7 BOOKING CONDITIONS 2017 YOUR CONTRACT IS WITH MODERN TRAVEL CENTRE LTD, a member of ABTA and ATOL 1. Your Holiday Contract: When you make a booking, you guarantee that you hae authority to accept and do accept on behalf of your party the terms of this contract. A contract will exist as soon as we issue confirmation of booking. This contract is made on terms of this booking agreement together with the essential information 2. Your Financial rotection: We proide full financial protection for our package holidays. When you buy an ATOL protected air holiday from us, you will receie a confirmation inoice from us (or ia the authorised agent through which you booked) confirming your arrangements and your protection under our Air Trael Organisers Licence number 752. If we, or the suppliers identified on your ATOL certificate, are unable to proide the serices listed (or a suitable alternatie, through an alternatie ATOL holder or otherwise) for reasons of insolency, the Trustees of the Air Trael Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you hae or may hae arising out of or relating to the nonproision of the serices, including any claim against us, the trael agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you hae claimed under the ATOL scheme. For further information, isit the ATOL website at org.uk. The price of our air holiday packages include the amount of 2.50 per person as part of the ATOL protection contribution (AC) we pay to the CAA. This charge is included in our adertised prices. When you buy a package holiday that doesn t include a flight, protection is proided by way of a bond held by ABTA with Natwest Bank LTD. 3. ABTA: We are a member of ABTA, membership number V3101. We are obliged to maintain a high standard of serice to you by ABTA s Code of Conduct. We can also offer you an arbitration scheme for the resolution of disputes arising out of, or in connection with this contract. The arbitration scheme is arranged by ABTA and administered independently. It proides for a simple and inexpensie method of arbitration on documents alone with restricted liability on you, in respect of costs. Further information on the code and ABTA s assistance in resoling disputes can be found on 4. Your Holiday rice: i) We resere the right to alter prices of any of the holidays shown in our brochures. You will be adised of the current price of the holiday that you wish to book before your contract is confirmed. ii) When you are booking purely accommodation only, you must pay a deposit equialent to the first night s accommodation rate. If you hae booked a package with Modern Trael Centre inclusie of trael, the deposit required is per person. On occasion, the deposit required may be higher than the aboe and you will be informed of this before the booking is finalised. The balance of the price of your trael arrangements must be paid at least 8 weeks prior to your first night s stay. If the deposit and/or balance is not paid in time, we may cancel your trael arrangements. If the full balance is not paid in time, we shall retain your deposit. All monies you pay to the agent are held by him on our behalf at all times. iii) For Adanced Registered holidays (which will be clearly identified in adance), where we cannot confirm all components of the booking at the time of issue (e.g. Flight operating dates), we will endeaour to inform you as soon as possible of the full details. Should we be unable to confirm any components, you may opt to accept reised alternaties with any applicable price adjustments or receie an immediate refund of any monies paid. i) The price of your trael arrangements can be aried due to changes in transportation costs such as fuel, scheduled airfares and any other airline cost changes which are part of the contract between airlines (and their agents) and the tour operator or organiser. Also, goernment action such as changes in Value Added Tax, local taxes (or any other goernment imposed changes) and currency changes in relation to an exchange rate ariation, may also cause ariation. The package price that you hae been quoted will be the final charged rate, unless goernment based action is imposed. In the case of any small ariation, an amount equialent to 2% of the price of your trael arrangements, which excludes any amendment charges, will be absorbed or retained. For larger ariations, this 2% will still be absorbed for increases but not retained from refunds. In either case there will be an administration charge of 1.00 per person together with an amount to coer agents' commission. If this means that you hae to pay an increase of more than 10% of the price of your trael arrangements, you may cancel your trael arrangements and receie a full refund of all monies paid, except for any amendment charges. Should you decide to cancel for this reason, you must exercise your right to do so within 14 days from the issue date printed on your final inoice. Whether you cancel or not you will also be entitled, on the terms set out in respect of major changes in paragraph 5 below, to accept an offer of alternatie trael arrangements from us, if we are able to do so and compensation as set out below. Should the price of your holiday go down due to the changes mentioned aboe, by more than 2% of your holiday cost, then any refund due will be paid to you. lease note that trael arrangements are not always purchased in local currency and some apparent changes hae no impact on the price of your trael due to contracts and other protection in place. 5. If You Change Your Booking: If, after our confirmation inoice has been issued, you wish to change your trael arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking or your agent. You will be asked to pay an administration charge of 25, and any further cost we incur in making this alteration. