Delamere & Oakmere Parish Council Meeting MINUTES OF THE MONTHLY, PARISH MEETING OF DELAMERE AND OAKMERE PARISH COUNCIL HELD ON MONDAY 17 TH JULY 2017 AT 7.15P.M. DELAMERE COMMUNITY CENTRE, STATION ROAD, DELAMERE Present: Councillors D Rutter (Chairman), J Edwards, T Overland, R Ackerley, A Bell, C George, C Ball, J Inskip and D Wheeler. Also, present Mrs J Monks and two representatives from the Highways Department of Cheshire West and Chester Council. Public Speaking Time No members of the public were present. 1 Welcome and apologies for absence The Chairman of the Parish Council, Councillor D Rutter welcomed Parish Councillors to the Parish Council meeting. Councillor J Powell sent her apologies as she was recovering from an operation. Councillor A Gore sent her apology, as she was unable to attend due to a family bereavement. Cheshire West and Chester Ward Councillor J Leather also sent his apology, as he was unable to attend the meeting. 2 Member s Code of Conduct and declarations of interest Councillor D Rutter declared a non-pecuniary interest in relation to 17/030508/FUL, Lot 4 Rectory Farm Chester Road Delamere, Erection of pole barn, as he was a neighbour. As such, Councillor D Rutter did not take part in the discussion or decision relating to this planning application. 3 Highways Department of Cheshire West and Chester Council Two representatives from the Highways Department of Cheshire West and Chester Council provided a brief update for the Parish Council. Concerning the Abbey Arms junction, the representatives from Highways Department of Cheshire West and Chester Council confirmed that the lining sub-contractor will be commencing the work from 17 th July and this will be done under night closures and should not take more than one week. The illuminated bollard missing on the Abbey Lane coming from Station Road approach will be reinstated and more signage will be installed. Page 225

The clerk received an email on 29 th June regarding the speed limit amendment for the A556/A49. The Highways Department of Cheshire West and Chester Council stated that they are now hoping to fund this scheme from Section 106 monies. If this is the case, the Parish Council is not required to contribute funds. The two representatives from the Highways Department of Cheshire West and Chester Council confirmed this. The Highways Department of Cheshire West and Chester Council have provided a copy of Speed Assessment for the A54 Middlewich Road/Chester Road. The proposal is to reduce the speed limit from 60mph to 50mph along the highlighted section. They are now in the process of ordering the signage and posts and are looking to implement this before the end of 2017. Once the speed limit has been implemented Cheshire West and Chester will send a bill to the Parish Council as the Parish Council agreed to part fund the scheme in the January 2017 minutes up to the value of 880.00. The Highways Department of Cheshire West and Chester Council confirmed that Stoneyford Lane is on a programme for assessment however monitoring is not due to be carried out until October. The Highways Department of Cheshire West and Chester Council have stated that the Stoney Lane speed monitoring will commence from September 2017. The clerk was requested to submit a formal request to the Highways Department of Cheshire West and Chester Council to review the speed limit on Stoney Lane to Watling Drive as part of this assessment. Councillor T Overland raised the issue of speeding on the A556 from the Sandiway traffic lights to J & S bikes in Oakmere. The representatives from the Highways Department of Cheshire West and Chester Council were not aware that this was due to assessed as such the clerk was requested to submit a formal request to the Highways Department from the Parish Council. Councillor D Wheeler reported that there were speed-monitoring cables that had been placed on Station Road. The representatives from the Highways Department of Cheshire West and Chester Council stated that these might not be their cables. The clerk was asked to enquire regarding this with the Highways Department office. Councillor T Overland stated that the road in the middle of the junction of the A49/A556 required attention as it was full of potholes. Cheshire West and Chester Council representatives stated that they were aware of the bad condition of this and were looking at a solution for this issue. Councillor T Overland stated that the hedge verge along the A49 has not been cut, however this may be due to the United Utilities work, which was being undertaken, the representatives from Cheshire West and Chester Highways Department said they would look into this matter. 