014 came into force in 2015, and is applicable to inland waterway ships. The objective of this Regulation is to protect the environment by reducing emissions of fluorinated greenhouse gases. Article 2(1) of this Regulation defines the products which are considered as fluorinated greenhouse gases, and a full list of these products is given in Annex I where HFC227ea is mentioned. In Article 11 of this Regulation the placing on the market of certain products and equipment is restricted. Annex III of the Regulation gives a list of products to which these restrictions are applicable. Fire protection equipment is one of the products listed in Annex III. In Article 13.05(1) of ES-TRIN 2017/1 the requirements for permanently installed firefighting systems are given. One of the extinguishing agents listed is HFC 227ea. As the (EU) Regulation 517/2014 is applicable on inland waterway ships, the NEWS N 8 NOVEMBER 2018 INLAND NAVIGATION BUREAU VERITAS / 2

3 requirements of Article 13.05(1) seem to be contradictory with respect to the use of HFC 227ea in the future. Annex III of regulation (EU) 517/2014 prohibits PFCs and HFC-23 as extinguishing agents in fire protection equipment but does not target the HFC-227ea; HFC-227ea may therefore continue to be used in firefighting systems. Nevertheless, HFCs as a whole are subject to a scheme to reduce quantities brought to market in the EU (article 15 of the Regulation). The maximum quantity of HFCs placed on the market will be reduced by 20% between 2015 and Consequently it is probable that the availability of HFC 227ea will gradually decrease and that it will become more expensive over the next few years. In conclusion, there is no contradiction between Regulation (EU) 517/2014 and the requirements of Article 13.05(1) of the ES-TRIN with regard to the future use of HFC 227ea. 6-Emission of gaseous and particulate pollutants from internal combustion engines / diesel engines Since October 7th, 2018, two similar regulations covering the emission of gaseous and particulate pollutants have been in force - Chapter 9 of ES-TRIN and Chapter 8a (or 8bis, in the French version) of the Rhine Rules. It is good to clarify this situation. In the case of a UNION CERTIFICATE for Inland Navigation Vessels: ED/2016/1629_M1 is applicable. Thus inland navigation vessels have to be in compliance with Chapter 9 (emission of gaseous and particulate pollutants from internal combustion engines) of ES-TRIN. In the case of a RHINE Vessel INSPECTION CERTIFICATE: The "Règlement de Visite des Bateaux du Rhin (RVBR) - Version " (Rhine Rules) is applicable, so that inland vessels have to be in compliance with ES-TRIN and in particular with Chapter 9 of ES-TRIN. In the Rhine Rules there is also a specific Chapter 8bis (emission of gaseous and particulate pollutants from diesel engines). NEWS N 8 NOVEMBER 2018 INLAND NAVIGATION BUREAU VERITAS / 3

4 This doesn't mean that the inland vessel with a Rhine Vessel Inspection Certificate has to be in compliance with both Chapter 9 of ES-TRIN and Chapter 8bis of the Rhine Rules. Indeed, in Article 8bis.02 it is indicated that: If the engine complies with the requirements of Regulation (EU) 2016/1628, Chapter 8bis of the Rhine Rules does not apply. If the engine complies with the requirements of Chapter 8bis of the Rhine Rules, Chapter 9 of ES-TRIN does not apply. According to footnote 1, Chapter 8bis will remain in force until 1 January 2020, the date on which the requirements of Regulation (EU) 2016/1628 in respect of inland navigation vessels will apply. 7- Amendments to ADN 2017 The following documents contain all the proposed amendments to ADN 2017 for entry into force on 1 January 2019 (as ADN2019): ECE/ADN/45, ECE/ADN/45/Corr.1, and ECE/ADN/45/Add.1 For more details, go to: Even if ADN2019 is in force on January 1st, 2019, the substances and articles of ADN may be carried over until 30 June 2019 in accordance with the requirements of ADN applicable up to 31 December END of some ADN transitional provisions on Dec. 31, 2018 Some ADN transitional provisions end on December 31st, 2018: NEWS N 8 NOVEMBER 2018 INLAND NAVIGATION BUREAU VERITAS / 4

