We store and handle a wide range of products including petroleum products, chemicals, and gases. The telephone numbers are: Office: and Mobile: The was prepared to make ship crews familiar with our facility in order to maintain a safe work environment. This document contains general Health, Safety, Security and Environment information, basic rules of behavior, instructions for emergency situations, relevant terminal regulations and information for safe and efficient operations while a vessel is alongside the berth. Therefore, irrespective of the permits required, everybody entering the terminal for the first time is obliged to make himself / herself familiar with this booklet. For emergency situations the facility is provided with emergency alarm points, fire extinguishers, and terminal radios. They are clearly marked and ship crew members must identify the nearest location before starting their operation. For orientation please refer to the map included. It is the obligation of all persons entering the terminal to protect the environment by preventing contamination of soil, water or the atmosphere. Visits to our facility are made at one s own risk. Oiltanking Texas City is not responsible for any damage, loss or injury which may occur during the stay on our property. Please do not hesitate to contact the Terminal Management on any query you may still have after reading this booklet or regarding other items not included in this booklet. 5 T e x a s C i t y Page: 5 of 20 2 Terminal Regulations 2.1 Ship s Responsibilities Responsibility of the Captain The Captain of a seagoing vessel, or the Captain of an inland vessel, should take care that he and all other persons, while on board the ship as well as on the dock, carefully follow all rules, regulations, formalities, measures and directions given, and/or to be given by, or on behalf of the authorities and/or Oiltanking Texas City. The Captain should take care that all agreements made between Oiltanking Texas City and persons on board the ship are carefully observed. All operations on board the ship, relative to the ship and/or the cargo, are to be executed under surveillance of the Captain, as well as operations carried out by personnel of Oiltanking Texas City. Ban on fire and smoking The use of open fire - which includes welding, smoking, use of matches, lighters and non-officially approved illumination - is forbidden under all circumstances on the dock, in the open air, or in enclosed areas where the construction or the ventilation system does not give protection against penetration of inflammable gases. Water pollution Unless officially approved, it is forbidden to allow the discharge of substances, in any way or for any reason, including overfilling, on the dock or into the water. Commencement and progress of operations When the dock has declared itself ready for delivery or receipt of the cargo, the loading or discharging of the ship shall commence until the complete cargo has been loaded or discharged. During this period, the Captain shall ensure that the ship receives or discharges the cargo without interruption and/or delay, with due observance of the relative agreements made with Oiltanking Texas City, and with observance of regulations and rules applicable to the cargo and the dock in question.

6 T e x a s C i t y Page: 6 of 20 Leaving the berth The Captain is bound to leave the berth as soon as possible, after termination of loading or discharging. Oiltanking Texas City has the right to demand that the ship be removed from its berth when Oiltanking Texas City deems this necessary for reasons of safety, compliance with safety regulations and/or directions from the harbour authorities or other authorities, the smooth continuation of activities, or for any other valid reason. Likewise, Oiltanking Texas City has the right to demand that the ship, which has taken berth alongside an assigned mooring and which, in spite of the installation's readiness, is not able to or - for whatever reason - does not commence loading or discharging cargo, or which discontinues any of these activities, clears the berth if Oiltanking Texas City issues this type of request. If the ship does not clear its berth on first request from Oiltanking Texas City, then Oiltanking Texas City has the right to shift (have shifted) or to remove (have removed) the ship for account and risk of the Captain and the owner of the ship. Availability of berth Oiltanking Texas City will determine if the berth is available for loading or discharging of cargo. This will be communicated to the owner s representative or agent. Direct transfer barge to ship or ship to barge For any manipulation of cargos which is to take place between the ship and any other vessel, prior written permission from Oiltanking Texas City is required. Even if Oiltanking Texas City has allowed such transfer, it will take place under the Captain's responsibility and for account and risk of the Captain and the owner of the ship, and not for account and risk of Oiltanking Texas City. Entering Oiltanking Texas City's premises Ship crew members being present on the dock as well as those who enter the terminal on request of the Captain and/or the ship crew members, do so entirely at their own risk, even when this happens with permission of, or under escort by, Oiltanking Texas City. Oiltanking Texas City is never liable for death, injury, damage, loss, fines, costs or other harm incurred by those who set foot in the terminal or on the dock. This section also applies to vehicles with which crew or other persons coming from or going to a ship are travelling in. The Basic Safety Rules (see chapter 2.2) have to be adhered to when entering the terminal premises.

