4 THE ANNUAL REPORT 2013 SCOPE OF THE PIK THE SCOPE OF THE PIK 1. The scope of PIK activity is: 1.1. prevention, detection, documentation and investigation of the criminal offences committed by Kosovo Police employees, regardless of rank and position while on duty or off duty; 1.2. inspection of the structures and functions of Kosovo Police to ensure accountability, effectiveness and efficiency in the implementation of applicable laws, sub-legal acts and standard operational procedures that are in force; 1.3. investigation and/or inspection of high profile disciplinary incidents, involving KP employees, as defined in Article 4, paragraph 1, and sub-paragraph 1.11 of PIK law; 1.4. investigation of all alleged disciplinary offences of police officers having the highest rank of the senior police management level and senior appointed police positions; 1.5. when there is a based suspicion that the General Director of Police has committed disciplinary violation, the Prime Minister may authorize the PIK to conduct the disciplinary investigations. Upon completion of disciplinary investigation the PIK shall report on findings to the Prime Minister; 1.6. to receive all citizens complaints, as well as to review and determine where the complaints will be disseminated for investigation, either to the Kosovo Police, or PIK. 4

6 INTRDUCTORY ANNUAL REPORT 2013 SPEECH OF THE MINISTER Bajram Rexhepi Minister for the Internal Affairs INTRDUCTORY SPEECH OF THE MINISTER 6 e Ministry of Internal Affairs, through the Police ThInspectorate of Kosovo, as an independent mechanism with the aim to supervise the way of performance of police duties by the members of Kosovo Police, during 2013 has also successfully fulfilled its mission by ensuring that the law was enforced in professional, effective and efficient manner. The Ministry of Internal Affairs during 2013, has managed to achieve several objectives related with the strengthening of the Police Inspectorate of Kosovo, in its functional and organizational aspect. In this regard 15 additional inspectors were recruited and trained by increasing the overall number of the Inspectorate staff in 72, as well as the working conditions and environment was improved for the staff of the Inspectorate by being accommodated in a new building as a capital project of the Ministry of Internal Affairs. With the purpose of increasing the quality of services for the citizens of the Republic of Kosovo, the internal administrative instruction have been revised, and these legal changes will impact the further increase of the efficiency of Police Inspectorate and in fulfillment of the mission of the Ministry for Internal Affairs for strengthening of rule of law and guaranteeing public security in all territory of the Republic of Kosovo, through applying a modern, professional, transparent approach and by respecting of the human rights. The reforms taken for years which were aimed to strengthen the Police Inspectorate of Kosovo, are bringing considerable results in practice. Within this context, during 2013, the Inspectorate has treated 1050 complaints received from the citizens, and this proves the trust of all citizens of the Republic of Kosovo on this institution. As an independent oversight mechanism, this institution enabled the preservation of public trust the trust of the people on the Kosovo Police as a professional organization which is based on legitimacy principles, transparence and respect of human rights and freedom of each individual. Furthermore, the data of 2013 prove that this trust is gradually increasing among the citizens of non majority communities of the Republic of Kosovo. Police Inspectorate of Kosovo during 2013, has widely expanded their work, they have treated 1050 complaints from the citizens, out of which 804 are low profile disciplinary complaints, 5 high profile disciplinary complaints and 241 complaints with criminal elements will be a year of institutional consolidation and implementation of mandate of the Ministry of Internal Affairs in the entire territory of Kosovo. In this respect the role and importance of continuing professional and efficient work of the Police Inspectorate in achieving these objectives is crucial. Inspectorate will ensure the citizens that the Kosovo Police shall exercise its responsibilities in accordance with the law and most advanced international standards, and above all, to ensure that the basic rights and freedoms of individuals are being respected, as set in the Constitution of the Republic of Kosovo and international conventions. Therefore, I invite all citizens of the country to cooperate with the Police Inspectorate of Kosovo, and at the same time to express the confidence that together we will continue with an increased commitment in improvement of the Kosovo Police performance, based on the most advanced international standards and practices, followed by principles of professionalism, transparency and nondiscrimination. Commending the work and commitment of officers and management of the Police Inspectorate of Kosovo, I use this opportunity to confirm my full support to for strengthening and independent functioning of this mechanism in the continuation of the successes that have been achieved so far.

7 INTRODUCTORY SPEECH OF THE EXECUTIVE CHIEF ANNUAL REPORT 2013 Fitim Shishani Executive Chief Police Inspectorate of Kosovo INTRODUCTORY SPEECH OF THE EXECUTIVE CHIEF Honored citizens of the Republic of Kosovo, I am pleased to present to you the annual report of the Police Inspectorate of Kosovo for As an independent law enforcement agency, fully consolidated, PIK also during the past year has shown that it is Prepared, Professional and Impartial in accomplishment of its legal mission. Enjoying these qualities, we have achieved that also in 2013, not only to maintain credibility as a professional institution, but also to cherish a further cooperation and confidence with our citizens.using our legal authorization, we have played our role in contributing the Police of the Republic of Kosovo, to be an institution in the service and respect of enforcement of the law and in the service of democracy and our society. Continuous reforms, entry into force of the new organizational structure, continuous advanced trainings to our staff members organized by the American ICITAP and other international partners, provision of better conditions for our employees and their welfare, are some of the segments that characterize the Police Inspectorate of Kosovo during For this achievement we use this opportunity to thank the 7 MIA for their unsparing help towards the development of the PIK. For Police Inspectorate, the year of 2013 will be remembered also for one very important fact in their work, today we have an assigned prosecutor in every region of Kosovo, who is exclusively dealing with the PIK cases and coordinates further actions related to the investigations. Such thing enables PIK investigators to be Prepared, Professional and Objective in their work. PIK is thankful to Robert J. Higdon, Jr. Assistant United States Attorney Chief, Criminal Division, Eastern District of North Carolina and his team, for his professional contribution in reaching the cooperation PIK- Prosecutors office. Barring in mind our achievements and challenges that we had during the past year, we are thankful to all those who contributed in permanent development of the PIK, in enhancing our performance and responsibility. Of course, American ICITAP has played a key role, then EULEX, OSCE etc. Being Prepared, Professional and Objective for our work, Police Inspectorate of Kosovo, ensures all citizens of our country, that we will work to improve our services and our main aim will be to increase the trust on law enforcement.

