SECTION IV: ENGLISH PROFICIENCY STATEMENT I, understand that the federal aviation administration (FAA) requires that all pilot applicants be able to read, write, speak and understand the English language and that my English language skills must meet or exceed the FAA and ICAO minimum requirements. I also understand that if English is my second language, my flight training course will take longer than the advertised length of time for training. VISA / MC / DISC (Circle one) Card # Expiration Date CCV Billing Address Billing Zip Code Signature: SECTION VII: RENTAL AGREEMENT The renting pilot is responsible for the safe and conscientious operation of the aircraft until it is returned and securely tied down at FL Aviation Center facilities. The following company aircraft rental policies and conditions apply to each flight. I, the renting pilot, agree: 1. To operate in accordance with all applicable FAA, federal, state, and local regulations. 2. Not to use the aircraft for flight instruction to any individual, unless I am an authorized FLAV Instructor on a specified dual training flight. 3. To land only at FAA designated airports that are safe and suitable under the prevailing conditions. Operations on turf runways are not approved without explicit prior approval from FL Aviation Center flight instructors or management. 4. Not to authorize or allow any other person to operate or handle the aircraft. 5. To telephone FL Aviation Center if I am unable to return the aircraft at the agreed time for any reason. 6. To pay any landing fees, tie down fees, or any other charge incurred by me while the aircraft is in my possession. 7. All over-night/multi-day rentals must have prior approval. 8. To pay a minimum charge of three hours for each day that the aircraft is in my possession, unless prior approval is acquired from management. Page 2

9. To report all accidents or incidents, major or minor, to FL Aviation Center at once, together with the names and addresses of witnesses and involved parties. In the event of an accident I will not permit the aircraft to be moved unless expressly authorized by FL Aviation Center management or local, state, or federal authorities and will do all that I can to protect the aircraft and its equipment from further loss. 10. Aircraft rental charges are based on an hourly rate charged to the nearest one-tenth (0.1) of an hour. I will maintain a credit card on file in the Schedule Pointe dispatch system, and agrees to be personally responsible for any payments and charges due FL Aviation Center, including late fees of 5% per month and any and all collection costs. 11. To obtain weather reports and forecasts, to utilize flight following for all cross-country flights, and to use the aircraft only for this purpose and over the route specified. 12. Should I need to purchase fuel for the aircraft, I will have it credited against my rental invoice for the amount of my purchase or the current FL Aviation Center reimbursement rate, whichever is less. I understand all purchases must be documented with an original receipt at the time the aircraft is returned. 13. To see that the aircraft is securely tied down in a proper area, master and ignition switches off, controls secured, and doors locked. 14. To remain current in each aircraft I fly in accordance with FARs. 15. To accept and abide by the current no show policy of FL Aviation Center. Specifically, I will arrive ontime and be prepared for each scheduled rental or lesson. Cancellations of reservations will be made a minimum of 24 hours prior to the reserved flight time. Late cancellations, no-shows, or reserved time not used will result in the pilot being billed a minimum of 1 hour aircraft and/or instructor up to the total aircraft time and CFI services reserved at the current billing rate. 16. I understand that the maximum rental block allowed without prior approval is 4 hours. If you would like to reserve the plane for a longer block, I will obtain approval from FL Aviation Center LLC management before booking the aircraft. 17. To pay all sales and uses taxes in accordance with state laws. 18. Not to either perform or authorize any repairs or adjustments, nor make any purchases in relation to the aircraft without authorization from FAC management. 19. To accept liability for any damage done to the aircraft while in my possession. 20. Not to smoke in the aircraft. If found to be in violation of FLAV s non-smoking policy, I forfeit all privileges as a FLAV customer. 21. To maintain aircraft security and cleanliness by following the checklist (i.e.: electrical switches, fuel selector value, control-lock, proper tie-down, locking all doors and installing pitot tube cover and removing all trash from the flight deck after each flight.) If found in violation of FLAV s security and cleanliness policy I agree that I may be charged for associated cleaning or repairs. Name: Date: Signature: Page 3