7 Jetty Information Page: 7 of Basic Safety Rules When entering Oiltanking Texas City s premises the following rules apply: Smoking is prohibited except in the marked smoking areas. It is prohibited to carry sources of ignition (e.g. lighters, matches) at all times. Use of non spark-/explosion-proof equipment (e.g. mobile phones, radios, cameras, calculators, battery-powered hearing devices) is only allowed by special permission from the management. The minimum personal protective equipment (PPE) consisting of safety hard hat, footwear (anti-static safety shoes with product resistant soles), safety glasses and protective clothing (antistatic) must be worn at all times. Where indicated through signposting or required by a Work Permit, additional PPE (e.g. eye and ear protection) requirements shall be met as well. It is forbidden to possess or consume alcohol, drugs or other intoxicants on the site or to be under their influence. It is not allowed to drink or eat during work or in tank farms, pump stations, manifolds, loading racks or jetties. Garbage and waste must be collected and disposed of in dedicated containers. Drivers of all vehicles must obey traffic signs and regulations. The general speed limit of 20 mph must be observed. Handrails and walkways must be used where provided. All accidents, injuries, incidents or near misses must be reported to operations or the HSSE Department. Instructions of Oiltanking Texas City personnel must be followed at all times. 10 Page: 10 of 20 5 Mooring The Captain shall ensure that ships alongside Oiltanking Texas City berths shall be secured with the minimum number of mooring lines. 6 Security Oiltanking Texas City is in compliance with the Maritime Transportation Security Act (MTSA). A Declaration of Security will be provided by Oiltanking Texas City. 7 Product Transfer Prior to any product transfer the Captain or PIC of the ship will complete the Declaration of Inspection before starting operation. 8 Other Facilities With prior arrangements, the following services can be provided at designated docks as indicated below: Activity Dock No. Supply of nitrogen 66 and 67 Supply of bunker fuels barge 66 and 67 Receiving/disposal of tank washing/slop 66 and 67 Ship/Barge cargo transfer via double banking 66 and 67

11 Page: 11 of 20 9 General 9.1 Vessel Information Oiltanking Texas City will provide the ship's agent with an electronic copy of the Dock Information and Tanker Nomination Form. The latter has to be filled in and returned. 9.2 Pre-Arrival Information The owner s representative or agent must contact Marine operations at and provide the following information: The amount in metric tons of inbound products on the vessel. If Oiltanking Texas City is the port of entry the ship agent must inform the Marine Office representative of the need for customs clearance The cargo name and amount (include +/- option request) in metric tons of outbound products The vessel is responsible for stowage in accordance with 46 CFR for inhibited cargoes and adjacent cargo prohibitions in 46 CFR Vessels loading any product using vapor control must be certified to load the specified cargo by name. The Marine Operations representative will provide the ship agent a vapor control form to be filled out in its entirety. This information is acquired in advance to expedite the ship pre-load conference. Any vapor return line on the ship which will be used at Oiltanking Texas City must be cleaned of its last contents prior to vessel arrival Notification of arrival 72, 48 and 24 hours prior to actual arrival A complete Crew List must be provided to Oiltanking Texas City prior to vessel arrival. to OTTC Security at: Securitytxc@oiltanking.com Vessel size is limited to 700 feet (213 meters) overall length. Vessels over this length require special permission to dock with 48 hours prior notice Vessels less than 175 feet (53 meters) between forward and aft perpendiculars can not dock at 66 or 67 docks.

12 Page: 12 of The minimum tug requirements for docking and undocking tankships at Oiltanking Texas City Docks 66 and 67 are: a. All vessels feet (0-107 meters) overall length require one (1) tug. b. Vessels with an operational bow thruster feet ( meters) overall length requires one (1) tug. c. Vessels with no bow thruster feet ( meters) overall length requires two (2) tugs. d. The harbor pilot or the vessel master, when weather or vessel congestion in the harbor requires, must use additional tugs when docking or undocking. e. Oiltanking Texas City retains the right to require additional tugs for either docking or undocking. f. Under no circumstances, other than emergency situations, will any vessel attempt to dock or undock without the tug assistance, as required in the previous paragraphs (a-e) Draft is limited to 36 feet maximum at 66 dock and 38 feet maximum at 67 dock All dockings will be starboard side to at 66 and 67 docks. Any exception must be approved by Oiltanking Texas City 24 hours prior to docking Every effort must be made to avoid placing assisting tugs between the vessel and the shore, to avoid wheel wash being directed toward the facility. In cases where the safety of the vessel or the dock is jeopardized, and a tug must be placed in this position, the Oiltanking Texas City shift boat (unit 21 on VHF channel 16 or 18) must be advised to protect any barges that might be affected by wheel wash Ocean going barges require the assistance of the Kirby shift boat (unit 21 on VHF channel 16 or 18) when docking or undocking at 65, 66 or 67 docks. 9.3 Safety Considerations Material Safety Data Sheets (MSDS) will be furnished by Oiltanking Texas City to the loading vessel on arrival for every Oiltanking Texas City cargo to be transferred. The MSDS must be reviewed by vessel personnel before cargo operations are commenced by the vessel.

