1 ARDLEIGH PARISH COUNCIL 547 MINUTES OF THE MEETING OF THE COUNCIL HELD ON 9 th NOVEMBER 2009 AT THE VILLAGE HALL AT 7.30PM Public and Police participation Present: Mr & Mrs Grant, District Cllr Buckle (Frinton), District Cllr Turner (Chairman TDC), Mr & Mrs Joslin, District Cllr Stock, County Cllr Candy & PCSO Beer. PCSO Beer reported that there had been very few incidents in Ardleigh over the past month, theft of foodstuff from Ramada Hotel, damage to flowerpots and a few burglaries. He reported that speed checks had been carried out with the speed gun in the village and on Old Ipswich Road. The lollipop man had taken the number of a vehicle that had driven directly at him and Stanway police were now investigating the incident. PCSO Beer reported trees overhanging the pavement near the salt works on Harwich Road. Clerk to action. Cllr Josselyn reported fly tipping on Wick Lane. PCSO Beer advised that fly tipping is in on the increase and must be reported, including car registrations where available. Cllr Watson reported that the 40mph signs along Dedham Road had been deliberately bent over. Clerk to contact Highways. The Chairman advised that the advertising blackboard from the Lion PH, which had been placed on the triangle of Highway land outside the church, was blocking views along the road and causing an obstruction. PCSO Beer to investigate. Mr & Mrs Grant of Crockleford Stud advised the Council that they had appealed against the Enforcement notice issued by Tendring District Council (TDC). They had been living on the site for 4 years, having bought the property without realising that there was no planning permission for the dwelling. Mr & Mrs Grant run a horse breeding business, with about 30 horses. They provide training and livery facilities and breed the horses to assist their son in his show jumping. They run a viable business, with one full time employee, a trainee and a day release student. Mr & Mrs Grant stated that they would be prepared to submit a retrospective planning application. The Chairman suggested that they could ask their neighbours to support the appeal. The Council agreed to write in support of their appeal. Mr & Mrs Grant left the meeting at 7.55pm. Mr & Mrs Joslin expressed concern about the caravan and concrete base being installed behind Tudor Cottage Station Road by the owners of the Lion PH. The TDC enforcement officer had advised the owners that planning permission was required for the installation. A notice of road closure had been posted to enable the caravan to be craned into place on Sunday 15 th November. Cllr Candy advised that TDC officers were to hold a meeting during the week to discuss what action could be taken. Cllr Candy to keep Mr & Mrs Joslin appraised of the situation. Mr & Mrs Joslin left the meeting at 8.10pm. District and County Councillors District Cllr Stock advised that TDC were now prosecuting anyone caught fly tipping, with very high fines being imposed. Cllr Stock reported that Betts on Ipswich Road Colchester is hoping to relocate the factory, leaving the site free for a possible development of 100 residential properties. The site is within the boundaries of both Colchester Borough Council and Ardleigh Parish Council. County Cllr Candy reported that Essex CC had a funding gap of 3million but savings would not be made through cuts in customer services. Cllr Candy advised that TDC would be submitting an objection to Essex CC regarding the proposed Sand and Gravel extraction site, A42 Ardleigh Rail. Cllr Candy reported that TDC have started work on the policy for Gypsy/Traveller sites within the area. The Enforcement notice for Esther-Lee Stables Crockleford Heath is currently with solicitors but no decision has been made regarding the issuing of the notice. It is unclear if the officers can serve the notice without reference to the Development Control Committee. Cllr Halsey commented that objecting to the planning application had so far cost so it was to be hoped that the enforcement notice would be served without further delay. Cllr Candy advised that she would keep the Parish Council informed of developments.

