Mu n i c i pa l Dr a i n ag e Ut i l i t y Texas Municipal Drainage Utility Survey In 1987, the Texas Legislature enacted the Municipal Drainage Utility Systems Act providing enabling legislation that allows municipalities to implement a user-fee-based funding mechanism for support of municipal drainage management activities (Texas Local Government Code 402.041 through 402.054.). Between April and September 2008, research was conducted to identify operating Drainage Utilities in the State of Texas. The primary research tool was Internet search. Through this investigation, fifty-eight (58) operating Utilities were identified; it is possible that there are others in place. Four (4) municipalities were identified that were in the process of implementing Drainage Utilities. Available Utility ordinances, customer rate structures, and fiscal year 2008 budgets were reviewed and summary information compiled. The compiled information was shared back with primary contacts in each municipality for confirmation, revision and supplementation. The Drainage Utility Advantage The Drainage Utility cost-of-service, user-fee-based revenue system operates on the same fiscal principles as other municipal utilities (i.e., water, wastewater and electric power). Fees are typically assigned to property parcels based on stormwater runoff potential of the property and billed monthly along with other municipal utility services. Installation of impervious surfaces such as rooftops and paved areas increases both the rate and amount of stormwater runoff and increases runoff pollutant loadings. The increase in runoff demand is conveyed and managed by municipal drainage infrastructure and waterway systems that are under municipal responsibility. This analog with other municipal utilities allows the Drainage Utility to equitably assign drainage management program costs to properties based on runoff characteristics. Drainage Utility revenues can be used to support all aspects of comprehensive municipal drainage management including administration; operation/maintenance; infrastructure repair/ replacement; and capital improvements for flood hazard reduction, stream restoration/erosion mitigation, water quality management and TPDES/NPDES MS-4 compliance. Drainage Utility revenue can also be used to support bond debt service, thereby leveraging the utility's annual revenue for large capital improvement programs. Additionally, there are no limitations on combining drainage utility revenue with other municipal funding sources such as the General Fund for drainage management purposes. The advantages of a Drainage Utility over tax-based funding alternatives are significant: Creates a stable, dedicated funding source independent from the General Fund that can support all drainage management activities including bond debt service for large capital improvements; The utility billing fee is based upon runoff contribution rather than property valuation and, thus, provides a fair and equitable cost-of-service, user-fee-based revenue source; and The opportunity for bond financing for drainage management capital projects can leverage Drainage Utility revenue and reduce competition with other general obligation bond financed capital project needs. Since the passage of the enabling legislation in 1987, the Drainage Utility in Texas has become a powerful funding mechanism for municipal drainage management programs. The municipalities that have implemented Drainage Utilities are realizing significant benefits from the availability of stable, long-term revenue streams supporting all elements of municipal drainage and stormwater management programs. Survey Results The following information on Texas Drainage Utilities is summarized from the survey: Population Served- 6,250 to 1,306,900 Annual Revenue- $95,000 to $51,283,000 Annual Revenue per Capita { Average $21.82, Median $18.79 { Maximum $72.24, Minimum $5.70 Utility Service Area- 3.7 to 407 square miles Operations and Maintenance is the primary use of utility revenue. Fiscal Year 2008 CIP appropriations range up to $89,826,000 (San Antonio). Utility revenue is supporting capital improvement programs through both pay-as-you-go and bond financing. Utilities are combining other revenue sources such as the general fund, grants and other fees with utility revenue to meet community drainage management service goals. In addition, some Utilities are exempting senior citizens. 3

Survey Data The individual survey spreadsheets compiled for each Utility are available from Espey Consultants, Inc. The individual spreadsheets are the best reference for specific detail on each Utility, particularly on assignment of fees to different property classes, credits and exemptions allowed, customer billing error appeals, and fiscal year 2008 CIP appropriations and utility revenue debt service. There are significant differences in the quantity of data assembled for each Utility dependent on Internet availability and City follow-up input.
