In this matter, I act for and on behalf of the Government of Mexico.. There is an extradition treaty in force between the United States and Mexico, 1 U.S.T. 0; TIAS.. The extradition treaty between the United States and Mexico provides in Article for the provisional arrest of alleged fugitives pending the submission of a formal request and supporting documents.

In accordance with Article of the Extradition Treaty, the Government of Mexico has asked the United States through diplomatic channels for the provisional arrest of BRUCE AINSLEY BERESFORD REDMAN, with a view towards his extradition.. According to the information provided by authorities in Mexico in the form authorized by the Extradition Treaty, BRUCE AINSLEY BERESFORD REDMAN is charged in the State of Quintana Roo, Mexico, with aggravated homicide, as described by articles, (I and 1, and punishable under article of The Penal Code of the State of Quintana Roo. On May, 0, the Second Judge of First Instance of the Judicial District of Cancun, Quintana Roo, issued an arrest warrant for BRUCE AINSLEY BERESFORD REDMAN as part of criminal case number 1/0.. As set forth in Diplomatic Note 0 dated June 1, 0, as supplemented by information provided to the United States Department of Justice by authorities in the Procuraduría General de la República (Attorney General s Office of the United States of Mexico, and as collected by United States law enforcement authorities providing legal assistance to Mexico, the facts of the case for which extradition is sought are as follows: a. On April, 0, at the Hotel Moon Palace Nizuc, in Cancun, Quintana Roo, Mexico, BRUCE AINSLEY BERESFORD REDMAN ( BERESFORD killed his wife Monica Burgos Beresford Redman ( Monica Burgos by asphyxiating her. b. BERESFORD and Monica Burgos had been having marital troubles for some time before her murder. According to a sworn statement made to Mexican authorities by Monica Burgos sister, Jeane Ferreira Burgos ( Ferreira Burgos, about a month

1 1 1 1 1 1 1 1 0 1 and a half before Monica Burgos was killed, Monica Burgos told Ferreira Burgos that BERESFORD was having an affair with another woman. Monica Burgos confronted her husband about his infidelity, which he acknowledged and asked for her forgiveness. Monica Burgos then withdrew assets from their joint bank account and moved them to a new account. When Monica Burgos discovered that BERESFORD still had contact with his mistress, she demanded a divorce and told BERESFORD that, if he agreed to the divorce, she would give him half the money she had transferred to the new account. She told him that, if he did not agree to the divorce, she would keep all the money. c. According to a statement made by Ferreira Burgos to United States law enforcement authorities, prior to BERESFORD and Monica Burgos trip to Mexico, Monica Burgos had changed the locks on their residence in Palos Verdes and told BERESFORD to stay away. Monica Burgos further notified the schools that their children attended that BERESFORD should not be allowed to pick the children up from school. In the weeks before the trip to Cancun, Monica Burgos took the children on a trip to Hawaii and refused to allow BERESFORD accompany them. d. The fact of BERESFORD s affair was confirmed through emails obtained by the Mexican authorities in which BERESFORD admitted to his wife that he had been unfaithful. e. In a sworn statement to Mexican authorities, Ferreira Burgos said that she learned from Monica Burgos that BERESFORD had proposed a family trip to Mexico at the end of March 0, and Monica Burgos accepted. Monica Burgos told Ferreira Burgos that BERESFORD paid for the travel.

Maria Beatriz Oaxaca ( Oaxaca, the nanny for Monica Burgos two small children (ages and, was interviewed by United States law enforcement and stated that BERESFORD and Monica Burgos had a big fight the night before they departed for Cancun. Oaxaca stated that the fight concerned the affair that BERESFORD was having. Oaxaca also stated that a day or two before the trip, she learned that BERESFORD wanted to buy life insurance for Monica Burgos and himself. Oaxaca does not know if BERESFORD actually purchased the insurance. g. BERESFORD, Monica Burgos, and their two small children traveled to Cancun, arriving on March 1, 0. They all shared room number 1 at the Hotel Moon Palace. h. The marital problems continued in Cancun. In a conversation from Cancun on April, 0, Monica Burgos told her sister, Ferreira Burgos, that she had found evidence that BERESFORD was still in contact with the woman with whom he was having the affair. i. Erick Uriel Gonzalez Reyes ( Gonzalez Reyes, an employee at the Hotel Moon Palace, provided a sworn statement to Mexican authorities. Gonzalez Reyes stated that, around :0 P.M. on April, 0, he saw a man and a woman arguing in front of the Los Tacos restaurant at the hotel. Gonzalez Reyes observed the interaction of the two people for several minutes and noticed that the woman was crying. Gonzalez Reyes said that, as he continued to watch the argument, he saw the man twice attempt to physically assault the woman, but the man stopped when he realized that Gonzalez Reyes was watching. Gonzalez Reyes later identified a photograph of Monica Burgos as the woman he