8 III. INTRODUCTION This is a summary report on the work of the Police Inspectorate of Kosovo (PIK) for the period January - December 2013 which contains documented activities and achievement. PIK has worked and managed according to the aims and objectives as set in the strategic plan , achieving sustainable and meaningful results. This report presents challenges and activities undertaken by PIK, based on the powers provided by the legislation in force, the main achievements during this period, difficulties in achieving strategic objectives and challenges facing the organization in the coming period. Police Inspectorate of Kosovo has developed its activities through its operations departments exercising investigative and inspection functions, such as: Investigation Department, Inspection Department, Integrity Test Department and Department for Analyze of Information and Complaint Management, while the Administration and Support Services Department has a supportive function to the operations departments. In 2014, the new structure of the Inspectorate shall start to be implemented, and which shall be described below. This report presents the PIK mission and organization, and continues with the other parts of this annual report, where the main challenges during the year are summarized, in implementation of operations functions (investigation and inspection) as well as support and administrative functions. Chapter on cooperation with citizens, local organizations and international relations contains specific activities of PIK in cooperation with citizens. Through various information campaigns regarding their rights, form and complain mechanisms we have achieved to raise the awareness of the citizens for PIK approaches. Increase of PIK performance and professionalism came through cooperation with various local and international organizations by exchanging of experiences, trainings, consultations and other mechanisms of interest to the Police Inspectorate of Kosovo. The final chapter on this report summarizes the objectives and activities of 2014 that are scheduled to be achieved in the future. 8

9 IV. PIK MAJOR CHALLENGES AND ACHIEVEMENTS DURING 2013 The Strategic Plan , is the basis of the PIK management, regarding the achievement of the objectives of this plan. There are a series of objectives, which for the PIK have been manifested in a series of challenges including the issue of the working conditions, and up to the increase of communication between departments. Even though we have been achieving a lot of success, there is still a lot to be done in successful fulfillment of these objectives. The legal mandate of the PIK as an independent agency, beside other, serves the Kosovo Police in successful implementation of its legal mandate. This is proved through the investigations in accordance with the law and inspection that enables the KP leadership in better decisionmaking for increase of efficiency and effectiveness. Implementation of the legal mandates of the PIK is related to human and financial capacities of this agency. Therefore, during the last year PIK has recruited and trained 15 young investigators/inspectors and this way increased its investigation and inspection resources. Among the continuous challenges of the PIK, identified in the Strategic Development Plan, was to establish and maintain the professional standards in implementation of PIK legal mandates. Internal regulation and PIK capacity building through training enables prevention and investigation of corruption and other criminal activities within Kosovo Police, as well as the mismanagement of personnel or finances. PIK faced these challenges by drafting and revising the administrative instructions and regulations which resulted in a well analyzed restructuring which it is expected to increase the capacities and managerial accountability, functional clarity of the departments, functionality at division level, which have not been in function until now, and clarity regarding building a long term carrier in our agency. Although, for a long time the issue of accommodation and creating better working conditions in the Police Inspectorate of Kosovo had been a permanent challenge, from last year this challenge no longer exists and the Police Inspectorate of Kosovo already has ideal working conditions which will be followed by raising the quality of its work. PIK will continue to provide better service for Kosovo Police, citizens, stakeholders, internal and external partners through a service toward the citizens who will be - complete, accurate, careful, conducted with commitment, courtesy. This year we will maintain and use the latest innovations in information technology to better serve Kosovo Police in enhancing its professionalism and its citizens. Updating of operating system and the expansion of IT on the implementation of legal mandates, equipment and software, will redesign of the computer system for use by departments regarding the resolution of complaints, investigation and discipline. 9

10 PIK will improve further his web portal that has a link to citizen complaints, the form of ad- hoc reporting, and opportunities to improve the image and promoting the use of social media tools (Facebook, Twitter, and YouTube). PIK has earned the trust of Kosovo Police and the citizens of Republic of Kosovo regardless of their ethnic or religious background. PIK has successfully managed to handle all complaints received and with a high efficiency referred to Kosovo Police or to the prosecutor for further proceeding. PIK has handled carefully all negative indications of police mismanagement by initiating concrete inspections and providing clear recommendations for necessary improvements for senior and executive management. One of the most important challenges during 2013 was the visibility of our organization, to be always close to the management of Kosovo Police, people who are in need for our services and other stakeholders. PIK has continuously reported to the Kosovo Police about investigations and inspections by distributing information to citizens and interest groups, showing transparency and willingness to work with others who share the same vision to have a decent and accountable police to citizens. RECEIVING COMPLAINTS AND INVESTIGATING CASES DURING 2013 Based on the authority given by law to the Police Inspectorate of Kosovo, PIK is obliged to accept all citizen complaints against KP employees review and determine which of the complaints should be investigated by PIK and which will be referred to the Kosovo Police or other responsible institutions. During the period of reporting, the Kosovo Police has had 8458 employees. In total, 328 employees have been subject to investigation in PIK. In percentage, this would be 4% of all KP employees have been under investigation. In 2013, 33 KP employees less than in 2012, have been under investigation. Diagram 1. Each investigation undertaken by the PIK is initiated through the complaint or official duty of the PIK. For the period January-December 2013, through 1064 complainants PIK has received 1050 complaints with allegations for disciplinary/criminal violations from police officers. These complaints have been received from our citizens of all ethnic and gender communities, in various forms as foreseen in complaint mechanisms us part of legal and sub-legal acts complainants have been consolidated in 1050 complaints treated by the PIK. A complain may include more than one complainant, depending on the circumstances. 11

12 According to PIK statistics complaints are from all ethnicities: 1012 Albanian or 95% of complaints, 38 Serb or 4% of complaints, 11 Bosnian or 1% of the complaints and one Turkish, one Gorani and one RAE. These percentages reflect the ethnicity composition of the Republic of Kosovo. According to gender, 983 complainants or 92% are male and 81 complainants or 8% are female. Diagram 2. Diagram 3. According to statistics 1050 complaints and initiations that were received by the PIK in 2013 are composed of: 525 complaints or 50% of complaints have been initiated ex officio by the PIK or citizens through PIK; 352 complaints or 34% of complaints are initiated by the citizens trough Kosovo Police in the PIK; 111 complaints or 11% of complaints are internal initiation by the Kosovo Police itself; 45 complaints or 4% of complaints initiated through the official website of PIK; 16 complaints or 1 % of complaints have been initiated through other various organizations; 1 complaint is an anonymous initiation; 12

13 Diagram RECEIVED COMPLAINTS IN PIK DURING 2013 CASE EXAMPLE 1: Police officer arrested for misuse of official duty Investigators of the Police Inspectorate of Kosovo - Investigation Department, received a information from citizens on suspicion of involvement of an police officer from Police Station in Prizren for misuse of authority - taking bribe. PIK officers after receiving the information have contacted a Prosecutor from Prosecution Office in Prizren, where with the authorization of the same office, an investigation procedure was initiated. After gathering information through investigative operating routes including covert investigative measures with the authorization of the relevant prosecutor, PIK investigators from the Department of Investigation have arrested a police officer (investigator) at the Police Station in Prizren with the suspicion that he has committed the offenses of abuse of official position, accepting bribe and intimidation. a) Analyzing, categorizing and distributing complaints for investigation 804 complaints or 77% of the complaints received by the PIK have been referred to the Directorate for Internal Investigations within the Kosovo Police, after being reviewed and categorized by the Department for Information Analyzing and Management of the Complaints in the PIK. In these 804 complaints, 1048 KP employees have been involved. Refereeing to the Directorate for Internal Investigation of the Kosovo Police, is due to the fact that the complaints didn t have elements of 13