13 Page: 13 of Oiltanking Texas City requires coverall goggles and chemical resistant gloves to be worn as the minimum personal protective equipment for handling all chemicals at this terminal. Certain chemicals are especially hazardous or toxic and the Coast Guard prescribed personal protective clothing must be worn for the products listed in 46 CFR All safety procedures and special requirements as outlined in 33CFR and 46CFR must be followed at all times. Coast Guard regulations require that the most recent 46CFR (parts 35, 150 and 153) be aboard the vessel (46CFR ) On arrival, the vessel will be secured in a safe manner. Vessels that employ constant tension winches will put out two additional lines in case of winch failure. Mooring line tension will be adjusted by the vessel while all necessary adjustments to hose support cradles will be made by the Oiltanking Texas City dock operator All tank inspections will be performed by an independent inspector assigned by Oiltanking Texas City or by the Oiltanking Texas City customer. Approval of tanks to load is totally based on the independent inspector s determination of tank cleanliness and readiness to load. Entry procedures for tank inspections are determined and issued by the independent inspection company. The entry procedures must comply with all existing regulations (46CFR / 935) and all applicable OSHA regulations Vessel officers must supervise the vessel loading or discharge. Adequate standby warnings must be given to the Oiltanking Texas City dock operator when topping off vessel tanks. Standby warnings must be given at 15, 10 and 5 minute intervals. Constant radio communication between the vessel person in charge and the Oiltanking Texas City dock person in charge must be maintained when a vessel tank is within 5 minutes of topping off. Vessel cargo tank or header valves must not be closed in against shore hoses except in emergency situations. When a vessel is discharging the Oiltanking Texas City dock operator will advise the maximum allowed pressure on the shore transfer system. Shore hoses and vessel pipelines will be cleared of all liquid to the ship cargo tank with nitrogen before a hose is disconnected. Hose ends will be blindflanged before being moved over the waterway from the ship to the shore. Drip pans will be supplied by the vessel under all hose connection points on the vessel. Vessel drip pans must be empty and free of objectionable odor prior to dock arrival. The vessel must have room in their slop tanks to remove liquid from their drip pans or water rinse them upon shore-side request.

14 Page: 14 of All passageway doors, ports and windows leading to the cargo deck must be closed and the vessel must insure that proper ventilation is supplied to prevent entry of toxic or flammable fumes to accommodation areas during cargo transfer operations In cases of severe weather in the immediate area, cargo operations are to be reduced or discontinued at the discretion of the vessel master, dock operator or the Marine Office representative All products must be loaded through a drop line (a pipe line extending to within a few inches of the bottom of the tank). All loading connections on the vessel must have a valve at the point where the shore hose is to be connected All vessels must have the Oiltanking Texas City supplied grounding cable connected to the Oiltanking Texas City dock before any hoses are connected to the vessel. The grounding cable must remain connected until all cargo operations are complete, hoses are disconnected and, if applicable, any spills to the deck of the vessel are cleaned up No personnel of any kind are allowed to enter any cargo or void tank after any hose connection is made from the facility to the vessel. This includes cargo hoses and nitrogen purge hoses The vessel must be adequately lit at night. Only intrinsically safe lights, including hand held lights, are approved for use While berthed at an Oiltanking Texas City dock, all vessel manifold headers must be blind flanged or have a cargo hose connected to the header flange. At no time will a vessel manifold header be open-ended unless a hose or blind flange is being removed or put in place.

