THE CORPORATION OF THE TOWN OF SAUGEEN SHORES COMMITTEE OF WHOLE MINUTES March 12, 2007 Committee of Whole Meeting of the Council of the Corporation of the Town of Saugeen Shores held on Monday the 12 th day of March, 2007 in the Council Chambers located at 600 Tomlinson Drive, Port Elgin. PRESENT: Mayor Mike Smith Deputy Mayor Doug Freiburger Vice Deputy Mayor Doug Gowanlock Councillors: Jane Barber, Luke Charbonneau Diane Huber, Thead Seaman, Victoria Serda ABSENT: Councillor Fred Schildroth 1. CALL TO ORDER Mayor Smith called the Committee of Whole Meeting to order. 2. DECLARATION OF PECUNIARY INTEREST AND NATURE None declared. 3. DEPUTATIONS 1. Allan Speer and Brian Johnston owners of 623 Green Street propose a licenced outdoor patio on the former TK Restaurant site. The deputation requested Town Council give consideration to allowing an outdoor patio on municipal property in front of the property on 623 Green Street. They requested the use of the existing patio space which operated as a licensed patio until late 2002, described as outdoor south east section licensed for 47 people. The Owners are not proposing to place any permanent structures on the town right-ofway. The space will have soft landscaping with tables and chairs for dining customers and will operate as an extension of the dining room. The two summer months can make a significant difference to the success of an operator and can offset the poor weather conditions in the winter. The added patio space will create as many as 5 extra full and part time summer student jobs. The sidewalk will not be impeded and patio seating will be set back at and separated by (movable) planters. The target client is a family casual dining supplemented with a beautiful patio on the front on the building with no plastic furniture or picnic tables.
The Committee asked staff if there was a by-law prohibiting the use of municipal property as a patio. Staff responded that there was no by-law restricting the use of municipal property, but there is a resolution of the previous council that set direction regarding the use of public property along the lake front shall not be used for private use and encroachments shall be removed to ensure future public use. If the municipality wishes to grant approval to allow a patio on municipal property the applicant shall be responsible for entering into an encroachment agreement and providing the necessary insurance to protect the municipality. The Deputation also requested that the three on-street parking spaces be eliminated to provide a better view of their restaurant and patio. The deputation feels that the on-street parking can be eliminated as they will be providing off-street parking adjacent to their restaurant. 2. Pat Dobeck resident of Emerald Drive and member of the newly formed Saugeen Shores Green Team made the following presentation regarding the Tim Horton s proposed on the corner of Emerald Drive and Albert Street. Average drive-thru time is 5 6 minutes AFFECT ON HEALTH Tailpipe emissions react to form ground-level ozone. Ozone irritates and inflames the respiratory tract According to Health Canada, more than 16,000 Canadians die prematurely every year because of air pollution. AFFECT ON CLIMATE CHANGE The transportation sector is the single largest source of climate-changing emissions in Canada.
Tailpipe emissions include massive amounts of carbon dioxide (CO2) and nitrogen oxides (NOx). CO2 is responsible for over 60% of the enhanced greenhouse effect, causing climate change. NOISE POLLUTION - ADJACENT RESIDENTIAL HOMES 24 hour speaker for placing orders Loud music from vehicles in drive-thru Disruptive engine noises from cars and trucks throughout the day and night Large delivery trucks during the night Night-time garbage pick-up and snow plowing SAFETY CONCERNS Children s playground across the street from one of the proposed entrance/exits Increased accidents due to: traffic congestion (3 accidents in <3 yrs) No turning lane on highway Poor visibility due to snow banks No provision for transport truck parking SAFETY RECOMMENDATIONS: 1. No vehicular entrance on Emerald Drive (too close to children s park) 2. Provide access for pedestrians and take-out window 3. Add sidewalks along highway and side street 4. Create a well-lit crosswalk from children s park to Tim Hortons 5. Prohibit parking for first 100 metres on Emerald Drive west of the highway 6. Prohibit large trucks from using Emerald Drive ENVIRONMENTAL RECOMMENDATIONS: 1. BAN DRIVE-THRU 2. RESTRICT night-time hours of business 3. Provide substantial landscaping and picnic tables 4. Make this Tim Hortons a destination of choice for local residents and visitors SAUGEEN SHORES COUNCIL LEAD THE WAY ACT NOW to protect FUTURE generations Oppose the drive-thru for proposed site Promote Tim Hortons as a destination Legislate a moratorium on future drive-thrus in Saugeen Shores 4. REPORT OF MUNICIPAL OFFICERS / COMMITTEES 4.1 Public Notice 4.2 General Government 1. Southampton 150 th Anniversary Celebrations - 2008 The Southampton 150 th Celebration committee has been actively planning for their 2008 anniversary event for several years. The celebration will be held from August 14 th to 17 th, 2008, with a number of major events planned for this weekend. One of
