The aircraft was undamaged, but the owner-pilot was seriously injured. The personal flight was operated under the provisions of Title 14 Code of Federal Regulations Part 91. Visual meteorological conditions prevailed, and no flight plan was filed for the flight. According to the pilot, he took off to the south, with no one else on board. Immediately after takeoff, the aircraft started to veer to the left, and the pilot responded by pulling on the right steering line. The flight path corrected, but the aircraft did not "feel right" to the pilot. By that time the aircraft was over the lake, and the pilot began a turn to the right to return for a landing. As the aircraft turned crosswind, at an altitude of about 50 feet above the lake, it pitched up, and fell backwards into the lake. The aircraft sunk to the lake bottom with the pilot strapped into his seat; he eventually freed himself and was rescued by boaters on the lake. The pilot was airlifted to a hospital in Medford, Oregon, for surgery. The aircraft was recovered from the lake bottom by friends of the pilot, shortly after the event. The pilot held a private pilot certificate with a single-engine land and instrument airplane ratings. He reported a total flight experience of approximately 1,500 hours, including approximately 100 hours in the accident aircraft make and model. At an unspecified date prior to the accident, the pilot had replaced a steering line and the bridle. The replacement bridle was a different design from the original bridle. During a flight after the bridle change but prior to the accident flight, the new bridle became caught on another part of the airframe; the pilot was able to reach back and free the bridle, and avoid a loss of control. Neither the bridle nor the airframe was modified in the period between that event and the accident flight. According to information provided by the pilot and the manufacturer, the aircraft had an empty weight of about 450 pounds, and was equipped with two seats and a 100hp Rotax engine. The pilot reported that the winds about the time of the accident were approximately 5 to 10 knots, with some gusts and turbulence. Page 1 Copyright 1999, 2010,

The approach was "seemingly normal," with the airplane trimmed for an approach airspeed of 62 knots, and configured with approximately one-half flaps. About 15 to 20 feet above the runway, with no pre-stall indication or buffeting noted, the airplane suddenly dropped, then impacted the runway. The airplane then veered off the left side of the runway, and the right wing was substantially damaged when it impacted a precision approach path indicator (PAPI) stanchion. Acft Owner: GLENHURST INC According to the student pilot, he was performing his second solo flight in the pattern. During the flare on the first landing, the airplane porpoised on the runway, resulting in the nose wheel impacting the runway three times, oscillating harder each time. After the first landing, an air traffic controller contacted the flight school to inform them of the porpoised landing. The student pilot completed three more landings, taxied back to the ramp, and exited the airplane. The first assessment of the airplane revealed no obvious damage, and it was flown two more times before another examination of the airplane by the operator revealed substantial damage to the firewall. Just before touchdown the pilot made a sudden right turn to avoid a single wire electric livestock fence when "the right wing then suddenly stalled" and control was lost. The airplane impacted terrain causing substantial damage to the fuselage frame, both wings, and the engine mount, but remained upright. The pilot stated that he had more experience in weight shift control light sport airplanes and that the throttle in that type of aircraft was controlled with the right foot. He commented that during the sudden right turn he might have inadvertently applied full right rudder thinking that he was applying full throttle. The individual who was piloting the parachute, who was the sole occupant, was killed in the accident sequence, and the powered parachute, which was owned and operated by the person piloting it, sustained substantial damage. The 14 Code of Federal Regulations Part 91 personal pleasure flight, which departed the Iosepa Recreation Area at a time estimated to be about 15 minutes prior to the accident, was being operated in visual meteorological conditions. No flight plan had been filed. According to the Federal Aviation Administration (FAA) inspector who responded to the scene, about 30 minutes prior to the accident, the person piloting the parachute had called the individual who had taught him how to fly it. During that conversation he said that he was thinking about going flying, but the person who taught him how to fly it told him that the winds were way beyond the limits of the parachute, and that he should not take it into the air. Because the pilot continued to express his desire to go flying, the person who had taught him how to fly it offered to come to the area where the pilot wanted to fly in order to check out the wind conditions. When that person reached a location almost to the place where the pilot was supposed to be waiting, he found the pilot and the parachute entangled in a barbed wire fence. He also noted that the variable winds were blowing at 30 knots with gusts to 35 knots. The powered parachute was not registered with the FAA, and the person piloting it did not possess an FAA pilot certificate. Page 5 Copyright 1999, 2010,