2 She understood that the applicants were considering submitting a new application for a reduced number of pitches. Cllr Halsey declared an interest in the planning application 09/00952/FUL Windsor House Colchester Road. 64 Minutes of the last meeting Cllr Chase-Gardener asked if minutes of the public meeting held on 16 th October regarding the Essex CC proposed Sand and Gravel extraction site were available. The Chairman reported that they were not yet finalised. Chairman to action. Cllr Halsey expressed concern that discussion of planning application ESS/39/09/TEN (Harveys Farm, Old Ipswich Road) had not been finalised at the previous meeting. The Chairman reported that, with the agreement of the Council, Cllr Talbot had visited the local residents and Ardleigh Reservoir to canvas their views on the application. All were very much against the application, the Reservoir because of dust and pollution, the residents because of noise, dust etc. The Parish Council objection was based on these findings. The Minutes of 12 th October 2009 were then approved and signed by the Chairman as a true record. PCSO Beer left the meeting at 8.30 pm. 65 Progress report on the last Minutes Essex CC Sand and Gravel extraction site: The Chairman reported that two meetings of the Steering Group had taken place. The proposed site is a Scheduled Ancient Monument. English Heritage had been unaware of the proposal and had objected to Essex CC. A draft response of the Council s objections will be circulated for comment prior to submission. Chairman and Clerk to action. Village Design Statement (VDS): Cllr Halsey asked why TDC had not taken any notice of the Ardleigh VDS. Windsor House Colchester Road Erection of two storey, single storey and first floor rear extensions (including rear facing balcony) and external/internal alterations. Ardleigh Parish Council opposes the application. The proposed extension will have a substantial visual impact both in the area generally and on the visual amenity of neighbouring properties. The extension will destroy the original character of the property. The proposals are not compliant with the requirements and recommendations of the Village Design Statement. The property has already been considerably extended and the proposal will make the property totally out of keeping with neighbouring properties and the area. The Old Stores The Street 1. Comments by 30 th November Cllr Buckle advised that he considered that a VDS was most important in a conservation area. Involvement in the consultation process would strengthen the withdrawal of Article 4. The Council agreed to request input to this document. Chairman to action. Crockleford Stud, Bromley Road: Enforcement appeal by Public Inquiry. Comments to Planning Inspectorate by 16 th November The Council agreed to write in support of appeal for the following reasons: o Dwelling in keeping with the surrounding rural area o Security for both Crockleford Stud and neighbouring businesses improved with occupation o No complaints received in respect of residents. Consultation period ends 2 nd January It was agreed that Cllr Watson would contact the GCG Environment Trust to investigate the possibility of adopting the operational kiosk opposite the fish and chip shop, although BT would then make the box non-operational due to lack of use. Quotation received for a Oak single door Notice Board for the cemetery: Notice-it Ltd , Church Notice Board Notice Point & HFL Displays had also been approached but provided only aluminium boards. Acceptance of the Notice-it Ltd quotation proposed by Cllr Chase-Gardener. Seconded by Cllr Watson. Approved. 2. Recreation, Play and Open spaces Colchester Road play area Risk assessments received from Cllr Harris and Josselyn. Another screw on scramble net has been exposed. It was agreed to investigate alternative fittings for scramble net. Clerk to contact Mr Andrew Bruce. A letter had been received from the WI asking for their bench on the Millennium Green to be moved. It was agreed to look at the cost of moving the bench and the cost of a new one. Clerk to action. 3. Environment and maintenance Mr Fryer provided recommendations for the replacement of the felled trees at Glebe Corner and Ardleigh Green. The Council requested recommendations to include indigenous species and costs. Clerk to action. Mr Fryer had provided costs to carry out the 6-month review of parish trees, , and to carry out recommended climbing inspections (Horse chestnuts within cemetery), Approved. Cllr Talbot reported that undulations in the road surface of Harts Lane were becoming deeper and more dangerous. Clerk to contact Highways.

6 Cllr Watson reported that the Chapel Road sign was buckled. Clerk to contact Highways. 552 The Clerk advised that no date had yet been notified for the installation of the Vehicle Activated Sign in Colchester Road. Clerk to contact Highways for an update. Cllr Talbot reported that the lamppost in the hammerhead of Gernon Road was not working. Clerk to contact Street Lighting. Cllr Smith reported that a number of black bin bags had been dumped in Wick Lane. Clerk to contact TDC. Cllr Smith reported that the hedges in Green Lane had become overgrown and were encroaching on to the road. Clerk to contact Highways. An had been received from R Fryer about the increased rubbish around the level crossing. Clerk to contact Network Rail. 4. Public Rights of Way Cllr Halsey reported that the footpath from Station Road had been re-routed without prior consultation. 5. Village Hall The monthly accounts to the 31 st October 2009 had previously been circulated. There were no questions. An interim report on the accounts to 30 th September 2009 had been received from Mr Tazzini, the auditor. There were no problems. Cllr Halsey reported that he had met with Mr Andrew Bruce to discuss the installation of the speed ramp in the Village Hall car park. No date had yet been given for the work to be carried out. The Clerk had received a report from Mr Phil Bland that the last cut for the playschool garden area was unable to be done because there were a large number of leaves covering the grass. Mr Bland had advised that it would cost 60 to clear the leaves. Acceptance proposed by Cllr Talbot. Seconded by Cllr Chase-Gardener. Approved. 6. Finance Report The monthly accounts to the 31 st October 2009 had previously been circulated. There were no questions. An interim report on the accounts to 30 th September 2009 had been received from Mr Tazzini, the auditor. There were no problems. Membership Renewal: Essex Wildlife Trust Cllr Chase-Gardener proposed that membership should not be renewed. Seconded by Cllr Andrews. Approved. The Clerk circulated a financial statement for the Gypsy/Traveller Site Fighting Fund to 31 st October With all donations/pledges received and known costs paid, the balance was It was agreed that the monies would not be reimbursed until the outcome of the Enforcement action/possible new application was received. Clerk to notify all donors of current situation. A copy of the Financial Regulations had been circulated prior to meeting, for their annual review. Acceptance proposed by Cllr Halsey.
