Trustee Wolf seconded the motion. Voting yes: Trustees Swanson, Ducommun, Krueger, Wolf, McKenna, and President Bielinski. Voting no: none. The motion carried. 4.2 Recognition of George Pearce for his service on the Board of Fire and Police Commissioners. President Bielinski thanked Mr. Pearce for his service and summarized his accomplishments while on the Board of Fire and Police Commissioners. He also noted that Mr. Pearce previously served on the Zoning Board of Appeals and was a Village Trustee for 8 years, volunteering for the Village for over 21 years. President Bielinski thanked Mr. Pearce for his dedication to the Village and presented him with a certificate of appreciation. Mr. Pearce thanked the members of the Fire Department for attending the meeting. He said he was very proud and excited to be a part of the process that promoted a woman to sergeant in the Police Department. He said it is easy to volunteer and work with the Village of Wilmette. 4.3 Announcement of cancellation of the August 12, 2014 Regular Village Board meeting. President Bielinski announced the cancellation of the August 12, 2014 Regular Village Board meeting. 3

10 President Bielinski noted that Ordinance #2014-O-31 was adopted this evening which amends the parking meter regulations in the Metra lot from parking for free after 6pm to parking for free after 4pm thus making it easier to find parking in the Village Center during the early dinner hour. 11 6.16 Zoning Board of Appeals Report, Case #2014-Z-21, 1935 Thornwood Avenue regarding a request for a 7.83 side yard air conditioner setback variation to permit the replacement and relocation of two air conditioning condensers in accordance with the plans submitted; adoption of Ordinance #2014-O-34. Ordinance #2014-O-34 was adopted with the Consent Agenda authorizing the variation of this case Zoning Board of Appeals Report, Case #2014-Z-23, 3900 Fairway Drive regarding a request for a 45 and 31 accessory structure height variation to allow the replacement and expansion of a driving range safety netting at the Wilmette Golf Club in accordance with the plans submitted; adoption of Ordinance #2014-O-35. Ordinance #2014-O-35 was adopted with the Consent Agenda authorizing the variation of this case Motion to reconsider adoption of Ordinance #2014-O-29 approving a special use amendment to the existing building at 2801 Old Glenview Road. Trustee Swanson made a motion to reconsider adoption of Ordinance #2014-O-29 approving a special use amendment to the existing building at 2801 Old Glenview Road, seconded by Trustee Ducommun. Trustee Swanson said at the time Mather Place presented their plans to expand the building at 2801 Old Glenview Road, Trustee Wolf recused herself from the case as her husband is a partner in the architectural firm that the applicants are contracted with. On May 27, 2014, the ordinance approving the request was inadvertently placed on the Consent Agenda. As such, Trustee Wolf did not have the opportunity to recuse herself from adoption of the ordinance. Accordingly, it is recommended that the Village Board vote to reconsider adoption of Ordinance #2014-O-29 thereby providing Trustee Wolf with an opportunity to recuse herself from the matter. 5

12 Trustee Wolf recused herself from items 6.18 and 6.19 and left the meeting at this time. Voting yes on the motion to reconsider: Trustees Swanson, Ducommun, Krueger, McKenna and President Bielinski. Voting no: none. The motion carried Motion to adopt Ordinance #2014-O-36 approving a request for a special use amendment to expand an existing special use (housing for the elderly), along with the following modifications and waivers to zoning regulations: a 0.53 floor area ratio increase, a 1 height increase, a onehalf story height increase, a 20.0 rear yard setback reduction, and an 11 space parking reduction to permit the construction of a three-story addition (four floors above adjacent ground) to the existing building at 2801 Old Glenview Road in accordance with the plans submitted. The use shall run with the use. Voting yes: Trustees Swanson, Ducommun, Krueger, McKenna and President Bielinski. Voting no: none. The motion carried. Trustee Wolf returned to the meeting. 6

