9 Title VI Complaint Procedure As a recipient of Federal Funding, The City of Buena Park Senior Mobility Program is required to comply with Title VI of the Civil Rights Act of 1964 and ensure that services and benefits are provided Any person who believes he or she has been discriminated against on the basis of race, color, or national origin by The City of Buena Park Senior Mobility Program may file a Title VI complaint by completing and submitting the agency s Title VI Complaint Form. The City of Buena Park Senior Mobility Program investigates complaints received no more than 180 days after the alleged incident. The City of Buena Park Senior Mobility Program will process forms that are complete. Once the complaint is received, The City of Buena Park Senior Mobility Program will review it to determine if our office has jurisdiction. The complainant will receive an acknowledgement letter informing her/him whether the complaint will be investigated by our office. The City of Buena Park Senior Mobility Program has 30 days to investigate the complaint. If more information is needed to resolve the case, The City of Buena Park Senior Mobility Program may contact the complainant. The Complainant will be notified in writing of the cause to any planned extension to the 30 day rule. The complainant has 10 business days from the date of the letter to send requested information to the investigator assigned to the case. If the investigator is not contacted by the complainant or does not receive the additional information within 10 business days, The City of Buena Park Senior Mobility Program can administratively close the case. A case can be administratively closed also if the complainant no longer wishes to pursue their case. After the investigator reviews the complaint, he/she will issue one of two letters to the complainant: a closure letter or a letter of finding (LOF). A closure letter summarizes the allegations and states that there was not a Title VI violation and that the case will be closed. An LOF summarizes the allegations and the interviews regarding the alleged incident, and explains whether any disciplinary action, additional training of the staff member, or other action will occur. If the complainant wishes to appeal the decision, he/she has 10 days after the date of the letter or the LOF to do so. 13 Public Participation Plan City of Buena Park Senior Mobility Program About the Buena Park Senior Activity Center and the Senior Mobility Program The City of Buena Park Senior Activity Center offers services to all seniors over 50 years of age. There are many activities seniors can enjoy here including a computer lab, fitness center, exercise and dance classes, painting and craft classes, pool room, and many other diversified activities. We also offer a daily lunch program and a Senior Social Club open to all seniors over 50 years of age. All activities are designed to bring seniors to the Buena Park Senior Activity Center so that they can participate in a more active life style that will insure a better quality of life. We have many staff on sight to serve as interpreters for our LEP (Limited English Proficiency) patrons if questions come up about our programs or activities. We have 2 transportation programs open to all low to moderate income seniors in Buena Park over 60 years of age. Our ST*R Transportation Program picks up Buena Park residents from their homes from 8am 10am, Monday Thursday and return them to their homes between 1pm 4pm the same day. Two 16 passenger buses are utilized for these trips and the program is run on a donation basis. Both of our drivers speak some Spanish and one of the drivers speaks Korean fluently. If anyone from our LEP communities has any questions that cannot be answered by our drivers we have staff who we can immediately contact to get their questions resolved. Our second transportation program is our non emergency medical transportation program. This program operates Tuesday Thursday from 8am 4 pm on a donation basis and utilizes a 5 passenger medical van. Residents are picked up at their homes and transported to medical appointments or shopping trips, then returned to their homes. Our transportation range covers the City of Buena Park and up to 3 road miles outside the Buena Park city limits. There is always someone on sight who can answer questions from our LEP populations. Purpose of this Plan The City of Buena Park intends to meet the requirements set forth by the Civil Rights Act of 1964 and by FTA circular B. The City of Buena Park encourages public participation through citizens expressing their concerns, desires, and values. It is the mission of the Buena Park Senior Activity Center to Improve the lives of seniors by creating opportunities to maximize their independence. At every opportunity through prescribed methods we will solicit input from seniors in order to best support persons served without creating disproportionately high and adverse human health or environmental effects on minority and/or low income populations. 13

