6 1 Introduction 1.1 Project Background and Description 1. The Orissa Integrated Irrigated Agriculture and Water Management Investment Program (the Investment Program or OIIAWMIP) aims to enhance the productivity and sustainability of the existing irrigation schemes in the four northern river basins and a part of the Mahanadi delta.1 This will involve renovating irrigation infrastructure, installing participatory irrigation management (PIM) systems with water user associations (WUAs), and empowering WUAs as a cohesive platform for irrigation operation and maintenance (O&M) and agriculture development. The OIIAWMIP will renovate sixmajor and nine medium irrigation schemes (having designed net irrigated area [NIA] of 185,000 ha) and about 1,400 community-based minor lift irrigation schemes (having NIA of 30,000 ha). These schemes are suffering from low performance in irrigated agriculture due to inefficient operation, system deterioration, and limited integration with agriculture support services and marketing systems. The OIIAWMIP will also strengthen the institutional basis for PIM and integrated water resources management (IWRM) with management reforms and capacity strengthening of the relevant institutions. 2. The renovation work under the HLC-Range-1 subproject is divided into two irrigation divisions namely Mahanadi North Division, Cuttack and Jaraka Irrigation Division, Jaraka. The total distance covered under Mahanadi North Division including Main and distributary canals are km and km covered under Jaraka Irrigation Division. The HLC Range -1 sub-project main canal is about 53-kilometre-long, and of this, 0-10 kilometre is under Mahanadi North Division and kilometre is under Jaraka irrigation division. Total 13,790 ha area covering 112 villages will be benefitted from canal rehabilitation and improvement work. The renovation work under the Jaraka Irrigation Division involves strengthening and widening of the existing embankment of almost 138 km as well as bank protection work. The project aimsto make irrigation systems in the state of Odisha more productive, efficient and sustainable by (i) renovating and extending irrigation systems; (ii) helping to form community water user associations that help manage local water resources; and (iii) improving the efficiency and effectiveness of government agencies that deal with water issues in the state.this Due Diligence Report is prepared for HLC Range -1 (10-53 km),i.e. under the Jaraka Irrigation Division. The subproject location is depicted in figure 1. Development Support Centre (DSC) 4

8 1.2 Sub-project Impacts and payment of compensation 3. As per the approved resettlement plan (RP) of June 2015, 178 households and 70 community property resources (CPR) were enumerated to be affected. The identified AHs were eligible to receive compensation and other allowances as per the approved entitlement matrix of the project. The RP was implemented in 2016,anda civil society organisation (CSO) was engaged to support the implementation of RP. The CSO along with the sub-project implementation office (SIO) staff verified the affected households list and found 151 out of 178 households during the field verification exercise. The remaining 27 households could not be and neither their structures at the site. The CSO and the SIO verified from the surrounding people and concluded that the households have moved before the implementation of RP and the structures are not existing. Therefore, the 27 households considered as missing and the final impacted list for the subproject froze at 151affected households (AH). The 151 households were served notices as impacted and identity cards were prepared for them. All the impacted households are non-titled and using the canal right of way. The verification exercise also recorded 26 community and 44 public structures such as electrical transformers, tube wells, mobile phone towers, etc. 4. All 151 Ahs were paid compensation as per the entitlement matrix including livelihood assistance, shifting assistance, vulnerability assistance and additional assistance to employees at minimum wage level as per the Government prescribed norm. CAP: The ADB Mission had noted the gap between the payment of compensation and the entitlement matrix and requested the OIIAWMIP to prepare a corrective action plan (CAP) to address the gaps in payment of entitlement matrix. The CAP assessment identified missing transitional allowance, allowance for temporary shed construction and transport allowance. The OIIAWMIP prepared the CAP and got the required approval for the payment of balance entitlements under the project. Development Support Centre (DSC) 6

9 6. Scope Change: While the CAP was under preparation, the OIIAWMIP decided to drop a section about 12 kilometres from kilometre 41 to 53 under the HCL subproject (refer Attachment 5). The decision was takenin view of the technical reason that the strengthening of 12km of the canal would have only benefited 500 hectares of land and which can be achieved through two minor canals in the area. The reduction in length of the maincanal and further optimisation of design to reduce the resettlement impacts, the number of affected households under the subproject was reduced to 81 from the list of 151. The package wise decrease in number of households from the phase 1 is given in table 2. 10 1.4 Due Diligence Report for minimising resettlement impacts 8. Due diligence was conducted to examine the safeguards issues of the proposed facilities in more detail, particularly with respect to the ADB Safeguard Policy Statement (2009) and requirements. This report provides the findings, copies of evidence for the avoided AHs under the subproject due to change in scope and restricting the impacts to the construction zone. 9. For the preparation of this document, the Executive Engineer (EE), Jaraka Irrigation Division and Staff from PMU visited the site and prepared an inventory of structures and households those are not falling under construction zone. In all 39 AHs were identified as avoided in different packages for falling beyond the construction zone of canal improvement works and will not be affected by the subproject. Although these AHs were paid compensation in the first phase, the DoWR decided not to displace the structures beyond the construction zone. Based on the field exercise, CAP was paid only to the affected AHs. The AHs avoided were consulted and explained that the subproject will not impact their structures and the project would not pay the amount under the CAP. The project authorities also assured that they would not be displaced from the present location. In addition to the 39 AHs, another 31 AHs between kilometre 41 to 53 were avoided since the project scope was reduced. The 31 AHs were explained that the subproject would not be implemented between km 41 to 53. Therefore, their structure would not be impacted, and the CAP payment will not be made. The written consent of not receiving the CAP payment from the avoided AHs have been attached in Annexure 1, the sample photos of avoided structures in Attachment 2, line diagram showing the location of avoided structures in Attachment Consultations during DDR preparation 10. The avoided AHs have been fully informed and closely consulted during the signing of consent letter. Consultation related to consent agreements were carried out between avoided AHs and officials from project authority. All the owners of the structures reviewed the draft version of consent letter (including heir respective legal representative in most of the cases) and were discussed between the parties. Terms and conditions of the consent letter were discussed and agreed with each owner of the structure. Project authority also explained the AHs that the ownership of land would remain with Government, but they can continue to stay at the present location. The consultations and negotiations with the owners of the structures (for which they signed the consent letter) were carried out in an atmosphere free of intimidation or coercion; the parties were provided with the opportunity to express their views and suggestions. Households have been consulted and provided with the necessary information regarding the avoidance of impacts on their structure and non-payment of CAP amount to them. The households have willingly given their consent to forgo the CAP amount instead of avoidance of impact on the structures. The DOWR has made the required effort under the project to minimise the resettlement impacts by restricting to the limits of the construction zone. It is, therefore, concluded that all reasonableeffortshavebeen made on the part of the DOWR in accordance with the safeguard policy requirements. Development Support Centre (DSC) 9