14 criminal act, or have not been qualified as disciplinary violations of the high profile, as set within the PIK Law. PIK has investigated 246 cases which are qualified to be investigated according to the PIK mandate, out of which 241 or 23% were cases with elements of criminal act, and 5 of these complaints have been high profile disciplinary cases, where in total 328 KP members are involved as suspects. CATEGORIZATION OF 1050 COMPLAINTS DURING 2013 Elements of Criminal Acts in the competence of PIK Elements for High Profile Disciplinary Investigations in the competence of PIK According to statistical comparison , regarding categorization of complaints for investigation in the PIK for criminal violations or alleged high profile disciplinary violations, for investigation in the KP, for low profile disciplinary violations we have this situation: For investigation in the PIK for alleged criminal violation or alleged high profile disciplinary violation, during 2013, PIK investigated 246 cases. While in 2012, PIK investigated 302 cases or 56 cases less in 2013 than in For investigation in the KP for alleged low profile disciplinary violations in 2013 there were 804 cases, while in 2012 there were 776 cases investigated or 28 cases more in 2013 than in

Diagram 6. b) Analyze of the trend of complaints according to months During 2013, complaints with elements of the disciplinary violations have prevailed which are the competence of Kosovo Police for Internal investigation 1. Out of 246 complaints categorized as the competence of the PIK and according to the statistical analysis the most overloaded month with complaints during 2013, were months of April, June and September. During these months the number of complaints has reached the number of complaints per month. Compared to 2012, where the most overloaded months were March, May and August, where the number of complaints have reached complaints. The average of complaints under the competence of PIK for investigation during 2013 was 20 complaints per month, while in 2012 this average was 25 complaints. Therefore, this year has a decrease of 5 complaints per month less than in the last year. 1.For details on the status of these complaints you can contact the responsible officers at the PK. 15

CASE EXAMPLE 2: Police officer arrested on suspicion of murder On November 2nd, 2013, around 16:00, the Kosovo Police received a information that in the town of Skenderaj, in the road "Skanderbeg ", near the mosque was a shooting incident with a firearm where as a result of this incident one person was wounded. Based on preliminary investigations it was suspected that the suspect V. G. member of the Kosovo Police, off duty, after a dispute has shot the victim B. B. The suspect of this case police officer was arrested by the Police Inspectorate of Kosovo, and with the decision of the prosecutor he was held for 48 hours and was suspended from duty. As part of the investigation PIK confiscated a 9x19 GLOCK that was allegedly used by the suspect in this case and a magazine with 13 bullets 9mm. Case is classified as a homicide based on Article 178 of the Criminal Code of the Republic of Kosovo. 16

17 c) Status of the cases investigated in the PIK Out of 1050 complaints received by the Police Inspectorate of Kosovo in 2013, from 241 cases with criminal elements, the Investigation Department has referred 133 (55%) cases were sent with criminal charges 2 from the Investigations Department in the respective Prosecutors offices. While with Special report 3 were sent 87 (36%) cases, while 21 (9%) cases are under investigation process 4 and are carried in Kosovo Police Inspectorate has managed that 91% of cases with criminal elements to investigate and refer to prosecution with criminal charges or special reports. These data show an increase of the efficiency of the PIK in 2013, for 13%, compared to 2012, where 78% of the cases with criminal elements have been proceeded further at the prosecutor s office with criminal charge or special report, while 22% of the cases have remained in the process of investigation and are carried out in Table 2. STATUS OF THE 241 CASES WITH THE ELEMENTS OF CRIMINAL ACT IN 2013 Cases in process in PIK 21 Total 241 Cases proceeded in the Prosecutors office With Criminal With the special charge report CASE EXAMPLE 3: PIK arrested Police Officer involved in a fatal accident On 09/19/2013, at 16:30, a traffic accident was reported where were involved a KP official vehicle, Toyota type, with three employees of the Kosovo Police and a civilian vehicle,, Volkswagen type, with four males and one female. The accident was reported to have occurred on a road in the village of Podujevo- Peran where as a result of serious bodily injuries from the accident two male victims who were in the civilian car have died and three others have suffered bodily injury. Investigators from Investigation Department of the Police Inspectorate of Kosovo ( PIK ), with the authorization of the Public Prosecutor have arrested a police officer S. F with the suspicion that it has committed the offense " Endangering Public Traffic ", 2 As explained in the last years report, the PIK drafts a criminal charge in which are presented the discovered proves in the process of collecting data and it is handed over to the state prosecutor, along with the things sketches, photos, received reports, records of the taken measures and activities, official notes, statements taken and other material that may contribute in effective implementation of the procedure. 3 In the measures and actions conducted by the PIK, the evidences and data collected does not provide basis for criminal charge, and if this doesn t justify the reasonable doubt that a criminal activity has been committed, Police Inspectorate of Kosovo sends this special report to the Prosecutors office. 4 Cases for which the PIK is still in the process of investigation until for those cases is raised criminal charge at office of state prosecutor or they are send to KP if there is no elements of criminal act. 17