14 Summary of Outreach Efforts The following is a summary of outreach efforts conducted by the City of Buena Park Senior Mobility Program as they relate to Title VI requirements under the Public Participation Plan. We also partner with other service organizations and non-profit agencies within the community so this list is by no means a complete list of the Senior Center s outreach to our minority or low-income populations. Buena Park Senior Activity Newsletter The Key This is the Senior Activity Center s information publication for seniors in the surrounding area. This publication chronicles all of our activities and programs at the Senior Activity Center. It also contains information about health issues, shared housing, food distribution programs, social services support groups, meals on wheels, support groups, and other services open to the community. Buena Park Today The City of Buena Park quarterly publication is mailed to the residents of Buena Park and also distributed at the Senior Activity Center. This publication covers upcoming events in Buena Park along with information for home improvement loans, classes for residents, and services for seniors. City of Buena Park website at This website contains valuable information for residents of Buena Park including our Tile VI Notice to the Public, housing information, transportation options, and community services available to seniors in the Buena Park area. The Buena Park Senior Activity Center s website This website provides updates on programs and activities at the Buena Park Senior Activity Center including; transportation programs, Medicare counseling, adult day care programs, public health and nursing services, and other outreach services available to all seniors in the area. This website also shows our Title VI Notice to the Public. Visits to various Senior Apartment and Mobile Home units within the Buena Park City Limits Bi-Lingual staff visit senior individuals in a group setting and explain to them the activities and transportation options to them at the Buena Park Senior Activity Center. This gives LEP seniors a chance to ask questions not only about our senior center but it provides them an opportunity to see what other community services might be available to them. 14

15 Social Worker The Buena Park Senior Activity Center also has a social worker available to provide invaluable information on Medicare, shared housing, and other outreach services needed by individuals in the area. Super Senior Saturday A highly publicized well attended health and welfare event put on by the Buena Park Senior Activity Center each year in the month of August. Many health professionals offer free services and testing in our biggest outreach event of the year. Many of the participants in the event are bi-lingual, multilingual staff are available to assist. Information about the Senior Mobility Program is available at this event. 15

16 Language Assistance Plan Overview The first section in this document describes the purpose of the Language Assistance Plan (LAP). The second section in this document provides the fourfactor Limited English Proficient (LEP) analysis (as outlined by the Department of Transportation (DOT) used to identify LEP needs and assistance measures. The four-factor LEP analysis includes: Factor 1: The number or proportion of LEP persons in the service area who may be served or are likely to encounter the City of Buena Park Senior Mobility Program Factor 2: The frequency with which LEP persons come in contact with the City of Buena Park Senior Mobility Program Factor 3: The nature and importance of programs, activities or services provided by the City of Buena Park Senior Mobility Program to the LEP population. Factor 4: The resources available to the City of Buena Park Senior Mobility Program and the overall cost to provide LEP assistance. The third and final section discusses the implementation of the Language Assistance Plan, which includes methodologies for identifying LEP individuals, providing services, establishing policies, monitoring the LAP, and recommendations for future LAP implementations. 16

17 Purpose of the Language Assistance Plan Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, and national origin programs and activities receiving federal financial assistance. One critical concern addressed by Title VI is the language barrier that Limited English Proficiency (LEP) persons face with respect to accessing information about and using transit service. Transit operators must ensure that this group has adequate access to the agency s programs and activities, including public participation opportunities. Executive Order 13166, titled Improving Access to Services for persons with Limited English Proficiency, forbids funding recipients from restricting an individual in any way in the enjoyment of any advantage or privilege enjoyed by others receiving any service, financial aid, or other benefit under the program, or from utilizing criteria or methods of administration which have the effect of subjecting individuals to discrimination because of their race, color, or national origin, or have the effect of defeating or substantially impairing accomplishment of the objectives of the program as respects to individuals of a particular race, color, or national origin. FTA Circular B was developed by the Federal Transit Administration (FTA) and details the administrative and reporting requirements for recipients of FTA financial assistance to comply with Title VI and related executive orders including LEP. The United States Department of Transportation (DOT) published guidance that directed its recipients to ensure meaningful access to the benefits, services, information, and other important portions of their programs and activities for LEP customers. The City of Buena Park Senior Mobility Program assistance plan (LAP) includes a four factor analysis and implementation plan that complies with the requirements of DOT LEP guidance. 17

