The Chairperson shall control the amount of time each person shall be allowed to speak, which shall not exceed three (3) minutes. Subject: Traverse City to Charlevoix Trail Request for Support of Resolution Presenters: Julie Clark, Executive Director of TART Trails, and Kristine Erickson, Director Background: Plans for the Traverse City to Charlevoix Trail are well underway, and Maple Bay Park and Natural Area could play a significant role in serving users, once the trail has been built. Attached is a map of Maple Bay Park, indicating the potential trail route and proposed trailhead location at Maple Bay. Following are two on-line links for exploring and learning more about the proposed trail: Requests: Partner TART Trails is asking the Parks and Recreation Commission to recommend to the County Board of Commissioners approval of a resolution of support (draft attached) for the Traverse City to Charlevoix Trail concept and development plan. TART also is asking for the Parks and Recreation Commission to authorize Parks and Recreation staff to work with the trail communities and TART Trails on the Traverse City to Charlevoix trail effort to explore roles and opportunities. Some examples of how the County might become involved in this project in the future are to: become the landowner for trail easements; act as fiduciary agent for grants; make improvements at Maple Bay Park, as determined and authorized by the Parks and Recreation Commission. Recommendations: 1. Motion to recommend to County Board of Commissioners that it approve and adopt the attached resolution of support for the Traverse City to Charlevoix Trail concept. 2. Motion to authorize Parks and Recreation staff to explore County roles and opportunities that would support the Traverse City to Charlevoix Trail project. 3

5 At a Regular Meeting of the Grand Traverse County Parks and Recreation Commission, held on the 10th day of November 2016, at 6:30 p.m., with members present, the following resolution was proposed: Motion by: Commissioner Supported by: Commissioner Grand Traverse County Parks and Recreation Commission RESOLUTION A RESOLUTION SUPPORTING THE TRAVERSE CITY TO CHARLEVOIX TRAIL CONCEPT PLAN WHEREAS, Grand Traverse County Parks and Recreation Commission has identified trails as an important part of its Strategic Plan, calling for continued partnership with TART Trails and other entities to provide further countywide connectivity through nonmotorized and multi-modal trails; and WHEREAS, Grand Traverse County Parks and Recreation Commission s Grand Traverse County Community Park, Recreation, Open Space, and Greenway Plan supports the development of non-motorized trails and connected trail networks; and WHEREAS, the Traverse City to Charlevoix Trail has been a community vision for nearly 20 years, and trail development has been supported through local and regional resources in 2015, and; WHEREAS, Grand Traverse County Parks and Recreation Commission believes that constructing the trail between Traverse City and Charlevoix will contribute to the recreation and non-motorized transportation opportunities in the region with its immediate connections to existing trail facilities and desired destinations and future trail extensions along the proposed corridor; and WHEREAS, the conceptual design of the Traverse City to Charlevoix Trail reflects the strategic goals of understanding and respecting the history, context and culture of the corridor; understanding trail users perspectives; cultivating trail support by connecting to hearts and minds; creating meaningful connections for work, play and health, and engaging volunteers and partners; WHEREAS, completing the trail provides positive economic, social and environmental benefits to the region; 5

6 NOW, THEREFORE, BE IT RESOLVED, that the Grand Traverse County Parks and Recreation Commission supports the conceptual plan of the Traverse City to Charlevoix Trail, as presented, and recommends that Grand Traverse County continue to play a supporting role in furthering trail development efforts. YMCA Contact Director spoke regarding Parks and Recreation-Grand Traverse Bay YMCA agreement, and the authority of the Parks Board to enter into such agreements. MOTION by Kachadurian, second by LeRoi, to recommend that the Parks and Recreation Commission approve entering into a two-year agreement with the Grand Traverse Bay YMCA for management and operations of the pool and fitness area at the Civic Center, and authorize the 7

8 Parks and Recreation President to effectuate the necessary documents, provided that funds are appropriated in the County s Fiscal Year 2017 and 2018 budgets. Department Report Senior Center Network Manager reported on the following: 78 new members joined 1,906 seniors participated in 7,342 units of service special events planned for veterans in November September is month of fall travel 8