As closed cases in the prosecutor s office are 5 cases. 105 criminal charges filed by the PIK, are in the process the competent prosecutor of the Republic of Kosovo. Table 3. 19 e) Five most common cases investigated by the PIK During 2013, PIK has investigated cases of various types and natures. Out of 246 cases, where out of 8458 KP members, under investigation were 328 or 4% of the total, the most common elements of the offense this year were almost identical to cases that were in the year Five (5) most frequent cases were investigated during 2013 were: 43 cases of endangering public traffic, 38 light bodily injury cases, 35 misuse of official position or authority, 30 cases of maltreatment during official duty, 20 cases of intimidation, Unlike 2012 when most cases the jurisdiction of PIK to investigate were: light bodily injuries, misuse during duty, misuse of official duty or authority, endangering public traffic, this year cases which are leading are: endangering public traffic, light bodily injuries, misuse of official position or authority, maltreatment during official duty and intimidation (see table No.4. bellow). 20 f) Criminal acts with elements of official corruption and against official duty investigated by the PIK Police Inspectorate during this year has paid special attention to official corruption and criminal offenses against official duty. This year PIK has received and investigated 51 cases of corruption offenses and other offenses against official duty among which the most common were: misuse of official position or authority 35 cases, 2 cases misappropriation in office, unauthorized use the property 2 cases, 9 cases receiving bribery, forgery of official document two cases and disclosure of official secret 1 case. Table CASES WITH ELEMENTS OF OFFICIAL CORRUPTION AND CRIMINAL ACTS AGAINST OFFICIAL DUTY DURING 2013 Abuse of official position or authority Receiving bribery Unauthorized use of assets Misappropriation on duty Falsifying official document Disclosure of official secret CASE EXAMPLE 4: Operation "Bribe" Investigators of the Police Inspectorate of Kosovo has implemented the order of pretrial Judge and have conducted six raids in the area of responsibility of Ferizaj. During this operation have being arrested five suspects, two of whom where police officers ( a lieutenant and a police officer ). The investigation in this case was initiated months ago by investigators from the Police Inspectorate of Kosovo and is led by a EULEX prosecutor with the grounded suspicion that the suspects have committed criminal offenses of: misuse of official position or authority, taking bribes, intimidation, aiding perpetrators after the offense and causing general danger. The realization of the operation "Bribery is also supported by the Special Operations Unit of the Kosovo Police, Forensic Unit, PK Directorate of Organized Crime etc.. PIK investigators have raided six different locations in Ferizaj, including an office at the Regional Police Directorate in Ferizaj. As material evidence from these locations were seized; guns, ammunition, computers, various documents, cash etc. 20

21 g) Ranks of the KP employees investigated by the PIK Kosovo police in 2013 had a staff of 8,458 employees. As it can be seen Kosovo Police has a complex structure with various functions and tasks and it is divided in subdivisions with various tasks and responsibilities. Within this report we will present high profile disciplinary and criminal violations of the Kosovo Police which are in PIK mandate to investigate according Police ranks in Kosovo (see table no. 6) Table 6. Kosovo police has ranked personnel of 1208 officers, who manage all lines of management, from the first management line up to the high executive management. In the KP are 682 sergeants, 302 lieutenants, 135 captains, 30 majors, 38 lieutenant colonels and 13 colonels. During 2013 PIK has investigated 39 rank officers, out of them 1 colonel, 2 lieutenant colonels, 3 captains, 11 lieutenants, 22 sergeants 273 police officers and 16 civilian staff members (see diagram no. 8). 21

23 e) Measures and recommendation issued by the PIK Measures and recommendation issued by the PIK during 2013 that came as requests and needs during investigations are: 16 arrests by the PIK, 46 recommendations for suspension by Chief Executive of the Police Inspectorate of Kosovo made to the General Director of the Kosovo Police and 2 recommendations for transfers by the Chief Executive of the Police Inspectorate of Kosovo made to the General Director of the Kosovo Police. CASE EXAMPLE 5 : Operation "Coordination" Directorate for Investigation of Organized Crime in cooperation with the Police Inspectorate of Kosovo, Kosovo Customs and Tax Administration of Kosovo, has made the arrest of eight suspects under suspicion that they have committed the same offenses 'organized crime' and 'smuggling of goods" A joint operation based on operating plan called "coordination", investigation took several months until December 2013, when resulted in the arrest of eight suspects after a search of 16 different locations, of which five houses and eleven business premises. Investigations in the case were developed with the authorization of the special prosecutor of the Republic of Kosovo, where have been a subject to investigation a suspected criminal group from Kosovo and Macedonia that have consistently smuggled goods from Macedonia in Kosovo using illegal routes. In different accessions, this organized group has used the border crossing Hani I Elezit where is suspected to have been assisted by two police officers that are already arrested. 23

24 VI. INSPECTIONS DURING 2013 One of the basic functions of the Police Inspectorate of Kosovo is to carry out inspections in the Police of the Republic of Kosovo, to report on the performance and efficiency in achievement of the aims of its management and to give recommendations regarding the efficiency, effectiveness and compliance of the police work with the applicable laws, to indentify and prevent any kind of deviation from the legal acts and procedures based on which the Kosovo Police is functioning. Through the inspection process, PIK assesses the way of performance of the duties in the Kosovo Police, by: Determining if the respective laws, regulations and policy and procedures of Kosovo Police are being implemented as they should be, and are suitable for achieving its aims; Determining if the police sources are being used efficiently and effectively and are suitable for achievement of its aims and organizational objectives; Preventing violations that might be done during the activities of the Kosovo Police; Identifying gaps and recommending legal and organizational measures for better functioning of the Kosovo Police; Towards accomplishment of the obligations arising from the legislation in order to exercise permanent oversight on the work of police organization, the Inspection Department has made preparations on conducting a number of inspections in the Kosovo Police, by drafting an Annual Plan of Regular Inspections 2013, where four regular inspections have been foreseen. Identification of these police areas where these inspections have been performed is based on the importance of the police programs./areas, its sensitivity and complexity, identified risks, frequency of the inspection and the need of organizing in time, when the relevant institutions have increased their attempts for enhancement of 24

25 the efficiency, effectiveness and responsibility in accomplishment of the tasks. During this year, Police Inspectorate has accomplished four regular and two extraordinary inspections, where 81 police units and 142 various files have been inspected and 152 police officers of all ranks and posts have been interviewed. The areas on which these inspections have been performed were: the area of specialized units, the area of public order, the area of respecting of detained persons rights, the area of procurement and the area of management with equipment and assets of the KP. Below we will present the number, the area inspected and the type of inspection for each inspection. From six inspections we are briefly going to present the content of five inspections published in the official webpage of the PIK, while one inspection report will be published in the first quarter of 2014, due to the procedures that need to be followed. 1. Regular inspections performed during 2013 are: 1) Inspection of performance of the Special Operations Units (SOU) 2) Assessment of material conditions and security aspect in the Holding Centers in the Kosovo Police 3) Inspection of the Evidence Room in the Kosovo Police 4) Inspection of the Procurement in the Kosovo Police 2. Extraordinary inspections were: 1) Assessment of police performance during night shift on the 24 th of May 2013, between Friday and Saturday, in the Police Stations and RTU. 2) Assessment of performance, readiness, trainings and working conditions of SIU. 25

