UTKINTON AND COTEBROOK PARISH COUNCIL MINUTES OF A MEETING OF UTKINTON AND COTEBROOK PARISH COUNCIL HELD AT COTEBROOK VILLAGE HALL ON TUESDAY 11 TH APRIL 2017 AT 7.30PM Present: In Attendance: Cllrs F Tunney (Chairman), R. Barnes, T. Boyle, T. Burford, A Needham and G Stewart Mrs M Meritxell Palazuelos-Vinas (Clerk & Responsible Financial Officer) Public Participation There was one member of the public in attendance, Mrs Anna Harvey. Mrs Harvey had expressed a wish to join the Parish Council and gave a brief review of her circumstances and background. Following this and her observing the proceedings it was agreed that, if she so desired, she could be co-opted as a Casual Vacancy at the next PC meeting. Resolved: To accept Mrs Harvey s application and put this to the vote at the Annual PC Meeting on 9 th May in Utkinton Village Hall. 11.04.01 APOLOGIES FOR ABSENCE Resolved: that apologies received from Cllr N Parker, CIIr I Priestner and CIIr E Moore Dutton be accepted. 11.04.02 DECLARATIONS OF PECUNIARY INTERESTS No declarations received. 11.04.03 MINUTES OF THE MEETING HELD ON 14 TH March 2017 Resolved: that the minutes of the meeting of 14th March 2017 be confirmed as a correct record and signed by the Chairman. 11.04.04 MATTERS ARISING FROM THE MINUTES Cllr Needham suggested a correction done in previous minutes 14.03.12 Permitted Footway and Cycleway to Tarporley. Action: Clerk to alter the minutes to read some rather than all with regard to the use of existing CWaC land towards the proposed footpath. 11.04.05 BOROUGH COUNCILLOR S REPORT CIIr G Stewart informed that the Tarporley News had reported that the development of housing on the, previous, Royal British Legion site in Tarporley have been rejected by Tarporley Parish Council. As Tarporley is our Service Centre, the parish council should know when something happens. Action: CIIr F Tunney to email CIIr E Moore Dutton and Mr Ken Parker(Chair of Tarporley PC) to ascertain why it has been rejected and ask if the Parish Council could be kept informed when this is resolved. 11.04.06 PLANNING APPLICATIONS The following Planning Matters were discussed: a) Ref 17/00709/FUL Cotebrook Village Hall Stable Lane (Single storey front extension) CIIr T Boyle informed that significant funds are needed to be raised to build the kitchen and a bigger toilet. b) Ref 16/05501/OUT Rowley Farm, Utkinton (Agricultural workers dwelling) Approved CIIr F Tunney commented that the plans are likely be submitted in the next few months. c) Ref 17/00790/OUT Haulage Yard Tarporley Road, Delamere/Cotebrook (Erection of detached dwelling - amendment to application 15/05189/OUT) CIIr T Boyle informed that the plans had been submitted and that concern had been expressed because the Japanese knotweed infestation over the wall blocking all continues and that it cannot be removed until the owner has sold the other piece of the land. Action: CIIr F Tunney to raise a concern with CWaC Planning about the access in and out and the parking there during the construction in the building area as it will require management of traffic off and on to the A49. (The following is the formal notification to CWaC of the concerns) : These comments are submitted on behalf of Utkinton and Cotebrook Parish Council following discussion of the application at the April 2017 Parish Council Meeting. The Parish Council is not submitting an objection per se but concerns as to two aspects: 1) That access to and egress from the site as well as parking of construction traffic needs to be controlled as the entrance to the site is restricted and it sits on the busy A49 and has the potential to cause issues with both passing traffic and also existing residential traffic. 2) It has been reported that there is a significant infestation of Japanese Knotweed in and around the site and that this would require control to eradicate the weed prior to any excavation or movement of spoil from the site. d) Ref 16/01492/OUT Northgate Field (Erection of 22 dwellings) Following discussion with the Planner, it was indicated that CWaC are awaiting a response from the developer and that, if or when, this revised application is submitted that it would take around three weeks to register and would then be available for external consultation by the Parish Council and concerned residents. It is likely, therefore, that it could take between six to eight weeks before the PC receives any notifications of movement on this development. Action: CIIr F Tunney to take council on the next stages.