Norte Proposal and Draft Agreement for Use of Space at Civic Center MOTION by Kachadurian, second by Marek, to direct Director to enter into agreement with Norte. Grand Traverse Conservation District Agreement Renewal MOTION by Marek, second by LeRoi, to renew the three-year contract with the Grand Traverse County Conservation District, as presented. Motion carried. Grand Traverse Conservation District staff made a presentation about the work the District does for the County at the Natural Education Reserve. 4. 2% Grant Requests Director discussed potential Parks projects that may qualify for Grand Traverse Band of Ottawa and Chippewa Indians two-percent grants. 5. ADA Compliance and County Parks Director presented an from a county resident asking to make county parks more accessible. 6. Park Rules Revision MOTION by Marek, second by McElyea, to adopt the amended Park Rules as presented in the agenda packet. Motion carried. 7. Independent Contractor for the Native American Marker Tree MOTION by Marek, second by LeRoi, to direct the director to hire a consultant for an amount not to exceed $200 for the Native American Marker Tree project. V. Approval of/additions to Agenda The Agenda for the September 15, 2016 Business Development Team Meeting was unanimously approved. VI. Civic Center Concessions Update Dzidra Minka reported a successful 2016 Summer Season in the new building between the ball fields at the Civic Center. She would like to continue her business at the Civic Center. Director stated she met with Dzidra and discussed the improvements to the concession stand inside the Civic Center, an expanded menu, a kitchen upgrade, improved appearance and more advertising and marketing. She recommends continuing the contract with the Pizza Wagon and partner with them to improve the inside concession stand. BDT members stated we have a good partnership with the Pizza Wagon and agreed with Director s recommendation. If the relationship continues with the Pizza Wagon, they will have to be flexible and work with vendors using the Arena and Civic Center Park to offer unique foods, a limited menu, or have the option to close the concession for a particular event. The Business Development Team agreed to recommend to the Parks and Recreation Commission to continue the collaborative relationship with the Pizza Wagon for the inside and outside concession stands. 11

12 VII. Civic Center Proposed Business Plan (Discussion) Erickson asked the Business Development Team to consider what should be included in the Civic Center Business Plan. Ideas presented were to promote the Concession Stand, a dog park, partner with Norte on the Safe Route to School Program and its bike rental and repair program, the new playground, an adult playground, pavilion improvements, and pool funding for improved maintenance issues. Easling Pool Operations Agreement and Review; Recommendation to County Board of Commissioners about Continuing Agreement Director discussed the memo regarding Easling Pool, and recommended that the Parks and Recreation Commission make a recommendation to the County Board of Commissioners to approve continuing an agreement with the Grand Traverse Bay YMCA to manage operations at Easling Pool. MOTION by Kachadurian, second by McElyea, to recommend that the County Board of Commissioners approve entering into a two-year agreement with the Grand Traverse Bay YMCA for management and operations of the pool and fitness area at the Civic Center, and authorize Board Chair or County 13