26 1) Assessment of the police performance during night shift on May 24 th 2013, between Friday and Saturday, in the Police Stations and RTU. On 24 th of May 2013, between Friday and Saturday, the Police Inspectorate of Kosovo has conducted an extraordinary inspection regarding the assessment of police performance during the night shift by the units of Public Safety Division, respectively from the Regional Commands, Police Stations and Regional Traffic Units. The purpose of this extraordinary inspection was to assess and to ascertain regarding the performance of police duties during the night shift, regarding the performance of the Kosovo Police in providing security for the citizens and protection of public peace and order. Police Inspectorate of Kosovo has inspected a total of 34 police stations/units, including six Regional Commands. Criteria used during these inspections have been basic, such as: the number of officers on shift, the number of high rank officers, the basic elements of the security of the police units, the basic elements of operating organization and the basic elements of administrative organization. Main recommendations: 1. Police Inspectorate of Kosovo recommends to the Kosovo Police Director to immediately initiate inspections and audits of the performance of Regional Directorates, regarding the human capacities engaged during night shift and to take disciplinary measures against the Leaders of the component unit who neglect the principles and procedures of the Kosovo Police. 2. Police Inspectorate of Kosovo recommends to the Kosovo Police Director to immediately initiate inspections and audits of the performance of Regional Directorates, regarding the leadership capacities- Ranks engaged during night shifts and to take disciplinary measures against the Leaders of all the levels who neglect the principles and procedures of the Kosovo Police. 3. Police Inspectorate of Kosovo recommends to the Kosovo Police Director to immediately initiate inspections and audits of the performance of Regional Directorates, regarding the basic security elements of the police buildings, patrols such as patrol plans and their schedules, communication and means for providing human rights such as the book of complaints and the situation of the holding cells on routine basis and on different shift, with the aim of improvement of the situation by taking disciplinary measures without compromise against anyone who falls in these basic criteria of policing. 26

27 2) Inspection of the performance of Special Operations Units (SOU) Pursuant to the Law of the Police Inspectorate of Kosovo and Inspections Annual Plan 2013, with the authorization of the Executive Chief, the Inspections Department has conducted a regular inspection on the Special Operations Units (SOU) of the Kosovo Police (KP). The purpose of this inspection is to assess the performance level of Specialized Operations Units, regarding their professional preparation on managerial duties and responsibilities for management of these specialized units and the results of their work. Main recommendations: 1. Police Inspectorate of Kosovo recommends that the Special Units Division should revise the applicable SOP that regulates the work of SOU and to harmonize it with the legal acts in force, and with the organizational-structural changes that are approved for SOU on the Police Inspectorate of Kosovo recommends, that the process of stabilization of the management structure within SOU should accelerate and in this way to avoid big differences in the SOU management regarding the extent of control and fulfillment of the posts with adequate ranks. 3. Police Inspectorate of Kosovo recommends the police management that during the implementation of the reform for SOU, to engage also in establishment of RRU, not only in the structural aspect but also in the practical aspect, followed by the necessary regulatory acts. 4. Police Inspectorate of Kosovo strongly recommends the KP management to start applying the principals and procedures of health insurance for members of the Special Units in accordance with the (SOP No 15), establishment of the conditions that need to be fulfilled for development of the necessary trainings (SOP. No.17.1). 5. Police Inspectorate of Kosovo recommends that the individual skills and knowledge s received during training, to be evaluated through standard tests, towards increase of the performance efficiency of the SOU. 6. Police Inspectorate of Kosovo recommends the SUD management to organize and have trainings for regular recertification of the trainers, re-certification according to the Principle 8.14 as well as the rules set for re-certification with long weapons. 7. Police Inspectorate of Kosovo recommends the Director of the Specialized Units Division, even though till the end of 2014, this unit(sou) is expected to be centralized in only one unique structure, that in the future to give priority to the mandatory courses, in order that all SOU personnel to be trained. 8. Police Inspectorate of Kosovo recommends to create a unique form for all regions where weapons and their equipment shall be registered in an exact way and to do the inventory of each equipment possessed by each unit (purchases, donations, expired equipments, etc) 27

28 3) Inspection of the Special Intervention Unit SIU Pursuant to the Law on the Police Inspectorate of Kosovo No. 03/L-231, with the authorization of the Executive Chief, the Inspections Department has conducted an extraordinary inspection from 11 th of June until the 1 st of July 2013, of the Special Interventions Units of the Kosovo Police. The purpose of the inspection is to assess the performance of the competent personnel engaged in the SIU, SIU management in accordance with applicable legislation, to give an objective assessment on respecting the legal provisions, rules and procedures, fulfillment of the objectives according to the expectations, as well as to give recommendations for improvement of the performance of duties and management of SIU. Main recommendations: 1. PIK, recommends the Director of Specialized Units Division, implementation of the Organizational Structure of the date 20/05/2012, approved by the General Director of Kosovo Police, regarding the general personnel, to put the persons with ranks in the positions in accordance with the structure of the SIU. 2. PIK recommends: the Commander of the Unit that based on the analyze of the factors and written testing, the parameters that determine the timing of mobilization and respond of this unit on cases and police operations, taking into a serious consideration that this unit to be on duty 24 hours, therefore to work on shifts. 3. PIK recommends: the Director of DSU of the KP to support the operators of SIU of all regions regarding transportation, to increase the number of the vehicles on call, with the purpose of increasing the performance, security, and motivation of the SIU.. 4. PIK recommends: the Acting Director of the Division of Specialized Units, that in the future to act based on the request of the Training Department and to apply exactly P the list of nominated police officers for training abroad, DSU to send to the Training department for further proceed. 5. PIK recommends: the Director of Specialized Units to re-evaluate the location in which the SIU is located, taking into consideration the maintenance/hiding the identity of operators in different operations performed by the SIU, to ensure that the equipment used by this unit to be of the highest quality and in better condition and in accordance with item 10 of the SOP of SIU, to supply them with civilian clothes and sports clothing, in order to maintain health during physical activities. 6. PIK recommends: the Director of Specialized Units to implement in practice the recommendations of IKSHP at Camp Vrella" in order to preserve the health of SIU members located in this camp. 7. PIK recommends: the Director of Specialized Units in collaboration with relevant directorates within the KP to take necessary measures to increase and improve the level of security at Camp "Vrella, as this camp with the units there is a set of vital importance for the country. 28

