(can we have Susie as concerned neighbor front the story?) I think we can can get a demo together (say by Thursday?) which could get into the weekend papers. I will ask Dailan * (& Susie) about the risk of alarming the owner such that we may not be able to get in next Sunday, as he advises we "survey " the property, but will have to leave if told to avoid arrest for trespass. (see * below) Thanks to all who have responded. I don't know exactly what PNF Code may be in place for this property (Limpinwood off Boorman s Rd)., but I trust Susie and Katie to follow up all the legals. Need we contact EDO? Some of the fauna you can sensus remotely by broadcasting their calls at night, such as Marbled Frogmouth and owls, which require modified logging or exclusions. S...Katie said there is an extreme emergency next to Susie Hearder s place - John Fish has started wholesale logging massive trees and koalas are fleeing in all directions, even onto her property where they have never been seen and where (I think) there are no koala trees. Koalas also fleeing north and east. Katie mentioned that she asked Sledge if NRG could help but he said you were busy with water mining. She agreed with me that while water mining is still in the DA phase this was more critically urgent and needing of direct action. Council was horrified and pushing state government to prosecute. Even Thomas George was shocked. Katie is pushing for George to buy the land back (1,000 acres of which he is allowed to log 100%). I wish they would damn well hurry up and do that! Susie asked council in a presentation years ago to buy it when it was only $1.2 but they said no. I asked her to keep us informed in case NRG decides to get informed. I think CEC will get involved somewhat but they are not really an activist group, like we are with demos etc, lol. What do you lot think? Menkit

2 Since it s on private property we can t blockade where the logging is taking place. Just spoke to Susie and she says the logging trucks are already coming 3 times a day (and also mining trucks can you believe? what the.???). She has an injured koala on the property right now. The koala has raw bloodied skin and dishevelled fur, possibly from falling out of a tree that was being felled. She called FOK and I urged her to call TVWC urgently. So this is what I propose:1. Get a large contingent of people together on a week day to demonstrate where the logging trucks meet Limpinwood road (on Boorman s Rd). 2. Take photos of our group and get a story together for the media. 3. Get NBN TV from Lismore to come up, video our group, interview Susie etc. (Not sure if the other neighbours are willing to be interviewed or not) 4. Once we have big media exposure we can get the guy who has a drone to come out and get better footage of what is going on. 5. Write letters to the editor. There is something gravely wrong with any developers being able to get Private Native Forestry Agreements (PNFA) that allow them to deforest 100% of their property with no ecological assessment and no oversight whatsoever. Especially when the state govt is the only compliance body and they are very slow to act if at all (LNP esp). This means developers get away with it every time. I remember some years ago when Katie raised a motion in council for there to be a review of PNFAs with more conditions put in place and guess who nixxed that one? Barry Longland. Thanks a lot, Baz. Call (02) and ask them what is going on and express concern. Media attention would be a help. Both Susie and Katie said they contacted the EPA but they are hopeless. Said they would come next week to check the roads but that seemed to be the extent of their concern. When there was massive erosion and pollution of the creek a year or so ago the EPA did nothing then either. Yes, media is what we need. Direct community action would particularly get their attention on this issue I think. The first question is is it being done under a Property Vegetation Plan and the Private Native Forestry Code, or is it a form of clearing under an exemption or the new clearing rules. If its PNF you contact the EPA, if its clearing you contact LLS. Ifs its not approved or outside the rules you can get the agencies to stop it quickly - if it is allowed they will do nothing. They said that the Private Native Forestry Agreements are given out without any DA's. He said there is NEVER any assessment process. If there is Old Growth Forest they can get that reviewed. If there is environmental protection zones they can get council's permission to log them. And there is no pre logging visit. He said re koalas you need high scat counts to stop logging. But of course nobody is looking. He also has Glossy Black Cockatoos and lots of Casuarinas. When I asked re this he said Fish was told not to log trees with chewed cones around them as they are protected trees. God knows who is protecting them. Fish has spent the past 4 yrs flouting the lousy laws that do exist. And it is impossible to see or do any surveys without trespassing. I have heard koalas since the logging trucks started 2 weeks ago. But today is the first time in 25 yrs that I have seen one on my property. He is high up in a tree and what I thought was a red gash turned out to be a red ear tag. I have had a FOK carer look at him and she suggested to monitor him. He has marks on his neck but very hard to see and carer said they could be from another male too. That is the other concern that they are logging in breeding season. The EPA told me they were coming up from Grafton this week to inspect the roads he has recently built. They seemed more concerned about the roads than koalas but did say they would look out for Tallowood trees as this is their primary food tree here. For your info I have over 200 acres here and 13 endangered species that I know of ( protected with a covenant with NCT) And definitely do have koala food trees. But he is logging most of the 800 acres he has left and is bound to have many more threatened species. I tried for 2 yrs to get anyone to survey next dr but nobody was interested.

4 I am concerned that I am seen as the continually complaining neighbour that goes to the papers.. And so far have not been taken seriously (except for Katie and Gary on council) The logging trucks are also a huge concern for the safety of ratepayers. Double B logging trucks are going down Boormans Rd where in many places it is not safe to pull over and there are blind spots. And they are travelling via the dangerous bends in Numinbah Rd just out of Chillingham. One section has a slip from the flood that hasn't been fixed. A disaster waiting to happen in my opinion. If you are going to do a call playback survey for owls etc. then you need an adjacent site (or sites) on a property or a public road where you will get good coverage of the subject property. If the road through the property is a public road that would make it easy, and you could also do a spotlight survey. Otherwise you need permission from the owner of the property where you are surveying from, and preferably easy access. Now that I know where the property is (I have sent some maps to Susie), the north east of the property has rainforest/brush Box in the gullies so is likely to have Marbled Frogmouths, it also has moderate topography and large areas mapped as Tallowwood so is likely to be a core area for Koalas. If you could get access to the boundary of the property from the adjoining property holders in that area it would be a plus for call surveys. Where the property extends down to the Oxley River would also be a high priority and has good access (?). Though you can also get access to some areas from the back of Susie's property. Maps Below The property is at the end of Boormans Rd, Limpinwood and is owned by Hewitville Pty.Ltd. The 1000 acre property is the large property in green in first map DP He has sold 3 blocks to the west - Lots 127,128 &129. The Private Native Forestry Agreement covers almost all of Lots 136 &138. There are large sections zoned Environmental Protection in the southern parts. 2nd map shows native veg with mostly disturbed old growth and rainforest. 3rd map shows corridors and key habitat. My property is in black. Hewitville property is to the east of mine. 4th map shows Environmental Protection Zones.

8 Attached is a map of the property showing zoning. Under Tweed LEP 2014 parts of the property corresponding to the Environmental Protection zones in LEP 2000 are "Deferred Matters", meaning the LEP 2000 requirements still apply. The Tweed LEP 2000 shows a significant part of the property to be Zoned 7(d) and part to be zoned 7(l). Under LEP 2000 in both Zones 7 (d) Environmental Protection (Scenic/Escarpment) and 7(l) Environmental Protection (Habitat) forestry is only allowed with consent and must satisfy the provisions of clause 8 (2) (which are a bit strange). The issue is that if he is logging the Environmental Protection zones he needs consent from Tweed Council. If he is logging those areas and doesn't have consent then Council should stop him. Someone needs to follow up with Council. Unfortunately the interesting forest to the north-east is not zoned for protection. PS I think Jimmy Malecki has a drone.
