2 AR 22/2005 GOVERNMENT ORGANIZATION 3 Section 21.1 is amended by adding the following after subsection (2): (2.1) The powers, duties and functions of the Minister in the Alberta Aids to Daily Living and Extended Health Benefits Regulation (AR 236/85) are transferred to the responsibility of the Minister of Seniors and Community Supports. (b) in subsection (4)(b) by striking out 6 months and substituting one year. 4 Section 5(2) is amended by adding the following after clause (o): (o.1) money that has been accumulated by a member of the household unit under the learn$ave savings program or under another savings program approved by the Minister; 5 Section 6(4) is amended (a) in the words preceding clause (a) by striking out received by and substituting available to ; (b) in clause (a)(xvi) by striking out of $1600 per academic year and substituting amount per academic year determined by the Minister. 6 Section 13 is amended (a) in clause (a) by adding and is attending an education program under the School Act after years old, in the words preceding subclause (i); (b) by repealing clause (b) and substituting the following: (b) if the member, other than a member referred to in section 1(1)(j)(ii), is 18 or 19 years old, is attending an education program under the School Act and (i) in the opinion of the Director, the relationship between the member and the member s parents is such that the member cannot reside with the member s parents, (ii) the member is a parent who resides with his or her child but does not reside with that child s other parent, or

7 AR 27/2005 INCOME AND EMPLOYMENT SUPPORTS (iii) the member was, before the member was 18 years old, a member referred to in clause (a), or (c) by repealing subsection (2). 7 Section 20(b) is repealed and the following is substituted: (b) health benefits means the following: (i) prescription and non-prescription drugs; (ii) optical needs; (iii) dental needs; (iv) emergency ambulance services; (v) essential diabetic supplies; 8 Section 21 is repealed and the following is substituted: Kinds of health benefits provided 21(1) The Director may provide the following health benefits to persons eligible in accordance with this Part: (a) prescription and non-prescription drugs listed in (i) the Alberta Health and Wellness Drug Benefit List published by the Department of Health and Wellness if those drugs are approved by the Minister, or (ii) the Drug Benefit Supplement published by the Department; (b) optical needs listed in agreements between the Minister and the Alberta Association of Optometrists and the Minister and the Alberta Opticians Association; (c) dental needs listed in agreements between the Minister and the Alberta Dental Association and College and the Minister and the College of Alberta Denturists; (d) emergency ambulance services in a list approved by the Minister; (e) essential diabetic supplies in a list approved by the Minister

8 AR 27/2005 INCOME AND EMPLOYMENT SUPPORTS (2) Health benefits not included in the lists and agreements referred to in subsection (1) may be provided if approved on review by the Health Benefits Review Committee under the Recovery, Administrative Penalties and Appeals Regulation (AR 381/2003). 9 Section 23 is amended by repealing subsection (2) and substituting the following: (2) A dependent child is financially eligible for health benefits if the child is a child of an adult eligible under section 22 for health benefits. (2.1) A dependent child is financially eligible for health benefits until the next date for annual renewal if the child is a member of a household unit where either the combined current income less the cost of ongoing health needs of the household unit or the combined prescribed income of the adults in the household unit is equal to or less than the following income levels: Household unit with one child $ Household unit with 2 children $ Household unit with 3 children $ Plus $2000 for each additional child (2.2) When a household unit that is receiving income support and benefits or benefits under the Assured Income for the Severely Handicapped Act ceases to be eligible for those benefits, a dependent child that is a member of that household unit is financially eligible for health benefits until the next date for annual renewal. 10 Section 26 is amended by striking out 23(2)(b) and substituting 23(2.1). 11 Section 28 is repealed and the following is substituted: Health benefits from other sources 28(1) The following persons are not eligible for health benefits for the purposes of this Part: (a) First Nations persons registered as status Indians under the Indian Act (Canada);