11.04.07 To Review and accept 2017/2018 Parish Council Budget Reviewed and accepted by all Councillors on meeting held 14 th March. Resolved: CIIr F Tunney to make A3 copies to send to all Councillors and Clerk. 11.04.08 AUTHORISIATION OF PAYMENTS The following Payments were approved for Payment a) Royal Mail Group Ltd (Response Serv. CIIr F Tunney informed that the Defibrillator would need to be added as to the register for 2017-2018. Action: Clerk to inform Came & Company (Insurance) 11.04.10 INTERNET BANKING After many attempts from Cllr Tunney to sort the Community Banking Account (this allows for internet banking and more traditional Cheque based banking) with NatWest, the situation is confused with it having taken since early February and this meeting (11 th April) and is as yet unresolved. In fact there is much confusion with NatWest and the addresses and details of signatories and the Parish Clerk. Given this uncertainty and perceived lack of competence CIIr F Tunney has looked at a number of banks - Co-op, Santander, Lloyds et all but one bank appears to cater specifically for Parish Councils and that is Unitytrustbank. He has obtained application forms and will obtain signatures to its acceptance but leave them undated and unsent until NatWest have resolved all of the issues with the current Parish Council accounts (and that of one Councillor who also banks with them.) Cllr Tunney proposed that if the situation is not resolved to the satisfaction of the Parish Council by 30 th April, he will instigate the move and the switching of bank accounts to enable the Parish Council to have full online access as well as retaining a more traditional cheque account. Action: CIIr F Tunney to report back. If the situation is not resolved to our satisfaction by NatWest by April 30 th 2017, to complete and sign the form to apply for a Community Account from Unitytrustbank, adding four signatories (CIIrs F Tunney, G Stewart, A Needham and M Palazuelos-VInas (Clerk)) 11.04.11 POSTAGE LICENSE Cllr Tunney commented that the Postage License enables the parish council to receive a response back when doing questionnaires, requests for consultation etc. 11.04.12 HIGHWAYS MATTERS Cllr Tunney has had no further responses from CWaC as to the general list of highway repairs for the Parish Action: CIIr F Tunney to ask CWaC for an update The paint for the two finger posts has arrived and has been given to Mr Dave Williams with the method statement Action: CIIr F Tunney to write to Mr Jamie Barron to request the two finger posts to be transferred to the parish council. The sink hole at Quarry Bank is a drainage pipe that is all flooding and has cracked. CWaC has closed the road and will take a couple of weeks to get fixed, as further investigation as to the root cause is required.

The damage to the verges on Quarry Bank will be reinstated by the builder (Lockwood Homes) within 4 weeks after the houses have been finished and has an email from the builder that they would reinstate verges up to and including that adjacent to High Gables. CIIr R Barnes expressed concerned about all the damage to the verge above High Gables to Rowley Farms and believes that it the builder should be liable for ths Cllr Tunney disagreed the matter was unresolved. Cllr Barnes also raised the long-standing issue of damage to the verges on Tirley Lane opposite to and between the two entrances to Monarchy Farm and that this was contrary to agreements reached with the owners (Mr and Mrs Norris) and stipulations within the original planning applications. Action: CIIr F Tunney to look at the previous planning applications and to write to Mr & Mrs Norris on behalf of the parish council to express these concerns. Cllr Tunney has investigated the issue raised by Cllr Barnes and has looked at previous Planning Applications and Decisions as well as previous Parish Council Minutes relating to this matter and can find no stipulation, instruction or addendum to any application relating to the making good of Tirley Lane by the occupants of Monarch Hall. What was evident were the minutes relating to a visit by Cllr Stewart (then Chair) to the property and a vague agreement by the occupier to look at this that was linked to repairs to be made by United Utilities. Neither event took place and Cllr Tunney is loath to formally write to the property owners. It is suggested that the Parish Council contact United Utilities to get a better understanding of the requirements to relay / repair the pies in that area. Clerk reported to CWaC that a road sweeper was required to clean all Quarry Bank. It has now been passed to Streetscene and we are expecting a response soon. CIIr T Boyle asked for a road sweeper for Cotebrook Action: Clerk to report to CWaC Streetscene CIIrs R Barnes and T Boyle informed that there is a lot of mud on the footpaths and pavements that need to be cleaned. Action: Clerk to report to CWaC Streetscene 11.04.13 REPORTS FROM WORKING GROUPS a) Quarries and Greens Cllr G Stewart informed that he has sprayed the weeds recently and that Mr Whalley will do all the works by the end of April at Quarry Wood, High Billinge and Shrine Hedges. b) Permitted Footway and Cycleway to Tarporley CIIr F Tunney informed that a route has been prepared and that there are two residents concerned over the possible land of their properties and that they had written to the Parish Council to express these. The resident from Holly Bank on Utkinton Road had asked for road signage to indicate narrowing and reduce speeds over the hill on Utkinton Road. CWaC had rejected this and the resident (Mr Outram) was due to submit his report to the Parish Council. Next stage is to put a plan together, what we think, what it would cost and see how it would go. Whilst, at this stage, no formal proposal existed, it was agreed that Cllr Priestner should submit a report on the status of the project to the next PC Meeting. Action: Cllr Priestner to submit a status report for the Parish Council to review at the next PC Meeting on 9 th May. CIIr G Stewart commented that the parish council should apply to some cost benefit analysis and processes. In another point vis-à-vis footpaths in general, Cllr A Needham commented that he is part from a Campaign