18 Four Factor Analysis Factor 1: The number or proportion of LEP persons eligible to be served or likely to be encountered by the City of Buena Park Senior Mobility Program The Buena Park senior Activity Center holds a unique position in regard to meeting the Title VI requirements. As a sub-recipient of FTA 5310 Grant funding, the agency s focus is primarily to transport Buena Park seniors over 60 years of age to the Senior Activity Center or to non-emergency medical or shopping appointments. This service is provided to these seniors because transit options are insufficient or do not exist. The Buena Park Senior Activity Center does not offer transportation to the general public other than in situations involving a coordinated plan with other entities. Most persons join the Senior Mobility Program through an application process, and all passengers must be Buena Park residents. Residents receive applications in different ways. We mail applications to them at their request and they complete the applications and mail them back. The applicant may also come to the Senior Activity Center to complete the applications. Interested individuals can also receive applications during our on-site visits or at various City sponsored events. Interpreters are available to translate and answer questions individuals. After the applications have been filled out the Transportation Coordinator evaluates the applications to make sure they have been filled out correctly. Once the application has been approved passengers are able to ride in our vehicles. DOT has adopted DOJ s Safe Harbor Provision, which outlines circumstances that can provide a Safe Harbor for recipients regarding translation of written materials for LEP populations. The Safe Harbor Provision stipulates that, if a recipient provides written translation of vital documents for each LEP language group that constitutes five percent (5%) or 1,000 persons, whichever is less, of the population of persons eligible to be served or likely to be affected or encountered, then such action will be considered strong evidence of compliance with the recipients written translation obligations. Translation of non-vital documents, if needed can be provided orally. If fewer than 50 persons in a language group that reaches the five percent (5%) trigger, the recipient is not required to translate vital written materials but should provide written notice in the primary language of the LEP language group of the right to receive competent oral interpretation of those written materials, free of cost. 18

19 Our Safe Harbor Provision study determined that three LEP groups met the Safe Harbor Provision for inclusion in our Title VI Report. They would be Spanish, Korean, and Filipino. All the following information was obtained from for the year 2010 for the City of Buena Park, CA. in the sections Profile of General Population and Housing Characteristics: 2010 Demographic Profile Data. Language information was obtained from Selected Social Characteristics in the United States American Community Survey 5- Year estimates, which was also part of the census data. The US Census Bureau American Community Survey estimates that of the 80,426 Buena Park residents; 20,349 speak Spanish at home and 11,159 speak English less than very well. 20 The other two populations that qualify for the Safe Harbor Provision LEP population would be the Korean and Filipino population. The City of Buena Park has an estimated 7,806 Koreans or approximately 9.7% of the total population. The Filipino Community has an estimated 6,767 population or approximately 8.4% of the population. Both of these groups are a part of the Asian community in Buena Park which makes up 26.7% of the total population of the city. The Korean and Filipino population combined is 67.8% of the Asian population of the City of Buena Park. The following population numbers for Korean and Filipino came from the US Census 2010 Demographic Profile Data for the City of Buena Park. The US Census Bureau American Community Survey provides the rest of the information for this table. Buena Park, California Estimate Percentage Total 80, % Speak only English 34, % Speak Korean or Tagalo at Home 11, % Speak English very well 4, % Speak English less than very well 6, % The City of Buena Park Senior Mobility Program provides transportation to Buena Park residents who are 60 years and older. The 2010 Demographic profile data shows an estimated 12,112 people over the age of 60 living in Buena Park which would be approximately 15% of Buena Park s population. Of the 12,112 people over 60 years of age approximately 57.4 % would be considered part of the Buena Park LEP population or 6,952 residents. This number would be further reduced because a great number of these individuals have access to transportation and do not need our transportation services at this time. Historical Analysis of LEP Persons Served by the City of Buena Park Senior Mobility Program. A final source of data to be considered to determine the number of LEP persons transported by our bus and non-emergency medical van for 2013 showed that we did not encounter any passengers or participants with Limited English Proficiency. 20