29 4) Inspection of the Holding Centers in the Kosovo Police Police Inspectorate of Kosovo pursuant to the Law 03/L-231, annual plan 2013, and with the authorization of the Executive Chief, the Inspections Department has conducted a regular inspection in the Holding Centers of the Kosovo Police. The purpose of the inspection was to assess the performance of the competent personnel engaged in the management of the Holding Centers in the Kosovo Police in accordance with applicable legislation, assessment of material and security conditions in these centers and to provide an objective opinion on respecting of legal provisions, procedures and rules. Main recommendations: 1. Police Inspectorate recommends the responsible officers of holding centers to take care for cleaning the Windows, for improvement of natural lighting. 2. Police Inspectorate recommends the Department for Management of the Facilities to find the opportunity to build a separating wall in the toilets, near those holding rooms where there is no privacy. 3. Police Inspectorate recommends the General Directorate and the Directorate for the Management of the Facilities to review the possibility of improving the monitoring offices. 4. Police Inspectorate recommends the General Directorate of Kosovo Police, that while drafting the organizational structure for the Holding Center to consider the number of persons detained in holding centers, as well as the number of police officers assigned to the relevant station. 5. Police Inspectorate recommends the Directorate for Management of the Facilities that according to the requests from police stations, to make repairs, or replacement of video control system (cameras) and if possible to replace the position of the cameras. 6. Police Inspectorate recommends the Directorate for Management of Facilities to repair the damaged bars and to replace those which are of the bad material. 7. Police Inspectorate recommends the holding centers to equip with safe drawers which have the possibility to be locked and store the items taken from detainees. 8. Police Inspectorate recommends the responsible persons for the detention center to preserve a physical copy of the files in another location. 9. Police Inspectorate recommends the Directorate for the Management of the Facilities that upon the requests from police stations to make repairs or replacement of fountain and sink. 10. Police Inspectorate strongly recommends the Police Stations to draft an evacuation plan at the Detention Center levels. 29

30 5) Inspection in the Evidence Rooms in the Kosovo Police Police Inspectorate of Kosovo has authorized an inspection of Evidence Rooms in order to assess the performance of duties from the officers in charge of these rooms. The purpose of organizing and implementing this inspection was to assess the performance of duties in accordance with the legislation, to assess the security level of the Evidence Rooms, to give an objective opinion on respecting legal provisions, procedures and rules in force Main recommendations: 1. PIK recommends the Director of Department for Support Services to intensify its cooperation with the Director of the Investigation Department and with the Regional Directors so that the Support Services Department to equip the evidence rooms with movable shelves, container, standard boxes, refrigerator, Fire distinguisher and other appropriate equipment for each evidence. 2. PIK recommends Police Regional Directors (RDP- Ferizja, RDP Gjilan) to take appropriate measures to eliminate humidity in the evidence rooms, which is an evident problem.. 3. PIK recommends the Regional Directors RDP -Gjilan and RDP-Mitrovica that in the Evidence Rooms, where doors have handles from the outside to put additional means for their security. 4. PIK recommends officials of Evidence Rooms that in the Registry of evidence and electronic data base, as well as in the cabins, shelves, drawers and metal boxes, to also present information on the location of evidence (the exact location ) 5. PIK recommends to the Evidence Rooms Officers that upon receipt of evidence by investigators of the case to ensure that the evidences are packaged in standard packages, which preserve evidences from possible damages or losses. 6. PIK recommends the Evidence Rooms Officers, that upon the registration of items/evidence to complete the data in an equivalent manner in the electronic data base. 7. PIK recommends senior management to take measures to provide paper bags with notes on official languages and to oblige officers of the Evidence Rooms to fill in the notes in the second part of the paper bag, in order to make sure that there are records on the chain of storage (from-to-date). 8. PIK recommends the Directorate for Strategic Planning and Legal Affairs, to engage in the drafting a new document that would regulate the exact work in the Evidence Room. 9. PIK recommends the senior police management to take caution regarding the internal control mechanism, and to engage in supervising and to require accountability, regarding the reports on inventory, audit and inspection of the Evidence Rooms. 10. PIK recommends the senior management to engage the Training Division to organize adequate training for Police Officers of the Evidence Rooms. 30

31 VII. ADMINISTRATIVE AND SUPPORT SERVICES The Department of Administration and Support Services (DASS) within the Police Inspectorate of Kosovo has a supporting and very important role in the work progress and achievement of the objectives of the Police Inspectorate of Kosovo. DASS through its staff members ensures that the operational departments are provided with material support, logistics, technical and all other administrative services in order to achieve the objectives of the operational departments. In the field of training, a total of 12 trainings were finished, where a considerable number of operation personnel were included (inspectors and investigators) as well as the staff members of the administration (see table no. 7). It is worth mentioning that during 2013, the finalization of the construction and transfer to the new building of the PIK has been done, as well as successful accomplishment of capital projects set for

33 PRACTICAL TRAINING PROGRAM IN PIK A PROGRAM FOR DEVELOPMENT AND INCREASE OF THE PROFESIONAL STANDARDS FOR NEW OFFICIALS After completion of the basic training at the Kosovo Academy for Public Safety (KAPS) in Vushtri, 15 PIK officials have started the Practical Training Program. With the decision of the Chief Executive of PIK, a working group was established to prepare a field training program for new officers that joined the PIK. Based on best practices, the working group prepared a program that fits the needs of the Police Inspectorate of Kosovo. The practical training lasts 6 months and during this time the young officers who undergo this training, should manage to achieve success and to become independent. The purpose of this program is to clarify the procedures and guidelines for the training of PIK officials recently certified in Kosovo Academy for Public Safety. Also, the program is intended to facilitate the transition of candidates from the school environment of theoretical learning, into practical learning, which requires direct application of skills in the performance of duty, including two broad areas of Investigation and Inspection. 33

34 INAUGURATION OF RENOVATED BUILDING OF THE POLICE INSPECTORATE OF KOSOVO May 2013 marked the inauguration of the renovated PIK building. The project for renovation of the building started in 2012 and was finalized one year later, and provides good working conditions with a space of about 2,700 square meters. Improving working conditions for PIK officers KPI is one of the factors that will positively affect the fulfillment of the legal objectives set in the development and strategic plan of the Police Inspectorate of Kosovo. The new renovated building is in accordance with all European standards, with a space of 2,700 square meters, 82 offices, halls and other spaces for work. This building is located near the elementary school along the main road to Hajvalia, in the highway Prishtine-Gjilan, the turn near the table at the entrance to the village Hajvali. 34

35 VIII. DEVELOPMENT OF COOPERATION WITH CITIZENS AND LOCAL ORGANIZATIONS Developing public relations and strengthening the cooperation with national and international organizations is of a special importance to the PIK. During this year, PIK has had a series of activities under continuing efforts to build sustainable relationship with citizens and different partners with government and non-government organizations and with the media. a) Cooperation with Prosecutors Office Cooperation with Public Prosecutors Office is also set by the applicable legislation. During daily work, employees of investigative structure and its management have established very close relations of cooperation for fighting corruption and other offences in the police. Upon the request of PIK management sent to the Head of the State Prosecutors, one special prosecutor is appointed to work with the PIK, and this is achieved in five Prosecutor s offices: Pristine, Gjilan, Ferizaj, Prizren and Gjakova. Police Inspectorate of Kosovo and the State Prosecutors Office of the Republic of Kosovo have established a partnership and cooperation in order to fight against negative phenomena encountered among members of the Kosovo Police, particularly in combating corruption through exchange of information concerning suspicion of involvement of police officers in criminal activities, cooperation in investigation of cases resulting in criminal acts, providing authorizations by the Prosecutor to undertake specific investigation actions by the PIK, assistance during the investigation process, as well as providing mutual advice in solving various problems that deal with fighting negative phenomena in the Kosovo Police. PIK also has good cooperation with administrative services of the prosecutors offices, where this service consists in providing accurate and quick information on cases which were proceeded by the PIK to the competent prosecutors. b) Cooperation with the Police Cooperation with the Kosovo Police is oriented to contribute in increase of the performance of both agencies and to provide reciprocity on technical, operational assistance and support, as set in the legislation in force. This cooperation was led by several meetings held to discuss issues related to the scope of the Police Inspectorate. 35