14 Administrator to effectuate the necessary documents, provided that funds are appropriated in the County s Fiscal Year budgets. Matt Cowall, Communications Director for the Land Information Access Association, and a member of the Friends of Easling Pool, spoke regarding the request of having the County Board of Commissioners approve entering into an agreement with the Grand Traverse Bay YMCA for a three year period of time, rather than the recommended two years. Long Lake Road Traverse City, Michigan MINUTES A. Call to Order The meeting was called to order at 4:31 p.m. B. Roll Call Commissioners Present: Pete Albers, Rodetta Harrand, Alisa Kroupa, Christine Maxbauer, John Roth Others Present: Bob Johnson, County Commissioner; Jeri LeRoi, Parks and Recreation Commissioner; Kristine Erickson, Director, Ryan Walsh, Office Manager, Marilyn Zielinski, Secretary, Grand Traverse County Parks and Recreation; Neil Horning, American Legion Baseball C. First Public Comment There was no public comment. D. Updates: Power Island Ferry Service; American Legion Baseball Season The Director proposed an evaluation of the current fees for Power Island. The committee discussed changing the fees for 2016 and concluded to keep the fees for the shuttle service and provide an additional service, in which residents can request flexibility around the set shuttle service schedule for a fee of $100 an hour, with a minimum 2 hour charge. It was also decided to raise the fees of the campsites to $25 per site/night for County residents, Sunday through Thursday and $35 site/night for Friday and Saturday. Out of County residents will pay $45 per site/night for each day of the week. The Director proposed evaluating the fees associated with the American Legion Baseball agreement. Neil Horning stated that the American Legion may be interested in having facilities management stripe the fields for the 2016 season. The Director will assess the fee calculations and reconvene with Neil before the start of the season. E. Review of Current Parks and Recreation Department Fees The committee discussed and concluded charging County Departments for the use of the meeting room. MOTION by Doren, second by Harrand, to change Rule 15 of the Grand Traverse County Parks and Recreation Park Rules to an enforceable civil infraction, after Director verifies with County Prosecuting Attorney s office whether Grand Traverse County, or whether the governing body where the rule is being enforced, would deputize individuals to enforce the rule. 23 Grand Traverse County Parks and Recreation Commission Rules Amended October 20, 2016 The following rules are promulgated by the Grand Traverse County Parks and Recreation Commission by authority conferred on the Commission by Act 261 of the Public Acts of the State of Michigan of 1965, MCL , as amended, for the protection, regulation and control of its facilities and areas, and with the approval of the Grand Traverse County Board of Commissioners. Section 1. Definitions. a. Commission shall mean the Grand Traverse County Parks and Recreation Commission. b. County Park Property shall mean all lands, waters and property administered by or under the jurisdiction of the Grand Traverse County Parks and Recreation Commission. c. Director shall mean the Grand Traverse County Parks and Recreation Director. d. Person or persons shall mean individuals, firms, corporations, or any group or gathering of individuals. e. Camping means the overnight lodging or sleeping of a person or persons in a tent, trailercoach, vehicle camper, motor vehicle, or in any other conveyance erected, parked or placed on the premises. Section 2. Unlawful acts generally. On lands owned or under the control of the department, it is unlawful for a person or persons to do any of the following: 1. To enter, use, or occupy County Park Property for any purpose when they are posted against entry, use, or occupancy, as ordered by the commission. 2. To dispose of refuse, rubbish, trash, or garbage not resulting from the use of countyowned lands in receptacles provided on Commission property. 3. To ignite any fire except within fireplaces, receptacles or open spaces designated and approved for such purposes by the Director. 4. To place or burn garbage within a designated fireplace, receptacle or open space designated and approved for the building of fires by the Director, or bury refuse, rubbish, trash, or garbage, regardless of its origin. 23

24 5. To use tobacco or smoke at the Grand Traverse County Civic Center. As used in this rule, the word smoke means any of the following: (a) using a cigarette, e-cigarette, cigar, pipe or vapors-tanks-mods or related product that contains tobacco, nicotine or any other related product that is lighted, burning or heated; (b) lighting a cigarette, e-cigarette, cigar, pipe or vapors-tanks-mods or related product that contains tobacco, nicotine or any other related product; (c) exhaling smoke or vapor from burning or heating tobacco, nicotine, or any other related product that is contained in a cigarette, e-cigarette, cigar, pipe or vapors-tanksmods or related product. 6. To cause a noise disturbance, which is defined as sound created by human activity with or without the use of any device, which by reason of its volume, intensity, location, or time of day impairs the health, welfare, or peace of another person of normal human sensibilities. The following acts and activities are declared to be noise disturbances and are prohibited. This enumeration shall not be deemed exclusive. a. The playing of any radio, television, phonograph, other sound reproduction device, or musical instrument in such a manner or at such a volume as to be sufficiently audible to annoy or disturb the quiet, comfort, or repose of persons in the vicinity. b. The keeping of any animal or bird which, by causing frequent or long continued noise, shall disturb the comfort and repose of any person in the vicinity. c. The use of any motor vehicle, in such a manner as to create a disturbing noise, including, but not limited to, the screeching of tires and the discharge into the open air of exhaust from the engine without a sufficient muffler. d. Shouting or other raucous or boisterous behavior for an unreasonable length of time. e. The use of a loudspeaker, public address system without a permit issued by the Director. f. On the Meadows Trail at the VASA Trailhead Property, on lands owned and under the control of the department it is unlawful for a person or persons to do any of the following: 1. To operate an off-the-road motor-driven vehicle such as a minibike, motorcycle, dunemobile, snowmobile, converted snowmobile, 24