17 Approved 6/2/2014 III. CONSENT AGENDA Ms. Woleben-Meade moved to approve the consent agenda for Cases 2014-AR-15, 1141 Central Avenue, Valley Lodge Tavern, Awning Sign. The motion was seconded by Mr. Phillips. Voting yes: Chairman Sheridan and Commissioners Collyer, Elkins, Miller, Phillips, Woleben-Meade. Voting no: none. The motion carried. IV. CASES 2014-AR-08 Chalet 3132 Lake Avenue Appearance Review Certificate Mr. Sivertsen called Case 2014-AR-08 for an Appearance Review Certificate request to replace parking lot lighting. Ms. Thalmann said they would like approval to replace the existing metal halide light fixtures with LED fixtures. Ms. Woleben-Meade asked the height of the exiting poles. Ms. Thalmann said they were 22 feet in height, so the new poles would be shorter. Mr. Elkins asked if the new fixtures would have a bronze finish. Ms. Thalmann said they would be bronze. Mr. Phillips moved to approved Case 2014-AR-08, 3132 Lake Avenue, Chalet, as submitted. The motion was seconded by Ms. Woleben-Meade. Voting yes: Chairman Sheridan and Commissioners Collyer, Elkins, Miller, Phillips, Woleben-Meade. Voting no: none. The motion carried AR-09 Westerfield Square Townhomes Westerfield Place Appearance Review Certificate Mr. Sivertsen called Case 2014-AR-09 for an Appearance Review Certificate request to install paving, landscaping, and site lighting. Chairman Sheridan said the President of the Homeowners Association, Tom Nathan, submitted a letter of support in his absence for the landscaping proposal. Ms. Woleben-Meade said the additional requested items of information had been provided in the packet and that the plant selections looked great. Chairman Sheridan asked if there was anyone in attendance that wished to speak. 2

Mr. Elkins said he has seen this used before and wasn t concerned with its application. Mr. Phillips said because there was so much film proposed the storefront would look like a darkened store that was vacant. Mr. Phillips asked for the floor plan of the space. Mr. Fiorito provided a copy of the floor plan that showed where the store fixtures would be located. Mr. Phillips asked if the tenant ever considered a display area instead of screening the window. Mr. Fiorito said he thought they were trying to maximize the interior floor area because the size of this store was much smaller than their typical store. Mr. Phillips said he would like to see something similar to the display area shown on the north side of the storefront. The Commission agreed the area should be used as a display area rather than a screen. Mr. Fiorito said he would like to take the commission s comments back to The Sports Authority and allow them to respond. The Village Board will hear this case on June 10, The applicant said that they are replacing an old condenser that sits 6 from the lot line. They chose an alternate location that is more pleasing to the neighbors. They picked quiet condensers and spoke with the neighbors about their plan. They will build a green wall in between that sits opposite the neighbor s condensers. It is the only practical location for the condensers and is an improvement over the current location because it is away from the lot line and is opposite from the neighbor s condenser rather than in front of the neighbor s front door Ms. Norman asked if they planned to replace one condenser with two condensers. The applicant said they are replacing one large condenser with two smaller condensers and the neighbors are aware of this change There were no additional questions for the applicant, there was no one in the audience to speak on this case and there was no communication on this case. 5.0 VIEWS EXPRESSED BY MEMBERS OF THE ZONING BOARD OF APPEALS 5.1 Mr. Duffy said that this is a straightforward request. The condensers are moved away from windows to the rear of the home where there are no windows. It is directly opposite of the neighbor s condensers. The old condenser is being moved away from the front door of the neighbors so the situation will be better for the neighbor. All standards of review are met. 24 2014-Z Fairway Drive May 21, TESTIMONY, COMMENTS AND ARGUMENTS ON BEHALF OF THE APPLICANT 3.1 Persons appearing for the applicant 3.11 Mr. Steve Wilson, applicant Executive Director, Wilmette Park District 3.2 Summary of presentations 3.21 Ms. Roberts said that this is a request for a 45 and a 31 accessory structure height variation to allow the replacement and expansion of a driving range safety netting at the Wilmette Golf Club. The Village Board will hear this request on June 10, The applicant said that the request is straight forward. They currently have netting on the east side of the driving range. It is 40 tall and there is only a fence on the east side of the range. As golf technology has advanced, golfers are hitting the ball to the left more and are carrying the ball higher and farther than they did a long time ago. They see more balls clearing the netting on the east. Balls clear the net on the west going onto the first fairway where golfers are. Golfers have been hit with balls. The entire project is driven 100% by patron safety. Because of the zoning code, the heights of the proposed netting will require a variation, which is what they are requesting. Most of the parks and facilities including this one are located in residential zoned areas. This property is unique for a residential area. This also necessitates their request. Regarding the presumption portion of the ordinance, this allows another unit of government to hold a public hearing. Prior to coming in front of the Board, they had that meeting at the golf course. They noticed that meeting to people who live within 250 of the property for that meeting and for tonight s meeting. Two individuals came to the public hearing and were part of the discussion. They had questions that were answered. Neighbors left happy with responses given at that hearing Chairman Sullivan asked if the proposal had any impact on neighbors. Mr. Wilson is a neighbor of the golf course and spoke with neighbors who live closest to the course and driving range. None of them came to the hearing or have concerns. They are also golfers Mr. Boyer asked if the proposal was to replace all netting. Mr. Wilson said that east side netting would be replaced and made higher and that netting would be added on the west side where there is no netting currently. 1