1 1 1 1 1 1 1 1 0 1 saw outside the restaurant, and said that a photograph of BERESFORD looked like the man who was arguing with her the evening of April, 0. j. According to a handwritten statement provided to hotel security officers, around :00 A.M. the next morning (April, 0, two English teenagers from the Cook family who were staying at the hotel were awakened by screams, crying for help and extremely loud banging from the room above [theirs].... It sounded like a wom[a]n in extreme distress. When the noises continued for about 1 minutes, the teenagers went to their parents room to tell them what they had heard. k. Hotel concierge Angelica Arroyo Ramirez ( Arroyo Ramirez provided a sworn statement to Mexican authorities and said that on April, 0, around :0 A.M., the Cook family approached Arroyo Ramirez and asked to file a complaint about the noise they had heard earlier that morning. Arroyo Ramirez determined that BERESFORD, Monica Burgos, and their two small children were staying in the room from which the screams, crying and banging had come, which was located directly above the room occupied by the Cook teenagers. The Cook family stated that the noises the teenagers had heard sounded like a woman crying and things being dragged across the floor. l. The morning of April, 0, Arroyo Ramirez telephoned BERESFORD s hotel room to make sure that everyone was all right. BERESFORD answered the phone and, when asked about the disturbance, replied that it was true that noises had come from his room and said that they were related to a fight he was having with his wife regarding the behavior of their children.

1 1 1 1 1 1 1 1 0 1 BERESFORD stated to Arroyo Ramirez that it would not happen again. Arroyo Ramirez did not speak to Monica Burgos. m. In a subsequent statement given to Mexican authorities after his wife disappeared, BERESFORD denied making the statement to Arroyo Ramirez regarding having an argument with his wife, and instead claimed that the noise was caused by a game that he and his wife were playing with their three year-old son which involved colliding with the bed or the wall. BERESFORD stated that it was his son who was making the most noise. n. Carlos Mario Vazquez Olan ( Vazquez Olan, a cleaning employee of the hotel, made a sworn statement in which he told Mexican authorities that he was assigned to clean rooms including number 1, which was occupied by BERESFORD. On April, 0, Vazquez Olan cleaned room 1 and did not notice anything out of the ordinary. On April, 0, Vazquez Olan arrived to clean room 1 and noticed the Do Not Disturb sign hanging on the door all morning. When he returned around :00 P.M., the Do Not Disturb sign was still on the door. At one point that afternoon, Vazquez Olan encountered BERESFORD coming out of room 1. When Vazquez Olan asked if BERESFORD wanted his room cleaned or new towels, BERESFORD declined and said that everything was fine. Vazquez Olan stated that the Do Not Disturb sign was still on the door to room 1 at :00 P.M. that evening. Vazquez Olan did not enter room 1 that day. o. According to an April, 0 sworn statement made to Mexican authorities, BERESFORD said that the last time he saw his wife was on April, 0, at approximately :0 or :00 A.M. in their room. He said that she left to go shopping and he did

1 1 1 1 1 1 1 1 0 1 not expect her to return until around :00 P.M. that night. BERESFORD also said that his wife left the hotel for the day and did not take her cell phone with her. In an April 1, 0 interview with United States law enforcement, Ferreira Burgos stated that Monica Burgos never traveled anywhere without her cell phone and certainly would not have left her cell phone at the hotel if she was traveling without her children. p. In his sworn statement, BERESFORD said that his wife did not return in the evening of April, 0 and that, around :00 P.M., he went to bed. He further stated that around :00 P.M., he awoke to find that she still had not returned. BERESFORD claimed that this worried him, and so he walked around the hotel to look for her. He said he went in and out of the room several times but never spoke to anyone at the hotel or reported his wife missing that night. BERESFORD said he then returned to his room and eventually fell back asleep. This statement conflicted with a telephone call that BERESFORD had with Ferreira Burgos. In her sworn statement to Mexican authorities, Ferreira Burgos said that she spoke with BERESFORD by telephone on April, 0, at which time BERESFORD told her he had fallen asleep the night of April, 0, but did not notice his wife s absence until he woke up the next morning. q. At about :00 A.M. on Tuesday, April, 0, BERESFORD told hotel employees that his wife was missing. He was told that he should report that information to the local prosecutor, but, instead, he went to the U.S. Consulate. At the Consulate, he was again told to report his wife s disappearance