7 e) Transitional provisions concerning the transport of substances hazardous to the environment or to health - Transitional periods applicable to substances: By way of derogation from Part 3, Table C, the substances listed below may be transported in accordance with the requirements referred to in the table until 31 December 2018: UN 1202 UN 1223 UN 1300 UN1863. f) Transitional provisions concerning the modification of tank vessels: Modification of the cargo area of a vessel in order to achieve a Type N double-hull vessel is admissible until 31 December 2018 under specific conditions. After this date such modification will still be acceptable but without the benefit of the transitional provisions indicated in ADN: Membrane tanks The ADN Administrative Committee issued derogation N 2/2015 dated August 28th, 2015 covering the use of membrane tanks. Now a proposal to amend the ADN rules with a view to introducing membrane tanks as an allowable ADN tank type is being examined by a Working Group of the ADN Safety Committee. Bureau Veritas is member of this small Working Group, which met for the third time in October. Presently, the use of membrane tank technology is not allowed by the ADN except in the form of a derogation, but it is thought that the ADN rules could include (in the 2021 version, at the earliest) the possibility to use membrane tanks. 10- FRANCE : «Arrêté du 2 octobre 2018 relatif au classement des zones de navigation des bateaux de commerce, des bateaux de plaisance et engins flottants et aux compléments ou allégements des prescriptions techniques applicables sur certaines de ces zones de navigation» Source : On October 2, 2018, France published a Decree on the classification of navigation zones for commercial vessels, pleasure boats and floating equipment. This decree also contains the additional technical requirements applicable to vessels navigating in Zone 1 and Zone 2 as well as the reduction of the technical requirements applicable in Zone 4. This Decree has been published only in French. 8 En conséquence, la décision n 55 du sous-secrétaire d Etat de la marine marchande du 19 mars 1957 réglementant la navigation des bateaux entre la limite transversale de la mer en Seine et le port de Honfleur est abrogée. Les arrêtés ministériels suivants sont également abrogés mais restent valides jusqu'à l'échéance des autorisations de navigation délivrées avant l'entrée en vigueur de l'arrêté: - l arrêté du 15 décembre 2014 relatif à la navigation de bateaux porte-conteneurs fluviaux en mer pour la desserte de Port 2000 et des quais de Seine à Honfleur ; - l arrêté du 30 mars 2015 relatif à la navigation en mer de bateaux fluviaux à passagers pour la desserte des bassins de Saint-Nazaire du grand port maritime de Nantes - Saint-Nazaire ; - l arrêté du 28 juillet 2016 relatif à la navigation en mer de bateaux-citernes fluviaux pour la desserte de Port 2000 aux fins de l avitaillement et des services aux navires. Les deux textes de niveau préfectoral suivants, et dont les dispositions ont été intégrées à l arrêté du 2 octobre 2018, devront être abrogés selon la même logique : - décision n 766/2004 du directeur régional des affaires maritimes de Haute- Normandie qui permet la navigation des bateaux de passagers dans l estuaire de la Seine jusqu à Honfleur ; - arrêté n 25 du 2 mars 2009 portant règlementation de l'accès des bateaux fluviaux à l'intérieur des limites administratives du grand port maritime de Marseille La navigation des bateaux à l'aval de la limite transversale de la mer sera désormais encadrée par un certificat de l'union supplémentaire "zone 1", délivré par les services instructeurs de la sécurité fluviale compétents selon la zone considérée (DRIEA Ile-de- France pour l'estuaire de la Seine, DDTM de Loire Atlantique pour l'estuaire de la Loire, DDT de Haute Garonne pour la Gironde, DDT du Rhône pour le golfe de Fos sur Mer). L'arrêté reprend les dispositions de l'arrêté de 2010 concernant la navigation sur les zones 2, 3, 4 et R, tout en renvoyant vers les règles techniques établies par le standard ES-TRIN, et non plus vers l'arrêté du 30 décembre 2008, qui va très prochainement être abrogé.
