1 DONNER LAKE PROPERTY OWNERS ASSOCIATION March President s Column By Gardner Combs February is drawing to a close and a False Spring is in full blown course. We will have to hope for another Miracle March to generate the normal water supply. But while we lean on the snow shovel waiting for the next storm thoughts of the real spring and coming summer bring to mind the upcoming Beach Clean-Up. Once again gather up your shovels, rakes, wheelbarrows and gloves and join us in making the Beach ready for the upcoming summer. Each year the members make this task seem easy and just a morning s work. At the conclusion of the Beach Clean-Up, and when the Beach Manager determines the work complete, he will declare the facility open and ready for the summer. After this determination members can bring their watercraft and boats for summer storage. Please respect this procedure and wait for the formal opening. This brings me to my annual appeal to the membership: Please consider the opportunity to participate in the governance of the DLPOA. We are an all volunteer organization that depends on the participation of the members. We are fortunate to have had a very small group of members who have taken up the responsibility of participation and run for the Board of Directors and Executive positions but we should not continue to rely on such a small number. So join in and become a active member. The Board has a published information and cited resources for Bear Boxes in some of the past issues of the newsletter. I would encourage any of the members who rent or are not in residence on mondays to consider installing a Bear Box. I know that many have and it certainly has helped the situation but we still have unsecured garbage containers being left out prior to the pick up day. We don t want to encourage the bears to forage in our area. As the other developments continue to require and enforce the use of the boxes the bears travel to the areas with opportunities for food. In your renewal package there were two additional appeals for the fireworks show and the Truckee Donner Land Trust. Please consider these as both represent different but worthy causes. I know the fireworks show is always memorable because of the participation of many of our members and the Town s sponsorship. The Land Trust continues it great work in preserving the open space all around us. Their acquisition of the Royal Gorge property this last fall is one of the crowning achievements of open space preservation. In closing I look forward to seeing all of you on the Beach for another great summer! Bear Boxes, Redux The previous newsletter provided particulars on the availability and reasons for installing a Bear Proof Garbage Box at your Donner Lake cabin or house. 2 Donner Lake Property Owners Association BOARD OF DIRECTORS MEETING October 27, 2012 Minutes A regularly scheduled meeting of the Board of Directors of the Donner Lake Property Owners Association (DLPOA) was held on Saturday, October 27, 2012, at the Cedar House Sport Hotel, Brockway Road, in Truckee, California. Call to Order / Introductions President Gardner Combs called the meeting to order at 1:02 PM. Board members present were President Gardner Combs, Vice-President Scott Denny, Sue Adkerson, Barbara (Barb) Lewis, Ed Meyer, Greg Henderson, Robert Farnsworth, Juanita Schneider, Bill Faustine, Dick Anderson, Chet Eccles, and Art Scotland. A quorum was established. Board members absent were Sandy Gustafson- Ripsteen, Barry Silberman, and Dorothy Dube Others present were Chief of Operations Raymond Hapai, Sharon Hapai, and Recording Secretary Judy Friedman. Approval of minutes of August 31, 2012 Board meeting It was moved by Ed and seconded by Juanita to approve the August 31, 2012 Board meeting minutes as presented. Motion carried unanimously. Secretary - Treasurer s Report Ray Hapai Chief of Operation s Report Ray Hapai Ray reported the Association will end the year with a surplus of just over $23,000. He reviewed the balances in the accounts and clarified specific line items. Ray s Chief of Operations Report included information on member renewals, as well as guest and renter card sales. Overall the additional income from renewals offset the lower sales of renter cards. The year ended with 54 openings. Certified letters were sent to 31 previous members who had not paid fees for this year. Of those, 9 renewed, 13 did not, and there was no response from the rest. In response to a question about why the 13 gave up their membership, Sharon said there was a general feeling among those members that they did not like the changes being made and it is not a happy beach anymore. Some may have been unhappy with the new entry system, which could make it more difficult for every family member to get on the beach unless each one is registered. Beach Manager Report Jim Saunders Gardner distributed Jim s report, which was reviewed by the Board. Brief discussion followed regarding Beach Clean Up day in the spring, which is an opportunity for members to volunteer; there was also discussion as to whether or not the entry system can tell who is at the beach when, for example, guests of members want to check in. (The answer to that is because we do not require members to swipe their cards when they leave the beach, we only know when they came in and not whether they are still there.) Beach Committee Report Greg Henderson Greg reported on this summer s improvements, including new picnic tables, umbrella stands, and 3 additional kayak racks. He is building a paddleboard rack for next summer. Greg is trying to figure out a solution to reserve lower kayak slots for those who cannot reach the higher ones. Greg noted some of his plans for next summer, including improved landscaping at the entrance. Membership Committee Report Barbara Lewis Barbara reported there was one person who inappropriately used a guest card for renters, in violation of the rules.. Discussion followed and it was agreed that Gardner would send the member a letter. Barbara said she has heard there are many people who like the new card system because everyone is playing on a level field. Old Business 1. Beach Tracks- update Sue Adkerson & Barbara Lewis 2