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Note: Certain trael arrangements (e.g. some types of airline ticket) may not be changeable after a reseration has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangement. A change is deemed to be a correction or an enhancement to the existing holiday. If you request major alterations to your holiday (this includes, for example, changing dates of trael or any changes of significance, in respect of the original holiday), this will be termed a cancellation and charges, as per aragraph 6, will apply. If you alter any arrangements during your holiday (for example, checking out of the hotel early), no refund for unused accommodation or serices will be made. Where flights are not used, this is likely to result in the flights on your itinerary to be automatically cancelled by the airline. We will not be held liable to any losses or expenses you incur, as a result of this. 6. If You Cancel Your Holiday: You, or any member of your party, may cancel your trael arrangements at any time. Written notification from the person who made the booking or your trael agent on your behalf must be receied at our offices. Since we incur costs in cancelling your trael arrangements, you will hae to pay the applicable cancellation charges up to the maximum shown in paragraph 7. Note: If the reason for your cancellation is coered under the terms of your insurance policy, you may be able to reclaim these charges. If one member of the party wishes to cancel, this may mean that the accommodation booked will be under-occupied and will result in the remaining occupants haing to pay any applicable supplements to retain the booking e.g. changing a twin room to a single room. The person who cancels will still remain liable to pay cancellation charges as per the scale below. You must gie us reasonable notice before the departure date to enable us to change airline bookings, etc. this normally requires at least 21 days notice. A transfer fee of 25 per person will be charged plus any additional costs we incur (e.g. fare difference). If you transfer the booking before paying the balance of the price, you will remain liable to pay it (and our transfer fees) if the transferee fails to do so. Some airlines restrict or do not permit the facility to change names on bookings and it may therefore not be possible to transfer your booking. In this case, your booking will be treated as a cancellation and you will be liable to pay cancellation charges as detailed aboe. If you are to change this with less than 21 days notice, this may not be possible and this will be treated as a cancellation.

8 7. If We Change or Cancel Your Holiday: It is unlikely that we will hae to make any changes to your trael or hotel arrangements, as we plan the arrangements many months in adance. Occasionally, we may hae to make changes and we resere the right to do so at any time. Most of these changes will be minor and we will adise you or your agent of them at the earliest possible date. We also resere the right in any circumstances to cancel your trael arrangements. For example, if the minimum number of clients required for a particular trael arrangement is not reached, we may hae to cancel it. Howeer, we will not cancel your trael arrangements less than 4 weeks before your departure date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to proide the booked trael arrangements, you can either accept an offer of alternatie trael arrangements of comparable standard from us, if aailable, or hae a refund of all monies paid. lease note that carriers such as airlines used in the brochure may be subject to change. Any changes to the actual airline/ferry company after you hae receied your tickets will be notified to you as soon as possible and in all cases at check-in or at the boarding gate. Such a change is deemed to be a minor change. Other examples of minor changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same standard. If we make a major change to your holiday, we will inform you or your trael agent as soon as is reasonably possible, if there is time before your departure. You will hae the choice of either accepting the change of arrangements, accepting an offer of alternatie trael arrangements of comparable standard from us, or cancelling your booked holiday and receiing a full refund of all monies paid. 8. Force Majeure: This means that we will not pay you compensation if we hae to cancel or change your trael arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist actiity and its consequences, natural or nuclear disaster, fire, aderse weather conditions. 9. Delays: It is our policy that once you hae checked-in, you are the responsibility of the carrier. Aderse weather conditions can result in delays, diersions and een cancellation of some serices. Transport may also be cancelled due to technical problems or force majeure. Except where this leads to a significant alteration to contacted serices, we will not be liable for any loss or expense incurred in such cases, nor obliged to refund any payment for unused accommodation or serices at our hotels. Where we hae a representatie present, we will always try to help you to make appropriate arrangements for meals and/or accommodation if your transport is delayed. You will be responsible for paying for any extra meals or trael serices. Howeer, if you hae purchased holiday insurance, you may find that it will pay certain benefits in the eent of delays. 