CEMVP-OP-CH 4 December 2007 MEMORANDUM FOR Record SUBJECT: Minutes of River Resources Forum Meeting #79, 29 August 2007 1. ntroductions / Approve Minutes/ Meetings A meeting of the River Resources Forum (RRF) was held on 28 & 29 August 2007 at the Americnn in Wabasha, MN. Attached is the attendance list and handouts from the meeting. Following introductions, the Minutes from RRF #78 were approved as prepared. The next meeting is scheduled for 4 & 5 December 2007 with location TBD. 2. Agency Activities Note: Only the agencies listed below had significant information to report. A. USFWS (Wege): The bald eagle has been delisted so it is no longer endangered, but it is still protected. The Refuge-wide meeting is today (28 Aug). B. W DOT (Kieck). They do not have a budget. Have been receiving applications for the Harbor Program, including one from Brennan Marine in LaCrosse, W. The City and County of LaCrosse will have a joint Harbor Committee. C. COE (Tapp): The new District Engineer, Jon Christensen, took office on 8 June. The Channel Maintenance Coordinator position remains open and is in the process of being advertised. Bill Meier continues the temporary promotion as a Channel Maintenance Coordinator until mid October. LD 3 will be dewatered this winter. Rehabilitation of LD 10 will continue until 2008. (Baumgard): The Corps is looking at a High Performance Organization (HPO) for the Locks and Dams which will affect the lock operations, Maintenance & Repair, and the Dredge. (Otto): The LUAP maps have been reproduced in digital format for the Mississippi River and public meetings will be scheduled for Mar/Apr 2008. D. W DNR (Benjamin): The DNR secretary resigned and a new secretary will be appointed. E. MN DOT (Lambert): Busy with -35W bridge collapse. Minneapolis port transports million tons/yr. No funding for port development in 2007. Pelzer St. in Winona should be operational by the end of Sept. F. USCG (Dentry): nvolved with the -35W bridge collapse recovery efforts. Staffed the EOC for the SE MN flooding, but not needed. The LaCrosse office has been closed. Board vessels at locks for investigations. G. MPCA (Mader): nvolved with -35W collapse rebuild and the SE MN flooding. There are concerns with lowering Lake Goodview in Winona and trenching to Kohner Pit due to contaminants (sewage, feed lots, septic systems) from the flood waters. There is no reorganization taking place at this time. H. LMRWD (Schwalbe): Kraemer site is nearing full capacity and negotiating with Kraemer on renewing the lease for future use. The Cargill East River site is under development. The pursuit of other sites is on hold for now. The Watershed District wants to know what steps are needed to include the MN River funding with the Upper Miss River funding. The MN River has triple the tonnage of Minneapolis.

Working with FEMA standards for rebuilding in the flood plain. There are many retirements in the office. J. A DNR (Konrad): Regulating shovel nose sturgeon 1500 below the dams. (Griffin): Working on MOU with COE for dredging. K. UMWA (Genz): River boats being affected by the -35W collapse. The annual meeting is scheduled for 20 Sept. 3. -35W Update (Dentry) - A slide show was presented on the rescue mission at -35W. Discussed the use of the Pool 1 placement site which will be available for dredge material otherwise the city of Mpls will be responsible for paying the difference in using an emergency site. An OST meeting would be scheduled prior to the use of an alternate site. The NTSB is trying to remove enough debris to open a 60 ft. channel downstream of Lower St. Anthony Falls to allow commercial barge traffic to pass. 4. Channel Maintenance Program [Handout #79 1]. A. MN River (Tapp) - Explained the funding issue due to the restrictions in reprogramming funds from Miss River to MN River and the Continuing Resolution. HQ denied the waiver to reprogram funds. Letters were sent to Congressionals requesting funds and funds were finally received on 28 July. Dredging started on 29 July. t was recommended by Col Christensen to dual track the request to combine the MN and Miss River funds. Both the COE and the politicians should work on the request. When FY08 funds are received, the Cargill East River site will be developed by M&R. An OST meeting will be scheduled prior to the start of construction. B. Dredge Schedule (Meier) - The dredge schedule for 2007 was reviewed. High flows delayed dredging on MN River. Andrie nc. subcontracted all mechanical dredging work in 2007 to L&S. Red Wing Harbor dredging underway with COE authorities and local funding. C. Channel Maintenance and Placement Site Schedule (Machajewski, Lund) - The schedules were reviewed. The West Newton Chute access dredging is awaiting EA approval. 5. Environmental Management Program (Powell) A. 2007 MVP budget - $5.983M - expected $4M, but an additional $2M was received in order to award the Pool 8 Phase Stage 2B construction contract. B. FY07 Construction Update (1) Pool 8 Phase Stage 2A ($280K) M&R started construction in July. Completed seed islands and are working on island N1. (2) Pool 8 Phase Stage 2B [($6.1M ($4.85M EMP/$1.25M OM)] Awarded to Matteson on 8 Aug. Three options will be awarded based on future funding ($1.6M, $530K, $1.0M). 2