25 2014-Z Fairway Drive May 21, 2014 (After 4.21) 3.25 Mr. Wilson said that his staff has gone to various golf conventions nationwide and they knew that they had to address the proposed project. They spoke with several national net providers who recommended a minimum height of 50. They are at 45 because of their experience in observing and they believe that 45 will improve safety and minimize the visual impact Ms. Norman asked if the netting was above the tree line. Mr. Wilson said it was above the tree line Mr. Surman asked about the color of the netting. Mr. Wilson said that it is dark and becomes transparent Chairman Sullivan asked if the netting was up year round or is it taken down when the range is closed. Mr. Wilson said that the proposed netting would stay up all year round No additional communication was received on this case. 4.0 INTERESTED PARTIES 4.1 Persons speaking on the application 4.11 Mr. Philip Fogelson 4077 Fairway Drive 4.2 Summary of presentations 4.21 Mr. Olson said that he went to the other hearing and understands the safety concerns. His concern has to do with visibility from site lines. He was not sure if studies were done, how high the netting has to be and asked about visibility from properties. It will be a lot higher and he said that the current back net is not visible from the neighbors. He is not that concerned about proposed netting on the east side, but his concern is about netting on the west side and asked whether it would impact the tree line. He agrees that higher netting makes sense. Chairman Sullivan asked if netting was visible from his home at this time. He said that he could not see netting at this time. His concern is whether it goes above the tree line. He noted that safety is the first concern. Will it be just as safe if the netting goes to the tree line or does it have to be higher than the tree line? What is the visibility from the houses based on height? 2

