Narratives Subject: OVI Type Date Time Author Approving Officer Initial Report 12/30/2015 0458 DONALD, VINCE G ADAMS, BRENT D While traveling east on W. Perkins Ave. I observed the listed vehicle in front of me without any tail lights on. I activated my overhead lights and stopped the vehicle in the parking lot of Demores. I made contact with the driver, Shawn Stacy who was eating Burger King. I asked Mr. Stacy for his license and proof of insurance and he provided me with his license and car rental agreement. While speaking with Mr. Stacy, I detected an odor of intoxicants on or about his person. I also observed an open bottle of bud light in the cup holder. Mr. Stacy recognized me and called me by name. I advised him that I would be right back with him. I again asked about the beer and the passenger held up a bottle of water and I advised him I was talking about the beer in the cup holder. The passenger then stated it was his. I took the bottle of beer and returned to my cruiser. At this time, Sgt Adams arrived. Sgt Adams spoke to the passenger while I got Mr. Stacy out of the vehicle. Mr. Stacy exited the vehicle and was unsteady on his feet and his speech was slightly slurred. I asked Mr. Stacy if he would perform a few field sobriety tests for me and he stated he would; the results are as follows. The first test was the Horizontal Gaze Nystagmus. I advised Mr. Stacy that I was going to be checking his eyes and that I would be moving my pen back and forth in front of his eyes. I advised Mr. Stacy to follow the tip of my pen with his eyes without moving his head. Mr. Stacy stated he understood. In doing the test, the pen was held 12 to 14 inches from her eyes and slightly elevated while her eyes were checked for equal tracking. Mr. Stacy showed distinct Nystagmus at maximum deviation in both eyes, and lacked smooth pursuit in both eyes. Mr. Stacy also showed onset prior to 45 degrees in both eyes. It should be noted that when the test started I had to remind Mr. Stacy not to move his head. The second test was the one leg stand. I explained the test to Mr. Stacy and I also demonstrated the test to him. I explained to Mr. Stacy that I wanted him to raise the foot of his choice approximately six inches from the ground keeping his foot parallel to the ground. I advised him while keeping his arms to his side, I wanted him to count to 30 by one-thousands. Mr. Stacy stated that he understood the test. Mr. Stacy raised his right leg but kept his knee bent. Mr. Stacy counted to 30 but did not count by one-thousand. Mr. Stacy started to sway at number 10. I asked Sgt. Adams to keep track of time during the test. Once Mr. Stacy was done with the test, Sgt. Adams stated that there were 4 seconds left. The third test was the walk and turn test. I advised Mr. Stacy to place his left foot on the line and then place his right foot in front of his left and stand heel to toe while I explained the test to him. I advised Mr. Stacy that I wanted him to keep his arms down to his side while I explained the test. I advised Mr. Stacy to take nine heel to toe steps counting the steps out loud. I advised Mr.Stacy that on the ninth step,i wanted him to take small steps and turn around and take nine steps,heel to toe again. I demonstrated the test for Mr. Stacy and he stated he understood. Mr. Stacy took his first step and lost his balance falling off the line. Mr. Stacy took nine steps with gaps between steps. Mr. Stacy counted the steps but his speech was slurred. When Mr. Stacy turned around to take his second set of nine steps, he again lost balance on his first step and falling off the line. Mr. Stacy took the nine steps and once he was complete, Mr. Stacy was placed in restraints and advised he was under arrest for OVI. Mr. Stacy was placed in the rear cruiser #8. I then spoke with the passenger to see if he had been drinking. Sgt. Adams administered a PBT for Mr. Wolfe and the results were. 075. I advised him that he could not drive the vehicle but if he wanted to contact someone to pick him up and the vehicle up, he could. Mr. Wolfe stated he was here visiting and did not know anyone. He requested that we park the vehicle. I explained that he could have someone come pick him and the vehicle up or it would be towed. A short time later, Mr. Stacy's aunt arrived and took control of the vehicle and Mr. Wolfe. I then transported Mr. Stacy to station where he was read and explained the BMV 2255 form in the presence of Sgt. Adams. Mr. Stacy stated that he understood the form and advised that he would take the test. I administered the test with the results being.151. Mr. Stacy requested a court date of 1/4/2016. Once the proper paperwork was completed, Mr. Stacy was served with his copies and released pending court. It should be noted that Mr. Stacy was released to his Aunt Peggy.