The student pilot and passenger were fatally injured. The airplane was registered to and operated by the pilot under the provisions of 14 Code of Federal Regulations Part 91 as a personal flight. Visual meteorological conditions prevailed for the flight, which operated without a flight plan. The flight was originating at the time of the accident. According to a Federal Aviation Administration (FAA) inspector who responded to the accident site, the purpose of the flight was to take the airplane's perspective buyer for a local flight before a possible purchase. After takeoff, the airplane was observed to stall and roll left, before impacting a tree and subsequently the ground. The airplane was nearly consumed in a post crash fire. At 1335, the weather observation facility at Stephens County Airport (KBKD), Breckenridge, Texas, located 19 miles northwest of the accident site reported, wind calm, visibility 10 statute miles, clear of clouds, temperature 90 degrees Fahrenheit, dew point 55 degrees Fahrenheit, and a barometric pressure of inches of Mercury. STEINKE HISTORY OF FLIGHT On October 9, 2009, at 1354 mountain standard time, an experimental Cruz SE5A Replica biplane, N3944U, crashed into a scrap metal yard about 1/2 mile north of the airport shortly after takeoff from the Phoenix Deer Valley Airport, Phoenix, Arizona. The pilot operated the borrowed airplane under the provisions of Title 14 Code of Federal Regulations Part 91, as a personal flight. The pilot, the sole occupant was killed. The airplane was thermally consumed in the post-impact fire. Visual meteorological conditions prevailed for the flight and no flight plan had been filed. One witness' attention was drawn to the accident airplane because he heard an unfamiliar sounding engine. He saw the airplane depart runway 25L at an altitude of about 150 to 200 feet, in a normal climb attitude. He stated that the airplane made a left crosswind turn; however, it rolled into a right spin. From the witnesses position he was able to see about 2.5 rotations before seeing a cloud of smoke; he estimated the airplane reached an altitude of about 500 feet. The witness reported that the climb appeared normal and the engine was running smoothly and producing takeoff power. Another witness in a parking lot reported that his attention was drawn to the airplane due to its low altitude; he estimated that the airplane was no more than 100 feet. The airplane passed overhead traveling in a westbound direction in level flight. The airplane then pitched up, and took an erratic turn to the right. As the airplane exited the turn it was in a nose up attitude, it flew another 100 feet and then started a nose down spin until it impacted the ground. PERSONNEL INFORMATION A review of Federal Aviation Administration (FAA) airman records revealed that the 37-year-old pilot held a commercial pilot certificate with ratings for airplane single and multi-engine land, and instrument airplane. The pilot also held a certified flight instructor (CFI) certificate with ratings for airplane single and multi-engine land, and instrument airplane. The pilot held a first-class medical certificate issued on August 25, It had no limitations or waivers. No personal flight records were located for the pilot. The NTSB investigator-in-charge (IIC) obtained the aeronautical experience listed in this report from a review of the FAA airmen medical records on file in the Airman and Medical Records Center located in Oklahoma City, Oklahoma. The pilot reported on his most recent FAA medical application dated August 25, 2009, a total time of 270 flight hours with 55 hours logged in the last 6 months. AIRCRAFT INFORMATION The airplane, N3994U, was an experimental-amateur built 1986 Cruz SE5A Replica biplane, serial number The airplane was powered by a Teledyne Continental Motors O-200-A, serial number A piston engine. According to an FAA inspector, the owner of the airplane, who was also the father of the pilot, reported that this was the pilot's first flight in the airplane. The owner also reported that all of the airplane's maintenance records were in the airplane at the time of the accident. The airplane was refueled on October 03, 2009, with 6.1 gallons of fuel. COMMUNICATIONS The pilot was in contact with the Deer Valley airport traffic control tower (ATCT). The local controller reported clearing the pilot for takeoff with a straight out restriction. At the departure end of the runway, the controller approved the pilot for a right turn. The pilot's transmission was unintelligible, and the controller reissued the right turn instruction. The controller then observed the airplane make a right turn and then go down about 1/2 mile west of the airport. Two additional controllers observed the airplane in a spin prior to impacting the ground. Page 7 Copyright 1999, 2010,