15 Page: 15 of Information Oiltanking Texas City will furnish an intrinsically safe portable radio to the vessel for the duration of cargo transfer operations. The vessel is required to sign a statement that the radio will be returned to Oiltanking Texas City or the vessel operator will be billed $2, (U.S. dollars) for replacement costs. The U.S. Coast Guard and Oiltanking Texas City require that the vessel deck officer in charge of the cargo transfer operation be in constant communication in English with the Oiltanking Texas City dock operator. Failure by the vessel to supply a deck officer fluent in English will result in the complete shutdown of cargo operations {46CFR (a) (2)}. If, for any reason, the dock personnel can not communicate with the ship by radio, all cargo transfer operations will be shut down until radio communications are re-established The declaration of inspections (DOI) must be executed by the vessel master or chief officer and by the Oiltanking Texas City dock operator, prior to the start of a transfer operation. Whenever a shift or watch change is initiated, the relieving personnel on both the ship and the dock must sign both the dock and vessel copies of the DOI, which signifies responsibility for the transfer Handling of stores or equipment across the Oiltanking Texas City docks is permitted. Requests for deliveries must be made in advance, by contacting the Oiltanking Texas City representative at or during regular business hours. Requests outside of regular business hours must be directed to the dispatcher at Alcoholic beverages of any kind are not allowed as a stores item at the Oiltanking Texas City Marine Terminal. Additionally, crewmembers returning to a vessel at the Oiltanking Texas City docks are not allowed to bring any kind of alcoholic beverage into the Marine Terminal In the event of a spill or leak from or to the deck of a vessel, the Oiltanking Texas City dock operator must be notified immediately. The vessel also must report the spill or leak to the appropriate U.S. government agencies The vessel must furnish ullage records on vessel tanks to the appointed independent inspector Funnel uptakes and boiler tubes must not be blown alongside Oiltanking Texas City docks. The vessel must not engage its propulsion unit while tied up to a dock.

16 Page: 16 of Bunkers are permitted to be loaded while at the Oiltanking Texas City docks. Potable water is not available at Oiltanking Texas City Sailing time must be calculated by the vessel and the Oiltanking Texas City dock operator. The laboratory must be consulted to allow sufficient time for product analysis when calculating sail time A gate list of approved vessel operators, owners and agents, and vendors is required for each vessel, to allow travel to and from the vessel. to: Securitytxc@oiltanking.com Only clean ballast (totally free of chemicals or oils) is allowed to be discharged into the harbor. Any ballast water that does not meet these criteria and is being discharged will be immediately reported to the U.S. Coast Guard by the Oiltanking Texas City dock operator No slops, oils or wash materials will be accepted ashore except as required under current MARPOL Annex I and II regulations Scuppers must be securely plugged at all times while a vessel is at an Oiltanking Texas City dock. Decks must be clear of tripping hazards or any other obstructions, to provide safe cargo transfer operations Vessels to be loaded must arrive at the Oiltanking Texas City docks ready to load in all aspects. Vessels discharging must be lab approved and ready to Discharge Upon Arrival The vessel notice of readiness (NOR) on tankers which will load cargo will be accepted when the tanker is boarded by the Texas City Pilots. If any ship tank fails the required visual inspection at the dock, the Notice of readiness is null and void. The vessel notice of readiness on tankers which will discharge cargo will be accepted when the tanker is boarded by the Texas City Pilots. If any ship tank fails the required lab analysis as determined by the Oiltanking Texas City lab, the Notice of readiness is null and void. Every effort should be made to sample inbound ships at preceding ports in order to eliminate lost time waiting on lab analysis.

17 Page: 17 of Pre-Transfer Conference A pre-transfer conference must be held on every vessel after it has been secured to the dock and all government requirements have been satisfied. The vessel master or chief officer, independent surveyor and Oiltanking Texas City dock operator must be present at the pre-transfer conference When the vessel is to load, the Pre-load Conference Check sheet and Loading Instructions must be used by all parties to agree on the following items: Customer s product name and Coast Guard cargo name MSDS are available and information is understood MARPOL requirements Proof of vessel documentation compliance Confirmation of quantity ordered *** (+/- option), min/max requirement, max amount allowed Vessel tank capacity Amount agreed to load Agreement on ship or shore stop Nitrogen purge/blanket and heating instructions Product viscosity (MPAs) when required by MARPOL Cargo loading rates Emergency procedures When all parties reach agreement, each party must sign the appropriate place on the checklist which indicates agreement to start the transfer operation (46CFR ). *** The wording for the load options clause in the COA is the % more or less is the ship s option on each grade, subject to charterer s approval, which shall not be unreasonably withheld The Declaration of Inspection form must be initiated at this conference Inhibitor certificates must be issued for each product requiring the addition of an inhibitor per 33CFR after the inhibitor has been added to the cargo tank. The certificate of inhibition must be completed in full by all involved parties and a completed copy retained aboard the vessel for the duration of the voyage Vapor control loading of any product requires a 4 inch 150# flange ship vapor connection with a stud located at the top of the flange, to prevent a cargo hose being connected to the vapor line. No transfer will be made until all requirements for vapor control loading are satisfied.