3 BOARD OF DIRECTORS MEETING - October 27, continued from page 2 Sue reported she and Chuck Perez received 4 quotes to reprint the member directory. Sue recommended a quote from FedEx for $1, for 1000 pieces. The directory would be 8 ½ x 11, velo-bound instead of the current spiral bound, and not have dividers. Discussion followed regarding what the finished piece would look like, the bids received, and how it would be distributed. It was suggested that Sue get copies of the proposed directory for each Board member and a decision will then be made. Later in the meeting, Sue noted the FedEx quote is valid for only 40 days. 2. Secretary/Treasurer position Barbara Lewis The Board discussed the duties of the Secretary/ Treasurer of the Board position, noting that many of the tasks are done by Judy Friedman and Ray and Sharon Hapai. Ray said that many of the duties the previous treasurer had done are now his responsibility, including reviewing payables to make sure they are being allocated properly and matching receipts. Ray said it is difficult for him to know if credit card expenditures are legitimate and said weekly reporting of beach receipts is currently not being done. Discussion continued regarding how expenses are paid, noting those requesting reimbursement should submit an expense report. It was agreed that a treasurer needs to be appointed who is fairly local and can work with Ray and Sharon. 3. DLPOA Bear policy support to Town of Truckee Greg Henderson Greg reported the Town of Truckee is considering a mandatory bear box policy. He suggested a letter be sent from the DLPOA Board acknowledging the problem and supporting the initiative. Discussion followed regarding the pros and cons of the proposed ordinance, given the possible expense of the bear box. Art voiced concern about the Board taking a position at this time without knowing the language of the policy proposal and without considering the financial consequences for members. For example, he pointed out that some members take their garbage home with them and thus should not be required to install an expensive bear box. Discussion continued as the Board considered whether to support the concept but request more information. It was moved by Greg and seconded by Robert to send notification to the Town of Truckee City Council prior to their next meeting thanking them for taking up the bear box issue, encouraging them to develop a policy regarding using bear boxes for trash, and asking that DLPOA be kept informed as to any proposed policy so the members can be notified. AYES: Greg, Bill, and Robert NOES: Sue, Juanita, Ed, Chet, Art, and Dick ABSTENTION: Barbara and Scott Motion failed. Art suggested that before this issue could be supported, more information is needed. The Association has one asset, the beach; the Board should not voice an opinion on behalf of the membership regarding other matters without knowing how the membership feels; and specific information about the bear box proposal should have been submitted to Board members prior to the meeting in order to make an informed decision. Greg noted the Board has taken a stance on local issues other than the beach, for example, the Truckee Land Trust. Gardner reported the Town has instituted mandatory boat inspections for aquatic invasive species, similar to what is being done on Lake Tahoe. Annual stickers will be issued for boats passing inspection. New Business 1. Wooden beach signs Robert Farnsworth Robert reported on the effort to have nicer signs on the beach, suggesting permanent signs that can 3

He asked for the authority to work with Greg to select a design for a wooden sign that would have most of the rules on one sign. Art asked that a written proposal be submitted to the Board before an informed decision can be made. Discussion followed regarding Robert s request to investigate options for a wooden sign, the reason metal signs are being used now, and how to best educate people of beach rules. There was consensus that Robert will investigate the options available, make a presentation to the Board, and then the Board will consider action. 2. Vetting candidate statements Barbara Lewis Barbara suggested candidate statements be vetted to make sure they are accurate. A brief discussion followed on how the statements would be checked. No motion was made, and no action was taken by the Board on this suggestion. 