10. Your trael arrangements: When you book your holiday, we will gie you the best information we hae about your trael dates, time, routing, carrier and aircraft type. Howeer, carriers can and do change dates, times and routing at ery short notice and we cannot control these changes. When such changes are made, we will do our best to help you make arrangements to minimise inconenience to you. If we are notified in adance, by the airline, of schedule changes affecting your itinerary, we will notify you (if there is time to do so before departure). If the timing change is two hours of less, this will be adised to you on your trael documentation when issued. If the schedule change is more than 12 hours, you may choose to cancel your holiday and receie a full refund and, sae where the change is for reasons of force majeure, you will hae a right to compensation. We cannot accept responsibility if you miss you departure because you check-in late. 11. If You Hae A Complaint: If you hae a problem during your holiday, please inform the releant supplier (i.e. your trael agent) and a resort representatie immediately, who will endeaour to address your issue. If your complaint is not resoled locally, please follow this up within 28 days of your return home, by writing to our Customer Serices Department at Modern Trael Centre, Roseille Street, St. Helier, Jersey, Channel Islands, JE1 4HE; giing your booking reference and all other releant information regarding your booking and stay. lease keep your letter concise and to the point. This will assist us to quickly identify your concerns and ensure swift response. It is strongly suggested that you communicate any complaint to the supplier of the serices in question, as well as to our representatie without delay and complete a feedback report whilst in the hotel. If you fail to follow this simple procedure, we will hae been depried of the opportunity to inestigate and rectify your complaint whilst you were in the resort and this may affect your rights under this contract. 12. What Happens To Complaints: Disputes arising out of, or in connection with this contract which cannot be amicably settled may be referred to arbitration, if the customer so wishes, under a special scheme arranged by the Association of British Trael Agents, and administered independently by the Chartered Institute of Arbitrators. The scheme proides for a simple and inexpensie method of arbitration on documents alone with restricted liability on the customer in respect of costs. Full details will be proided on request or can be obtained from the ABTA website (www. abta.com). The scheme does not apply to claims for an amount greater than 5,000 per person. There is also a limit of 25,000 per booking form. Neither does it apply to claims, which are solely in respect of physical injury or illness or their consequences. The scheme can howeer deal with compensation claims, which include an element of minor injury, or illness subject to a limit of 1,000 on the amount the arbitrator can award per person in respect of this element. The application for arbitration and Statement of Claim must be receied by the Chartered Institute of Arbitrators within nine months of the date of return from the holiday. Outside this time limit arbitration under the scheme may still be aailable if the company agrees, but the ABTA code does not require such agreement. For injury and illness claims, you may like to use the ABTA / Chartered Institute of Arbitrators Mediation rocedure. This is a oluntary scheme and requires your tour operator to agree for mediation to go ahead. The aim is to help you resole your dispute in a quick and cost effectie way. Details are aailable upon request or from Our Liability to You: (i) We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents, our suppliers and subcontractors, whilst acting within the scope of, or in the course of their employment in the proision of your trael arrangements. We will accordingly pay to you such damages as might hae been awarded in such circumstances under English Law. (ii) In respect of trael by air and sea, and the proision of accommodation our liability will be limited in the manner proided by the releant international conention. You can ask for copies of these international conentions from our offices (Modern Group Offices, Brooklyn Street, St Helier, Jersey, JE1 4HE). 14. ersonal Injury Unconnected With Your Booked Trael Arrangements: If you, or any member of your party, suffer death, illness or injury whilst oerseas arising out of an actiity which does not form part of your package trael arrangements or an excursion arranged through us, we shall at our discretion, offer adice, guidance and assistance. Where legal action is contemplated and you want our assistance, you must obtain our written consent prior to commencement of proceedings. We limit the cost of our assistance to you or any member of your party to 5, Conditions of Carriage: The contractual terms of the companies that proide the transportation for your trael arrangements will apply to this contract. These may contain terms, which affect your rights to compensation. You may ask for copies of the releant conditions of carriage from our offices. This brochure is our responsibility, as your tour operator. It is not issued on behalf of, and does not commit the airlines mentioned herein or any airline whose serices are used in the course of your trael arrangements. lease note that in accordance with Air Naigation Orders in order to qualify for infant status, a child must be less than 2 years of age on the date of its return flight. 16. Data rotection: In order to process your booking and to ensure that your trael arrangements run smoothly and meet your requirements, we need to use the information you proide (such as name, address, address, any special needs/dietary requirements etc.). We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the releant suppliers of your trael arrangements such as airlines, hotels, transport companies etc. The information may also be proided to public authorities such as customs/immigration if required by them, or as required by law. We will not pass on any information to any person who is not responsible for any part of your trael arrangements. This applies to any sensitie information that you gie us such as details of any disabilities, or dietary/ religious requirements. (If we cannot pass this information to the releant suppliers, we cannot proide your booking. In making this booking, you consent to this information being passed on to the releant persons). 17. Insurance: It is adisable to take out an insurance policy at the time of booking, as you are at risk as soon as your deposit is paid to us. If you fail to make appropriate insurance arrangements in a timely manner, we will not be liable for any losses or expenses, which you may incur for claims which might normally hae been coered by insurance, in respect of circumstances for which we are not responsible.