4 Speed limit contribution for Blakemere Lane, Delamere Road, School Lane, Post Office Lane and Ashton Road, Norley/Delamere/Kingsley. The clerk had received a formal request dated 9 th May 2017 from the Highways Department of Cheshire West and Chester Council to contribute towards the speed limit amendments for Blakemere Lane, Delamere Road, School Lane, Post Office Lane and Ashton Road, Norley/Delamere/Kingsley. The other two Parish Councils were willing to contribute however; they are awaiting a decision from Delamere and Oakmere Parish Council. The full cost of the scheme is 5,141.63. The required contribution from Delamere and Oakmere Parish Council is therefore 1,122.69. The Parish Council would fund this scheme to not exceed 1,122.69 and the funds would be taken out of the New Homes Bonus Fund. The clerk was asked to notify the Highways Department of Cheshire West and Chester Council of this decision. 5 Minutes of the last Parish Council meeting The minutes of the Delamere and Oakmere Parish Council meeting on Monday 19 th June 2017 be approved as a correct record. 6 Progress Reports The Delamere Grove Residents Association and the residents of Eddisbury expressed their thanks for the Parish Council s assistance with the installation of the defibrillator. The clerk noted that that Eddisbury Hill Park Residents Association has not installed the defibrillator. The clerk had contacted Cheshire West and Chester Council Planning department regarding the installation of the new noticeboard at Hogeshead Lane in Oakmere. Councillor T Overland had provided a map of the proposed location and the clerk will sent this to the Planning Department to see if the Parish Council needs to submit a planning application for this 7 Vacant seat application following the resignation of Councillor Rothwell No applications had been received. Councillor A Bell will put a notice on Facebook and Parish Councillors were asked to see if any residents where interested in the position. Page 227

8 Correspondence The clerk had received a request from the Chair of Oakmere Cricket Club concerning whether funding was available for assistance with the purchase of a defibrillator for the Cricket Club. The clerk was asked to reply to the email and inform them that funding was available via the British Heart Foundation and that any funding for the installation may be sought from the Ward Members budget. In addition, the clerk would inform the Chair of the planned defibrillator training in September at Delamere Community centre. 9 Planning The Parish Council considered all the planning applications that had been received up to 17 th July 2017. (a) No objections were made to 17/02233/FUL, Conversion of Existing Stables to One Dwelling, Sandiford Lodge Sadlers Lane. (b) 17/02697/S73, Removal of condition 34 (Renewable energy) of planning application, 14/01086/OUT for construction of up to 180 residential dwellings (useclass C3), Vehicular access, public open space, new footpaths, landscaping, land Remediation, clearance, and ancillary works including a sustainable Drainage system. Land at Former Marley Tile Works Site Station Road Oakmere. The following objection was submitted to the Planning Department of Cheshire West and Chester Council. Delamere and Oakmere Parish wish to object to the removal of this planning condition because the justification given in the developer's application letter is not valid. The letter states that since the Ministerial Statement was released (25 March 2015) Cheshire West and Chester Council have not been imposing conditions on permissions relating to energy standards for new dwellings. This is clearly incorrect, as the outline permission which the developer wishes to amend was itself granted after that date (on 14 May 2015). The condition was applied in accordance with Policy BE21 of the Vale Royal Local Plan, as subsequently adopted in the Cheshire West and Chester Local Plan. (c) No objections were made to 17/02835/S73, Variation of condition 3 of planning permission 13/04507/WAS to allow for an additional 6 months to complete works, Fishpool Quarry Fishpool Road Delamere. (d) No objections were made to 17/02900/FUL, Removal of existing projection conservatory - replaced by orangery. Finchley Chester Road Oakmere. (e) No objections were made to 17/02875/OUT, Replacement of existing bungalow with two storey dwelling Santon Eddisbury Hill Delamere (f) No objections were made to 17/030508/FUL, Lot 4 Rectory Farm Chester Road Delamere, Erection of pole barn. 10 Financial Regulations. The clerk informed the Parish Council that new financial regulations, dated May 2017 from the National Association of Local Councils, which include rules for internet banking. The Parish Council adopted the new financial regulations. 