their fundraising initiatives is the sale of a 16-month Then and Now event calendar that they are planning to have on sale for the May 2007 long weekend. The committee has requested financial assistance from the town in the form of a loan to get the calendar produced early this year to allow sales to get underway. The total project is estimated to cost $27,000. The committee has fundraised $10,000 to date which will immediately be applied to the cost, leaving an outstanding balance of $17,000 to be repaid over the next year. The Committee recommended that the Council of the Town of Saugeen Shores support the Southampton 150 th Anniversary Celebrations with a loan in the amount of $17,000 to assist in the production of a 16-month Then and Now event calendar, with full repayment of this loan to be made by August 31 st, 2008. 4.3 Environmental Services and Transportation 1. Cruiser's Cruise Night Saugeen Shores Chamber of Commerce and the Saugeen Memorial Hospital Foundation have made application for a Special Events - Cruiser's Cruise Nite to be held in Southampton on Thursday nights, from May 17 th to September 13 th a the Dominion Lookout. This is the thirteenth year of the weekly summer event with proceeds being donated to the Saugeen Memorial Hospital for equipment purchases. The organization has sufficient Staff to erect the barricades and provide assistance to affected residents to access to and from their properties, being one resident on the south side of High Street and one resident on the north side of High Street and one resident on the northwest corner of High and Huron Streets. A copy of Certificate of Insurance has been received showing the Town of Saugeen Shores listed as an additional insured. The Assistant Director of Public Works will notify the various agencies affected by this closure. The Committee recommended that permission be granted to Saugeen Shores Chamber of Commerce and the Saugeen Memorial Hospital Foundation to hold Cruiser's Cruise Nite each Thursday evening commencing May 17 th, 2007 until September 13 th, 2007 from 5:00 p.m. until 9:30 p.m. and further, that High Street be closed west of Huron Street to Lake Huron. 4.4 Planning & Development 1. Site Plan Agreement - Tony Freisinger - Business Park Lot By-law 99-2006 authorized the sale of a.518 acre parcel of land located in the Port Elgin Business Park on Hepner Crescent to Mr. Anton Freisinger.
He has now made application for site plan to construct a 309.7 square metre industrial building for a wood working shop and indoor storage. Staff has required a few minor alterations to the site plan as per the Zoning By-law as follows: Removal of the 2 storage containers and replaced with outdoor storage. Asphalt surface be extended to the rear of the building on the west side. These requirements will be competed prior to the signing of the Site Plan Agreement and the issuance of a building permit. The Committee recommended that Council authorize staff to proceed with processing of a site plan agreement on Hepner Crescent for Anton Freisinger. 4.5 Community Services / Parks and Recreation 1. Proposed Facility Rental Rate Increase for 2007 Mike Myatt, Director of Community Services presented a report explaining that during 2007 budget discussions, Saugeen Shores Council discussed rate schedules for our facilities and programs. The rate increases being proposed for 2007 range from zero percent for our banquet hall/meeting room facilities to 5.5% for our ice rental rates and 4% for our summer beach carnivals. Our Tourist Camp fees rose from $1650.00 to $1710.00 in 2006 and an increase to $1760.00 is being recommended for 2007. This represents a 2.9% increase to our seasonal rates. In addition to the 2.9% increase, all seasonal permit holders will be invoiced for additional refrigerators up to $150.00 for second units. Our overnight transient sites will increase by 3.3% to $31.00 per night. We have moved away from transient bookings at the Port Elgin Tourist Camp and replaced primarily with seasonal campers. A total of 10 transient sights will be maintained for guests. Transient rentals are being adequately accommodated at other tourist camps. Our Harbour docking fees increased by $1.00 per foot in 2006 (2.8%) to $37.00 per foot, and it being recommended that this rate be increased from $37/ft to $39/ft for 2007. This represents an increase of 5.4%, and our transient fees would increase from $1.35 per foot to $1.40 per foot (3.7%). This rate was increased in 2006 to $1.35 from $1.30 in 2005 which represented a 4.0% increase in 2006. Meaford in comparison is moving to a $37.00 rate for 2007, Midland $40.00, Thornbury $37.00 per foot. At the higher end of the scale, Wiarton offers seasonal docks ( hydro and winter liftout/storage included) for $64.00 per foot and Kincardine rates are under review ( presently $35.00 per foot) Mike Myatt recommended that the majority of our pool program rates be increased
with several of our rates increasing by approximately 3.2% as outlined in Schedule A. Other local municipalities are surveyed by our staff on a regular basis to compare our rental rates and user fee rates. Our ice rental rates for example being proposed at $115.00 per hour compares to Hanover, $116.00, Owen Sound $140.00, Walkerton $107.00, Goderich $112.00, Collingwood $130.00, Paisley $102.00, and Wingham $106.00 per hour. Staff is recommending that the majority of our playing field rates be increased across the board by 4.6.%. Community Services with the support of Council have invested a significant amount of dollars in to our IPM, Turf Management Program over the past four years and we have seen good results with the quality of our turf for our soccer and ball field users. These rates were increased by 4% in our 2006 budget..
