1 By-law A By-Law of the City of Greater to Permit and Regulate the Operation of Certain Off-Road Vehicles on Certain Highways in the City Whereas the Highway Traffic Act, R.S.O. 1990, Section Chapter H.8, as amended, provides that the council of a municipality may pass a by-law permitting the operation of certain off-road vehicles on any highway within the municipality that is under thejurisdiction of the municipality, or on any part or parts of such highway, within the limits provided for in the said Act and regulating the months or hours of operation; And Whereas pursuant to 0. Reg. 316/03, as amended, made under the Highway Traffic Act, a municipality may only authorize the operation of all-terrain vehicles, multi-purpose off-highway utility vehicles and recreational off-highway vehicles on municipal highways; And Whereas the Council of the City of Greater deems it in the public interest to permit and regulate the operation of all-terrain vehicles, multi-purpose off-highway utility vehicles and recreational off-highway vehicles upon certain of its highways; Now Therefore the Council of the City of Greater hereby enacts as follows: Interpretation 1. In this By-law: "All-terrain Vehicle" means an off-road vehicle that: (a) (b) (c) '(d) has four wheels, the tires of all of which are in contact with the ground; has steering handlebars; has a seat that is designed to be straddled by the driver; and is designed to carry, (i) a driver only and no passengers, or (ii) a driver and only one passenger, if the vehicle,

2 (A) has one passenger seat that is designed to be straddled by the passenger while sitting facing forward behind the driver, and (B) is equipped with foot rests for the passenger that are separate from the foot rests for the driver; "By-law Enforcement Officer" means a member of any police service with jurisdiction in the City; "City" means the municipal corporation of the City of Greater or the geographic area within the limits of the City of Greater, as the context requires; "Highway" means a highway as defined in the Highway Traffic Act, that is under the jurisdiction of the City; "Multi-purpose Off-highway Utility Vehicle" means an off-road vehicle that, (a) (b) (c) (d) has four or more wheels, the tires of which are all in contact with the ground, has a steering wheel for steering control, has seats that are not designed to be straddled, and has a minimum cargo capacity of 159 kilograms; "Recreational Off-highway Vehicle" means an off-road vehicle that, (a) (b) (c) (d) has four or more wheels, the tires of which are all in contact with the ground, has a steering wheel for steering control, has seats that are not designed to be straddled, and has an engine displacement equal to or less than 1,000 cubic centimetres; "Off-road Vehicle" means an off-road vehicle within the meaning in of the Off-Road Vehicles Act. l nterpretation. 2.-(1) Whenever this By-law refers to a person or thing with reference to gender or the gender neutral, the intention is to read the By-law with the gender applicable to the circumstances. (2) References to items in the plural include the singular, as applicable

3 (3) The words "include", "including" and "includes" are not to be read as limiting the phrases or descriptions that precede them. (4) Headings are inserted for ease of reference only and are not to be used as interpretation aids. (5) Specific references to laws in the By-law are printed in italic font and are meant to refer to the current laws applicable with the Province of Ontario as at the time the By-law was enacted, as they are amended or replaced from time to time. (6) Any reference to periods of time, stated in numbers of days, shall be deemed applicable on the first business day after a Sunday or Statutory holiday if the expiration of the time period occurs on a Sunday or Statutory holiday. (7) The obligations imposed by this By-law are in addition to obligation otherwise imposed by law or by contract. (8) Whenever certain hours are specified in this By-law or its Schedules, they shall mean Standard Time or Daylight Saving Time, whichever is then in effect in the City. Severability I Conflict 3.-(1) If any section, subsection, part or parts of this By-law is declared by any court of law to be bad, illegal or ultra vires, such section, subsection, part or parts shall be deemed to be severable and all parts hereof are declared to be separate and independent and enacted as such. (2) Nothing in this By-law relieves any person from complying with any provision of any Federal or Provincial legislation or any other By-law of the City. (3) Where a provision of this By-law conflicts with the provisions of another By-law in force in the City, the provision that establishes the higher standard to protect the health, safety and welfare of the general public shall prevail

4 Right to Operate 4.-(1) No person shall operate an Off-road Vehicle on any highway under the jurisdiction of the City except as expressly provided for to the contrary in this By-law. (2) Despite Subsection 4(1), and subject to Subsection 4(3) and Subsection 4(4), a person may operate an All-terrain Vehicle, a Multi-purpose Off-highway Utility Vehicle or a Recreational Off-highway Vehicle on those highways or part highways under this jurisdiction of the City: (a) identified in Schedule "A" to this By-law and shown on the sketch attached as Schedule "B" to this By-law during the period from April 1st in any year to and including November 30th in that year; and (b) identified in Schedule "C" of this By-law and shown on the sketch attached as Schedule "D" to this By-law during the period from December 1st in any year to and including March 31st of the next following year. (3) Despite any section in this By-law, no person shall operate an All-terrain Vehicle, a Multipurpose Off-highway Utility Vehicle or a Recreational Off-highway Vehicle on a highway in contravention of 0. Reg. 316/03, made under the Highway Traffic Act as amended or replaced from time to time. (4) Despite any section in this By-law, no person shall operate an All-terrain Vehicle, a Multipurpose Off-highway Utility Vehicle or a Recreational Off-highway Vehicle on a highway between the hours of 11:00 p.m. on any day and 7:00a.m. of the next following day. Enforcement - No Obstruction, Etc. 5.-(1) This By-law may be enforced by any By-law Enforcement Officer. (2) No person shall hinder or obstruct, or attempt to hinder or obstruct, any person exercising a power or performing a duty under this By-law

5 Offences 6. A person who contravenes any of the provisions of this by-law is guilty of an offence and on conviction is liable to a fine as provided for in the Provincial Offences Act, R.S.O., 1990, c. P.33. Short Title 7. This By-law shall be known and may be cited as the "Off-Road Vehicles By-law". Schedules 8. The following Schedules are hereby incorporated into and form a part of this By-law: Schedule "A" Highways on which an All-terrain Vehicle, a Multi-purpose Offhighway Utility Vehicle or a Recreational Off-highway Vehicle may be operated April 1st to November 30th; Schedule "B" Sketch showing Highways on which an All-terrain Vehicle, a Multipurpose Off-Highway Utility Vehicle or a Recreational Off-highway Vehicle may be operated between April 1st and November 30th; Schedule "C" Highways on which an All-terrain Vehicle, a Multi-purpose Offhighway Utility Vehicle or a Recreational Off-highway Vehicle maybe operated between December 1st in one year to March 31st in the next following year; and Schedule "D" Sketch showing Highways on which an All-terrain Vehicle, a Multipurpose Off-highway Utility Vehicle or a Recreational Off-highway Vehicle may be operated between December 1st in one year to March 31st in the next following year. Repeal 9. By-law and all amendments to By-law are hereby repealed
