LAW on the approval of the National Town and Country Planning Plan Ð Section I Ð Lines of Communication * Art. 1. Ñ The National Town and Country Planning Plan Ñ Section I Ñ Lines of Communication shall be approved in accordance with the appendices nos. IÐVIII which are integrant part of the present law. Art. 2. Ñ The works stipulated under the present law for lines of communication are of national importance and constitute a public utility cause. Art. 3. Ñ The works included in the National Town and Country Planning Plan Ñ Section I Ñ Lines of Communication shall be comprised in the investment lists Ñ annex to the budgets of the main officials with power to authorize expenditure on the basis of feasibility investigations elaborated and approved in accordance with the legal provisions. The works may be financed, totally or partially, by foreign investors, too, under the terms of law. Depending on the common interests with the neighbouring countries, another development works of the lines of communication, considered to have priority, established by a Government resolution, may be achieved, too. The planning of the carrying out of the works stipulated under the present law shall be established by the Government. Art. 4. Law No. 71/July 12, 1996 National Town and Country Planning Communication shall be compulsory and shall be implemented in the territorial planning of the counties, municipalities, towns or communes, as the case may be. The delimitation of the plots of land, of the passages and of the location that are necessary for the lines of communication shall be established by town planning and/or town and country planning documentation, and by feasibility investigations approved under the terms of law. Expropriation on reasons of public utility, the occupancy of the plots of land, and the drawing out from the agricultural and forest production shall be made under the terms of law. The authorization for the execution of definitive constructions on the plots of land reserved to the development of the lines of communication established by the town and country planning documentation shall be prohibited. Art. 5. Ñ The central public administration authorities and the local public administration authorities shall cooperate in order to ensure the implementation of the present law's provisions.