to protect Rural England (CPRE) and submitted a magazine from Cheshire Viewpoint Association for all Councillors to see (subscription of 3 x month). Action: CIIr A Needham to provide some additional information to CIIr F Tunney so he can garner comments as to whether the Parish Council should subscribe to being a member of CPRE. c) Plans for a grant-aided Forest School in the Quarry Wood CIIr F Tunney has applied to Cheshire Wildlife Trust (CWT) for a grant of up to 1000 and commented that this will require a combination of a combination of CWT resources and volunteers from the village, school and PTA. A letter to the nearby residents has been sent and we are just waiting for some more answers. One resident has formally written that they are happy with the proposals, however, one neighbour has expressed some concern as to the stability of the wall and verge on the east side of Tirley Lane between the school and the Quarry. This will be the subject of a discussion between CWaC and the resident. Action: CIIr F Tunney to inform when he has received all the responses from the nearby neighbours. 11.04.14 WEBSITE AND COMMUNICATIONS The website continues to grow in terms of its readership and the Facebook pages can be seen to generate comment the latest output being the Item about Quarry Bank has reached almost 400 readers. The newsletter (The Courier) has been circulated along with the Neighbourhood Plan documents. 11.04.15 NEIGHBOURHOOD DEVELOPMENT PLAN

Flyer and postcard were sent and, to date, a small number (5) of formal responses have been received. Councillor Tunney asked fellow Councillors to encourage residents to responds to speak with the neighbours so they can complete the postcard by the end of April. CIIr F Tunney had submitted a question to the consultation enquiring as to why the proposed Tarporley ward excludes some properties that had, previously, been included as part of the 2015 CWaC Governance and Parish Boundary review. Action: Councillors Needham and Priestner to attend this seminar and report back. The Sandstone Ridge Trust Annual General Meeting 2017 (held on 20th March 2017) CIIr. It is, therefore, highly likely that the concerns expressed by UCPC will not be taken into account and the village/hamlet of Utkinton will become designated as a LSC in the forthcoming CWaC Local Plan2. d) War Memorial CIIr G Stewart reported that a quotation for 2500 has been made for repairing all the deterioration, put a stainless of steel banding at the base of the crosses, repair of the inscriptions and general tidy up. There was Government funding of up to 4.5 million nationally and that this could lead to national grant aid funding of up to 2million. CIIr F Tunney informed that he is waiting for a reply from a tv producer (BBC TV The Repair Shop ) that were interested in things that needed to be repaired etc. Action: CIIr F Tunney to forward the information to CIIr G Stewart. Action: CIIr R Barnes to speak with John Johnson at Rose Farm and see if we could all raise money to repair the war memorial prior to the Centenary Commemorations of the Armistice in 1918. Also to look at some visible form to demonstrate progress (a thermometer style banner that could be updated monthly.) e) Sandstone Ridge Trust CIIr A Needham reported that this project started in January 2017 and will be running until December 2018. Involves local people and groups for their opinions, and combine them with evidence and policy analysis to understand the ley issues, needs and opportunities facing the conversation and enjoyment of the natural beauty and special qualities of the Ridge. Pull together a Sandstone Ridge family for stakeholders that involves actively looking after the area and its future. Create a brand and identity for the Ridge that strengthens partnership working and helps to unlock potential investment opportunities for environmental, cultural, access, education, health, rural tourism, and land management projects, adding value to what is already being done in the area. Tunney has had no further responses from CWaC as to the general list of highway repairs for the Parish Action: CIIr F Tunney to ask CWaC for an update. CIIr Tunney reported that a new sinkhole in front of the two new houses has appeared at Quarry Bank and that CWaC has already been informed. Resolved: that the fingerposts have been properly painted and that CIIr G Stewart thanked Dave William for his work on renovating the two finger posts. Action: Clerk to send a thanks letter to Dave Williamson. CIIr T. Boyle reported that Woodlands Close were thankful. Clerk reported that a road sweeper from Streetscene will clean Utkinton and Cotebrook on the week commencing 19 th May 2017 including footpaths and pavements. CIIr R. Barnes reported that there is a requirement for upgrading or securing the path between the greens at Cotebrook which is a land rented to United Utilities. Action: CIIr F Tunney to email an extract from the Parish Council meeting of January/February 2004 relating to the lease of the land from United Utilities. Action: Clerk to establish contact with United Utilities and seek advice as to their (United Utilities) obligations in maintaining the pathway. 09.05.10 REPORTS FROM WORKING GROUPS a) Quarries and Greens Cllr G Stewart informed that Mr Whalley contacted him on the 9 th May to carry out all the works at Quarry Wood, High Billinge and Shrine Hedges. b) Permitted Footway and Cycleway to Tarporley CIIr I Priestner advised that there is a need to run a committee inside the land owners. CIIr A Needham reported that the main concerned is that the costs to get the children to Tarporley High School is around 900 a year and that they are not keen to wear the reflectent coats while walking through the road. CIIr F Tunney informed that we should take this out and bring it in the Agenda for July. c) Plans for a grant-aided Forest School in the Quarry Wood CIIr F Tunney has applied to Cheshire Wildlife Trust (CWT) for a grant of up to 1000 and that he is awaiting from a response. d) War Memorial CIIr G Steward had two quotations for the repairs and that he expects a response by July. Tunney reported that the Parish Council is now online and that a debit card and card reader have been received.