36 Except regular meetings, cooperation with Kosovo Police has been on daily basis by exchanging information and supporting each other in fight against negative behaviors within Kosovo Police. In a lot of occasions joint investigation and operations have been developed which have resulted on a good coordination in solving the cases and implementation of the legal mandates of these two institutions. In the framework of cooperation with Kosovo Police should be noted that proactive approach of the KP in relation to the initiation of cases and taking concrete actions to raise the level of discipline in the organization and increase its efficiency and effectiveness. In total during 2013, 111 complaints or 11% of total complaints that were handled in the PIK, were initiated by the Kosovo Police against its officials. This percentage speaks of increased police commitment in order to increase the quality of internal control and improving performance of KP. Police Inspectorate highly evaluates the level of cooperation with Kosovo Police by aiming that this cooperation will be further more strengthened in the following years, based on authorizations and legal competencies of the PIK towards increase of efficiency and effectiveness of the police. c) Cooperation with the Ombudsman Institution Police Inspectorate of Kosovo and Ombudsman as two independent institutions, have a close cooperation in the protection, supervision and promotion of human rights and freedoms in the Republic of Kosovo. d) Public Relations Depending on operational needs on the field, in cooperation with various departments within the PIK, press releases are published; various meetings and press conferences are organized in order to reflect the achieved results by the PIK. One of the PIK engagements for 2013, within the engagements for strengthening transparency was the beginning of publication of the PIK magazine "Integrity". Besides internal information, mainly through various articles published in the official PIK magazine, the magazine "Integrity" is considered as an important 36

37 project for external information, especially to the Kosovo Police officers, but also to the national and international partners on the engagements of the PIK. The current activities that are carried out by the PIK during 2013, towards strengthening transparency and cooperation with citizens are: Publication of cases that arise the interest of the public (mainly through press releases and conferences); Issuing statements for the media, participating in television debates, shows of the informative character etc; Additional engagements in the field of public relations; Preparation, editing and publishing of the magazine "Integrity" Response to requests addressed by various media on issues related to the PIK activities, etc. Police Inspectorate of Kosovo has consistently informed the media about the work and activities that are developed through various forms in order to show transparency and to inform citizens. Being committed to increase transparency in relation to the citizens, PIK has conducted many public appearances. An important role in informing the public on the work of PIK has played the official electronic page which has been an open window for all those who have been interested in the activities and reports on various cases. One of the strategic goals of the Police Inspectorate is also to focus on providing better service to citizens by offering a complete, concise and correct service, performed with dedication and with courtesy. Within this, about two years ago, another way of contact with citizens has started to function. In home of the official website, on the right side is the link for complaints, which after being clicked, gives the citizens a possibility to complete their data regarding the possible complain. 37

38 During 2013 a total of 45 complaints from citizens are processed through the official website or through PIK official address info.ipk@rksgov.net Besides the PIK website, an important role for informing citizens has played also the use of social sites such as Facebook and Twitter. From the official statistics of the official Facebook address, it can be seen an increased number of visitors on the official PIK address in this social network. The ages with most frequently visit the official address of the PIK is of years, with 34%, followed by those of years old which reaches 19%. In increasing the number of visitors to this social network has impacted the timely updating and publishing of photo news photos and various PIK activities. Besides the engagements in the field of public relations as a focus in 2013 was the capacity building of PIK officials, as well as enhancement of cooperation between the media and PIK. It is worth mentioning the training organized by the Public Diplomacy Speaker Program on Strategic Communications with the help of American ICITAP for the MIA and its agencies in addressing strategic communication and communication in crisis situations. The training was provided by the American specialist for publications and communication, Maruerite H. Sullivan. In this training have participated public information officers of the MIA, Police Inspectorate of Kosovo, Kosovo Police as well as officers from the Kosovo Academy for Public Safety. This training had the purpose to increase the capacities in this field as well as cooperation between MIA and its subordinate agencies. 38

39 XI. COOPERATION OF THE PIK WITH AMERICAN ICITAP For over a decade after the war and start of establishing the central institutions of the country and issue of the new laws, a lot of foreign donators have given their contribution through advises and various trainings for the PIK. Over time some have completed their mandates (example OSCE) and left, while some have given and continue to give their contribution in increasing our efficiency to be prepared, professional and objective in carrying out our duties. Professional development of PIK continued during 2013 as well, PIK cooperation with the American ICITAP, has been and is of particular importance and of a multidimensional character. This cooperation, except of advisory and supportive nature, it is directly showing results in building character and self-esteem of PIK employees. PIK in 2013 has benefited from ICITAP, in terms of advises and gaining new and advanced knowledge by competent and experienced experts from worldwide known organizations in the field of law enforcement, through specific training from necessary areas for increase of the quality of work in the PIK and various donations of necessary equipment for carrying out the mandates and mission of the PIK with high quality. Regular meetings of the PIK management with representatives of this organization, their dedication and hard work, contributed that the PIK to be recognized as an organization which proves to its citizens and others that it is a well trained organization, prepared to face the challenges, and objective to seek the truth while exercising its functions. Like other years, ICITAP, this year as well has remained to be most supportive organization for the PIK. The contribution of this organization has been a priority and irreplaceable in providing advices and expertise in extracting and reviewing administrative instructions deriving from the PIK law, Administrative Instructions that have made a concrete reorganization by clearly dividing the duties and responsibilities of the PIK that guarantee efficiency and enhance of the working quality of the PIK. Trainings provided by ICITAP to the PIK during this year have been irreplaceable in professional capacity building of PIK employees, by offering programs and experts from the best agencies of the USA and the in the world in the field of law enforcement. Trainings provided by ICITAP for the PIK, have been more than needed for accomplishment of the PIK mission. 39

40 Among the important trainings conducted during 2013, was the two week training for "Advanced Internal Investigation" and the two week training "Advanced techniques for Interviewing and Report Writing" which are highly appreciated by the PIK and aims to include them within its SOP s, so that they can be mandatory since it is considered that as such they shall contribute in increase of the PIK work quality. Members of the Police Inspectorate of Kosovo have participated in many other training organized by ICITAP, such as Joint investigation on trafficking of human beings, Amendments in the Criminal Code and the Code of Criminal Procedure, Advanced techniques of financial investigation, etc, that have affected in increase of the professional capacity of the PIK staff. Seeing willingness for cooperation from this organization, the PIK has set as one of its strategic objectives to continue cooperation with this organization. 40