18 Page: 18 of Vessels which are to unload will be advised of the maximum shore side transfer rate and pressure. 9.6 Vessel Readiness Vessels must remain in constant readiness to leave the berth in the event of an emergency. There must be sufficient number of crew members aboard the vessel at all times to move the vessel if required to do so by an emergency Main propulsion engines, boilers or turbines must not be immobilized while the vessel is moored at the dock. The vessel must not engage the driving mechanism to the propeller when cargo hoses are connected or while the vessel is moored to the dock Fire warps must be deployed over the side both fore and aft while moored at an Oiltanking Texas City dock. Each cable used as a fire warp must be suitable for towing the vessel and must have a usable loop convenient to a towing vessel alongside at the waterline. 9.7 Vessel Repairs and Cleaning No welding or cutting by torch is permitted on any part of the vessel without written permission from the Oiltanking Texas City Chipping, scraping, blowing boiler tubes, or any other operation which can produce sparks, is prohibited Vessel tank cleaning or gas freeing is not allowed without specific written approval from the Marine Planner No personnel of any kind are allowed to enter cargo or void tanks after any hose connection is made from the facility to the vessel. 9.8 Emergency Instructions Two fire/emergency sirens are located in the Marine Terminal. The sirens will sound to signal that an emergency evacuation alert exists The fire alarm will sound for the area of the terminal affected by the emergency. The alarm signal for 66 dock is and for 67 dock. In the event of a shore-side alarm signal, the Oiltanking Texas City dock operator will contact the vessel via the supplied radio with details and/or instructions.

19 Page: 19 of The alarm signal to be used to signify a vessel emergency while at our docks is a continuous sounding of short blasts from the vessel emergency alarm horns Immediately upon hearing any of the above emergency signals, the vessel officers must alert all crewmembers and prepare to move the vessel from the dock. ALL CARGO TRANSFER OPERATIONS MUST BE STOPPED. The vessel manifold valves are to be closed at the direction of the Oiltanking Texas City dock operator. The vessel crew must assist the Oiltanking Texas City dock operator in disconnection of cargo hoses, if requested to do so Vessel fire fighting equipment must be kept ready for instant use at all times while at the dock. Fire water is available at 66 and 67 docks. An international fire hose connection is available for vessel use in case of firewater failure on the vessel While moored at an Oiltanking Texas City dock, any emergency aboard a vessel must be immediately communicated to the Oiltanking Texas City dock operator, via the Oiltanking Texas City supplied radio. 9.9 Marpol Annex I, II, V Oiltanking Texas City has a Certificate of Adequacy for Reception Facilities for compliance with MARPOL I oily waste and MARPOL II category A-D noxious liquid waste (cargoes unloaded here only) All oily waste will be handled by a mobile facility. Oiltanking Texas City has an agreement with Garner Environmental to handle oily waste. Garner is EPA permitted to handle oily waste. A vessel needing this service must use Garner or another EPA permitted company at their expense MARPOL V Aphis waste disposal is handled as a joint venture with several Texas City industries through the Texas City Port Authority. Request for disposal of aphis waste at the port of Texas City must be made to the Texas City Harbor Master at

20 Page: 20 of Transportation between Docks and Gate Walking between the entrance gate and Oiltanking Texas City docks is prohibited at all times. Oiltanking Texas City will NOT furnish transportation to and from vessels berthed at 66 and 67 docks for anyone. Vessel crewmembers must wait at the vessel until their provided transportation is available Crewmembers must wear the following personal protective equipment when walking to and from the ship and dock: Hardhat Safety glasses or coverall goggles Long pants and a shirt Closed type shoes (no thongs, sandals, etc.) Taxi service is not allowed inside the Marine Terminal. Any arrangements for taxi service must be made for pickup at the main entrance gate area Personal vehicles of crewmembers are not allowed inside the Marine Terminal. Company vehicles of ship agents, owners and vendors are allowed inside the Marine Terminal, but only with prior written approval from the Oiltanking Texas City Marine Planner U.S. Government, Texas City Harbor Master, ship agents, ship operators, Texas City pilots, and other agencies designated on the entry list at the security gate will be allowed to bring personal vehicles inside the Marine Terminal. These vehicles must have their company designation clearly visible from the outside of the vehicle at all times.