Action: Cllr. Tunney to fill in all the documentation to include the Clerk, Meritxell Palazuelos-Vinas a fourth signatory and also to request for a second debit card for her. The four signatories will sign an Agreement where they will need to request approval from the other signatories to be able to make a purchase. 13.06.09 HIGHWAYS MATTERS F. Tunney has had no further responses from CWaC as to the general list of highway repairs for the Parish Action: CIIr F Tunney to ask CWaC for an update. Cllr. F. F Tunney reported that Heaths Lane was removed from the Grip Fibre programme because there was too much patching works required. So CWaC have managed to move it to the full surfacing programme but this will not be until August. As per Stephen Pinnington email dated on from 6 th June Clerk reported to Streetscene that the road sweeper has cleaned Utkinton but that there is no sight or evidence of it in Cotebrook. (email sent on 9 th June, expecting an answer soon) Action: that Cllr. Tunney to contact Mr Scott (Quarry bank) as his hedge is big and needs to be cut. Action: that F Tunney to put in the website that all householders with hedges need to cut them properly as it may affect the traffic. Farmers are not aloud to cut hedges during the nesting times. 13.06.10 REPORTS FROM WORKING GROUPS a) Quarries and Greens (including Quarry Wood on Tirley Lane) Cllr G Stewart informed that Mr Whalley 1 st cut on Quarry Wood, High Billinge and Shrine Hedges were done on 13 th June 2017. Action: F Tunney to email Victoria Kerr from United Utilities and ask if they can give us some indications about what are they doing about it. b) Plans for a grant-aided Forest School in the Quarry Wood CIIr F Tunney has applied to Cheshire Wildlife Trust (CWT) for a grant of up to 950 and that it has been accepted. d) War Memorial Previously CIIr G Stewart had two quotations for the repairs and that he expects a response by July. Action: CIIr G Stewart to ask if somebody could donate the stones like the sandstone and also to pass the measurements to CIIr R Barnes so he can ask John Johnson at Rose farm. Replace stones like the sandstone that exists. 13.06.11 WEBSITE AND COMMUNICATIONS No further information. 13.06.12 NEIGHBOURHOOD DEVELOPMENT PLAN F Tunney reported that they are planning two public meeting 15 th July and 22 nd July in both village halls. Action for clerk: Need to know what we have to do to arrange a motorcycle parade on the roads (around the Ward in and around the parish). What do we need to do? Involve the ward with the local business 13.06.15 OTHER BUSINESS a) Helicopter landed in Fox and Barrell land F Tunney reported that this has been withdrawn by the resident. b) Formation of sub-committees for Utkinton and Cotebrook Parish Council Proposal: To form three sub-committees with three councillors reporting each parish council meeting: 1) Quarries and Greens, 2) Planning and development, 3) Neighbourhood Planning. Noted: that F Tunney will propose the above in the next parish council meeting held on 11th July 2017. CIIr. T Boyle reported her resignation from the parish council. Action: that T Boyle to write formally to the clerk with her resignation. So the parish council we can start looking for a Co-opt councillor. Action: F Tunney to prepare an advert for the website and Facebook. CIIr T Burton reported that to join the A51 at the Junction between Willington Lane and the A51 is very dangerous and visibility is much reduced.