2a. Beach Security (Agenda addition) Juanita presented a proposal for $4,110 to purchase a system that can include up to 5 security cameras to video-monitor and record actions at the beach after hours and during the off-season. Art stated that no action should be taken on the proposal because it was added to the agenda today without advance notice and information being provided to Board members. Gardner pointed out the board has very few meetings each year and there have been varying opinions as to how to conduct business between meetings. The next Board meeting is in the spring, which may not allow enough time for this item if the Board considers it favorably. Discussion followed regarding Juanita s proposal. Greg suggested getting more information from Miah, who installed the new gate system, since he is working on a similar video-monitoring program for Tahoe Donner. It would be worth waiting on this item until Miah has done more investigation of systems and can help DLPOA make an informed decision. Juanita agreed Budget Scott Denny Scott presented the proposed budget explaining how he came up with the projections on specific line items based on past history. According to the Bylaws, the Board can increase the initiation fee by $100, so Scott proposed $2,600 for this budget. Barbara agreed with the fee, suggesting the processing fees should be increased to $275. She explained the work involved and suggested the applicant should be asked to do more of the investigation work or pay a higher fee. Discussion followed. Gardner suggested the applicant be sent a packet to be completed, have notarized, and sent back, which could minimize the processing fee. Discussion continued. Gardner explained that initiation fees are used for capital projects. The Beach Committee will be submitting projects that could cost $50,000 - $100,000 and rather than use reserves or surplus, those items should be paid by initiation fees. Robert added that initiation fees help keep member yearly dues reasonable. Discussion continued. It was moved by Barbara and seconded by Sue to increase the processing/research fee to $275. Motion carried unanimously. It was moved by Sue and seconded by Juanita to increase the initiation fee from $2500 to $2600. Motion carried with Art voting no. Scott continued to review the proposed budget, including the recommendation to increase the guest card fee to $200. Discussion followed on how to simplify the guest and renter card system and the fees charged. Bill suggested having just one nonmember card, which would make the whole process simpler and maybe less expensive for families who rent. Art said he ran for the Board because he feels restrictions to beach access are unnecessary and raising the guest card fees gets expensive, which restricts the benefits of membership. He would support a single guest/renter card for $150. Discussion continued on the current process and the pros and cons of the proposed fee. 4

5 BOARD OF DIRECTORS MEETING - October 27, continued from page 4 It was moved by Bill and seconded by Chet to combine the member/renter card and charge $150. AYES: Scott, Sue, Ed, Bill, Art, Chet, and Dick NOES: Juanita, Barbara, Greg, and Robert Motion carried. The Board considered the daily fee, which, since the member/renter card has been combined, would apply only to a non-member not accompanied by a member. There was clarification on the revenue from the current fees, noting it is difficult to ascertain the daily unaccompanied numbers. It was moved by Barbara and seconded by Juanita to charge $8 per day for unaccompanied non-members for those 5 years old and over. AYES: Scott, Sue, Ed, Bill, Chet, Dick, Juanita, Barbara, and Greg NOES: Robert and Art Motion carried. It was moved by Greg and seconded by Juanita that all additional fees remain the same. Motion carried unanimously. Gardner asked if there are any projects coming up that might impact the budget. Scott reviewed the information from the Beach Committee and added $5000 to the proposed budget for unspecified items. Executive Session was convened at 3:10 PM : Executive Session was concluded at 3:20 PM Remarks and Criticisms Greg will follow up on the Town s bear box proposal and information to the Board during the winter so a decision can be made on whether or not to comment. Robert suggested including an article in the newsletter and on the website about bear boxes with recommended vendors so members can do research on the issue if they choose. Board discussion about renters not obeying the rules. The new entry system at the kiosk could help address that issue but the option has been eliminated since it will now not be possible to distinguish renters from other users. Bill asked for more information on the boat inspections and associated fees. Gardner said the fees are based on the size of the boat and the proposal is on the Town of Truckee website. The Invasive Species Committee is proposing to be at the DLPOA boat launch at the beginning of the season and make periodic inspections at that location. There is a budget for a Certified Inspector at the DLPOA launch. Barbara received a phone message from Rich Martell voicing concern about a house being built next to the trail. He had a question about whether or not they are encroaching on the trail, but Barbara has not called him back. Call to Order President Gardner Combs called the meeting to order at 11:05 A.M. Board members present: President Gardner Combs, Vice-President Scott Denny, Barry Silberman, Barbara (Barb) Lewis, Greg Henderson, Robert Farnsworth, Juanita Schneider, Bill Faustine, Dick Anderson, and Chet Eccles. Others