21 Factor 2: The Frequency with which LEP individuals come into contact with the program The City of Buena Park Senior Mobility Program assessed the frequency their staff has or could come into contact with LEP persons over the past 10 years. The result of the report is that there were no individuals participating or wishing to participate in the program with Limited English Proficiency. Informal driver surveys result in the same result. Factor 3: The nature and importance of the program, activity, or service provided by the program to people s lives The primary purpose of the City of Buena Park Senior Mobility Program is to provide appropriate and adequate transportation for seniors who live in the City of Buena Park. The program provides vital transportation for seniors to and from their medical appointments and to nutrition programs at the Buena Park Senior Activity Center. Factor 4: The resources available to recipient for LEP outreach, as well as the costs associated with that outreach The City of Buena Park Senior Mobility Program is committed to providing language assistance to LEP populations who need services to gain access to the transportation program. The City of Buena Park Senior Mobility Program does not have a specific budget line item for language access and outreach. Translation services are provided by in house staff. The majority of outreach to the community is covered under the budget for the Senior Activity Center. The budget for the Senior Mobility Program is a small portion of the whole budget for the City of Buena Park. SUMMARY The summary of the four factor analysis is identified by the following: No true LEP participants have been served in the past 10 years. No participant was underserved by the Senior Mobility Program due to language barriers The other languages spoken in Buena Park that meet the 5% Safe Harbor Provision are Korean, Tagalo, and Spanish 21

22 Language Assistance Implementation Plan Methodologies City of Buena Park Senior Mobility Program Identifying LEP Individuals The evidence of the Four Factor Analysis, very few LEP individuals are referred to or participate in the City of Buena Park Senior Mobility Program. There are a few languages spoken in the City of Buena Park; Korean, Spanish and Tagalo that meet the 5% threshold. There does not seem to be a language barrier at this time with individuals applying for the program or for participants currently enrolled in the program. For the past 10 years the City of Buena Park Senior mobility program has not failed to provide services to individuals in the City of Buena Park. Providing Services The City of Buena Park Senior Mobility Program currently does not have a need for professional translation services however it does have staff members available that are bilingual. The following documents are made available to the public in Korean, Spanish and Tagalo: Title VI Notice to the Public Staff members are available to translate any other documents, included but not limited to: Title VI Complaint Form Title VI complaint Procedures Communicating Availability of Language assistance Individuals seeking to become participants in the City of Buena Park Senior Mobility Program meet with the Transportation Coordinator who provides one-on-one attention and guidance for the program. The Transportation Coordinator has access to staff members that speak Korean, Spanish and Tagalo for translation services. Monitoring The City of Buena Park Senior Mobility Program evaluates itself on the feedback from the participants in the program. The agency frequently meets with staff for any potential issues or problems. The transportation staff evaluates the program annually to find areas it can improve upon. The Title VI plan will be evaluated annually and will be updated every three years. Employee Training The City of Buena Park Senior Transportation Program conducts monthly in-service trainings for staff which include driver and passenger safety, customer service and language assistance training. 22

23 Membership of Non Elected Committees and Councils The City of Buena Park Senior Mobility Program does not have a board of nonelected officials at this time. Title VI Equity Analysis The City of Buena Park Senior Mobility Program does not have transit related facilities. 23

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BUENA PARK, CALIFORNIA, APPROVING AND ADOPTING THE TITLE VI PROGRAM FOR THE BUENA PARK SENIOR MOBILITY PROGRAM WHEREAS, the City of Buena Park Senior Mobility Program is a recipient of federal funding and is required to meet federal regulatory requirements for Title VI of the Civil Rights Act of 1964 including new provisions detailed in U.S. Department of Transportation s FTA Circular B, Title VI Requirement and Guidelines for Federal Transient Recipients, WHEREAS, the Buena Park City Council wishes to authorize approval of the compliance plan developed by staff to comply with necessary provisions of the Civil Rights Act, WHEREAS, The City of Buena Park Senior Mobility Program assures that no person or group of persons on the basis of race, color, or national origin, including limited English Proficient persons are subjected to discrimination in the level and quality of transportation services, programs and activities provided, whether federally funded or not; : NOW, THEREFORE, the City Council of the City of Buena Park does hereby approve and adopt the City of Buena Park Senior Mobility Program Title VI Program PASSED AND ADOPTED this 12th day of August 2014 by the following called vote: AYES: COUNCILMEMBERS: NOES: COUNCILMEMBERS: ABSENT: COUNCILMEMBERS: ABSTAIN: COUNCILMEMBERS: Mayor ATTEST: City Clerk I, Shalice Tilton, City Clerk of the City of Buena Park, California, hereby certify that the foregoing resolution was duly and regularly passed and adopted at a regular meeting of the City Council of the City of Buena Park, held this day of.