26 2014-Z Fairway Drive May 21, VIEWS EXPRESSED BY MEMBERS OF THE ZONING BOARD OF APPEALS 5.1 Mr. Boyer said this is a recreation use and area and it s caught in residential zoning. That is the first issue. Because of the use, applying residential zoning is harder. This type of property should receive relief from zoning codes. There is a safety issue. He would not want to install the fence and then have someone be hit by a golf ball and be seriously injured. The size and its placement will not be detrimental to the surrounding neighborhood. The east area is mainly commercial and to the west is residential, but it is quite a distance away. The public was invited to an open meeting and there are few objections. There is one person in the audience who objects, but Mr. Boyer believes that the size of the fence will not cause site line issues. All standards of review are met and he keeps revisiting the safety issues if new netting is not installed. 5.2 Mr. Duffy agreed with Mr. Boyer s comments. Because this is a residentially zoned district, the circumstance is unique and there is not a zoning district for this property. The applicant has to come before the Board for a variance request for most things done on this property. Safety is a huge concern. The netting is important. He supports the proposal and said that the standards of review are met. 5.3 Mr. Surman said he understands the concern about the visual. The people who live along the perimeter see a lot of trees that will block the view. The fencing is a dark color and will disappear. He supports the proposal. 5.4 Ms. Norman also supports the application. The standards of review are met because of the location of the property and also because of the presumptions in favor of the park district. 5.5 Chairman Sullivan agrees with his colleagues. The Park District has put a lot of effort and money into upgrading the course. People on the course need protection. It is a distance away from the neighbors and is not on the property line. 36 Case 2014-Z Forest Avenue 3.0 TESTIMONY, COMMENTS AND ARGUMENTS ON BEHALF OF THE APPLICANT 3.1 Persons appearing for the applicant 3.11 Mr. Andrew Venamore, applicant Mach I 3.12 Mr. Zulfiqar Bokhari, owner 1100 Forest Avenue 3.2 Summary of presentations 3.21 Ms. Roberts said that this is a request for a square foot (2.18%) total floor area variation, a side yard adjoining a street parking pad setback variation, and a 4.5 rear yard parking pad setback variation to permit the construction of a two-and-one-half-car detached garage and parking pad on a legal non-conforming structure. The Village Board will hear this case on June 24, The applicant said they want to replace an existing detached garage that is substandard. It is about 18 x 20. The idea is to replace it with a larger structure, which is 128 square feet larger. The proposed garage dimensions are 25 x 20. There is a parking pad proposed adjacent to the garage. The idea behind the project was to enclose all of the owner s cars in a garage 30 wide by 20 deep. They presented that to staff, but based on the non-conforming conditions of the home, they decided not to move further with that concept. They then decided to reduce the garage to a 2.5 car structure. The idea was to get most of the owner s cars off of the street. At the moment, the applicant lives in the home with his family; his parents also live in the house. They have four vehicles, his, his wife s, and the parents cars, which they wanted to put under cover. They have a fourth vehicle that is for the babysitter to use. They want to reduce street congestion and get the vehicles into a garage. There is a church one block away that until quite recently was amenable to the applicant parking vehicles in their lot. The church is no longer allowing the owners to do this. What is driving the request is the age of the home, which was built in 1999 under a different zoning ordinance. That allowed the house and the garage to exist. The ordinance changed since construction and the property is non-conforming. If they were to replace what was there with something of the same dimensions, a variation would be needed. Thus, they would need a variation for a 20 x 20 garage, which is a bare minimum 8

37 Case 2014-Z Forest Avenue size. The reason to go the extra half size is to make it more practical so there is storage. The idea behind the parking pad was because they decreased the proposed garage size. The parking pad would be for the third car and the fourth car would park behind the garage, between the garage and the alley. While the variations seem extreme, based on the above, there are hardships related to this case. The request might be slightly excessive, but they did reduce what they originally proposed. This is a reasonable request to the Zoning Board. There is not a lot that can be done with the FAR as it relates to the house. They tried to minimize their FAR request Acting Chair Romanek asked Ms. Roberts how many times the ordinance has changed since the house was built. Ms. Roberts said that the ordinance changed in 2003 and that is when the base formula for floor area decreased by square feet. That is the same formula that applies today. The base formula is the floor area formula before bonuses are added on. It is the straight floor area calculation Acting Chair Romanek asked about overnight parking in front of the house. Mr. Bokhari said there is parking in front of the house, but not when there is snow accumulation or leaf collection. Two vehicles are parked outside when parking is available. The church has hired a towing service and he received a message that the arrangement is not sustainable. The problem with parking is exacerbated in winter. Neighbors will take their primary vehicle on the street and move it behind the garage in the alley. He would be willing to do this but it s difficult given the number of vehicles that they have Mr. Boyer clarified that the current garage width is 18 and that is a one-and-a-halfcar garage that can house one car. The owner said that they can fit one normal car and one small car. There is currently no parking pad. One of their neighbors has a parking pad and they thought that this might help with parking issues and reduce the garage size Mr. Surman asked if there was any impervious issue with the request. Ms. Roberts said that they are well within the impervious coverage limits Mr. Surman said there are two proposed site plans. They will have to eliminate one of them. One is on 1.4 and one is near the back of the packet. One shows the parking pad and one does not. The applicant said that the one at the back of the packet is for the floor area 9