25 amphibious vehicle, or any other motorized device, except on designated roads, trails, or areas posted for such use without proper written permission. 7. To place or erect a fence or barrier, to construct or occupy improvements, or to enclose the lands or obstruct the passage of another person or persons in any way from entering, exiting or using County Park Property without permission of the Director. 8. To peddle or systematically solicit business of any nature; distribute or post any handbills or other advertising matter or post signs without permission from the Director. 9. To paint, mark, or otherwise apply any chemical or harmful substance on any tree, rock, or any other land, water, structure or property without the permission from the Director. 10. To park vehicles of any type in areas posted as no parking; or, where designated parking areas exist, to park vehicles of any type in an area other than the designated parking area. If a motor vehicle is found parked on County Park Property, then the license plate displayed on the motor vehicle shall constitute prima facie evidence that the person who parked it there is the owner of the vehicle. 11. To camp on County Park Property unless approved and designated for such purposes by the Director and with an approved permit issued by the Director. 12. To store or leave property on county lands for more than 24 hours without written permission of the Director. This subdivision does not apply to lawfully occupied, designated camping sites when camping with a permit authorized by the Director. 13. To ride or lead a horse, pack animal, or other riding animal, or any animal driven vehicle on any area, except on roads that are open to the use of motor vehicles, trails, bridle paths, and campgrounds designated for such use by the Director. 14. To possess a dog without a leash or on a leash greater than six-foot in length except upon County Park Property open to hunting. 15. To enter or remain on County Park Property between the hours of 11:00 pm and 6:00 am unless the property is open for events between these hours. 16. To possess a bow and arrow, crossbow, trap or other instrument used for hunting or trapping of animals; or to hunt or trap on any County Park Property unless that property is open to hunting and/or trapping by Rule of the Commission. 17. To possess, consume, or offer for sale alcoholic beverages except in locations approved for such by the parks and recreation commission. 25

To refuse to comply with the above rules upon the demand of an authorized local enforcement officer; or to interfere with the officer s enforcement of the ordinance; or to retaliate against another who has made complaint of a violation of a park rule; or to interfere with an employee or agent of the Grand Traverse County Parks and Recreation Department while performing his or her official duties. Section 3. Enforcement Officers. The Grand Traverse County Sheriff and deputies are authorized as local enforcement officers of this ordinance. Section 4. Fines and Imprisonment. Any person violating any provision of the foregoing rules shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not more than $100 and costs of prosecution, or imprisoned in the Grand Traverse County Jail for a period not exceeding 90 days or both, for each offense. Section 5. Compliance with Other Laws. Nothing in this ordinance impairs or precludes a separate cause of action provided by statute or common law for conduct prohibited herein. Section 6. Severability. The provisions of this ordinance are severable and if any part is declared void or unenforceable by a court of competent jurisdiction, the remaining parts shall remain in force. 26

