APPEAL NO: 15-124 RESPONSE DPW PERMIT HOLDER LOBSTA TRUCK this facility will not be able to exist within 6 feet from either parking meter and the fire hydrants to the east of the two spaces From conversations with SF DPW staff, the minimum clearance required of MFFs from parking meters does not apply to mobile food trucks that park on public streets. This clearance requirement was set for mobile food carts that occupy the sidewalk. In regards to the fire hydrants, the permitted spot is more than 7 feet away from a fire hydrant and has been confirmed by SF DPW staff. The appellant has also stated in his own brief that we are more than 7 feet from the fire hydrant for the parking spot we applied for. If this facility parks within the equivalent of 2 parking spaces they will be within 7' As previously stated, the permitted spot is more than 7 feet away from a fire hydrant and has been confirmed by SF DPW staff. Our "active street facing facade" depending on your definition is within 50' Mixt Greens has no active street facing façade (Exhibit A). Their restaurant is set back significantly from the street and is on the side of a building facing a public outdoor space (Exhibit B). Additionally from that same code the 50 feet only applies if the active street facing façade extends beyond 75 feet from its primary entrance. Not only does Mixt Greens not have
an active street facing façade, it does not have any signage on the building that extends past 75 feet from its primary entrance (Exhibit B). Names of Other Appelants: MG RESTAURANTS, SPLIT BREAD, NOP 560 MISSION LLC Tony Alcala is an employee of Mix Greens. Mixt Greens is the same company as MG Restaurants. From a CA Secretary of State business search, the agent for service is David Silverglide, who is the co-founder of Mixt Greens. Split Bread is another one of their concepts and is part of the same company, Good Food Guys. From the website of Split Bread: Who We Are Andrew Swallow and David Silverglide successfully built Mixt Greens to six units in San Francisco and Los Angeles before deciding to turn their sights on revolutionizing sandwiches the same way that Mixt Greens revolutionized salads. Their management company, Good Food Guys is incredibly passionate about bringing great food to as many people as possible and operates both Mixt Greens and Split Bread. NOP 560 MISSION LLC is the landlord for Mixt Greens. We also believe these permits are operating on the same side of the street MFF-0084, MFF0103, MFF0023, MFF0094 15-MFF0084 is an approved permit for 536 Mission St to vend on Mondays, Wednesdays, and Fridays. The days of the week this permit is approved for are Tuesdays and Thursdays.
15MFF-0103 is an approved permit for 560 Mission St to vend Monday through Friday. Of the four mentioned permits, it is the only one that we would be vending with at the same time and on the same side of the street. 15-MFF0023 is not approved as a permit and as such not operating. It is a new application that is currently being reviewed by SF DPW. 15MFF-0094 is an approved permit for the opposite side of the street at 531 Mission St. They are only permitted to vend on Tuesdays and Thursdays for 1 hour, from 11AM to 12PM, and on Mondays, Wednesdays, and Fridays for 1 hour, 1PM to 2PM.