38 Case 2014-Z Forest Avenue calculations, which doesn t include the parking pad. He agreed that the title proposed site plan on that sheet is misleading Mr. Surman asked if one can have a parking space right at the lot line. Ms. Roberts said that there needs to be 5 from the alley lot line and 15 from the side lot line adjoining a street Mr. Surman said an existing hedge would need to be removed to make it fit. From a safety perspective, he thought that they would want to keep structures off of the sidewalk. Ms. Roberts said that there is no sight line requirement where alleys cross a sidewalk but there is the 15 setback, which applies to the parking pad Mr. Surman said as proposed, the plan preserves more of the back yard. Would the applicant be willing to turn the parking pad adjacent to the garage? The applicant said that is the reason why the pad is shown as it is. It is a practical solution versus running it north/south. The proposed orientation maintains more open space in the rear yard Mr. Surman said that the variance request would not have to be as great if it was turned the other way. He s always thought of that setback being for safety Mr. Boyer asked if the applicant could cut down the hedges and park the car on the grass. Ms. Roberts said that there is a Village code against this. He couldn t park on the grass without getting in trouble Mr. Duffy asked about the new garage bonus. Ms. Roberts said that it is 20 x 22 or 440 square feet Mr. Duffy said that the applicant talked about the fourth car that would be behind the garage, so it would be on the alley. The applicant said that he is showing a 5 apron Mr. Duffy said that the original proposal was 30 wide for three cars. Now they are asking for a 25 wide garage for two cars. What would they have done with bikes, lawn equipment etcetera if they got the 30 garage? The applicant said that a 30 garage is large. The amount of practical space becomes bigger. There is still reasonable space after the cars are parked inside. 10

39 Case 2014-Z Forest Avenue The difference in coming down to 25 means that they can get some storage on the side Mr. Duffy said it seems to him that the request could be minimized from the current Mr. Surman said that with the parking pad the way that it is, if it was turned, they could keep the hedge, which would improve the aesthetics Mr. Duffy said if a car is parallel parked, perpendicular to the garage, you could see more when trying to get out of the spot. With the pad as proposed, your view is blocked by the hedge by the sidewalk and by the garage. 5.0 VIEWS EXPRESSED BY THE ZONING BOARD OF APPEALS 5.1 Ms. Norman said that she had the same problem with this case as she did with the previous case because she believes that variations can be minimized and haven t been. She does not think that having more cars is a hardship and does not warrant a variation for taking away green space. 5.2 Mr. Boyer said that this one falls in the same category as the last case. There is a design flaw. This is a big new house that got caught in prior codes and is nonconforming. If it was built today, the garage would be about 22 x 20, 440 square feet. The builder decided to maximize square footage and put on the smallest possible garage and caused a problem. There is a hardship with this case. The proposed garage is a little larger than what the Zoning Board would normally grant, but the issue comes back to property rights and who is being protected in this case. It is not an overly excessive request. He wants to hear what his colleagues say about the parking pad. There is more than one way to lay it out. But the way they have proposed takes away the least amount of green space. 5.3 Mr. Surman said that the current garage looks older than 1998 when the house was renovated. The applicant said that it is somewhat hard to tell. The slab is a mess. He thinks that they squeezed as much out of the house as possible and the former owners left the garage as is. They resided and reroofed the garage. There is a massive crack in the slab. 5.4 Acting Chair Romanek said they would have an additional 300 square feet. Mr. Duffy said they maxed out so they lost 300 square feet. 5.5 Mr. Surman said that the current code indicates that every house has to have a twocar garage. 11

40 Ms. Roberts said that two enclosed parking spaces are required. Case 2014-Z Forest Avenue 5.6 Mr. Surman said this is a hardship compared to the past case, which had to do with convenience and more seating. In the present case, they are talking about storing a car. He doesn t have a problem with the garage. He would like to see the parking pad further away from the street. 5.7 Mr. Duffy said that the norm is 22 x 20 so why grant 25 in this case. They cannot fit a third car in there. He can understand why the applicant wants a larger garage but it is increasing FAR over the current code. He is okay with the parking pad. He has seen parking pads off of alleys in the Village. Some of been granted and some haven t. 5.8 Mr. Surman asked if Mr. Duffy meant parking pads that were near the lot line. Mr. Surman said he did not have a problem with parking pads away from the street. 5.9 Mr. Duffy said that was why he raised the question if it is better for the pad to be perpendicular or parallel to the alley. He thought the way it was proposed is a safer alternative regarding sight lines. These are not Chicago alleys. Backing out blind, being parallel to the garage, seemed to be a worse condition than the impact on the street being parallel to the alley Acting Chair Romanek clarified that Mr. Duffy thought it was safer as proposed with the parking pad parallel to the alley Mr. Kolleng said that he agreed with a lot of what Mr. Boyer said. He does not have an issue with the garage. The percentages are similar to previous requests that have been granted. There is no negative feedback from neighbors. There are no impervious issues. Hardship can be debated for a long time. He thinks that the parking pad is a good solution on days where there is over 2 of snow and they cannot park on the street. He can support the proposal Acting Chair Romanek also has no issue with the proposal. She said they have tried to minimize the request. There are a lot of people living in the home and the parking issues are a hardship. The present garage is old and small. She wondered if it was possible to vote on only a portion of the request. Ms. Roberts said the motion is for the entire request. (After 6.11) 5.13 The applicant asked Mr. Surman whether his concern related to the proximity to the sidewalk Mr. Surman said he is not sure of the impact. The hedge is beautiful and then 10 of the hedge would be gone. 12