I agree to accept and abide by the current no show policy of FL Aviation Center. Specifically, I will arrive on-time and be prepared for each scheduled rental or lesson. Signature: SECTION VIII: ACCELEREATED FLIGHT TRAINING ONLY FL Aviation Center, LLC s ( FLAV ) pre-paid training courses are designed to encompass all of the estimated costs of completing your training course(s) to become a certified pilot. This includes training materials, aircraft rental, instructor time, and simulator time. The Student is required to provide his/her own transportation to and from the FLAV facility as well as all personal accommodations during his/her stay and training at FLAV. A deposit is required with this application in order to guarantee your training slot. The remaining amounts must be paid NO LATER than five (5) days PRIOR to the start of the Student s scheduled training course. A cancellation fee of $500 will apply should you decide to cancel or terminate your training. Should FLAV have to terminate the Student s training session due to misconduct by Student or abuse of FLAV equipment by the Student, no refund shall be paid and Students payment shall be forfeit. FLAV accepts Visa, MasterCard, Discover, Travelers Checks, Electronic Funds Transfers, and Cash as forms of payment for the initial deposit. Balances in excess of $2000 which are not paid by check, Electronic Funds Transfer, or money order will incur a 3% credit card processing fee. No guarantees are implied with any of our courses. The courses are designed to be completed in the times specified; however circumstances that are beyond our control could prevent you from completing the course in the specified time. These circumstances may include but are not limited to the following: Adverse weather, equipment failure, force majeure or other unforeseen circumstances beyond FLAV s control, and/or the student s own physical or mental limitations. In the case of a training course not completed in the specified time, the student may elect to extend their training until completed or return at a later date to finish the course. The training and hours received up to that point may still count toward your certificate or rating, even if you elect to finish your training at another facility. FLAV s intent is to do all that is in our power to see that you achieve your goals during your training with FL Aviation Center, LLC. We pride ourselves on providing the best quality equipment, materials, and instructors. Your complete satisfaction is our primary goal; however, if you perceive that any aspect of your training experience is not meeting your expectations, please let us know how we can better serve you and we will do our best to make your training course a positive and memorable experience for you. SECTION IX: Covenant Not to Sue, Liability Release, and Assumption Of Risk Agreement I,, hereby affirm that I am aware that flying and activities associated with flying have inherent and unforeseeable risks which may result in serious injury or death. I understand and agree that neither my instructor nor Florida Aviation Center, LLC ( FAC ), nor any of their respective employees, officers, agents, contractors, or assigns, (hereafter referred to as Released Parties ) may be held liable or responsible in any way for any injury, death, or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in flying aircraft, flying in aircraft, flight instruction, aircraft rental, aircraft operations, ramp operations, or any associated activities involved with these activities, (hereafter referred to as Flight Activities), or as a result of the negligence of any party, including the Released Parties, whether passive or active. In consideration of being allowed to participate in Flight Activities, I hereby personally assume all risks of Flight Activities, whether foreseen or unforeseen, that may befall me while I am participating in these activities. I, further release, exempt, and hold harmless the Released Parties from any claim or lawsuit by me, my family, estate, heirs, or assigns, arising out of my participation in Flight Activities including both claims arising during any course of training or after I receive my pilot certification(s). I also understand that Flight Activities are physically demanding and that I must seek the ongoing care of a licensed and authorized aviation medical examiner and that I will not hold Released Parties responsible for events resulting from my physical condition, limitations, or incapacitation. I further state that I am of lawful age and legally competent to sign this liability release or that I have acquired the written consent of my parent or guardian who have also reviewed this Release and who also agree to its terms. I understand the terms herein are contractual and not merely recital, and that I have signed this document of my own free act and with the knowledge that I hereby waive my legal rights. I further agree if any provision of this Agreement is found to be unenforceable or invalid, that provision may be served form this agreement; however the remainder of this agreement shall then be construed as though the unenforceable provision had never been contained therein. I, BY THIS INSTRUMENT AGREE TO EXEMPT AND RELEASE MY INSTRUCTORS, FLORIDA AVIATION CENTER, LLC, AND ALL RELATED ENTITIES AS DEFINED ABOVE FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OF ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING IT BEFORE I SIGNED IT ON BEHALF OF MYSELF AND MY HEIRS.
