CA OVERVIEW PPB CA #11-39595 On Sunday ay 15, 2011, at about 9:48 a.m. an a Portland Police officer assigned to responded to 73 rd and Southeast Yamhill on a man standing in the rain for over an hour. Arriving, the officer saw the man standing in the rain next to a stop sign. The officer tried talking to the man but he was mostly unresponsive but did say something in Spanish. The officer told the man Uno emento and he walked back to his car to request the help of a Spanish-speaking officer. When the officer went back to car and the man followed him and the officer tried to get him to wait, but the man put his hand up mimicking the officer. The officer continued to step back. The officer said he saw the man s forehead and jaw tense up and he thought the man was either going to swing at him or run away. The officer said the man tightening his arms and fists and kicked at him. The officer then took the man to the ground and the man resisted and he punched the man 7-10 time times to get the man to stop fighting him. The man stopped resisting and the officer handcuffed the man. Once the man was in custody the officer called for medical personnel to check the man for injuries and he learned that the man was the subject of a missing report. Later, the officer learned the man had a mental illness. There was a community member who was the original caller to 911 who witnessed the entire encounter and he said he believed the officer acted appropriately.

R/c to listed location where caller saw a man who had been standing in the same spot, in the rain, for the past 1.5 hours. Caller thought he should be checked on. I found the subject standing next to the stop sign on the northwest corner of 73/Yamhill, so I parked about 2 car lengths from him and walked up to him. He was wearing jeans and a t-shirt which was soaked because of the rain. I approached him and asked if he was ok. The subject had a blank stare and then said something in spanish. I know very little spanish so I asked if his house was nearby. He said said something under his breath and then said Salem. I tried asking more questions but I could tell I wasn't going to get anywhere. I told him "Uno momento" and walked back to my car to call for Ofc Reynaga's assistance with spanish speaking. I tried to go out on the air, but the subject turned and walked towards me. I put up my hand and index finger and said again, "Uno momento". Trying to tell him to hold on a minute. The subject then put his hand up, like he was mimicking me. I stepped back and tried to tell him again to wait a minute, but then I could see his forehead tense up along with his jaw. I have seen this before and I felt like he was getting ready to take a swing at me or take off running. Before I could act, the subject tightened up his arms and fists then tried to kick me with his right leg. I caught his leg, threw it up over his head, and he fell to the ground, face first onto the sidewalk. I immediately got on top of him and told him to give me his hands. The subject then rolled over and was on his back. I then struck him 7-10 times in the face as he was trying to grab my hands. He stopped resisting, and then turned away. I got on the air and said to send cover. I got the subject on his stomach and eventually got him handcuffed. I told dispatch to send me one more car and to start medical because I saw he had a cut on his head from the fall, and his left eye was starting to swell. Ofc Kile arrived and spoke to a witness who saw everything. Please see his special report. Ofc Reynaga arrived and was able to get the subject's name. I then remembered Ofc Feist had taken a missing person's report a short time ago. I spoke to him and this was the same subject who was missing. Ofc Feist took the missing report and cleared it with case number 11-39583. He said the group home Brambila left wanted him to be checked by medical for his diabetic issues and to have Project Resond talk to him. AR checked him out and then transported him to Portland Adventist for his diabetic problem. I followed AR to the hospital and dropped off Brambila's property. I called Project Respond and they said they would go to the hospital and interview Brambila. They were informed by the group home earlier that they would be talking to him, once he was found. COPUTER I checked myself and found that I had a srcapped up left knee and a cut on my right ring finger knuckle. I self treated my injuries and later documented it in the injury log. By our arrival, Officer Storm had the subject handcuffed and the subject was on the ground awaiting medical attention. I checked nearby residences to see if anyone saw what had happened. I spoke to (WI) Clardy in front of his home. Clardy happened to be the person who called 911 in regards to the subject. Clardy said he saw the man had been standing on the NW corner of 73/Yamhill for over 1 1/2 hours by himself and mumbling things. Clardy walked over to the subject to see if he was OK due to the fact it was cold and rainy and because he had been standing there for so long. Clardy decided to call 9-1-1. COPUTER Clardy said he saw Officer Storm arrive and talk to the subject. He told me he saw Officer Storm using hand gestures as a way to communicate but did not know what was being said. He told me Officer Storm kept a safe distance between him and the subject. Clardy said he saw Officer Storm take a few steps back away from the subject and reach to his radio as if he was going to transmit something. Clardy said he thought there was now about ten feet or so between the two men. Clardy said the subject then approached Officer Storm and appeared to stick his hand out towards him. Clardy said the Officer then moved back again a few more steps. Clardy said the man then rushed the Officer and a physical altercation ensued. Clardy said the Officer had to "take down" the man. Clardy said he saw the Officer roll the man over and handcuff him. I asked Clardy if he felt the Officer did anything inappropriate or use excessive force in any way and he said, "No, it happened fast. He had to take the guy down."