41 Case 2014-Z Forest Avenue The applicant said that the owner would like to keep the hedge, which would not change the condition. His concern was maintaining the hedge Mr. Surman said that the fence might be on the property line and the hedge is inside of the fence. The applicant said that the hedges are the fence. The parking pad would be back in to park and then drive out. The owner wanted to keep the hedge and not change the property s look from the street. It does a good job of screening the car from view. Flipping that and running it perpendicular to the alley, what would logically happen would be the same apron, the same 5 setback and then a 9 x 20 pad. He would be going from 180 square feet and if it was perpendicular, it would be 225 square feet. Maybe they need to reduce the length to 19 to ensure that the Evergreens remain healthy Mr. Surman asked what they were actually proposing. The owner said his intention was that the hedge would stay and there would be a natural barrier from that side, coming down the street, and not seeing a car Mr. Surman said he likes the idea of the hedge being maintained whatever the pad configuration. He said that they could have an 18 parking space; whatever length you need to provide enough room for the hedge. The Zoning Board cannot say that they have to maintain a hedge. The owner said they have aesthetic incentives to maintain the hedge. They would just have to ensure that the smallest cars would be there because they would have the least amount of impact. The applicant said that a reduction might be possible. He could reduce the length to 19 and then there would be 18 to 20 of where the pad would end and the base of the Evergreens so they can better maintain them Mr. Duffy clarified that the pad would be kept parallel to the alley, taking a 20 dimension down to 19. Is the request amended? Ms. Roberts suggested making a new motion with the new numbers Mr. Duffy said the side yard adjoining a street setback decreases from to But the 4.5 rear parking pad setback variation does not change because it is off of the alley. 6.0 DECISION 6.1 Ms. Norman said, for the purposes of discussion, she moved to recommend granting a request for a square foot total floor area variation, a side yard 13

Motion carried. 7.0 FINDINGS OF FACT UPON WHICH DECISION WAS BASED A majority of the Zoning Board of Appeals finds that the request meets the variation standards of Section 5.4.F of the Zoning Ordinance. The particular physical conditions of the property, the size and condition of the existing detached, and the change in the zoning ordinance since the house was built, impose upon the owner a practical difficulty. The plight of the owner was not created by the owner and is due to the unique circumstances of the how and when the house and garage were built. The difficulty is peculiar to the property in question and not generally shared by others. The proposed variations will not impair an adequate supply of light and air. The revised plan is intended to protect an existing hedge 14

43 Case 2014-Z Forest Avenue to screen the parking pad from the street. The variations, if granted, will not alter the essential character of the neighborhood. A minority of the Zoning Board of Appeals finds that the request does not meet the variation standards of Section 5.4.F of the Zoning Ordinance. Specifically, there are no particular conditions of the property that impose upon the owner a practical difficulty or a particular hardship. The plight of the owner is due in part to their personal situation of owning four cars; this is not a deficiency of the property. Since the owners intend to park only two cars in the garage, they could make reasonable use of the property with a two-car garage that is smaller than the proposed. 8.0 RECOMMENDATION The Zoning Board of Appeals recommends granting a request square foot (2.18%) total floor area variation, a side yard adjoining a street parking pad setback variation, and a 4.5 rear yard parking pad setback variation to permit the construction of a two-andone-half-car detached garage and parking pad on a legal non-conforming structure in accordance with the plans as amended. 15