Minutes of River Resources Forum Meeting #79 29 August 2007 (3) Clear Lake P&S for dredging topsoil for the LD 4 Embankment project is delayed due to funding shortage. f bid price is excessive, the wetland scrapes will be reconsidered for topsoil. (4) Pool Slough completed. C. FY07 Planning (1) Harpers Slough and Capoli Slough delayed due to mussel survey protocol issue (maybe Sep 08). (2) Conway Lake, Lake Winneshiek, and McGregor Lake deferred due to funding shortage. D. FY08 Budget Anticipating $4.5M for MVP E. Drawdowns (1) EMP Coordinating Committee gave the ok to fund drawdowns with EMP funds. This will be discussed in more detail at the Dec RRF. (2) RRF requests the WLMTF initiate a project proposal/fact sheet for a specific pool to be presented to the FWWG for review then presented to RRF in Dec. 6. Water Level Management (DeZellar) A. Handouts Links to the handouts can be viewed by accessing the St. Paul Districts Environment web site (Drawdown Reports). Putting in for Chief s Award for the Water Level Management Program. t was suggested by Steve Tapp to update the tables in the reports to reflect current dredging results. (1) Water Level Management Update, August 2007 (2) Summary of Results of the Pool 5 & 8 Drawdowns (3) Upper Mississippi River Pool 8 Drawdown Report B. Drawdowns (1) Pool 6 - Scheduled for a minor drawdown in 2008 with a maximum of 1.0 at the dam and a maximum of 0.5 at the control point. There will be monitoring of vegetation, sediment and mussel mortality. There will be no advance main channel dredging. Recreation access dredging may be required. Need to update the Letter Report/Environmental Assessment and have a new FONS signed by the DE. Completed the pool wide survey of mussels in Pool 6. Public meetings are scheduled for 25 Sep at Winona State and 26 Sep at Trempealeau Village Hall. (2) Pool 9 On hold for now. (3) Pool 3 Working on Fact Sheet. Many challenges, but looks feasible at this time. 7. Xcel Powerline Update (Lilley & Rasmussen) [Handout #79-2] - Public meeting in Winona on 11 Sep. Discussed the Certificate of Need (CON). 8. Navigation & Ecosystem Sustainability Program (DeZellar) A. Handouts were provided prior to the RRF meeting and discussed during the meeting. B. WRDA - Passed both the House and the Senate. C. FY 07 Work Plan - Economic Re-Evaluation Report D. nstitutional Arrangements all RRF partners need to be involved with EMP/NESP integration. 3

Pursue GS identification of areas of concern and use this information to educate the public. 10. Recreation Work Group (Otto) A. Beach Plans (1) Pool 9 Draft will be distributed to RWG members in Sep and plan to have endorsed at Dec RRF (2) Pool 10 Hold OST with Friends of Pool 10 B. Boating Study - 9 of 10 flights are completed with the last on Labor Day. Data will be compiled in Sep 11. Navigation Work Group (Machajewski) - Mooring buoy near LD8 is not used by towing industry. ndustry would prefer a cluster of pilings. - The UMRBA added more flexibility to the language in NESP for mooring buoys. t now states Construct mooring facilities at Locks 12, 14, 18, 20, 22, 24, and LaGrange Lock or other alternative locations that are economically and environmentally feasible. 12. Pool 2 (Genz) - The Nav Work Group is reviewing the options to reroute Freeborn in Pool 2.
