1 ELECTION OF CONVENER It was noted that in terms of the Licensing (Scotland) Act 2005 a Forum, at its first meeting in each calendar year, must elect one of its members to be Convener. It was unanimously agreed that M Dymond be appointed as convener. M Dymond assumed the chair at this point. ORDER OF BUSINESS The Convener intimated that she proposed to alter the order of business to facilitate the conduct of the meeting by considering items 6 and 7 of the agenda prior to item 3. 2(a) MINUTE OF PREVIOUS MEETING There was submitted the Minute of the meeting of Renfrewshire Licensing Forum held on 9 September, 2015. DECIDED: That the Minute be approved. 2(b) JOINT LICENSING BOARD/LICENSING FORUM - INQUORATE MEETING There was submitted a note of the joint meeting of the Licensing Board and Licensing Forum of 25 November, 2015 which had been inquorate. DECIDED: That the information be noted 3 MINIMUM PRICE ON ALCOHOL The Assistant Managing Solicitor (Licensing) updated the Forum with regard to progress in respect of the Scottish Government s proposals on minimum pricing on alcohol. He indicated that the European Court had ruled that minimum pricing may be legal provided there were no alternative options. Other measures which could be considered included taxation. He advised that the matter had been referred back to the Court of Session for a final determination which was expected later in the year. Details of the determination would be forwarded to members of the Licensing Forum when available. DECIDED: That the information be noted. 4 ALCOHOL(LICENSING, PUBLIC HEALTH AND CRIMINAL JUSTICE) (SCOTLAND) BILL - STAGE 1 REPORT There was submitted an update by the Assistant Managing Solicitor (Licensing) relative to the progress of the Alcohol (Licensing, Public Health and Criminal Justice) (Scotland) Page 6 of 22
Bill which had been introduced in the Scottish Parliament by Doctor Richard Simpson MSP on 1April, 2015. The Health and Sport Committee has been designated as lead committee for Stage 1 consideration of the Bill on 22 April, 2015. The update advised that th Committee had taken evidence on the Bill over four meeting between October and November 2015 and heard from a range of health and representative groups (on 6 October); a range of licensing experts and licensed trade representatives (on 27 October); representatives with an interest in advertising followed by police, courts and social work representatives. The report intimated that in its conclusions, the majority of the Health and Sport Committee was not persuaded that the Bill was an effective and workable package of measures to tackle alcohol misuse, and believed that the Scottish Government s forthcoming updated alcohol strategy offered a more effective route to consider changes to alcohol policy. As a result the majority of the Committee did not support the general principles of the Bill. The Assistant Managing Solicitor (Licensing) was then heard in answer to questions from members on the update. DECIDED: That the information be noted. 5 POLICE SCOTLAND UPDATE Police Constable White provided an update on Police activity in the Forum area, advising that20 test purchases had been undertaken since mid November with three premises failing the test.. He advised that over the Christmas period, there had been a reduction in incidents of note, no serious incidents and premises were generally well run. Following the success of the recent licensing seminar, senior management had indicated a desire to run several more seminars, possibly one during the summer and one in winter. Police Constable White then responded to questions by members of the Forum in relation to various aspects of the report. DECIDED: That the report be noted. 6 SCOTTISH FIRE AND RESCUE SERVICE - UPDATE Watch Manager Coats advised the Forum of licensing activities undertaken by Scottish Fire and Rescue over the past few months indicating that the service continued to routinely visit licensed premises. Watch Commander Coats was then heard in answer to questions from Members of the Forum. DECIDED: That the information be noted. Page 7 of 22
7 LICENSING STANDARDS OFFICER - UPDATE The Licensing Standards Officer (LSO) provided an update in relation to his recent licensing activities. He advised that 181 compliance visits had been undertake to licensed premises, 20 of which required revisits, mostly for minor matters. There had been one complaint regarding excessive alcohol displays He indicated that at the last meeting of the Licensing Board, two licences had been approved, one off-sales and one for a cinema. The LSO was then heard in answer to questions from members of the Forum. DECIDED: That the information be noted. 8 MEMBERSHIP The Convener advised that the issue of membership of the Forum had been considered as part of the development day discussions. DECIDED: That the information be noted. ADDITIONAL ITEM The Convener, being of the opinion that the following item was competent and relevant, agreed to its consideration at this time. 9 BEST BAR NONE AWARD The Convener advised that Hamishes Hoose had received two awards from the Best Bar None scheme. Piero Pieraccini indicated that he had also progressed to the national finals of the Community Bar of the Year category. Members of the Forum congratulated Mr Pieraccini and Hamishes Hoose on the achievements. This formed the basis of discussions at the development day, held on 3 rd February 2016. Members discussed the responses from the survey and decided to collate several actions. These actions are detailed in the table below and are for further discussion at the next Licensing Forum meeting, scheduled for 11 th February 2016. It is suggested that this action plan forms the basis of future work the Licensing Forum may choose to participate in. Page 9 of 22

Summary 1.1 This report details proposed arrangements for meetings of the Renfrewshire Licensing Forum until May 2017. 2. Recommendations 2.1 That the Forum considers and approves the dates for future meetings of the Forum as detailed in the report; 2.2. That it be delegated to the Clerk in consultation with the Conveners of the Forum and the Licensing Board to determine which of these meetings will be a Joint meeting with the Licensing Board; and 2.3 That members advise of their preferences in relation to the format and times of future meetings. 3. Background 3.1 In terms of the Constitution approved at the meeting of the Forum held on 2 October 2007, there is a requirement for the Forum to meet no less than 4 times per year and for one of these meetings to be a joint meeting with Renfrewshire Licensing Board.
3.2. It has been the custom and practice that the Forum meet on a quarterly basis, with meetings being held during February or March, April or May, August or September and October or November. 3.3. It is proposed that meetings of the Forum be held on:- Wednesday14 September 2016; Wednesday 16 November 2016; Wednesday 8 February 2017; and Wednesday 10 May, 2017 3.4 At previous meetings, during discussions regarding difficulties encountered in connection with the filling of vacancies on the Forum and the subsequent retention of members, reference has been made to the possibility of the format and times of meetings of the Forum being altered.