The Village Board will hear this case on June 24, The applicant said they want to add a wraparound porch because to improve their exterior living space in the front of the house and given them a better sense of community with neighbors. They also want to help increase the neighborhood curb appeal. They will use architectural details that are period related. Several neighbors have full exterior porches and wrap-around porches. By adding a wraparound porch, they would improve the curb appeal for their block and for their home Mr. Boyer asked when they bought the house. The applicant said they bought the house in Mr. Boyer asked if the house was renovated when they bought it or did they do the 8

74 renovations. Case 2014-Z Maple Avenue The applicant said that it was renovated when they bought it. They found plans for a wrap-around porch with the renovation that the previous owners did not carry out. There is a small front entry porch that they use to walk up the steps Mr. Duffy clarified that there were existing plans for a wrap-around porch. The applicant said they found architectural plans that were left and there were two designs. One is the current porch and one was for a wrap-around porch. They did not think that it would be a big deal to add the wrap-around porch but then they learned that they needed variances Ms. Norman asked if they considered decreasing the variations by making the porch smaller and not go around the side. The applicant said they would need the variations regardless even if they went across the entire portion of the house. The FAR would decrease if they did not wrap the porch Mr. Surman said the request is for 232 square feet Mr. Duffy said if they did not wrap around and just kept it even with the house, they would eliminate 84 square feet Mr. Surman that the plans for the wrap-around could have been previously rejected since the house is now over on FAR. The applicant said she didn t know if the previous owner ever asked for that plan or not. The old wrap-around porch plan is larger than what she is currently requesting. The old plan shows the front porch wrapping all the way around to the screened-in porch Mr. Boyer asked if this porch stopped short of the screened-in porch. The applicant said that it does. The proposed porch wraps around the side and stops at the chimney. They are reducing the amount that their current porch comes out. It comes out 7 10 and the new porch would come out Mr. Boyer asked if there were stairs to the side of the house. The applicant said there are no stairs over there. It doesn t wrap that far around the side Mr. Duffy referenced page 17 that shows a drawing with dimensions. Is that a step that he sees? 9

75 The applicant said that those are stairs to the front of the house. Case 2014-Z Maple Avenue 3.33 Mr. Duffy asked if the dimensions on page 17 were the dimensions that were being used. Ms. Roberts said that those are the dimensions being used. Page 17 refers to the floor area worksheets Mr. Duffy mentioned the dimension of 2 x 9 or 18 square feet to add to the 84 square feet that he brought up before. That s 102 square feet if there was not a wrap-around. They eliminate 102 square feet of the 232 square feet of request Mr. Surman said that the Zoning Board sees a lot of requests like this and the request has to relate to a hardship. He understands why the applicant wants a porch but that is not a hardship. He saw neighbors enjoying their porches. He does not know the hardship in this case Mr. Duffy said that the Zoning Board often sees these types of requests and often it is easy to say that a variance will be given for the front step because the porch has to be a certain depth so the step extends out. In his mind, he is looking at this and asking if the porch has to be that big. He is okay with the variance into the front yard and the variance for impervious surface. It is increasing the FAR that is more of an issue for him. The applicant said that their idea for wrapping around was to put a small table outside and enjoy the neighbors Mr. Duffy said that the Zoning Board needs to be able to judge hardship. That is what he is struggling with Mr. Surman said that the design is good, but the Zoning Board has to look at the hardship and how to they apply in this case Acting Chair Romanek asked if the applicant had anything to add The applicant talked about a specific house at 1210 Gregory, five houses down and behind her, with the exact same porch as what they are proposing. They got their idea for a porch from this neighbor and from the old plans for the porch at her own house. They see neighbors enjoying porches and that is what they want to have Acting Chair Romanek asked the applicant if she would reduce her request. The applicant said they would consider reducing the request Acting Chair Romanek asked when the house was built. 10