30 RESOLUTION # Easling Pool Refurbishment Project Fund WHEREAS, the Grand Traverse County Board of Commissioners met in regular session on, 2016, and reviewed a recommendation by the Grand Traverse County Parks and Recreation Commission to authorize creation of a trust and agency account to accept donations for the purpose of refurbishing Easling Pool at the Grand Traverse County Civic Center, and WHEREAS, funded by the Paul Easling Memorial Fund, Easling Pool opened in 1970 to serve county residents. Three years later, it reverted to county ownership because the Memorial Fund was depleted. For 46 years, the public pool has served the needs of county residents and beyond, teaching generations how to swim and be safe around water, and providing exercise and recreational opportunities, especially during nine months of the year when outdoor swimming is impossible, and WHEREAS, Easling Pool is an aging facility, and requires substantial improvements to preserve it as a community asset for future water safety education and recreational opportunities, and WHEREAS, in May 2016, Rotary Charities awarded a $5,000 grant to Parks and Recreation to develop a pool fundraising plan and conduct research to help put the pool on a sustainable physical and financial trajectory, and WHEREAS, a document containing the Easling Pool Funding and Transition Plan prepared by North Sky consultant Becky Beauchamp, and the Pool Financing Study and Report prepared by Matt Cowall, Communications Director, Land Information Access Association (LIAA), has resulted from the research and planning funded by the Rotary Charities grant, and WHEREAS, the document provides estimated costs for new air handling equipment; re-piping the pool s mechanical room; purchasing and installing new air handling equipment, ultraviolet sanitization system, filtration system, pool liner, decking, and lighting; materials and labor for painting the natatorium and locker rooms; ten percent contingency costs; capital campaign costs for a campaign director and for materials, mailings, and special events; with a recommended campaign goal of $625,000, and WHEREAS, during the next two to three years, the Friends of Easling Pool, a citizens group committed to preserving the pool as a community asset, will follow and execute the Easling Pool Funding and Transition Plan to raise funds to refurbish the pool so that it can continue to serve the community for years to come. County Parks & Recreation FROM: Steve Largent, Conservation Team Coordinator SUBJECT: 2017 NER DRAFT BUDGET DATE: July 17, 2016 As you know, 2017 is when the removal of Boardman Dam is scheduled to take place as part of the largest dam removal effort in Michigan s history. Extra work is needed to ensure the public is kept as safe as possible and informed. Please budget $18,000 for the work described below. Signage to direct and inform the public is included in the contractor bid documents but we anticipate the need for additional signage outside their scope. We ll also need to replace fencing along the Lone Pine ADA trail where the public will be directed to designated viewing areas. The fencing was installed over 15 years ago and is in need of replacement in several locations. There is a need to have the watercraft (canoe/kayak) landing and parking area designed to provide safe sustainable access once Boardman Dam is gone. We anticipate a design cost of $5,000. The new section of river, like Brown Bridge, will prove to be extremely popular to paddle once the dam is gone. A complete design that includes cost estimates for implementation will help inform the 2018 budget. There are also general maintenance needs that have been neglected over the past few years due to budget issues. General trail and access maintenance consists of upkeep such as trimming, pruning, and mowing along trails as well as the replacement of dog waste bags and posting of adequate signage. On-going repairs to aging fencing, stairs, boardwalk, and overlooks are considered necessary for the safety of users. The Conservation District will continue to oversee and implement all aspects of the above mentioned work plan projects, including but not limited to, permits, material acquisition, coordination of labor, and staff support to the NER Advisory Committee as outlined in the Scope of Services in the three-year Resource Management Agreement between the Conservation District and Grand Traverse County. Lastly, the Resource Management Agreement between the Conservation District and Grand Traverse County expires on December 31, I will contact you in a couple weeks to discuss how to proceed with renewing the Agreement. 42 Memorandum Grand Traverse County Planning and Development Fax To: From: County Commission Tom Menzel, County Administrator Jean Derenzy, Deputy Director Planning & Development Date: September 13, 2016 Subject: County Owned Properties --- Marketing for Possible Sale To assist with the identification of properties that are currently County owned but not needed to serve the goals, current mission or future vision of the County, I have worked with Prosecutor Chris Forsyth to complete an analysis of current properties. In addition to the goals, mission and vision of the County, additional analysis included: 1. Deed Restrictions on property. 2. Grant dollars used for property improvements and what are/were those restrictions. 3. Where purchase dollars were received from and if those dollars need to be returned to any restricted fund. 4. Current use of property. 5. Appraised value of property. The approach at this time is to look at only vacant property. Further analysis is needed for properties that hold County services but excess land, such as the LaFranier property. To move forward with just the vacant properties allows the County to complete further due diligence on occupied properties as well as allow the vacant properties to get on the tax rolls and/or move the vision of the County forward with the applicable taxing jurisdiction and/or non-profit. Two properties are being recommended to be marketed: 1. Whitewater Property ( ): This 161-acre parcel abuts State land. The property was originally purchased by the County for a landfill site. Appraisal was completed; identifying an opportunity to sell the property as a whole or splitting the property and selling in 40-acre splits. 2. Keystone/Brimley Road Property ( ): This 36 acre property was originally purchased for possible location of a materials recycling facility and a septage treatment facility which was an industrially zoned property. It was rezoned recreational a few years ago. To achieve the maximum value, it is recommended the property be rezoned for residential development. 42
