Idyllic and surrounded by the River Aare on the edge of the picturesque old town of Thun; Natural and urban experience; rolled into one. Thun is optimally accessible by public and private transport. The Freienhof is situated 5 minutes' walk from the train station and can be reached within 20 minutes from Bern and in 75 minutes from Zurich by the motorway. We also have a garage for 60 cars. Our 66 individual rooms, most with views of the river Aare, are comfortably equipped with a bath or a shower, WC, hairdryer, telephone, TV, radio, safe, kettle for tea/coffee and free internet connection. 1. General conditions 1.1 Reservation of technical and organisational services In the absence of specific requirements of the event organiser, the seminar rooms will be furnished with our standard equipment, including technical equipment, and the event will be organised according to the schedule specified in the contract letter. 1.2 Use of rooms The reserved facilities will be made available to you 30 minutes before the start of the seminar on the first day of the event. If you require the facilities before this time, we will charge a supplemental fee. Kindly contact our seminar division in advance if you want to make use of this option. 1.3 Hotel rooms If Hotel Freienhof Thun AG is not able to make all agreed hotel rooms available, the hotel shall try to offer at least equivalent or better accommodation. Any resulting costs, such as higher room rates, transport costs, etc., will be borne by Hotel Freienhof Thun AG. 2. Invoicing Any services ordered but not used during the event, as well as "no shows", will be charged at full cost. Unforeseeable additional costs incurred during the seminar, which were not confirmed in the reservation, will be charged on a time and material basis. Unless otherwise specified by the event organiser, all itemised services will be charged to the total account. Unless otherwise agreed in the contract, all extra services that are not itemised and not customary (such as phone calls from the rooms, consumption at the bar, garage fees) will be settled individually by each participant before departure. The event organiser shall be liable if participants fail to settle their individual bills. Kindly specify the correct invoicing address when returning the signed copy of the contract letter. 3. Revocation and cancellation 3.1 By the event organiser If the event organiser cancels the event or parts thereof, the following cost will be due: Change in the number of persons by up to 10% up to 14 days before the event: cancellation free of charge less than 14 days before the event: confirmed services to be charged at full cost The final invoice will be based on the number of persons specified 48 hours before the start of the event. Change in the number of persons by more than 10% or cancellation of the entire event 60 to 30 days before the event: confirmed services to be charged at 50% 29 to 15 days before the event: confirmed services to be charged at 75% 14 to 01 days before the event: confirmed services to be charged at full cost 3.2 By Hotel Freienhof Thun AG Hotel Freienhof Thun AG is entitled to withdraw from the contract without compensation for the following reasons, and in particular 3.2.1 if the required advance payment has not been made within the set time-limit; 3.2.2 in the event of unforeseeable, exceptional circumstances, circumstances not caused by a fault of the hotel or of force majeure, if these circumstances make it impossible or unreasonable for Hotel Freienhof Thun AG to perform the contract. 3.2.3 if the event / the event organiser might harm the image and reputation of Hotel Freienhof Thun AG; this includes sales events and organised shopping excursions. 4. Payment terms In the absence of specific terms agreed in the reservation agreement, the following payment terms shall apply: Eight weeks before the event, Hotel Freienhof Thun AG will invoice at least 50% of the expected overall costs of the event. Final invoice: 20 days after the date of invoice. We request settlement of invoices of less than CHF 300.00 in cash upon departure. Our invoices are issued in CHF and include value-added tax. In addition, a visitor s tax will be charged for all overnight guests at the rate of CHF 2.50 /night 5. Approval of overtime Events can be extended into the evening hours. If the reserved duration of the event is likely to exceed the statutory closing time, the customer shall contact Hotel Freienhof Thun AG not less than 7 days before the event to obtain the necessary approvals and to take the organisational measures. 6. Self-catering The event organiser, event participants and guests may only bring their own food and beverages to the event if this has been agreed in writing with Hotel Freienhof Thun AG. In these cases, Hotel Freienhof Thun AG is entitled to charge a service fee to cover the operating costs (e.g. a corkage fee). 7. Liability 7.1 Of the event organiser The event organiser shall be liable to Hotel Freienhof Thun AG for any damage and losses caused by the event organiser or by event participants without having to show any fault on the part of the organiser. 7.2 Of Hotel Freienhof Thun AG Hotel Freienhof Thun AG shall not assume any liability for theft or damage incurred by the event organiser, participants, speakers, or to materials provided by third parties. This shall also apply if parked or manoeuvring vehicles are lost or damaged. 8. Final provisions These General Terms and Conditions may only be modified by written agreement. The General Terms and Conditions are governed by Swiss law only, and the place of jurisdiction shall be Thun. 19

Our prices INCLUDE value-added tax at the special tax rate of 3.8% for accommodation/breakfast and 8% for all other services; EXCLUDE visitor s tax in the case of seminar flat rates and room rates. The visitor s tax is charged for all overnight guests at a rate of CHF 2.50 /night. 20
