1 REGULAR MEETING OF THE VILLAGE BOARD OF THE VILLAGE OF LAKE DELTON Monday, June 13, 2011 Upon giving proper notice pursuant to Section Wis. Stats, and certifying compliance with the open meeting law, the Regular Meeting of the Village Board of the Village of Lake Delton was called to order on Monday, June 13, 2011 at 4:00 P.M. at the Kay C. Mackesey Administration Building. Present were President John Webb; Trustees Tom Diehl, Leslie Bremer, Doug Clausen, Gordon Priegel, Cary Brandt and Frank Kaminski. Also in attendance were Attorney Dick Cross, Director of Public Works Gary Hansen, Water Operator David Sterr, Assistant Zoning Administrator Jess Eastman, Administrative Lieutenant Janet Klipp, Wayne Manternach, Dave and Pat Schultz, Nick Laskaris, Tom Brown, Adam Makowski, Linda Schultz, Ann Prior, Donna Hartsing, Ken Binkley, Tanya Hansen and the news media. Motion by Trustee Priegel, Second by Trustee Brandt for adoption of the meeting agenda. Motion Jason Field addressed the board requesting that the large billboard just north of the Dairy Queen, which was recently ordered to be removed, be permitted to stay. Motion by Trustee Diehl, Second by Trustee Brandt to approve the grandfathered, legal nonconforming sign north of the Dairy Queen for use by the new amusement Zorbing. Motion carried with Trustee Kaminski voting in opposition. A Public Hearing was held on an application for a Class B Fermented Malt Beverage and Intoxicating Liquor License applied for by Wett LLC, Adam R. Makowski, Agent, d/b/a Wett at 1470 Wisconsin Dells Pkwy expiring 6/30/2012. This license is a transfer of a recently approved license to Zeus Entertainment LLC at 1881 Wisconsin Dells Pkwy. No one appeared in opposition to the granting of the license. Motion by Trustee Diehl, Second by Trustee Clausen to grant the Class B Fermented Malt Beverage and Intoxicating Liquor License for Wett LLC, at 1470 Wisconsin Dells Pkwy expiring 6/30/2012. Motion Motion by Trustee Kaminski, Second by Trustee Priegel to ratify the action taken at the Regular Meeting of the Village Board held on May 9, 2011; Special Meeting of the Village Board held on May 23, and May 31, 2011 and June 6, 2011 as delivered. Administrative Lieutenant Klipp presented the monthly report for Chief Dorner. Public Works Director Gary Hansen presented his report for the month along with a power point presentation on some of the projects and duties which have been carried out by the department. A review was made of Compliance Maintenance Annual Report. Motion by Trustee Priegel, Second by Trustee Brandt for Adoption of Compliance Maintenance Resolution No for the year Water Operator David Sterr presented his monthly report. Assistant Zoning Administrator Jess Eastman reported on the activities of the Zoning Department. Motion by Trustee Clausen, Second by Trustee Bremer to approve the application by the Schultz family for two (2) new 288 sq ft double sided billboards on the Schultz property on east frontage road. Motion carried with Trustee Priegel voting in opposition. Motion by Trustee Bremer, Second by Trustee Brandt to approve the application by Mike Wentland for placement of a five (5) sq ft digital display sign on east elevation of his office at 11 W. Munroe Ave, as recommended by Mr. Eastman. Motion by Trustee Diehl, Second by Trustee Bremer to approve the application by Trireme, LLC for a sq ft freestanding sign for Race Mountain Go-Karts at 1450 Wisconsin Dells Pkwy. Motion by Trustee Diehl, Second by Trustee Bremer to approve the application by Wett, LLC at

2 1470 Wisconsin Dells Pkwy for signage for the new WETT Nightclub, a 600 sq ft wall sign on west elevation of the building facing Wisconsin Dells Pkwy and a 195 sq ft freestanding sign to replace the existing on premises sign, with the stipulation that there be an agreement with Nick that he cannot enlarge the freestanding on premise sign now approved at 195 square feet. Motion by Trustee Kaminski, Second by Trustee Priegel to approve the application by Badger Display Signs for signage at JoAnn Fabrics and Gifts for the following: a) JoAnn Fabrics and Gifts 100 sq ft wall sign on north elevation over entry doors b) Fabric 8.6 sq ft wall sign on north elevation to east of doors c) Classes 13.2 sq ft wall sign on north elevation to west of doors. d) 72.5 sq ft panel replacement in freestanding sign on southwest corner of Commerce and Hwy 23 Motion by Trustee Diehl, Second by Trustee Priegel to approve the applications for Swim Rafts on Lake Delton expiring 6/30/2012 applied for by: Debbie Hillgamyer 541 Canyon Road Lighthouse Cove Condos 530 E Hiawatha Drive Anna Olszewski 55 Dam Road Starlite Pointe 1151 Canyon Road Walter Bochenczak 1040 E Hiawatha Drive Chris & Dea Michels 451 Canyon Road Kathy & Joe Bradley 900 E Hiawatha Drive Kate Pettit 730 E Hiawatha Drive These requests remain the same as requested in previous years. Hiawatha Drive Considerable discussion was had on the application of Thomas Brown, d/b/a Port Vista for an Outdoor Musical Performance permit for Thursday nights and weekends till 11:00 P.M. Several people were in attendance speaking against the license, Donna Hartsing, Ken Binkley, Ann Prior, Dave and Pat Schultz. The clerk had received s from Ruth Robinson, Robert Prior and Ann Prior objecting to the granting of the license and an was presented from Bob & Kim Sabey at the meeting. Motion by Trustee Diehl, Second by Trustee Bremer to deny the application to Thomas Brown for Outdoor Musical Performances as submitted and that if he wants to come back with a plan to address the concerns, it will be considered at the next meeting to be held on June 27 th at 2:00 PM. Motion Considerable discussion was on the application of Green Owl, for an Outdoor Musical performance Permit for Thursdays and Saturdays 7:00 PM 10:00 PM approx. Tanya Hansen appeared on behalf of the 18 property owners in Tall Timber Retreat. All are being affected by the noise from the music at the Green Owl. Motion by Trustee Diehl, Second by Trustee Bremer to deny the request for outdoor music for the Green Owl. If the owner wants to come back with a plan showing how he can face the speakers toward the building, which should solve the problem, the board will be willing to hear him. Motion by Trustee Kaminski, Second by Trustee Brandt for adoption of Ordinance No AN ORDINANCE CREATING CHAPTER 32 OF THE MUNICIPAL CODE, REGULATION OF EXCESSIVE NOISE, IN THE VILLAGE OF LAKE DELTON. Roll call vote was taken with the following results. Ayes 7, Nays 0, Abstaining 0, Absent 0. Motion carried unanimously. Motion by Trustee Kaminski, Second by Trustee Priegel to approve the application for Fireworks Possession and Display applied for by Bartolotta Fireworks for Kalahari Resort Convention Center for July 4, 2011, starting at 9:45 PM with duration of 20 minutes. Motion carried with Trustee Brandt abstaining. Motion by Trustee Priegel, Second by Trustee Clausen for payment of claims as presented.