8 WRECKAGE AND IMPACT INFORMATION FAA inspectors responded to the accident site located 1.5 miles west of the departure end of runway 25L at Deer Valley Airport. The airplane came to rest in a scrap metal yard and had been thermally consumed by the postimpact fire. FAA inspectors were able to identify all the hardware for the flight controls. MEDICAL AND PATHOLOGICAL INFORMATION The Maricopa - Office of the Medical Examiner completed an autopsy on October 13, The cause of death was listed as blunt force head trauma and thermal injury. The FAA Forensic Toxicology Research Team CAMI, Oklahoma City, performed toxicological testing of specimens from the pilot. Analysis of the specimens contained no finds for carbon monoxide, cyanide, volatiles, and tested drugs. TESTS AND RESEARCH The airframe and engine were inspected by FAA inspectors along with a representative from Teledyne Continental Motors (TCM), a party to the investigation. Visual examination of the engine revealed no obvious mechanical malfunctions. It was noted that the crankshaft was pushed aft of its original position and the TCM representative was not able to rotate the engine by hand. Under the supervision of the FAA, the engine was disassembled. Damaged components included the crankshaft propeller flange, crankshaft main bearings, crankshaft oil slinger ring, and crankshaft gear cluster. The inspection revealed no abnormalities that would have prevent normal operation and production of rated horsepower. Page 8 Copyright 1999, 2010,

The private pilot, sole occupant, received serious injuries. The airplane was substantially damaged during the accident. The aircraft was registered to and operated by a private individual under the provisions of 14 Code of Federal Regulations Part 91 as a personal flight. Visual meteorological conditions prevailed for the flight, which operated without a flight plan. The pilot reported that he had recently completed building the airplane and was conducting a local test flight. About an hour after departure, and while in cruise flight, the pilot stated that the engine gave a "hiccup". As he proceeded toward his departure airfield, the engine started to lose power. The pilot turned on the fuel boost pump and switched fuel thanks, but the engine continued to lose power. Unable to maintain altitude, the pilot elected to conduct a forced landing in a field. The pilot stated that as he lined the airplane up for the landing, the engine died. He added, that he was just able to clear trees and a fence at the beginning of the field, however, the airplane impacted the ground hard. The airplane's left wing and fuselage were substantially damaged during the forced landing. Additionally, the propeller separated from the engine when the crankshaft broke at the crankshaft flange. The airplane was registered to and operated by the commercial rated pilot, who was not injured. Visual meteorological conditions prevailed and no flight plan was filed for the local flight conducted under 14 CFR Part 91. According to the pilot, after a normal touchdown he felt the tail drop about 6 inches followed by a loud grinding noise. As the airplane began to decelerate, it began to yaw to the left. The pilot applied full right rudder and right brake, but was unable to stop the yaw to the left. The airplane continued to rotate to the left and began to bounce/skip to the side and roll. The lower right wing struck the ground and the engine came to an abrupt stop. The pilot reported that the right main landing gear strut, entire brake assembly, wheel, tire, and wheel pant were damaged. The lower right wing tip and aileron sustained structural damage from impacting the ground. The tailwheel separated from the airplane and there was structural damage to the rudder frame and aft section of the fuselage where the tailwheel connects to the airplane. The propeller was also damaged. An inspector with the Federal Aviation Administration (FAA) performed an examination of the airplane and reported that the tailwheel attach bolt at the lower aft portion of the fuselage pulled through the fuselage structure where it was mounted. The bolt was intact and there was no obvious damage to the threads. It could not be determined as to why the bolt separated. Weather at Meadowlake airport at 1630 was reported as clear skies, visibility 10 miles, and wind from 100 degrees at 5 knots. Page 10 Copyright 1999, 2010,

