Premises not compliant by 30 th September 2014 will be required to cease the sale of alcoholic beverages until they are in full compliance. Any premises not listed under items 9 and 10 have not met the requirements for application of renewal and will not be legally licensed for the sale of alcoholic beverages as of 1 st October Persons wishing to object to the renewal of an existing license have until 48 hours prior to the date of the Board s annual session to do so in writing and are welcome to attend the meeting to voice their concerns. The deadline for written objections against new applications is 7 days prior to the date of the Board s meeting. Objectors are required by law to attend in person, or by representation, in order to have their objections heard. Special attention should be drawn to the fact that it is illegal for anyone below the age of 18 years old to be in a nightclub, bar or in the area of a bar that is located in a restaurant. Consumption of liquor by persons under the age of 18 on licensed premises or in public places is an offence. Section 3, subsection (1)(a) of the Liquor Licensing Law 1985 (2000 Revision) states that whoever disposes, exposes for sale or offers for sale any intoxicating liquor is guilty of an offence unless he/she holds an appropriate license under the Liquor Licensing Law. Dispose includes sell, barter, exchange, give, supply, deliver or otherwise pass or allow to pass into the control of some other person for value; and any disposal of intoxicating liquor shall be presumed to be for value and in pursuance of a sale, unless the circumstances under which the disposal is made negative such presumption. This also applies to functions where tickets for admission are sold to include the cost of alcoholic beverages. Guidelines for the disposal of intoxicating liquor in licensed premises are determined by the category of license held by each establishment. Some premises may have more than one category of license. Patrons of these establishments are reminded that they are subject to prosecution for any breaches of the law, including the licensees and staff of the establishments. Businesses holding a Distributor category Liquor License are restricted to sales for export and sales to other licensed premises only. Conversely, businesses holding,, Restaurant or Hotel category Liquor Licenses are not permitted to sell to other licensed establishments. Holders of and Hotel category Liquor Licenses are restricted by law to sales for consumption on the premises, with the exception of off the premises only in sealed containers of minimum quantities as specified in the law. Wine & Beer and Restaurant category Liquor Licenses permits the disposal, to any person by whom food has been ordered at a restaurant for consumption on the premises, of beer and wine or other alcoholic beverages. Patrons, who intend to visit premises holding these types of licenses for the sole purpose of consuming intoxicating liquor, should consider patronizing establishments holding a category Liquor License. 37 Holders of a Restaurant category Liquor License along with a Music & Dancing License are reminded that their current licenses does not cover catering at other locations and are restricted to their restaurant premises only. The bar on a sea-going vessel, licensed under Section 7(7) of the Liquor Licensing Law, must be locked and no intoxicating liquor may be disposed of, exposed for sale, offered for sale or consumed on such vessel while it is at or within half a mile of any land. The same restrictions apply for the playing of music. Permitted hours and days for premises holding Distributor and category Liquor Licenses are Monday to Saturday, 9:00 am to 6:00 pm. Some premises have special permitted hours of 9:00 am to 7:00 pm, 10:00 am to 7:00 pm or 10:00 am to 10:00 pm.