41 X) COOPERATION OF THE PIK WITH EULEX AND OSCE g) Cooperation with EULEX The European Mission for the enforcement of Law and Order- EULEX has played a very important role in the PIK. The cooperation has been at a high level, where their advisory contribution is highly valued, in the field of investigation as well as in the field of inspection. Our greatest gratitude goes to EULEX Prosecutors who have helped us in several criminal cases, and without any hesitation they supported PIK in every stage of investigation. Numerous meetings held between the monitors of this mission and the senior officials of the PIK, by offering their experiences in cases of mutual interest, with the intention to achieve better results in the fight against corruption and organized crime. PIK has appreciated the work of this mission in improving law and order in Kosovo. The contribution of this mission has been emphasized not only in providing advises and expertise on various issues in the implementation of PIK functions, but also in issuing and reviewing administrative instructions deriving from the PIK law and a great help of its experts in drafting and reviewing the Standard Operating Procedures of the PIK. h) Cooperation with the OSCE OSCE Mission in Kosovo this year has also continued its cooperation with the Police Inspectorate of Kosovo, mainly through organizing various conferences and seminars with focus on improvement on the public relations field. PIK took part in a conference organized by the OSCE "Improved information to the citizens through the media on security issues" held in Prizren. OSCE Mission organized one more conference for Police Public relations officers and oversight agencies in the region in order to help them in establishing contacts and cooperation.in this conference participated Public information officers from the State Police of Albania, media representatives from the Ministry of Internal Affairs of Macedonia, representatives of OSCE missions in Kosovo, Macedonia, Albania and Montenegro, representatives from public information office of the MIA, and its agencies such as Police Inspectorate of Kosovo, Kosovo Academy for Public Safety as well as ICITAP representatives. In this three days conference it was discussed about the ways of communication with media and with the public in the organizations where these representatives come from, exchange of experiences and possibilities for cooperation among police organizations and participating countries. PIK will continue to be part of these initiations by this organization, there where it is considered that our contribution might be needed. 41

42 XI. INTERNATIONAL COOPERATION OF THE PIK This year PIK participated in the 13th Conference of EPAC (European Partners Against Corruption) that was held in Krakow, Poland on November EPAC was founded in 2004 in order to contribute to the field of police oversight and the global fight against corruption. More than 65 police oversight and anti corruption organizations - institutions from European countries including the Police Inspectorate of Kosovo (PIK) took part in this EPAC conference. During four plenary sessions at this conference, important topics were addressed, such as regulations of integrity within police, corruption and its combat in police services, integrity test- legal framework, etc. Presentations by delegates raised some important issues and current issues such as the European Commission proposal concerning the European Public Prosecutor's Office and up to the topics related to police oversight agencies. PIK highly appreciated the importance of exchanging experiences between police oversight institutions of the European countries. PIK also participated in technical seminar in Slovenia (28 to 29 October 2013) organized by EPAC, where it was discussed about the role of use of information technology in the fight against corruption. End of October marked also the event of the Law Tech Europe Congress 2013 in the Czech Republic where the participants were representatives of the Police Inspectorate of Kosovo. Participants of this Congress highly evaluated as for the exchange of experiences in the field of computer crimes as well as the possibility to get informed regarding the latest developments in information technology. PIK attended the fourth conference in Macedonia (5 to 7 November) organized by the OSCE Mission and DCAF for the police integrity, accountability and external oversight. High PIK management participated in this conference. Joint photo of the delegates from different countries, participants in the 13 th EPAC Conference, where Kosovo was represented by PIK delegation. The scope of international cooperation will continue during the next year as well, as an effort to increase the level of cooperation of the Police Inspectorate of Kosovo and similar organizations as PIK. 42

43 XII. CONCLUSION This year, PIK has entered a critical stage of its strategic development with initiated deep structural reforms, preparing new SOPs which we believe will increase accountability, good management, will improve performance and will further increase the pride of our employees. But yet there is still work to be done. During this year our dedication and professionalism associated with the fulfillment of legal mandates - investigation of criminal acts, disciplinary violations, and inspection of police work is not fluctuated. The burden of implementing legal mandates with the PIK law, in strengthening the rule of law is found within a 4% of Kosovo Police members who have been subject to investigations by the PIK and for regular and extraordinary inspections the doors have been opened in each area of KP management that was inspected. Commitments of the PIK in 2014 will be towards the exercise of responsibilities in an organized, systematic and well planned, ensuring well studied working plans, supported with indicators of risk assessment. In accordance with the law and international most advanced standards we will work to help Kosovo Police to advance its performance, to guarantee security and order for all citizens of the Republic of Kosovo. We are grateful to the Ministry of Internal Affairs and the Kosovo Police and we hope that our work from the investigation part and inspections will serve the Kosovo Police in reaching its legal mandate and together to provide the citizens a level of security that they should enjoy, while we as institutions in service to the citizens to reach their trust which we must earn. 43

44 DEFINITIONS 1. Definitions used in this Law have the following meaning: Investigator - the personnel of the Police Inspectorate of Kosovo who perform criminal investigations involving Kosovo Police employees, including investigations into high profile disciplinary incidents and disciplinary investigation of police officers having the highest rank of the senior police management level and senior appointed police position; Inspectors - the personnel of the Police Inspectorate of Kosovo that perform inspections of the Kosovo Police; MIA - the Ministry of Internal Affairs; The Minister - the Minister of Internal Affairs; PIK - the Police Inspectorate of Kosovo; Kosovo Police Employee - all personnel that includes the police officer and the civilian staff of Kosovo Police; Police - the Kosovo Police; Law Enforcement Agency - all law enforcement agencies that have police powers; Integrity Investigation - a technique or method used to verify the ethics and integrity of Kosovo Police employees. Inspection - evaluating Kosovo Police performance in achieving objectives in accordance with required legislation and standards; High Profile Disciplinary Case - a case or patterns of events attracting significant public attention, including but not limited to allegations of: 44

45 - direct conflict or incidents between the police and communities that relate to racial, ethnic or discriminatory acts; - an acute problem of a direct conflict between the police and the community. The conflict may take the form of police harassment, brutality or excessive force; - all use of lethal force incidents; - death in police custody; - fatal traffic accidents involving police employees; Service complaints - complaints made about police standards, operational instructions or the principles of police service; Criminal conduct complaints - the complaints regarding criminal conduct of a police employee, made known to the appropriate authorities. 45