present: Chief of Operations Raymond Hapai, Beach Manager Jim Saunders, Recording Secretary Ginger Charlton and approximately 60 members. Approval of Minutes of June 30 General Membership Meeting Motioned/Seconded/Passed to approve the minutes of the June 30, 2012 General Membership Guest speaker: Exec. Director (and founder) of the Bear League: Ann Bryant Ann Bryant introduced herself and complimented the group on their beautiful property. She said that garbage, dog food, and bird food will all attract bears and urged property owners to make sure that they don t leave any of these items where the bears can get them. She added that bear-proof containers are the best way to go and recommended that property owners buy them, especially if they use their home as a rental. Treasurer s Report Ray Hapai Ray reported that the Association is in great shape, staying within budget, and will end the year with a comfortable balance. 32 members have not renewed their membership so far. There are 735 active memberships and 36 openings for membership available. Donner Lake Property Owners Association GENERAL MEMBERSHIP MEETING September 1, 2012 Preliminary Minutes The following Proposed Minutes will be brought to the membership for approval at the next Membership Meeting. 6 Chief of Operations Report Ray Hapai Ray reported the newsletter went out in August. It is full of useful information, the latest Board meeting minutes, contact information, and the winners of the DLPOA sand contest. Gardner thanked Ray and Sharon for all of the work they do behind the scenes. Beach Manager Report Jim Saunders Jim thanked everyone for a good summer. He reported 1000 new membership cards were made this year bringing the total to 4,100 since the new system was started. He reported water is being released from the lake beginning today so members need to make sure they get everything out of the cove soon. He added that staffing is limited and asked members for their help in saying something to people who they see doing things that they shouldn t be doing. Gardner thanked Jim for everything he does and said that the beach has never looked better. Committee Reports 1. Beach Committee Greg Henderson Greg reported three new picnic tables were purchased and have been installed this year. He said they will last forever but they can t be drilled so there are no holes for umbrellas in them. To solve the problem, umbrella stands were made that bolt to the side of each metal table. Three new kayak racks have been installed. Greg reported that for two weeks there has been an issue with vandalism. All the 5 MPH buoys disappeared so a diver was hired, who found seven of them about 40 yards out. They were able to recover four. He said without the buoys, skiers were coming in right next to the swim area and endangering swimmers and kayakers. Greg added that staff would try to design an anchoring system that will be harder to vandalize.

Membership Committee Barbara Lewis Gardner explained all new membership paperwork goes through Barbara and she has to deal with many problems caused by folks who don t read the bylaws. He led the audience in a round of applause for her. Barbara said she s discouraged because the people who need to read the articles in the newsletter are the ones who don t. She explained that there are many properties owned by trusts but that memberships cannot be owned by trusts. At least one living human being needs to own the membership and they need to own at least 20% of the property. She said specifics are found in the bylaws and newsletters and urged members to read them. New Business Gardner reported that he and Scott Denny didn t coordinate on whom was buying the food and beer for the 4th of July picnic and they bought too much. Therefore, there will be no charge for members today for the leftover hotdogs, hamburgers, and beer. Open Mike: Questions and comments from the membership An owner asked if the rate increase for the renter cards worked. Gardner gave the history on why renter cards were created and noted the fees are the same as Tahoe Donner. He said he doesn t think the guests cards are working as well as they should because some people have given guest cards to their renters. A committee has been formed from the Board to work on the various cards and fees and they are just beginning to look at this issue. Gardner said that he thinks a single card will be the resolution but it s still open. An owner who has a cabin on Cedar said they had problems in July with amplified sound coming from the public beach and asked if it caused a problem on this beach. Gardner said the Association has no control over what the public beach allows and although staff has tried to have them turn it down, 7 it doesn t work. The owner suggested if the Board wrote a letter to Parks and Recreation, they would listen. Gardner said if the problem continues, they would do that. The daughter of an owner said her 80-year old mother and her friend are having problems with the kayak racks. They need lower racks because they can t lift their kayaks up but the lower racks are always taken when they return from kayaking. Gardner said he is aware of the problem but doesn t know what can be done since the racks are open to all. Another member suggested numbering each space and members could claim a space that would be theirs for the season. Gardner said the Board tries to not get involved in disputes and if they start marking spots, staff will have to be policemen. He will discuss the issue with staff to try to find a solution. An owner asked if it was possible to get the compressor back. Gardner said the Association does have double action hand pumps available but the compressor is an issue because people don t respect it. People play with it and two have been blown up. A member publicly thanked Jim for the sand castle contest and having everything ready at 7. Date, time and location of next General Membership meeting: An audience member noted that the date listed for the next meeting appears to be incorrect. The corrected date for the next meeting was changed to Saturday, June 29, 2013 at 10:00 A.M. on the beach, west end of Donner Lake. The correction will be posted. 