5 INTRODUCTION Introduction This bibliography records publications of the Scottish Parliament during this period. It also includes some statutory publications. Its objective is to help people to understand the Parliament and its work by providing a comprehensive and comprehensible guide to the relevant documentation. Under each heading we explain what the documents are and then list them. There is guidance on how to obtain each type of document. In addition, a number of volumes of guidance have been produced by the Clerking and Reporting Directorate to explain how key aspects of Parliamentary business operate in practice, by reference to relevant standing orders, determinations, conventions and practices. Although the guidance is aimed primarily at MSPs and clerks, it is also a useful reference source for anyone wishing to follow Parliamentary proceedings in detail. 6 BILLS Parliamentary Publications Bills A Bill is a draft law. Bills are either public seeking to change the general law or private seeking powers for a particular individual or organisation that are in excess of or in conflict with the general law. Public Bills can be introduced by a member of the Scottish Executive (an Executive Bill ), a parliamentary committee (a Committee Bill ), or an individual Member of Parliament (a Member s Bill ). Private Bills are introduced by the person seeking the powers provided for by the Bill. A Bill is issued with accompanying documents. These can include, whether it is within the Parliament s legislative competence (statement on legislative competence), an explanation of the Bill s provisions (explanatory notes), the policy behind the Bill (policy memorandum) and estimates of the Bill s administrative and other costs (financial memorandum). Accompanying documents are usually grouped for publication. Bills are numbered sequentially within each session as they are published, in the following way SP Bill 1, SP Bill 2 etc. Accompanying documents have the same numbering system as the bill they relate to but with the addition of an explanatory abbreviation, e.g. SP Bill 1-EN (explanatory notes), SP Bill 1-PM (policy memorandum). Subsequent versions of the bill are numbered SP Bill 1A, SP Bill 1B etc. Each version of the bill has an addendum to the title describing what stage the bill is at - [As Introduced], [As Amended at Stage...], [As Passed]. 15 LEGISLATIVE CONSENT MEMORANDUMS Legislative Consent Memorandums Legislative Consent Memorandums are lodged in the Scottish Parliament by the Scottish Government. They relate to Bills under consideration in the United Kingdom Parliament (Westminster) which contains what are known as relevant provisions. These provisions could: change the law on a devolved matter (an area of policy which Westminster devolved to the Scottish Parliament in the Scotland Act 1998); or alter the legislative competence of the Scottish Parliament (its powers to make laws) or the executive competence of Scottish Ministers (their powers to govern). Under an agreement known as the Sewel Convention, Westminster will not pass Bills that contain relevant provisions without first obtaining the consent of the Scottish Parliament. The consent itself is given through a motion (a Legislative Consent Motion) which is taken in the Chamber but the detailed scrutiny is undertaken by a Scottish Parliament committee on the basis of a memorandum. On occasion, a memorandum is lodged which invites the Parliament to note that the Scottish Executive does not intend to lodge a legislative consent motion on a particular bill. Legislative Consent Memorandum LCM(S2) 9.1 Consumers, Estate Agents and Redress Bill November 2006 Session 2, 2006 That the Parliament endorses the principle of giving consumers an effective voice as set out in the Consumers, Estate Agents and Redress Bill, introduced in the House of Lords on 16 November 2006, and agrees that the relevant provisions to achieve this end in the Bill should be considered by the UK Parliament. Lodged on 28 November LCM(S2) 12.1 Statistics and Registration Service Bill December 2006 Session 2, 2006 That the Parliament agrees that the provisions of the Statistics and Registration Service Bill, introduced in the House of Commons on 21 November 2006, which relate to statistics in Scotland and which are within the legislative competence of the Scottish Parliament or which confer functions on the Scottish Ministers, should be considered by the UK Parliament. This Bill was introduced in the House of Commons on 25 January Lodged on 27 February LCM(S2) 10.1 Tribunals, Courts and Enforcement Bill November 2006 Session 2, 2006 That the Parliament agrees that the relevant provisions of the Tribunals, Courts and Enforcement Bill, introduced in the House of Lords on 16 November 2006, (a) relating to the establishment of a new Tribunals Service and an Administrative Justice and Tribunals Council and (b) providing immunity from seizure for international works of art on loan to exhibitions in this country, so far as these matters fall within the legislative competence of the Scottish Parliament, should be considered by the UK Parliament.