11 Bank Mandate The bank forms were completed to add Councillor D Rutter to the NatWest account. The authorised signatories in the current mandate, for the accounts detailed in Section 2 of the bank form, be changed in accordance with sections 5 and 6 and the current mandate will continue as amended. 12 Finance The clerk reported that the current bank balances were as follows and bank statements showing these amounts were presented and signed by the Chairman. Bank account balance is 37,667.47 as at 30 th June 2017 (The bank balance amount includes the New Homes Bonus fund 21593.02.) Earmarked funds as follows; 675.00 earmarked funds for the speed limit contribution for Abbey Lane and Station Road as requested by Cheshire West and Chester Council resolved to spend this in November 2015 minutes. 250.00 for plaque for tree at Hogshead Lane resolved to spend in November 2016 minutes. 334.00 for contribution for the speed limit reduction for Stoneyford Lane, (subject to plans), resolved to spend in November 2016 minutes. 1,458.00 left for cost of the Forestry Commission legal fees for a 25-year lease on the land at Frith Avenue, resolved to spend this in December 2016 minutes. (Amount of 1,032.00 paid in March 2017 towards solicitors fees.) 880.00 earmarked funds for the speed limit contribution for A54 Middlewich Road resolved to spend this in February 2017 minutes. 893.08 plus VAT for new noticeboard at Hogshead Lane resolved to spend this in May 2016 minutes. Total of earmarked funds to date is 4,490.08 244.20 unpaid cheques. June income received is 276.00 for the installation of the defibrillator at Eddisbury Caravan site from the Ward Members budget. 14 August Recess As there is no meeting of the Parish Council in August it was; Planning The Clerk should liaise with the Chairman and Vice Chairman on planning applications received during the Recess with subsequent discussion with all other Councillors. The Chairman, Vice Chairman and the Clerk be authorised to deal with all routine matters during the Recess. The signing of required cheques to be undertaken by authorised signatories in accordance with the bank mandates and then detailed on the September payment schedule. 15 Little Wood The clerk had submitted several requests to Cheshire West and Chester Council to undertake various tasks at both the play area and at Little Wood; however no response had yet been received. The clerk was requested to take this matter further and included Cheshire West and Chester Ward Councillor J Leather into this correspondence. 16 Land at Frith Avenue The next residents meeting was scheduled for 23 rd August 2017 and the clerk was requested to pay the room hire for this meeting. Councillor J Inskip reported that the plan for the land was almost complete and one estimate had been received for the work. The plan would be presented to the Parish Council at the next Parish Council meeting in September. The clerk was requested to add this as a formal agenda item. Councillor J Inskip was requested to circulate the plan and proposals to all the Parish Councillors prior to the September meeting. Councillor J Edwards confirmed that he had received a letter from the solicitors, Bonallack & Bishop. Councillor J Edwards was requested to circulate a copy of this letter to all the Parish Councillors and to the clerk for their information. This letter requested a 300.00 Money on account payment and requested proof of identity and residential address from each authorised signatory. A cheque of 300.00 for the Money on account payment. Councillors J Edwards, C George and D Wheeler would provide ID to the clerk to forward to the solicitors. Councillor J Edwards explained to the Parish Council that the solicitors had recommended searches in relation to the lease and that these would result in additional costs. The Parish Council would not require the searches. 17 Update from Cheshire West and Chester Councillors None present. 18 Councillor s report and future agenda items Councillor R Ackerley informed the Parish Council that there were overhanding branches on Eddisbury Hill in Delamere. The clerk was requested to report this to Cheshire West and Chester Council for their attention. Councillor A Bell reported that he had received a good response from the advert for the defibrillator training in September. Councillor C George reported that the newsletter had been sent to the printers and will be distributed shortly. Councillor D Rutter gave his apologies for the September meeting of the Parish Council as will be on holiday; Councillor J Edwards agreed to chair the meeting in his absence. 19 Date and time of next meeting The next Parish Council meeting is Monday 18 th September 2017 at 7.15pm at Delamere Community Centre.