8 Watercraft Inspection Protect Donner Lake from Invasive Species Posted Date: 1/22/2013 January 22, 2013 For more information, contact: Dan Olsen, WATERCRAFT INSPECTIONS PROTECT DONNER LAKE FROM INVASIVE SPECIES Surface waters within the Town of Truckee will receive additional protection from aquatic invasive species introduction as a result of Town Ordinance This new ordinance requires that motorized and/ or trailered watercraft be inspected prior to launching in Donner Lake, as well as other water bodies within town limits. Non-motorized watercraft will be subject to inspection if identified as high risk for transport of aquatic invasive species into Truckee waters. If established in local waters, aquatic invasive species, such as Quagga Mussels and Eurasian Water Milfoil, could degrade aquatic ecosystems, inhibit recreation, damage infrastructure and equipment and cause depreciation in property values. The health of local waters is extremely important to the character, natural beauty and economic vitality of the Town of Truckee, said Dan Olsen, Animal Services/Code Compliance Manager. We believe that boaters, anglers and others who recreate on Truckee waters will embrace this effort to protect this precious natural resource. Development of Truckee s Watercraft Inspection Program is underway and will continue through early Leading the effort is a Steering Committee made up of representatives from the Town of Truckee, Truckee Donner Recreation & Park District, Truckee River Watershed Council and Tahoe Resource Conservation District. Additional input and guidance is provided by local stakeholders who serve on a Working Group. Together, the Steering Committee and Working Group aim to launch the program in May Prop with mussels Preventing invasive species introduction is crucial to preserving recreational opportunities on Donner Lake, said Dan O Gorman Recreation Superintendent for Truckee Donner Recreation and Park District. District staff provided voluntary watercraft inspections at Donner Lake in 2012 and look forward to conducting inspections again in Inspections for Donner Lake will be conducted by Truckee Donner Recreation and Park District staff at the public launch ramp on Donner Lake. Additional off-ramp locations will be announced as appropriate to accommodate increased boating activity. An inspection fee schedule is currently under development by the Town and will likely include a range of annual or monthly rates. 10 Beach Committee Chair Report: By Greg Henderson Last season I promised to look into two separate watercraft storage issues for the 2013 season. One, make it easier for physically challenged members to store their kayaks and two, figure out a way to store paddle boards. Starting this season, the lowest racks on all 10 kayak storage racks will be reserved for physically challenged members. There will be a total of 20 spots available. To participate you must first have paid for kayak storage. When you check in at the kiosk, to pick up your prepaid storage sticker, you can explain your need to staff. Staff will then install the new, blue, Lower Rack Priority sticker to your watercraft. All lower racks will display the new stickers to help designate the priority. LRP lower rack priority 13 This program can only work with the understanding and cooperation of those able bodied members who will kindly store their units on the upper racks. Paddle board storage units are very expensive. To date we have not received enough interest to warrant the purchase of one storage unit; if and when we get enough such interest, we will likely need to charge a higher storage rate for paddle boards as the units are three times more expensive than the other racks. Want to be a Member of the Board of Directors or an Officer of DLPOA? For those of you interested in running for the Board of Directors or for one of the three officer positions in DLPOA, you will need to let us know of your intention to do so by May 1 if you want to appear on the ballot. If you wish to have a candidate statement included with the Election package that is sent with the ballots to each Member, you will need to send that to us by May 1 as well. Please note that only Members may run for these elections; individuals in the immediate family of Members are not eligible. You can send in your notice to run and your candidate statement to manager@dlpoa.org. Officers (President, Vice President, Secretary/ Treasurer) serve one year terms, thus each is open for election. The remaining Board Members serve two-year terms and are staggered for election. This year there are 7 (seven) openings.