76 The applicant said it was built in Case 2014-Z Maple Avenue 3.43 Acting Chair Romanek asked the age of the plans that showed the porch option. The applicant said that her plans are from She said that plans are probably from 2008 or 2009 when the house was rehabbed There was no one in the audience to speak on this case. There was no additional communication on this case. 5.0 VIEWS EXPRESSED BY MEMBERS OF THE ZONING BOARD OF APPEALS 5.1 Mr. Duffy said he loves the porch, but the Zoning Board has standards of review that everything is compared to and judged by. Finding a hardship in this case was difficult. It was a want, not a problem with the lot size, where the house is sited on the lot or where something else was overbuilt that would take away from square footage. He does not have an issue with the other variances requested, but he does have an issue with the FAR request. 5.2 Mr. Boyer said that this is an interesting case and the Zoning Board might see more of these cases, with relatively new homes looking for additional square footage, for example the house at 9 th and Greenleaf. Tonight s case is an older home that was previously renovated. When it is not a renovated house and someone comes in wanting to restore it and expand with an addition or a porch, the board usually supports these requests because they do not want to see these old homes lost. The board wants to avoid newer homes dominating the block. The Comprehensive Plan states that people should live in the front of their home. He has no problem with the setback for this request since that s where the house is built. If this request came up in a different situation, he would vote for it. But this is a newer renovated house. He asks himself, who are they protecting by denying this request? He is weighing private property rights against what someone can build. He does not see property values impaired with this request. Light or air is not impaired. He does not have a problem with what is submitted. 5.3 Mr. Kolleng said there have been a lot of porch cases before the Zoning Board and most are approved. This case is not dissimilar from most other cases that were approved. He can support this request. There has been no negative feedback from neighbors. The only standard of review that comes into play is hardship. He agrees with Mr. Boyer s comments regarding property rights. Hardship is a controversial standard as far as he is concerned. The voting doesn t seem consistent between similar issues. He said that standard is not being impacted so the request should not be denied. The homeowners did not renovate the home. They bought a renovated home. Had they renovated the home, perhaps they would have included the wrap around porch 11

77 at that time. Case 2014-Z Maple Avenue 5.4 Mr. Boyer said he thinks that the former owner was a builder who wanted to maximize his FAR to get the most profitability. 5.5 Mr. Duffy said the porch bonus was smaller than it is today and he would have been penalized to build the porch in 2008 or Mr. Boyer said that this is an older home that has been renovated. The porch is a design element that is in keeping with the older home. 5.7 Ms. Norman said the hardship is the standard that the Zoning Board is given to use to review these cases. She sees no hardship. The request could be reduced, as Mr. Duffy pointed out earlier. She said that the standards of review are not met. 5.8 Mr. Surman said he has difficulty with the hardship. It would be a great porch from a design standpoint. It would be acceptable from a design standpoint to not have it wrap around especially since they have a screened porch on the side. Other porches in the area have front versus wrap around porch. Seven feet deep is a deep and usable depth. He has an issue with the FAR request and not the two other requests. 5.9 Mr. Duffy referenced the screened porch on the side and its impact on this case. Ms. Roberts said that it counts as floor area and does not qualify for a bonus. There was a bonus granted for the proposed porch. They get a 200 square foot bonus. The 232 square foot request includes the bonus Acting Chair Romanek said that one is looking at homes built in 1908, she can agree with Mr. Boyer that these are homes that should be kept. Our Village has to maintain these homes and to make these homes as useful, as modern and as much in keeping with the Village s plan as possible. The particular physical condition of the property, the siting of the house on the lot, impose upon the owner a practical difficulty in building an expanded front porch. The plight of the owner was not created by the owner and is due to the siting and the size of the house. The difficulty is peculiar to the property in question. The difficulty prevents the owner from making reasonable use of the home with an expanded front porch consistent with others in the neighborhood. The proposed variations will not impair an adequate supply of light and air to adjacent properties. The variations, if granted, will not alter the essential character of the neighborhood. Three members of the Zoning Board of Appeals find that the request does not meet the variation standards of Section 5.4.F of the Zoning Ordinance. Regarding the floor area portion of the request, there is no difficulty or hardship preventing the owner from making reasonable use of the property. There are no physical conditions of the property necessitating floor area relief for a front porch of this size. The owner is creating their own hardship by seeking a porch of this size. The porch could be reduced in size while still acting as a desirable architectural feature of the home. 13