There were no discrepancies noted then, with the takeoff, and initial climb. When the airplane reached approximately 65 feet above the ground, just over the asphalt end section of the runway, he leveled off the climb and raised the flaps. Suddenly, the engine, "quit", had a loss of power. The pilot lowered the nose of the airplane and attempted to level off before landing but hit the ground hard, collapsing the main gears, which resulted in substantial damage to the fuselage structure. He and the passenger exited the airplane unharmed. Later the pilot realized and confirmed that the friction lock on the engine throttle was not engage correctly resulting in the throttle to roll back to the idle position. The pilot was fatally injured and the airplane was substantially damaged. The airplane was operated by Royal Selangor Flying Club, Malaysia under the pertinent civil regulations of Indonesia. The pilot was operating the airplane under the provisions of Title 14 Code of Federal Regulations Part 91. The private pilot and passenger were not injured; the airplane sustained substantial damage. The cross-country flight departed South Grand Lake Regional Airport, Ketchum, Oklahoma, about 1215 central daylight time. Visual meteorological conditions prevailed, and no flight plan had been filed. The pilot reported that during the landing roll the airplane veered off the runway. He countered with opposite rudder control, and the airplane then swerved back across the runway and into the opposite verge. The airplane was registered to and operated by the pilot under the provisions of Title 14 Code of Federal Regulations Part 91. The private pilot sustained minor injuries and his one passenger sustained serious injuries. Visual meteorological conditions prevailed and no flight plan was filed for the personal flight. The cross-country flight was originating at the time of the accident with an intended destination of Omak, Washington. According to a Federal Aviation Administration (FAA) inspector who responded to the accident site, the pilot was departing runway 33 when witnesses on the ramp heard the engine begin to sputter. The pilot reported to the FAA inspector that shortly after liftoff, he heard a faint pop sound from the engine. As the airplane crossed over the departure end of the runway, the engine lost power and the pilot initiated a forced landing to an adjacent field. Subsequently, the airplane struck trees and came to rest on its right side. Examination of the airplane by the FAA inspector revealed it came to rest near the departure end of the runway. The right wing was bent upwards about 90 degrees and the left wing was bent and buckled throughout. The wreckage was recovered to a secure location for further examination. The flight instructor received serious injuries, and the private pilot received minor injuries. The airplane, which was owned and operated by the private pilot, sustained substantial damage. The local 14 Code of Federal Regulations Part 91 instructional flight, which was taking place in visual meteorological conditions, departed Moses Lake Municipal Airport about five minutes prior to the accident. No flight plan had been filed. According to the Federal Aviation Administration (FAA) inspector who responded to the scene, the private pilot had recently purchased the airplane and was getting checked out in it by the flight instructor. They had just taken off for the second flight of the day when the engine started overheating and losing power. Since they were unable to make it back to the airport, the instructor pilot took control of the airplane and attempted a landing in a rough agricultural field. Although the touchdown was successful, during the landing roll the airplane nosed over onto its back. The private pilot, sole occupant, received only minor. The airplane was substantially damaged during the accident. The aircraft was registered to and operated by a private individual under the provisions of 14 Code of Federal Regulations Part 91 as a personal flight. Visual meteorological conditions prevailed for the flight, which operated without a flight plan. The pilot reported that he was on a cross-country flight from Mount Pleasant, Texas to his farm in Kansas. The pilot stated that while the airplane was in cruise flight, the engine's exhaust temperature gas (EGT) kept climbing. The pilot said that he would richen the mixture a bit. However, after a few minutes the EGT would start climbing again. Finally, after enriching the mixture all he could, the engine started to lose power. Unable to restore engine power, he elected to conduct a force landing in a field. The airplane's nose landing gear collapsed upon landing and the left wing and right wings were substantially damaged.
