Asia Pacific Conference (APK) in New Delhi in 2012 The 13 th Asia Pacific Conference of German Business will be held from 1 st to 3 rd November 2012 in Gurgaon, New Delhi. With reference to the erstwhile Press Note 1 of 2005 (Consolidated FDI Policy), which prohibited any foreign company with an existing joint venture/tie up in India as on January 12, 2005 from setting up its
own company/joint venture in the same field of business unless FIPB (Government) approval or No Objection Certificate ( NOC ) from the Indian partner is obtained, has been done away with. Effective from 1 st April 2011, the Circular provides a major relaxation in FDI policy; whereby obtaining the prior approval of the FIPB and receipt of the No Objection Certificate from the existing JV partner is no longer a prerequisite for investing in the country. The relevant extracts of the press release is as under: A discussion paper had been released by DIPP last year on the need for review of this condition. There is a felt need to attract fresh investment and technology inflows into the country, as also to reduce the levels of State intervention in the commercial sphere. Keeping in view the above, Government has decided to abolish this condition. It is expected that this measure will promote the competitiveness of India as an investment destination and be instrumental in attracting higher levels of FDI and technology inflows into the country.