1 1 1 1 1 1 1 1 0 1 to the local prosecutor, which he did at around : P.M. on April, 0. r. Hotel security guard Rodolfo Mogo Almeida ( Mogo Almeida was interviewed by Mexican authorities and provided a sworn statement that the hotel keeps very detailed records of persons entering and exiting the hotel property, including checking names against a list of hotel guests, and that every hotel guest leaving the property is identified. Mogo Almeida s shift is from :00 A.M. to :00 P.M., Monday through Saturday. He stated that he had not seen Monica Burgos until being shown a video of her as the search party was organized. s. After the hotel created a search team to look for Monica Burgos, her body was found by a hotel employee on April, 0, at approximately :0 A.M., in a sewage tank on the hotel grounds. The tank was approximately meters from the building where BERESFORD s hotel room was located. The tank had an opening at the top and one of the two covers was not properly closed. t. An autopsy revealed that the cause of Monica Burgos death was asphyxia by suffocation. The autopsy report also reported the presence of bruising to the victim s face and a blunt head wound that the examiner stated was related to the time and date of death. u. On April, 0, a forensic expert examined BERESFORD s hotel room. He found stains on a pillar in the room, on the sheets on the bed, and on a railing on the balcony of the room. The stains tested presumptively positive for the presence of blood.

1 1 1 1 1 1 1 1 0 1 v. The hotel room in which BERESFORD and his family were staying has a view of the sewage tank in which the victim s body was found. There was a footprint and damaged plants leading to the sewage tank, indicating that the body may have been moved from another location and deposited there. w. The hotel room in which BERESFORD and his family were staying has a door which is opened by an electronic card key. Records from the hotel indicate that one of the keys issued to BERESFORD and his family was used to open the door to their room, number 1, at least nine times between midnight and :00 A.M., in the early morning hours of April, 0. At least four of these entries are recorded as occurring during a fifteenminute period between :00 A.M. and :1 A.M. x. A purse was found with Monica Burgos body in the sewage tank. The contents of the purse included identification documents for Monica Burgos and other personal items. The purse did not contain a hotel key card. y. During the April, 0 interview of BERESFORD conducted by Mexican authorities after the disappearance of his wife, law enforcement officers observed scratches or abrasions on both of BERESFORD s hands, behind his ear, on his left shin, and on his right ankle. BERESFORD said the scratches on his hands and legs came from climbing a slippery wall during an excursion earlier on the trip. He stated that the scratches behind his ear were caused when he surfaced too quickly while swimming and hit a rope connected to the boat. z. A colleague of BERESFORD, Tim Blixseth ( Blixseth, gave a statement to United States law enforcement

Blixseth stated that he had not heard from BERESFORD in a year when he received an e-mail from BERESFORD on April, 0, indicating that BERESFORD s wife was missing. Blixseth asked BERESFORD to call him. That evening, BERESFORD called Blixseth at approximately :0 P.M. and said, I lost my wife. Blixseth stated that it was as if BEREFORD was reading from a script. There was no emotion. BERESFORD and Blixseth spoke again and BERESFORD said that Monica Burgos had left to go shopping on April, 0, but there was no record of Monica Burgos ever leaving the resort even though each guest was checked in and out of the resort by hotel employees. Blixseth stated that BERESFORD was very calm and it was as if he had just lost his dog.. Aggravated Homicide is an extraditable offense under Article, Paragraph 1, of the Extradition Treaty between the United States and Mexico, and Item 1 of its Appendix.. Copies of the photographs identified by witnesses as being BERESFORD have been provided by Mexico.. BERESFORD is at large and believed to be in the Central District of California. The United States Marshals Service has detailed location information. WHEREFORE, the undersigned complainant requests that a warrant for the arrest of BRUCE AINSLEY BERESFORD REDMAN be issued in accordance with 1 U.S.C. 1, and the Extradition Treaty between the United States and Mexico; and that, upon such hearing as is required by federal law, if the Court deems the evidence sufficient under the provisions of the treaty to sustain the charges for which extradition is sought, the Court certify

the same to the Secretary of State so that a warrant may be issued for the surrender of BRUCE AINSLEY BERESFORD REDMAN, to the appropriate authorities of Mexico. The United States also requests that the Court take such other actions as may be required under the provisions of the treaty and the laws of the United States.