9 AR 27/2005 INCOME AND EMPLOYMENT SUPPORTS (b) persons who are eligible for health benefits under sections 4.06 and 4.07 of Schedules A and B to the Hepatitis C Settlement Agreement; (c) immigrants and refugees and their children while being fully maintained by their sponsors in accordance with an undertaking and sponsorship agreement under the Immigration and Refugee Protection Act (Canada); (d) refugees under the Immigration and Refugee Protection Act (Canada) who are receiving financial assistance from the Government of Canada; (e) persons with study permits issued under the Immigration and Refugee Protection Act (Canada); (f) foreign nationals with temporary resident visas issued under the Immigration and Refugee Protection Act (Canada); (g) foreign workers with work permits issued under the Immigration and Refugee Protection Act (Canada); (h) temporary resident permit holders issued under the Immigration and Refugee Protection Act (Canada), except those approved for entry into Canada by the Alberta Immigration Review Panel; (i) persons illegally in Canada. (2) If an employer of a person eligible for health benefits under this Part offers a health benefits plan, the person must participate in that plan if, in the Director s opinion, it is reasonable to do so. (3) If a person eligible for health benefits under this Part is participating in (a) a health benefits plan referred to in subsection (2), or (b) another health benefits plan, the person must first submit claims for health benefits under the plan referred to in clause (a) or (b), if in the Director s opinion it is reasonable to do so. (4) If the health benefits that are provided under a plan referred to in subsection (3)(a) or (b) are not equal to the health benefits that may be provided under this Part, the Director may provide the balance of the health benefits in accordance with this Part

10 AR 27/2005 INCOME AND EMPLOYMENT SUPPORTS 12 Section 34 is amended (a) in subsection (1)(c) by striking out and the other members of the household unit are in Alberta and substituting immediately before the date of acceptance and enrolment in an approved training program ; (b) in subsection (3) by striking out or at the end of clause (a), adding or at the end of clause (b) and adding the following after clause (b): (c) the household unit has liquid assets that exceed the total cost of the requested part-time training benefits. 13 Section 1 of Schedule 1 is amended (a) in subsection (1)(g) by striking out urban centre transit pass, ; (b) by adding the following after subsection (4)(c): (d) the Youngstown Home. 14 Section 8(b) of Schedule 2 is amended by striking out 6 months and substituting one year. 15 Schedule 3 is amended (a) in section 3 by repealing subsection (1) and substituting the following: Escaping abuse 3(1) The Director may provide an allowance of $1000 to an applicant or recipient who is establishing a new residence to escape a situation in which the applicant or recipient, or a dependent child of that applicant or recipient, is being abused. (b) by repealing section 5(b) and substituting the following: (b) to receive treatment in a residential facility that is approved by the Alberta Alcohol and Drug Abuse Commission and the Minister, (c) by repealing section 12 and substituting the following:

11 AR 27/2005 INCOME AND EMPLOYMENT SUPPORTS Employment training and transition supports 12(1) If an adult member of a household unit is seeking employment, has a job offer or is applying for or participating in an approved training program or any other training or employment program required by the Director, including an employment preparation program, the Director may provide that adult member an allowance to cover the related costs not covered by core essential benefits under section 1 of Schedule 1, including, but not limited to, the following: (a) application, deposit, registration or testing fees required before the start of classes for a training or employment program referred to in this subsection; (b) costs associated with operating a vehicle; (c) costs for work clothing; (d) costs for transportation. (2) The maximum allowance that may be provided to each adult member of a household unit to whom subsection (1) applies is $300 (a) for each 12-month period commencing August 1 and ending July 31 if the household unit is designated in the full-time learner category, or (b) per calendar year if the household unit is designated in the expected to work or working category or the not expected to work category. (d) by repealing section 13 and substituting the following: Employment maintenance allowance 13(1) The Director may provide an allowance to an adult member of a household unit who (a) is employed, and (b) has one or more dependent children to assist the member in maintaining employment. (2) The maximum allowance that may be provided to each adult member of a household unit to whom subsection (1) applies is $

12 AR 27/2005 INCOME AND EMPLOYMENT SUPPORTS (a) for each 12-month period commencing August 1 and ending July 31 if the household unit is designated in the full-time learner category, or (b) per calendar year if the household unit is designated in the expected to work or working category or the not expected to work category. (e) by repealing section 16 and substituting the following: Treatment for addictions 16 If an adult member of a household unit requires treatment for problem gambling or alcohol or drug abuse, the Director may provide an allowance of $15 per day for the duration of a treatment program in a residential facility that is approved by the Alberta Alcohol and Drug Abuse Commission and the Minister. (f) by adding the following after section 18: RESP Allowance 18.1 The Director may provide an allowance of $100 to an applicant or recipient for each dependent child of the applicant or recipient who (a) is under 2 years of age, and (b) was born on or after January 1, 2005 to establish a Registered Education Savings Plan under the Alberta Centennial Education Savings Program for that child. (g) in section 19 by striking out sections 1 to 18 and substituting sections 1 to This Regulation comes into force on April 1,
